Siman 201 is the longest in Yoreh De’ah, but its disagreements reduce to a small number of root questions — and nearly all descend from one: does drawing invalidate by Torah law, or only by the words of the Scribes? Whoever holds that question holds the measure of השקה, the fate of doubt, and the way a mikveh is repaired.

1. שורש הסימן — three defects, and the question that governs them
Seventy-five seifim, and yet a single subject: the qualification of water. Water can be disqualified in three ways, and only three — it was drawn, it is in a vessel, it flows away. The rest of the siman does nothing but define those three words, and then say what repairs them.
The yesod — three defects, and a question of rank: (א)שאוב: a man’s hand detached the water from the ground by gathering it. (ב)בכלי: the water is enclosed in what is made to receive. (ג)זוחלין: the water goes away instead of staying. And upon each of the three the same question stands, which decides all the rest: is this defect of the Torah or of the Scribes? For upon its rank depend the doubt (lenient or stringent), the measure of joining (a hairbreadth or the neck of a wineskin), and the manner of repair.
Three defects, three ranks — and they are not the same:
For זוחלין, the Arukh HaShulchan rules that it is Torah law, since it is derived from a verse in the Torat Kohanim:
For שאובים, that is precisely the ma’hloket of the next section, and it is not settled.
For the כלי, the Arukh HaShulchan remarks that the matter is far from obvious, and himself raises the difficulty:
The verse and its twofold derivation. Everything starts from אך מעין ובור מקוה מים יהיה טהור: the spring, in which a man’s hand has no grip at all, and the cistern, which is entirely by a man’s hand. The Torat Kohanim derives two things from it at once — that the mikveh be by the hand of Heaven, and that its base be as the ground:
2. שאיבה מדאורייתא או מדרבנן — the ma’hloket that governs the whole siman
Seif 3 stands in one line: the forty se’ah must not be drawn. It is the Rama’s gloss that opens the question — he distinguishes the whole from the part, and attaches each to a different rank. And this distinction is no mere precision: it is a stand taken within a ma’hloket of Rishonim, and it will decide, at seif 53, the measure of a contact.
A mikveh entirely drawn: invalid by Torah law, or by scribal law?
Shitah
Position
Rambam
By Torah law all gathered water serves — drawn or not; the invalidity of drawing is scribal, learned by an analogy.
Ri (in the Tur)
Drawing invalidates only rabbinically; therefore every doubt, even about an entirely drawn mikveh, is lenient.
Rabbenu Shimshon, and this is the Rosh’s conclusion
Entirely drawn is invalid by Torah law until the majority is valid; beyond that, drawing invalidates only rabbinically.
Rama
Follows Rabbenu Shimshon and the Rosh: entirely drawn, stringent doubt; a drawn minority, lenient doubt.
And it is not a two-sided ma’hloket. The Arukh HaShulchan counts at least four, each drawing the line elsewhere: Rabbenu Tam distinguishes by order of arrival, the Raavad by whether a man carried it or the water fell from vessels of itself, the Rash by whether the vessels receive impurity:
Nafka minot, and they are all in the siman:(1) a doubt about an entirely drawn mikveh — lenient for the Ri, stringent for the Rama (seif 3, and the Chakh at ס״ק קמ״א on seif 68). (2) the measure of contact at seif 53 — a hairbreadth or the neck of a wineskin. (3) the figure of twenty-one se’ah at seif 4, which the Chakh explains by assuming the Mehaber holds drawing rabbinic in every case. (4) a doubt about the width of a hole at seif 52, which the Arukh HaShulchan decides stringently for an independent reason: the שיעור itself is הלכה למשה מסיני.
The Arukh HaShulchan on measure and doubt (ערוך השולחן יו״ד ר״א:ק״פ): even one who holds the defect rabbinic must be stringent about a doubt of measure, because immersion itself is of the Torah and measures are a law of Moshe from Sinai:

3. נהרות — immersion in a river, and two statements of the Gemara that contradict each other
The question is ancient and practical: a river swells in the rainy season, and rainwater becomes the majority in it. Does the river keep its status as a spring, purifying while flowing? Two statements of the Gemara stand opposed, and the Rishonim divide according to which they take.
Two statements, and they do not say the same thing. On one side נהרא מכיפיה מתברך — the river is blessed from its own source, and for every handbreadth of rain that comes down two rise from below; from which it would follow that the flowing waters are always the majority. On the other, it was taught that the Euphrates purifies while flowing only in Tishrei, and that Shemuel’s father made mikvaot for his daughters in Nisan:
How the Rishonim divide:
Shitah
Position
Rabbenu Tam, and with him the Rash, the Sefer HaTerumot and the Semag
We rule like נהרא מכיפיה מתברך: one immerses in a river all year — but only in a river that never dries up.
Rabbenu Chananel, and so the Rif, the Ri, the Rosh and the Rambam
We rule like the other statement: in the rainy season one does not immerse in a river. The Rambam adds a distinction of place — at the spring’s own site, always; downstream, no.
Mehaber
If the נוטפין prevail, purification is only in an אשבורן: a mat must be set round so that the water comes to rest.
Rama
Teaches stringency — and at once reports the lenient custom without protesting.
The Chakh specifies what exactly is permitted (ש״ך יו״ד ר״א ס״ק י״ג): not merely to immerse in a river, but to immerse in it as it flows, without needing to arrange anything there resembling a mikveh:
The Taz adds a reason that the Baer Hetev reports in his name (באר היטב יו״ד ר״א ס״ק ו): the danger is not only the reckoning of the waters but the place where she immerses. Melting snow and rain come down from a high point near the bank, and קטפרס אינו חיבור — a slope is not a joining. She may therefore immerse at a spot not joined to the flowing water:
📜 The text of the Shulchan Arukh — seif
4. זריעה — the question of the Terumat HaDeshen and the Rosh’s answer
The Taz, at ס״ק ג, brings a question that at first seems technical and in truth touches the very foundation of the notion of drawn water. Two defects behave differently in the face of abundance, and nothing explains why — until one grasps what each of the two defects corrects.
The question of the Terumat HaDeshen, as the Taz reports it: why does a majority of rainwater strip a river of its power to purify while flowing, whereas a thousand drawn se’ah poured at once into an already constituted mikveh of forty se’ah do not invalidate it?
The answer, in the name of the Rosh — and it is the concept of זריעה: if drawn water does not spoil the mikveh, it is because it is as if sown there, and thereby becomes attached water again:
And the second half of the answer is the most instructive: sowing repairs only what was detached. But the defect of נוטפין is not detachment — a mikveh made entirely of rainwater is perfectly valid — it is that they do not purify while flowing. Sowing can therefore do nothing for them:
Ḥakira: is drawing a defect in the water or a defect in the manner of its arrival? זריעה presupposes the second: there is nothing wrong with the water in itself, it was merely detached, and pouring it into attached water reattaches it. That branch also explains why the snow of seif 30 is not disqualified — it was not water at the moment of passage — and why the frozen mikveh of seif 31 is purified of its drawing.
Nafka mina, and the siman gives it itself: at seif 15, forty se’ah and any spring at all allow one to draw as much as he wishes; at seif 21, an invalidated mikveh is not repaired by adding valid water but is repaired by joining. In both cases it is not quantity that repairs — it is reattachment.
📜 The text of the Shulchan Arukh — seif
5. שיעור ההשקה — a hairbreadth against the wineskin-neck, and why it is the same ma’hloket as at seif 3
Seif 52 requires the neck of a wineskin to join two mikvaot; seif 53 is content with a hairbreadth to make a drawn mikveh valid. The Rama, at seif 53, half reverses this, then adds that even for drawing some require more — “and it is fitting to rule so.” The Chakh shows that these three positions are not three separate opinions but a single line, drawn from the ma’hloket of seif 3.
The Mehaber, at seif 53: a hairbreadth suffices, and even if the waters of contact do not see the face of the air.
The Rama, immediately after: the hairbreadth holds only for the rabbinic invalidity; for a Torah invalidity the neck of a wineskin is required — and even for drawing, some disagree, “and it is fitting to rule so.”
The Chakh lays down the general rule already at seif 52 (ש״ך יו״ד ר״א ס״ק ק״ט):
« דוקא הפסול מדאורייתא בעי כשפופרת הנוד אבל הפסול מדרבנן סגי בכשערה כדלקמן סעיף נ״ג » (ש״ך יו״ד ר״א ס״ק ק״ט) and then explains why drawn water is the exception (ש״ך יו״ד ר״א ס״ק קי״ד) — the wineskin-neck is required only to validate a deficient mikveh from a complete one; for a drawn mikveh they were lenient, drawing being only scribal:
And here is the core — the Chakh at ס״ק קי״ז shows that the ma’hloket is not about the measure but about the rank: those who require the wineskin-neck even for a drawn mikveh do so consistently with themselves, holding at seif 3 that an entirely drawn mikveh is invalid by Torah law. Consequently, where the mikveh is mostly valid and only partly drawn, all agree that a hairbreadth suffices:
What the Chakh gains by this — the Bach’s astonishment. The Bach wondered: how can the Rosh require the wineskin-neck, when the Mishnah teaches expressly that one validates mikvaot, the upper from the lower, and brings them into contact even by a hairbreadth? The Chakh answers that the Rosh reads that Mishnah of an upper mikveh invalid only rabbinically:
The Taz says the same in one line (ט״ז יו״ד ר״א ס״ק ס״ג), and thereby removes the commonest misreading — “the invalidity of drawing, which is rabbinic” does not mean that all drawing is rabbinic:
Practical nafka mina: a pool filled entirely from the water main, which one wishes to validate by contact with a rainwater pool. By the letter of the Mehaber, a hairbreadth suffices. According to the Rama — “and it is fitting to rule so” — the neck of a wineskin is needed, that is, an opening of two fingers. This is the difference between two mikveh designs, and it is settled before the concrete is poured.

6. הדלי הנקוב — does perforating the bucket help at all?
Seif 40 gives the most practical act in the whole siman: perforating the bucket with which the mikveh is emptied, so that it ceases to be a vessel. The Taz devotes to it his longest ס״ק — nearly five thousand characters — to say that he does not understand its mechanics, that a responsum of the Ramban agrees with him, and that all the decisors teach it nonetheless.
The Mehaber’s remedy
The Taz’s objection (ט״ז יו״ד ר״א ס״ק מ״ז): seif 39 has just laid down that everything coming by a man’s hand invalidates, even without a vessel — down to water splashed from his feet. What then does a hole in the bucket’s bottom achieve?
And he recalls the seif that carries it:
And the answer he finds — which does not satisfy him. The Ramban’s responsum, siman רל״א, says expressly that perforating the bucket helps nothing; and the Taz notes that this responsum reached us truncated, the copyist having written that he found no more:
« ומטעם זה כתב באמת בתשובה להרמב״ן סימן רל״א הבאתיו לעיל סעיף ט״ו דאין מועיל תיקון נקיבת הדלי כשרוצה לנקות המקוה ולא ראיתי שום מפרש או פוסק שירגיש בזה » (ט״ז יו״ד ר״א ס״ק מ״ז) From this he draws a conclusion that is also a lesson in method:
The Chakh, for his part, does not argue the mechanics: he reports the practice The Agudah had proposed reckoning the water let out; he notes that he did not see his teachers do so:
« ודנתי לפני רבותי להכשירו אם לא שהוציאו כל המים וינגבו המקוה בסדינים או בחול או ינקבו הכלים שדולין בו לבטלו מתורת כלי » (ש״ך יו״ד ר״א ס״ק נ״ז) And on the size of the hole he brings the Bach (ש״ך יו״ד ר״א ס״ק פ״ד):
The modern extension — perforating a vat already set into the ground:

The perforation works even after fixing, and one may even stop it afterwards — it is then like a gutter fixed and then hollowed.
Rabbi Akiva Eiger
The perforation, yes; the stopping, no — the vat had already acquired the name of vessel while detached, the hole makes it only an invalid vessel, and once stopped it becomes a vessel again.
Arukh HaShulchan
Reports the same distinction, and adds the converse case — perforated before fixing, one may argue that stopping does not restore the name of vessel.
Two Nekudot HaKesef on this movement. The Chakh answers the Taz, who rejected the Bach’s distinction between stopping in order to dry and stopping in order to validate
« ואיני מכיר חילוק זה דהא גם כאן אין עושה כן אלא שלא יזובו המים דרך שם » (ט״ז יו״ד ר״א ס״ק ס״א) and he finds it perfectly simple:

7. המשכה — the channelling of drawn water, and the three conditions one forgets
המשכה is the device that makes nearly every constructed mikveh possible: drawn water that has run over the ground ceases to invalidate. But it has three conditions, and each has its ma’hloket — the quantity already valid, the order of operations, and the surface over which the water runs.
First condition — the measure. Seif 45 fixes it in five words:
And the valid majority must be present: twenty se’ah and a bit, says seif 44.
Second condition — the order, and it is the Rama’s gloss at seif 44:
« אבל אם המשיך תחילה מים פסולים ואח״כ הביא עליהם רוב מים כשרים לא מהני » (שו״ע יו״ד ר״א:מ״ד) The Chakh explains exactly the case intended (ש״ך יו״ד ר״א ס״ק צ״ט): he first channelled drawn water into a pool that did not hold twenty se’ah, and afterwards rain came upon it — and reopening the gutter later repairs nothing:
The Taz hardens the matter further, against the Prisha (ט״ז יו״ד ר״א ס״ק נ״ה): this invalidity is of the same nature as ordinary drawing, and there is no remedy until the first waters have gone out, as at seif 22:
Third condition — the surface. And here is the ma’hloket of seif 46:
Shitah
Position
Raavad, and this is the Mehaber’s letter
Over the ground, or over a gutter that never bore the name of a vessel while detached — but not over vessels.
Rokeach, reported by the Mordechai and cited by the Rama
Only over ground fit to absorb: a stone pavement does not suffice, and it is good to be stringent
Nafka mina, and it is the building plan. According to the Raavad it suffices that the channelling run along a masonry conduit; according to the Rokeach, packed earth or an absorbent material is needed. The form of mikvaot built for four centuries follows the second opinion, out of stringency, not obligation.

8. כ״א סאה — why that figure, and two ways of reading it
Seif 4 requires twenty-one se’ah in the mikveh of a non-Jew who takes payment for it. The figure is strange: it is neither forty nor a round fraction. The Chakh rejects the simplest explanation, and his reason for rejecting it is worth following step by step — for it rests on what the Mehaber holds about drawing.
The seif (שו״ע יו״ד ר״א:ד):
What the Chakh rejects (ש״ך יו״ד ר״א ס״ק י״ז): one would think the twenty-one se’ah come from the principle “a rabbinic doubt is lenient” — twenty-one out of forty is the majority. But then the figure would be pointless: the Mehaber holds further on, at seif 53, that even an entirely drawn mikveh is invalid only rabbinically, so the reason would always be available:
His reading: this is a mikveh kept under lock, which can be filled only by channelling over the roof. At twenty-one se’ah, the channelling suffices to save the rest (seif 44). The Rama, who holds at seif 46 that channelling works only over the ground, cannot use that reason — and must fall back on the rabbinic doubt, hence his requirement that the twenty-one se’ah be there always:
And here is a point to be reported and not decided. The Arukh HaShulchan expounds the same seif and says he concludes as the Chakh does — but he attributes to the Beit Yosef, and not to the Rama, the view that channelling works only over the ground:
The student will keep both before him and ask the Rav.

9. הספק — why seif 67 and seif 71 give two opposite answers
Eight seifim on doubt, and two of them seem to contradict each other four lines apart: a doubt about drawn water is pure, and an impure man who may have immersed remains impure. There is nevertheless no contradiction — but the object of the doubt must be named exactly.
The principle (שו״ע יו״ד ר״א:ס״ז):
Ḥakira: is the doubt about the object (is this water a mikveh?) or about the subject (has this man been purified?)? About the object, the question is the rank of the defect, and we go leniently because drawing is only rabbinic. About the subject no question of rank arises: the man has a presumption of impurity, and a presumption yields only to certainty.
And the Chakh at once closes the leniency (ש״ך יו״ד ר״א ס״ק קמ״א): it holds only where the majority of the mikveh is valid water — otherwise, for one who holds like the Rama that entirely drawn is Torah law, it is a Torah doubt, and there one does not say I say:
One more difficulty, which the Chakh raises at ס״ק קמ״ט: seif 74 declares invalid every mikveh that is found, whereas seif 39 rested on the opposite presumption — that mikvaot are valid. Why?
« פסולים ולא דמי לדלעיל סעיף ל״ט דהתם היינו טעמא משום שחזקת מקואות כשרות ופי׳ הרא״ש (ופוסל) העושה מקוה כדי לטבול בו עושהו (אלא) א״כ עשאו בכשרות » (ש״ך יו״ד ר״א ס״ק קמ״ט) His answer holds in a sentence: there it was known that a man made it in order to immerse; here we do not even know that it was ever meant as a mikveh:
« אבל הכא לא ידעינן כלל אם נעשה לשם מקוה או לא » (ש״ך יו״ד ר״א ס״ק קמ״ט) To be noted and not decided: the Chakh, as Sefaria gives him, refers to seif 39; the Baer Hetev, who reports him at ס״ק ק״ט, writes seif 69. One of the two carries a misprint, and one cannot say which without the printed edition.
Nafka mina: an open rainwater pool in a garden, for which no one answers. A doubt about drawing would be lenient — but there is no doubt here: there is a presumption, and it is unfavourable (seif 74). By contrast, a mikveh known to have been made for immersion, left empty and found full, is valid (seif 69) — because it is at least known to have been intended.

10. חפירה בצד הנהר — a frontal objection, and the retraction that follows
The Rama, at the end of seif 52, permits digging a pit beside a river and immersing in it even without forty se’ah: the earth is riddled with channels, and the water comes into it from the river. The Arukh HaShulchan begins by saying that this contradicts the Tosefta and the Rambam — then, in the next paragraph, defends the Rama by reading him otherwise. The two paragraphs are read together.
The Rama’s gloss
The objection (ערוך השולחן יו״ד ר״א:ל״א):
And the retraction in the next paragraph (ערוך השולחן יו״ד ר״א:ל״ב): the Rama’s source is the Raavyah in the Mordechai, who spoke of actual fine holes passing from one to the other, none of them a wineskin-neck wide but all combining to make one:
Nafka mina, and it is immediate: if the Arukh HaShulchan’s reading is right, the Rama’s permission requires that the holes be seen. A pit dug a metre from the river, with no visibly perforated wall, does not fall under that gloss; it falls under the Tosefta, which says that digging beside a river is not a joining.
11. המקוה המחומם — a prohibition, a custom, and a declaration of the Arukh HaShulchan
The siman’s last seif closes the circle opened by the first: the bath does not purify, and yet the bath returns. The subject is entirely current — no mikveh today is cold — and the chain of sources here is short and perfectly legible.
The reason, in five words
The Rama (שו״ע יו״ד ר״א:ע״ה): the lenient permit, one should be stringent — except where the custom is to be lenient, and then one does not protest:
And the declaration of the Arukh HaShulchan (ערוך השולחן יו״ד ר״א:רט״ז), one of the firmest pages in the whole work:
And washing after the immersion, which the Rama forbids by custom. The Arukh HaShulchan gives its precise source — one of the eighteen decrees, which declared impure one whose head and most of his body came into drawn water, lest people take the clean rinse for the purification — and then marks its limit: entering a hot bath-house is permitted according to all, the decree having concerned only washing with water:
📜 The text of the Shulchan Arukh — seif
12. חקירת היסוד — three axes, and what depends on them
Everything above arranges itself on three axes, and nearly every ma’hloket of the siman can be placed on one of them.
Axis א — the rank of the defect: Torah or scribal? On it depend doubt (seifim 3, 67, 68), the measure of contact (seifim 52–53), and the reading of the figure at seif 4. Axis ב — the object of the defect: the water itself, or the manner of its arrival? On it depend זריעה (Taz ס״ק ג), the snow of seif 30, the frozen mikveh of seif 31, and the difference between adding and joining at seif 21. Axis ג — the doubt, about the object or the subject: on it depend seif 67 against seif 71, and the presumption of seif 74 against that of seif 39.
A fifth Nekudot HaKesef, and it corrects the Chakh himself. At ס״ק ע״ז the Chakh had followed the language of the Rosh that “all the water passing over the hollow is drawn”; he acknowledges here that this is not to be taken literally — it is the whole gutter that becomes a vessel by reason of those hollows:
And one last piece, which the Baer Hetev gives in a line (באר היטב יו״ד ר״א ס״ק כ״ט): those who disagree at seif 15 hold that even in a spring that does not hold forty se’ah, drawing invalidates:
This level decides nothing: it sets out the ma’hlokot and names their sources. For practice see level 4 — and for any application, the Rav.
