Yoreh De’ah · Nedarim

Siman 203 — What is praiseworthy and what is despicable in vows

Seven seifim, and an entirely new field. The simanim before it spoke of water, of purity, and of what comes between the water and the object; this one speaks only of speech and what it binds. It begins with an unqualified blame — whoever vows, even if he fulfils it, is called wicked — and ends with a measured praise: the vow that mends a flaw is a fence for abstinence, provided it does not become a habit. (Shulchan Arukh, Yoreh De’ah 203 — 7 seifim)

Do not be in the habit of vowing. Whoever vows — even though he fulfils it — is called wicked, and he is called a sinner. The siman opens with blame, and the blame does not depend on fulfilment: it falls on the word given.

Base — Beginner & Intermediate

The Hebrew text of the seven seifim with a flowing English translation: the blame of the vow even when kept, the ledger opened by delay, the private altar and release, charity and the words “without a vow”, the time of distress, the vow that spurs and the vow as a fence — with the twenty entries of the Shach, the Taz, the Baer Hetev and the Pitchei Teshuva, cited one by one, the gemara of נדרים, the Tur, the Beit Yosef and the Rambam.

Halakha lema‘asse — Psak

The practical halakha according to the ש״ך, the ט״ז, the באר היטב and the פתחי תשובה, then contemporary cases: the collection, the promise of a gift, the resolution about study, the adopted conduct, the vow already uttered. Note: the נקודות הכסף do not comment on this siman, and the ערוך השולחן is not available to us here. Note also: the Admur HaZaken did not write a Shulchan Arukh on Yoreh De’ah — a level of ruling, not “Daat HaRav”.

Frequently asked questions — Siman 203

Is it forbidden to make a vow?

The siman does not say “forbidden”: it says not to make a habit of it, and it blames one who vows even when he fulfils.

Seif 4 goes further and requires vowing nothing at all. The Taz, at ס״ק א, distinguishes two degrees of blame according to whether one has an opening for release. For your own case, ask your Rav.

What must one say when pledging at a collection?

Seif 4 gives the formula, and the Shach closes the way out one would think open:

One must say expressly “without a vow”: pledging in silence does not suffice, for a pledge made without qualification is already a vow. For your own case, ask your Rav.

Why is the vower likened to one who builds a private altar?

It is a beraita of Rabbi Natan, and the Ran gives its exact reason:

One who vows thinks he is doing a mitzvah: the Torah forbade things, and he too forbids himself. The Ran answers that he is mistaken — for to add to what the Torah forbade is to offer outside the appointed place. For your own case, ask your Rav.

What is to be done with a vow already uttered?

Seif 3 points to the remedy, and the Rambam puts it more firmly:

Release is a sage’s business, not the vower’s. And it has two exceptions: a vow of consecration is fulfilled, and an oath is treated with the same restraint. For your own case, ask your Rav.

Are there permitted, even recommended, vows?

Yes, and the siman gives three cases:

A time of distress permits; the vow that spurs one to what is already owed is permitted, and becomes a mitzvah when it guards from a transgression; the vow that corrects a trait of character is praiseworthy. For your own case, ask your Rav.

Does saying “I shall learn this chapter” already bind?

The Shach writes it plainly, and the Baer Hetev repeats it:

The sentence alone, with no formula of vow at all, already lays the obligation. That is why one adds “bli neder”. The Pitchei Teshuva, at ס״ק ב, leaves open whether this holds also for an undertaking of abstention. For your own case, ask your Rav.
