A new field opens here. The two preceding simanim spoke of water, of purity, and of what comes between the water and the object; this one speaks only of speech and what it binds. The title says it: איזה דברים משובחים ואיזה הם מגונים — which things are praiseworthy and which are despicable. The Shulchan Arukh announces ובו ז׳ סעיפים, and these seven run from an unqualified blame to a measured praise.

8. Summary and comprehension questions

1. The text of the Shulchan Arukh — the seven seifim

The siman reads in three movements. Seifim 1 to 3 blame the vow and point to the remedy: release. Seif 4 descends into practice — charity, the collection, the two words to say. Seifim 5 to 7 rise again: the permitted vow, the vow that is a mitzvah, and the praiseworthy vow — each bounded by the sentence that carries it.

Seif א — racha and chote: the blame, even on a vow kept

Title of the siman: which things are praiseworthy and which are despicable; and it contains seven seifim.

Do not be in the habit of vowing. Whoever vows — even though he fulfils it — is called racha, a wicked man; and he is called chote, a sinner.
The siman opens a new world, and it opens with blame. The two preceding simanim spoke of water and purity; this one speaks of speech and what it binds. And its first sentence does not say a vow is forbidden — it says one must not make a habit of it, and that the one who vows is blamed even if he keeps it. The Taz, at ס״ק א, asks why two words for one blame, and his answer divides the siman into two cases.

Seif ב — the ledger that opens

Has a man delayed his vow — his ledger is opened.
Three words, and a change of subject. Seif 1 blamed the vow; seif 2 no longer speaks of the vow but of the delay. The Shach, at ס״ק א, explains the image: from heaven the ledger of his deeds is opened, and they are examined closely. The Taz, at ס״ק ב, shows that the Tur gave two interpretations and that the Shulchan Arukh took only one — and that choice is itself a position.

Seif ג — the private altar, and when release is better

One who vows is as though he built a private altar at a time when private altars are forbidden; and one who fulfils it, as though he offered a sacrifice upon it — for it is better that he seek release from his vow. And this applies to other vows; but vows of consecration are a mitzvah to fulfil, and he shall not seek release from them save under duress.

Gloss: and likewise, if he swore about some matter, he shall not seek release from it save under duress (Mordechai, third chapter of Shevuot in the name of the Maharam; and see the Beit Yosef, end of siman 230).
Here the siman turns. Having blamed, it teaches the remedy: have the vow released. But it at once sets a limit — vows of consecration are to be fulfilled, and release is sought only under duress. The gloss extends that limit to an oath, and the Shach gives the reason at ס״ק ג: of an oath it is written לא ינקה.

Seif ד — charity, and the two words that save

One must take care not to vow anything at all. And even for charity it is not good to vow: rather, if the thing is in his hand let him give at once; and if not, let him not vow until he has it. And if a pledge for charity is being taken and he must pledge with them, let him say “without a vow”.
The most practical seif of the siman. It speaks not of theology but of a collection: a list is passed round and one must sign. The rule has three moments — if the money is there, give at once and vow nothing; if it is not there, vow nothing and wait; and if one must pledge with the others, say expressly “without a vow”. The Shach, at ס״ק ד, closes the door one would think open: to pledge without saying anything is already a vow.

Seif ה — the time of distress

In a time of distress, it is permitted to vow.
Four words, and a source that is not in the siman. The Beit Yosef supplies it: the Tosafot at the beginning of חולין ask how Yaakov could vow if vowing is blamed, and answer that in a time of distress it is permitted — following the Bereshit Rabba on וידר יעקב נדר.

Seif ו — the vow that spurs

One who says “I shall study this chapter” and fears he may grow slack in the matter — it is permitted to him to vow in order to spur himself. And likewise, if he fears his inclination will overpower him and he will transgress some negative commandment, or grow slack in fulfilling a positive one — it is a mitzvah to swear and to vow, in order to spur himself.
From permitted to a mitzvah, in a single sentence. The vow that spurs one to study is permitted; the vow that guards from a transgression is a mitzvah. The Shach, at ס״ק ה, adds a remark that shifts everything: saying “I shall study this chapter” already lays a vow-obligation upon him, even without a formula. And the Pitchei Teshuva, at ס״ק ב, reports a question left open: does that hold also for a mitzvah of abstention?

Seif ז — the vow as a fence, and the limit of the fence

One who made vows in order to set his dispositions right and to mend his deeds — he is diligent and praiseworthy. How? One who was a glutton and forbade himself meat for a year or two; or who strayed after wine and forbade wine to himself for a long time, or forbade drunkenness for ever; likewise one who chased after gifts and was eager for wealth, and forbade himself presents or the benefit of the people of a given country; likewise one who took pride in his beauty and vowed to be a nazirite — and vows of that kind. All of them are a way of service to the Name, and of such vows and their like the sages said: vows are a fence for abstinence. And though they are a service, let a man not multiply vows of prohibition nor accustom himself to them; rather let him abstain from the things it is fitting to abstain from, without a vow.
The longest seif of the siman is the Rambam’s, word for word or nearly. It gives the only category of vow called praiseworthy: the vow that corrects a trait of character. Four examples, four traits — gluttony, drunkenness, greed, pride in one’s looks. And it ends with the clause that keeps it from becoming a method: let a man not multiply vows of prohibition nor accustom himself to them.

2. Where the siman comes from — the gemara of נדרים, the Yerushalmi, the Rambam, the Tur and the Beit Yosef

The siman is almost entirely a chain of talmudic sources gathered by the Tur. Its first sentence is a beraita:

The two descriptions in seif 1 come from two different places, and that is where the Taz’s question is born. The first is Shmuel’s:

The second is a beraita brought by Rav Dimi, brother of Rav Safra:

Seif 2 comes from a story on the same page: Rabbi Yannai the elder releases his great-grandson by asking whether he would have vowed had he known.

Seif 3 is the beraita of Rabbi Natan, also cited on the same page:

A nuance not to be missed. The gemara teaches this beraita in connection with what may serve as an opening for releasing a vow, and concludes that one opens neither with its first clause nor with its second. The Shulchan Arukh therefore takes it not as a technique of release but as a description of the vow itself — and draws the practical consequence: it is better that he seek release from his vow.

The whole of seif 7, and the second half of seif 3, are the Rambam’s, at the end of his laws of vows:

The phrase נדרים סייג לפרישות comes from the mishnah of Avot, in Rabbi Akiva’s list:

The Tur and the Beit Yosef

The division that stands behind the whole siman. Two tannaim do not agree on which is preferable. Rabbi Meir: better not to vow at all. Rabbi Yehuda: better to vow and pay. The beraita is cited at the beginning of חולין and in the third chapter of נדרים; the Taz shows at ס״ק ב that the two Yerushalmi interpretations the Tur brings fall on either side.

3. The vocabulary of the siman

נדר — vow — the utterance that makes a thing forbidden to the one who speaks it, by attaching it to something already forbidden. The whole siman speaks of it.
שבועה — oath — the utterance that binds the person himself. The gloss of seif 3 applies to it the same restraint as to a vow, and the Shach at ס״ק ג gives the reason: of an oath it is written לא ינקה.
נדרי הקדש — vows of consecration — those that dedicate property to the Temple or to charity. Seif 3 sets them apart: they are fulfilled, and release is sought from them only under duress.
נשאל על נדרו — to seek release from one’s vow — to come before a sage who, finding an “opening”, undoes the vow from its root. The Rambam makes this a mitzvah for vows of prohibition.
בלא נדר — “without a vow” — the formula of seif 4, to be said expressly. The Shach at ס״ק ד insists: pledging in silence does not suffice; to pledge without saying anything is already a vow.
לזרוזי נפשיה — to spur himself — the motive that makes the vow permitted in seif 6, and a mitzvah when it guards from transgression. The Shach at ס״ק ו maintains it even where an oath would not take effect, on a matter of mitzvah.
סייג לפרישות — a fence for abstinence — Rabbi Akiva’s phrase in Avot, which the Rambam and seif 7 take up. It is the only praise the siman grants the vow, and it is at once bounded.
פנקס — ledger — the image of seif 2. The Shach at ס״ק א: from heaven the ledger of his deeds is opened and they are examined closely. The Taz at ס״ק ב explains that it is the ledger in which his transgressions are recorded.

Twenty entries in all on this siman: six of the Shach, five of the Taz, seven of the Baer Hetev, two of the Pitchei Teshuva. Here they are one by one, in their order.

The Shach — six

The Baer Hetev — seven

The Pitchei Teshuva — two ס״ק

The second entry leaves a question open, and that is rare. The Pitchei Teshuva brings the Shach — the mere saying of “I shall study” already lays a vow-obligation — and then refers to a responsum, the Shemesh Tzedaka, which asks whether this holds only for a mitzvah one undertakes to do, or also for an abstention. He does not decide, and we shall not decide in his place.

The Nekudot HaKesef, and the Arukh HaShulchan

The Nekudot HaKesef carry no entry on this siman — on the previous siman, 202, they carried one, and there it is read. As for the Arukh HaShulchan, his text is not available to us here; we therefore do not cite him on this siman, and we do not presume what he writes there.

6. The Rambam — הלכות נדרים, the end of chapter י״ג

The last three halakhot of the laws of vows carry seif 7 and the end of seif 3. Here they are in full — seif 7 follows them so closely that one can read them side by side:

A difference worth noting. The Rambam writes that for a vow of prohibition already uttered, it is a mitzvah to seek release. The Shulchan Arukh, at seif 3, writes more softly: it is better that he seek release from his vow. The substance is the same — the remedy lies in release — but the degree is not put in the same words, and it is the Rambam’s text that gives level 4 its firmest formulation.

7. Modern practical cases

Case 1 — A pledge of a donation to the synagogue

This is seif 4, word for word. If the sum is available, give it at once and promise nothing. If it is not, promise nothing and wait. And if one pledges with the others, say expressly בלי נדר — and say it, not think it: the Shach at ס״ק ד closes that door.

Case 2 — “I undertake to learn a page a day”

Seif 6 permits it expressly when one fears growing slack. But the Shach at ס״ק ה warns: the sentence alone, with no formula of vow at all, already lays the obligation. One who does not mean to be bound must therefore add בלי נדר — here as in the synagogue.

Case 3 — A resolution taken to correct oneself

This is seif 7, and it is the only case in which the siman praises the vow. But the praise is bounded in the same sentence: one does not multiply, one does not grow used to it, and one prefers to abstain without a vow. A resolution, yes; a method of vows, no.

Case 4 — A vow uttered in a moment of anguish

Seif 5 permits it in four words, and the Beit Yosef gives its source: the Tosafot on חולין, in the name of the Bereshit Rabba, about Yaakov’s vow. This does not erase what follows — a vow once uttered is a vow, and it will have to be either fulfilled or released.

Case 5 — A vow one regrets

Seif 3 shows the way: better to seek release — and the Rambam, more firmly, makes it a mitzvah for a vow of prohibition. But release is a sage’s business, not the vower’s own. And for a vow of consecration, or for an oath, one goes there only under duress.

Case 6 — A commitment taken and left hanging

This is exactly seif 2. The siman does not reserve its warning for one who breaks his word: it reserves it for one who delays. The Taz at ס״ק ב explains the image of the ledger, and the Tur’s story — the ship that sank — is the illustration it gives.

8. Summary of siman 203

The siman in one sentence: the vow is blamed even when kept (seifim 1 to 4), permitted when distress or slackness warrants it (seifim 5 and 6), and praiseworthy only when it corrects a trait of character — and even then, without making it a habit (seif 7).
Three things to keep. One — the blame is not on failing but on the very act of vowing, and seif 2 adds delay to it. Two — two words settle almost the whole of practice: בלי נדר, said aloud and not merely thought. Three — the vow is praised only as a remedy for a flaw, never as ordinary conduct.

Comprehension questions

  1. Seif 1 uses two words of blame. Where does each come from, and what distinction does the Taz set between them?
  2. Seif 2 no longer speaks of the vow but of delay. How does the Shach explain the image of the ledger, and how the Taz?
  3. Why did the Shulchan Arukh take only one of the two Yerushalmi interpretations the Tur brings? Which tannaitic dispute is at play there?
  4. Seif 3 distinguishes two kinds of vow as to release. Which, and where does the Rambam put it more firmly than the Shulchan Arukh?
  5. Seif 4 requires saying “without a vow”. The Shach rejects a more convenient reading: which, and in whose name?
  6. Seif 5 holds in four words and indicates no source. Where does it come from, and by which verse?
  7. Seif 6 moves from permitted to a mitzvah. Where exactly, and what remark of the Shach shifts its reach?
  8. Seif 7 praises the vow and bounds it in the same sentence. Cite the bound, and say where it comes from.
