Siman 204 — Halakha lema'asse: what binds and what does not

The ruling on דין המתפיס בנדר, line by line, with the source of each verdict

This level does not seek depth of reasoning — the Lamdan level takes care of that — but the line of the ruling: for each utterance the siman envisages, what binds, what does not, and what remains disputed. Where it is so, we also say that the sources do not agree, rather than deciding in their place. In matters of vows, the practical conclusion always belongs to the Rav.

3. The admitted anchors — the halakha of seif ב
4. The Temple table: a ma'hloket one does not settle alone

7. The ruling table of the siman
8. What the sources do not give us here

1. What this level is, and what it is not

This level sets out the ruling as it is read in the sources of the siman: the Mehaber, the Rama's gloss, the Shach, the Taz, the Baer Hetev, the Pitchei Teshuva and the Rambam. It does not replace a Rav, and in matters of vows it cannot: a נדר actually pronounced requires a התרה, which is done neither alone nor by reading, but before a חכם or three men. All that follows is therefore the table of what binds — not a permission to act.

A second thing must be said at once, because it changes the practical reading of the whole block. The Rama, at the next siman, writes that nowadays everyone is judged as an עם הארץ, “because most are not בני תורה” — and that sentence, set down at 205, echoes back onto 204: wherever a source says “for an עם הארץ a התרה is needed”, one must read, in practice, “a התרה is needed”.

2. The formulations that bind — the halakha of seif א

Ruling. Three formulations bind, and the Shulchan Arukh places them on the same footing. (א) Attachment proper: “this loaf is upon me like a קרבן”. (ב) “יאסר עלי ככר זה” — naming no קרבן at all. The Rambam grounds the third on the verse

The Shach expressly sets aside the lenient reading that would have seen in “יאסר עלי” an intention to lean on a Torah prohibition — which, at siman 205, would not bind:

Ruling — the chain. It is admitted without reserve, and is three times wider than one supposes: it stops neither at number (the seif says “even up to a hundred”), nor at delay (the Rambam: “even after several days”), nor at kind (the Shach ס״ק ד, reproduced as it stands by the Baer Hetev ס״ק ג). And a day enters the chain like an object.

One point of practice on which the Shach insists, and which is easily missed: vocalisation changes the sense of the formulation. The Baer Hetev repeats it for the student:

3. The admitted anchors — the halakha of seif ב

Ruling. An anchor is anything דבר הקדוש בקדושת הפה — the lamb of the offering, the pens, the altar, the Sanctuary, Jerusalem, and any one of the vessels of the service. The Shulchan Arukh's list is the Rambam's. Conversely, that whose holiness does not come from a mouth — the firstborn animal — is not an anchor.

The Shach gives the glossary, and one must know it to know what is being spoken of:

Ruling — ambiguity is read on the binding side. A word that may denote a consecrated thing or a profane one is understood in the consecrated sense: This is the rule the Taz applies to “כאימרא”, and it is what makes this siman formidable in ordinary conversation.

4. The Temple table: a ma'hloket one does not settle alone

Here is the point of the siman where practice and the reading of the sources diverge most, and it must be said honestly rather than decided in their place. The Rama writes that “כשלחן סתם” does not bind, while adding that an עם הארץ must nonetheless seek release. The Taz holds that this distinction is not in the source and that the formulation does bind. The Shach likewise holds that the distinction is not the source's, but he does not conclude: he writes וצ״ע.

The Baer Hetev, which is the practical digest, does not choose between them: he reports them together, and repeats as far as the Taz's conclusion. That is a signal — the practical digest here transmits the contestation rather than the gloss.

Conduct. The three readings meet on one point, and that is the one to retain: a התרה is required. The Taz because the vow took hold; the Rama because an עם הארץ must seek release (and, read with the gloss at 205, that applies today to all); the Shach because a צ״ע does not permit. What varies is the reason; what does not vary is that one does not get out of it alone. The case is brought before a Rav.

5. “ואני”: the halakha of seif ג

Ruling. One who hears his fellow's vow and says “אני כמותך” within the כדי דיבור is caught in the same prohibition; and the chain continues from man to man, each speaking within the כדי דיבור of the one before, up to a hundred. The Shulchan Arukh sets down no reservation here, and none of the siman's four commentaries glosses this seif: it is the Rambam's halakha, taken up as it stands.
Conduct. Two things follow, and they are concrete. (א) An assent said in the instant — a “me too” thrown out — can suffice to bind; one must not think a vow has to be pronounced on one's own account. (ב) Past the כדי דיבור, nothing attaches. But measuring the כדי דיבור after the fact, from a memory, is not an operation one performs oneself: it is precisely what one lays before the Rav.

6. What is not yet in the world: the halakha of seif ד

Ruling, in three lines. (א) Upon oneself, by קונם: one may forbid a דבר שלא בא לעולם. (ב) By full הקדש: one may not. (ג) Upon another, even by קונם: one may not. The Shach gives all three in one sentence, and the Pitchei Teshuva opens his entry by recalling the third.

A very concrete case is discussed in these two entries, and it is not settled there with one voice: he who vows to give מעשר on a profit still to come, then becomes poor and retracts. The Shach reports it in the name of a responsum, with a fine distinction — if the money itself already exists, the vow takes; and the Baer Hetev notes that the Taz, at siman 215, disputes that conclusion:

Conduct. An undertaking of צדקה or מעשר formulated on future income is therefore not a simple question: depending on how it was said, it may or may not have taken hold, and the Acharonim do not agree. This is exactly the kind of case settled with a Rav and not by reading — all the more since, as the Shach notes, a vow of צדקה is also a הקדש, which changes the nature of the problem.

8. What the sources do not give us here

The Nekudot HaKesef. On several simanim of Yoreh De'ah it is the Shach's reply to the Taz that decides, and one would expect to find it here — the controversy over the table invited it. They do not comment on siman 204: no entry is available to us for this siman. The column therefore stays empty, and we do not fill an empty cell with a conjecture.
And finally, conduct. This siman teaches how far an ordinary word can bind. It does not teach how to release — that is the business of the simanim that follow, and of a Rav. If one thinks one has pronounced one of these formulations, one does not decide for oneself that “it was not serious”: one goes to a Rav, who will judge whether there is a נדר, and whether it should be released.
