The Base level read the four seifim. Here we open what they do not say. Siman 204 sets out a mechanism — התפסה — and that mechanism raises, among Rishonim and Acharonim alike, questions that will then govern simanim 205 and 206. We take them one by one, each time with the text before our eyes.

📑 Plan of study

1. היקף “דבר הנדור” — is the anchor the קרבן, or anything forbidden by a man's mouth?
2. קדושת הפה against קדושת מעי אמו — why the בכור is out of play
3. המתפיס בשבועה פטור ובנדרים חייב — the reason for the difference
4. The ma'hloket of the שלחן — the Rama against the Shach and the Taz
5. השרשרת — what travels along the chain of a hundred
6. דבר שלא בא לעולם — why the נדר goes where הקדש does not
7. נפקא מינות and a recapitulation of the positions

1. היקף “דבר הנדור” — how far does the anchor extend?

The Mehaber writes two things in a single seif, and they do not obviously go together. First: the נדר is the one that attaches to a דבר הנדור, and the example given is “like a קרבן”. Then, immediately: “or he says יאסר עלי ככר זה”. But this second formulation attaches to nothing at all. Is it, then, a full נדר, or a derived case?

Does the term דבר הנדור denote (א) a thing vowed to Heaven — a קרבן and its like? or (ב) anything that a man's mouth has rendered forbidden, even a plain loaf forbidden by “יאסר עלי”?

The Tur writes — and everything turns on his word — that “he says: this loaf is forbidden to me”, adding that this too is a נדר:

The Beit Yosef stops there: why “too”? If this formulation is the very definition of the נדר — the one in which there is precisely no התפסה — then the word “too” is out of place. The Taz devotes his whole first entry to this difficulty, and his answer is a reversal:

The Taz's יסוד. דבר הנדור does not mean “vowed to Heaven”: it means vowed, full stop. A loaf I have forbidden by saying “אסור עלי” is, from that moment, a דבר הנדור — and another loaf may therefore be attached to it. The Tur's “too” therefore bears not on the prohibition (which is obvious) but on the capacity to serve as an anchor: that loaf too can carry an התפסה.

The Taz notes in passing that his father-in-law — the Bach — had reported in the Ran's name that “אסור עלי” would be only a יד (an unfinished vow, cf. siman 206) and not a full נדר; the Taz sets that reading aside. Here is what the Taz reads in the Ran:

If “אסור עלי” is a full נדר (Taz), a second loaf attached to it is forbidden. Were it only a יד, one would first have to establish that the first prohibition is truly of the rank of a נדר before anything could be attached to it. The question is therefore not one of vocabulary: it decides the fate of the second loaf.

Seif ב widens the anchor: not the קרבן alone, but anything דבר הקדוש בקדושת הפה. The criterion is therefore not the intensity of the holiness — the altar is no less holy than a lamb — but its origin. The gemara draws the line on the limiting case of the firstborn animal:

The Rambam draws the rule in its sharpest form:

What makes a thing fit to carry an התפסה is that it was made forbidden by a human speech-act. The firstborn animal is holy ממעי אמו: no mouth made it so, and therefore no mouth can attach to it. It is exactly the same line that will separate, at siman 205, the דבר הנדור from the דבר האסור — pork, נבלה, the idol: forbidden, but not by a word.

It comes from the baraita:

And the Rambam sets out the same list in his הלכות נדרים:

One ambiguity remains: “lamb” may denote a lamb of offering or a lamb of the flock. The Taz settles it by the rule of interpretation:

The whole mechanism of the siman — attachment — exists only in the נדר. It is unknown to the שבועה. The Rambam counts it among the four differences:

And the reason he gives a few halakhot further on — it is the clearest formulation in the corpus:

The gemara had already said it in two words, explaining the order of the mishna at the beginning of Nedarim:

The reasoning, unfolded. The נדר places a status upon an object: this loaf now belongs to “the forbidden category”. A status of an object can be copied onto another object — and that is exactly what התפסה does. The שבועה changes nothing in the object: it creates an obligation within the person. But an obligation cannot be copied from one object to another: it is nowhere in the world of things.
נפקא מינה, and it is the thread of the whole block 204-206. This same distinction will govern siman 206 seif ה: “הנודר שלא אוכל” is not even a יד, because the formulation “that I shall not eat” binds the person — it is the language of שבועה in the mouth of a man who thought he was making a נדר. The Taz will write there the very sentence the Rambam writes here.

4. The ma'hloket of the שלחן — the Rama against the Shach and the Taz

This is the sharpest controversy of the siman, and it is instructive because it turns not on a sevara but on the reading of a source. The Rama glosses seif ב from the Hagahot Mordechai in the name of the Maharam, and draws a distinction between שלחן שבמקדש and שלחן סתם.

The Shach's reading

For the Shach, the Maharam's dividing line is not which table, but which speech-act: “this loaf is upon me like the table” is an התפסה — that binds; “I vow by the table” is the language of an oath — that does not bind, because there is no Divine Name in a table. The Rama would have shifted the line from one axis to the other.

The Shach does not, however, stop at a refusal: he seeks a place for the Rama, and finds it only at the cost of some strain. Here is his attempt, then his conclusion:

The Taz's reading

The Taz reconstructs the question put to the Maharam and shows that it did not bear at all on the difference between the two tables. In passing he rejects the Levush's answer — that a table, unlike a lamb, evokes first of all the ordinary table — by an argument of fact:

His conclusion is twofold, and goes further than the Shach's: not only is the Rama's criterion the wrong one, but there is no difference at all between the two tables.

Three positions, and they do not coincide. (א) The Rama: “כשלחן סתם” does not bind; one nonetheless releases for an עם הארץ. (ב) The Shach: the Rama's distinction is not the source's; he attempts a defence, judges it strained, and closes on וצ״ע — he doubts, he does not declare an error. (ג) The Taz: “כשלחן סתם” does bind, exactly like “כאימרא”, by סתם נדרים להחמיר; and what the Rama wrote here is a mistake, confirmed by the Bach. The Baer Hetev (ס״ק ה) reports both together, and as far as the Taz's closing phrase.
A very concrete נפקא מינה. A man says: “this loaf is upon me like a table” — without saying which. For the Taz he is forbidden For the Rama, nothing has taken hold, save that an עם הארץ will have to seek release. For the Shach the question stays open — and “open” is not “permitted”. We do not conclude here: one goes to a Rav.

5. השרשרת — what does the chain of a hundred carry?

Seif א says “even up to a hundred, all are forbidden”. The Shach adds two extensions that the Shulchan Arukh had not written:

His source is the Rambam, who gives the chain with both its dimensions — time (“even after several days”) and kind (bread, honey, wine):

And the chain is not limited to objects: a day enters it too, as the Rambam's next halakha shows — it is exactly the end of seif א:

What exactly travels along the chain? (א) Each link refers back, step by step, to the original קרבן — the chain is only one long finger pointing at it. (ב) Or each link acquires in its own right the status of a דבר הנדור, and the next link attaches to it, without looking back to the origin. The Rambam, writing “even after several days” and changing kind at each link, reads better according to (ב); and that is also what the Taz assumes in ס״ק א, for whom a plain “אסור עלי” suffices to make an anchor.

Seif ג gives the same figure, but with men in place of objects: a hundred persons, each saying “ואני” within the כדי דיבור of the one before. The Rambam sets it precisely under the heading כיצד המתפיס בנדרים חייב — so for him it is indeed an התפסה, and not a different institution:

6. דבר שלא בא לעולם — why the נדר goes where הקדש does not

Seif ד is one line, and it carries one of the most discussed sugyot in the Talmud. The gemara grounds it in an a fortiori internal to the קונמות:

The Shach draws the threefold rule from it, and it is that which must be retained:

The קונם does not move the thing: it does not give it to the Temple, it does not take it out of its owner's possession. It only places upon me the prohibition of using it. But to forbid, the thing need not exist — it is enough that I exist. That is why I can forbid to myself another man's fruit, and why I can forbid to myself what is not yet born. הקדש, by contrast, must take something; and one does not take what is not.

The Pitchei Teshuva takes the question to a real case, and it is there that the Shach's limit — “upon another, no” — becomes difficult:

The ma'hloket reported by the Pitchei Teshuva. A shochet forbids his shechita to all Israel. (א) The Mahara Alfandari: this is a דבר שלא בא לעולם — the future slaughterings do not exist — so nothing took hold. (ב) The Bnei Yaakov: it is not a דבר שלא בא לעולם, for he forbids not a future object but his own shechita, and he exists. (ג) The Sha'ar HaMelech distinguishes: forbidding all his benefit makes the prohibition bite on the body, which exists; forbidding a particular benefit does not, and one falls back into the דבר שלא בא לעולם — whence he concludes, in this precise case, like the Mahara Alfandari.

Siman 204 does not state a list of prohibitions: it sets out a mechanism. A word creates a prohibition when it hooks a permitted thing onto a thing already forbidden by a human mouth. Everything the Rishonim and Acharonim dispute here comes down to three questions: what may one hook onto (the ma'hloket of the שלחן), how far does the chain run (the Shach's ס״ק ד), and on what can the hook bite (seif ד and the דבר שלא בא לעולם).
