Siman 204 said what makes a word bind: attaching to a דבר הנדור. This one says the opposite — and the opposite takes longer to say. Attaching to a דבר האסור, a thing the Torah forbids of itself, creates no נדר: neither “like the flesh of a pig”, nor “like my mother”, nor “like יין נסך”. And yet the Shulchan Arukh requires of an עם הארץ that he go and seek release — with a particular stringency. This paradox occupies twenty-two commentary entries for two seifim. These are rules למעשה: we study them here, we apply them with a Rav.

1. What is this siman about? Two seifim, twenty-two commentary entries

Siman 205 is the shortest of the block: two seifim. It is also one of the densest: those two seifim carry twenty-two commentary entries — ten of the Shach, five of the Taz, five of the Baer Hetev, one of the Pitchei Teshuva, one of the Nekudot HaKesef. There is no contradiction in that: the siman deals with a failure, and a failure is discussed at greater length than a success.

The previous siman said what binds: attaching to a דבר הנדור, a thing forbidden by a man's word. This one says what does not bind: attaching to a דבר האסור, a thing forbidden by the Torah itself — pork, the idol, נבלה, one's mother, one's sister. Nothing takes hold. But the Shulchan Arukh does not stop there: it adds at once that, for an עם הארץ, one must nonetheless go and ask a חכם, and with a particular severity. It is this paradox — it is not a vow, and yet it must be released — that occupies the greater part of the apparatus.

Two seifim, two failures, and a paradox. Seif א: attaching to a Torah prohibition — nothing takes hold, but an עם הארץ must nonetheless seek release, and by a פתח, not by a mere חרטה. Seif ב: saying of one's wine that it shall be יין נסך — nothing takes hold; but if he said it by way of a penalty (דרך קנס) and transgressed, יש אוסרים ויש מתירים.

2. The boundary: דבר הנדור on one side, דבר האסור on the other

The line comes from one word of the verse, and the gemara draws it in a single sentence. It already served at siman 204; here it is the whole siman:

The mishna in Nedarim gives the very list our seif א takes up — and one recognises in it pork, the idol, נבלות וטריפות:

And the next mishna gives the second half of the seif: the man who spoke thus of his wife, and the פתח ממקום אחר that is opened for him:

The criterion, as the Rambam formulates it. Why does “like pork” not bind, while “like a קרבן” does? Because an ordinary animal can become a קרבן by a word — so the comparison means something. But nothing can become pork. The Rambam makes a general rule of it, and it is what one must retain from the whole siman.

3. The text of the Shulchan Arukh, seif by seif

Seif א — Attaching to a Torah prohibition, and what is nonetheless required of an עם הארץ

One who says: “these fruits are upon me”, or “such a kind upon me”, or “what I shall eat with so-and-so upon me” — like the flesh of a pig, or like an idolatrous cult, or like נבלות וטריפות and their like; and likewise one who says to his wife: “you are upon me like my mother, or like my sister, or like ערלה, or like כלאי הכרם” — all these are permitted, and there is no נדר here. And if the speaker was an עם הארץ, he requires a שאלה before a חכם, and we show him that his wife is forbidden and that those fruits are forbidden, and we are stringent with him: חרטה alone does not suffice for him, but a פתח must be opened for him from another place and his vow released — so that vows not be treated lightly. Gloss of the Rama: some say that nowadays all are judged as עמי הארץ, most not being בני תורה (responsum of the Rashba); and yet some say that even for an עם הארץ a שאלה is required only when he forbids his wife upon himself, and not for other vows (Tur, and see ס״ק ד).
Two moments that must not be confused. (1) The law: attaching to a דבר האסור creates no נדר. The thing remains permitted. (2) The precaution: if the speaker is an עם הארץ, he is treated as though the vow had taken hold — he is shown that his wife is forbidden, and made to seek release — for a reason that is not his own: כדי שלא ינהגו קלות ראש בנדרים, so that people not treat vows lightly.
חרטה does not suffice: a פתח is required. The Shulchan Arukh here hardens the procedure of annulment itself. Ordinarily, a regret bearing on the vow's origin may suffice; here it is required that the חכם open a door for him from another place — that he bring him to discover a consequence he had not thought of, which shows him he would not have spoken had he known it. The Shach (ס״ק ג) notes that the Ran adds a limit: that door is not opened for him by his mother's honour.

Seif ב — “let my wine be יין נסך”: the word of penalty

One who says that his wine shall be יין נסך and his bread פת כותים — he has not become forbidden thereby. But if he said it by way of a penalty (בדרך קנס) — for example: “if I do such a thing, or if I transgress such a thing, my bread shall be פת כותים and my wine יין נסך” — and he transgressed: some forbid and some permit. Gloss of the Rama: and even so, for an עם הארץ there is room to release [him]. And all this concerns an individual who took it upon himself; but a community may, in the time of the Sanhedrin, chastise rebels and transgressors [by decreeing] that their wine shall be יין נסך and their bread פת כותים, and whatever they decree in this stands (responsum of the Rashba). See above at siman 229, one who says: “if I do such a thing, I shall not be a Jew”.
Why this does not bind. Libation wine and the bread of the כותים are things forbidden, not things vowed: one cannot therefore attach to them. The Taz says it in five words (ס״ק ג), and the Shach twice (ס״ק ז and ס״ק ט). It is exactly the same reason as in seif א — siman 205 is one principle stated twice.
And why some nonetheless forbid. When the formulation is pronounced as a penalty — “if I transgress, let my wine be…” — the Shach reports in the name of the Rivash a quite different reasoning: this is no longer an התפסה, it is a man taking upon himself a stringency, as a court may impose one. The others reply that none of this helps: he did not attach to a דבר הנדור.

4. The key concepts of the siman

דבר האסור — “A forbidden thing”. Forbidden by the Torah itself, not by a man's word: pork, One does not attach to it. It is the exact opposite of the דבר הנדור of the previous siman.
עם הארץ — A man without halakhic learning. The term here bears not on piety but on knowledge: one who does not know that his word bound nothing. It is for him — and for the effect of his example — that a שאלה is required. The Rama adds that nowadays all are so judged.
שאלה לחכם — The request addressed to a sage. The procedure by which a vow is released. It is no formality: the חכם must establish that there is matter to release, then find the path of annulment.
Regret. Declaring that one regrets the vow from its origin — that one would never have formed it. Our seif says expressly that, in this case, that does not suffice.
פתח — The “opening”. A consequence of the vow unknown to the speaker which, once disclosed, shows he would not have spoken. It is by this that the חכם releases. The seif here requires a פתח from another place — the Ran specifies: not by his mother's honour.
יין נסך — Libation wine. Wine bound up with idolatrous worship, forbidden for consumption and for benefit. The Shach (ס״ק ו) specifies that the seif speaks of the case where the man said explicitly that he meant that wine.
פת כותים — The bread of the כותים. The object of a rabbinic prohibition. Like יין נסך, it is a דבר האסור: one does not attach to it.
דרך קנס — By way of a penalty. Not “my wine is יין נסך”, but “if I do such a thing, my wine shall be יין נסך”. It is this penal conditional that makes up the whole second half of seif ב, and on which יש אוסרים ויש מתירים.

5. The apparatus of the Shach (ש״ך) — the ten ס״ק

Ten entries for two seifim. The first is a treatise in itself: in it the Shach copies out the whole beginning of the Rambam's הלכות נדרים, and it is from there that the siman's general rule comes. We give it in four extracts.

The Shach begins with the derivation — from the verse “איש כי ידור נדר לה׳” we learn: until he vows by a דבר הנדור — then copies the Rambam: the נדר divides in two, vows of prohibition (forbidding to oneself what is permitted) and vows of consecration (obliging oneself to a קרבן). From there he draws the rule that decides everything: could a vow produce that to which I attach myself? If so, it binds; if not, not.

An important exception, reported by the Beit Yosef in the name of the Rashbatz: one who was compelled (נאנס) so to forbid a woman — the rabbis were not stringent to the point of imposing a שאלה upon him. The seif's stringency aims at carelessness, not at compulsion.

The Shach explains the stringency: elsewhere, a regret bearing on the vow's origin may suffice; here, even such a regret does not suffice, and a פתח is required. He then reports from the Ran a limit on the פתח: it is not opened for him by his mother's honour — that is, by saying “would you have spoken had you known your mother would be dishonoured by it?”

Here is the ma'hloket of the siman, and the Shach takes sides. The Bach holds that nowadays all are עמי הארץ for every vow. The Shach replies that it is the Rama's words — the second י״א, which limits the requirement to the case of the wife — that are primary, because the sugya proves it, and because that is the view of the Rosh, the Ran and Rabbeinu Yeruham.

Why the wife and not the rest? Two reasons, and they are not the same. The Prisha: because he has put himself in the way of nullifying פריה ורביה. The Ran: because that is what a man commonly does, out of vexation — the danger lies in frequency, not in gravity.

A decisive precision for reading seif ב: he must have said explicitly that he meant the wine of idolatrous worship. Otherwise the expression could be understood differently, and the Shach refers to siman 208 for the rule of interpretation.

The reason first, in six words: he did not attach to a דבר הנדור. Then a long discussion by the Bach on a responsum of the Rosh: one who says “let my wine be forbidden to all Israel if I do such a thing” — why is that not a vow, since “this loaf is forbidden to me” is one? The answer retained: one may forbid to oneself (לאסור אסר על נפשו), one may not forbid to all Israel otherwise than by קונם.

The Rivash's reasoning, and it is remarkable: these stringencies are not of strict law — but a man may impose them upon himself, exactly as a court may, according to the needs of the hour, punish beyond the letter. It is therefore no longer a question of התפסה at all.

The reply holds in six words, and they are the same as at ס״ק ז: he did not attach to a דבר הנדור. The Shach does not elaborate — there is nothing to add.

The Shach explains the Rama's gloss: “to release” means here by a שאלה; and he adds the sentence that weighs heaviest in the whole siman — and now all are like עמי הארץ, and the prohibition is practised. He reports it from the Beit Yosef in the name of a responsum of the Rashba.

6. The apparatus of the Taz (ט״ז) — the five ס״ק

The reason in one sentence, and it is the clearest in the siman: all those are forbidden of themselves; one therefore cannot say of a permitted thing that it shall be “like this”, since it is impossible that it too become forbidden of itself.

The Taz gives a third reason, different from the Shach's two: the concern is not what he said, but what he will get into the habit of saying. By dint of using the language of prohibition about her, he will end by forbidding her through a דבר הנדור — and then it will take hold.

Five words, and it is the whole siman: there is no דבר הנדור here.

The Taz identifies the lenient view — it is the Rosh, reported by the Tur at the end of the siman — then raises a difficulty on another responsum of the Rosh brought by the Beit Yosef: it says that forbidding one's wine to all Israel does not bind, whereas the Tur himself writes, at the beginning of siman 204, that the language of איסור makes a נדר. The Taz proposes a distinction (one may forbid upon oneself, not upon another) and concludes that this responsum is not authoritative. It is precisely here that the Nekudot HaKesef's single entry attaches.

The Taz explains the Rama's reasoning: it is precisely because he said it by way of a penalty — and the Beit Yosef reports it in the name of the Rivash — that the Rama decided on the stringent side for an עם הארץ.

7. The Baer Hetev, the Pitchei Teshuva and the Nekudot HaKesef

Taking up Taz ס״ק א; the Baer Hetev adds to it, in parentheses, the Rambam's general rule — the very one the Shach had copied at ס״ק א.

The Baer Hetev here joins the Shach's ס״ק ב and ג: the Ran's limit on the פתח, and the Rashbatz's exception for one who was compelled.

The digest of the ma'hloket: the Bach on one side, and on the other the Shach's conclusion — the Rama's words seem primary.

The Shach's ס״ק ז and ו joined in one line: the reason (no דבר הנדור) and the precision on the sense of “יין נסך”.

The Shach's ס״ק י, then the Taz's ס״ק ד copied out almost in full — so that the hurried reader of the Baer Hetev also receives the Taz's difficulty on the Rosh's responsum.

The Pitchei Teshuva

His single entry in the siman, and it touches the most sensitive point. The Shulchan Arukh said that “you are upon me like my mother” does not bind. The Pitchei Teshuva reports, by way of the Baer Hetev, a view of the Ralbach: if the man said “you are forbidden upon me like my mother”, it is a true נדר. He at once notes that the Tashbetz left the matter in צ״ע, and refers to a long discussion in the Machaneh Efraim. The question therefore stays open — and it is one of those one does not settle alone.

The Nekudot HaKesef

The Nekudot HaKesef are the Shach's reply to the Taz. On siman 205 there is a single entry, and it bears precisely on the Taz's ס״ק ד — Sefaria indeed places its mark at that point in the Taz's text. It holds in a few words:

That is: the difficulty the Taz raises, the Bach had already raised — and the Shach refers the reader to what he himself wrote about it in his commentary. It should honestly be noted that the internal reference there points to a ס״ק whose number does not coincide with the one under which the Bach's discussion is read in our edition of the Shach (it appears there at ס״ק ז). We flag this rather than correct it.

8. The table of the siman

9. Practical cases

These cases illuminate the mechanism. They do not conclude: a vow pronounced is brought before a Rav, and the Rama's gloss on seif א — nowadays all are judged as עמי הארץ — indicates well enough that the reflex “it was nothing” is precisely the one the siman means to discourage.

He says, irritated: “this dish is upon me like pork”.
This is the very case of seif א: he attached to a דבר האסור. In law, nothing took hold. But the Rama's gloss means the question does not stop there — one puts it to the Rav, who according to the case may require a התרה.
A man says to his wife, in anger: “you are to me like my sister”.
Seif א aims at exactly this utterance, and it does not bind. But it is the case for which the Shulchan Arukh requires a שאלה of an עם הארץ, and the Shach (ס״ק ה) explains why: because it is the utterance a man most readily pronounces, in vexation. And the Pitchei Teshuva recalls that a neighbouring formulation — with the word “forbidden” — is disputed. Such a case is brought at once before a Rav.
He was compelled to pronounce such a formulation.
The Shach (ס״ק ב) reports from the Rashbatz that in a case of compulsion (אונס), the rabbis were not stringent to the point of requiring a שאלה. The circumstance therefore counts — and it is precisely the kind of circumstance one lays before the Rav rather than judging oneself.
He says: “if I start smoking again, my wine shall be יין נסך” — then he starts again.
This is the דרך קנס of seif ב, and the Shulchan Arukh itself leaves the matter open: יש אוסרים ויש מתירים. The Rama adds that, for an עם הארץ, there is room to release. Nothing here is settled by reading.
A community decrees a penalty of this kind against transgressors.
The Rama expressly distinguishes this case from that of an individual, relying on a responsum of the Rashba: the question is no longer that of a vow but that of the community's power. The gloss situates it in the time of the Sanhedrin.

10. Synthesis and comprehension questions

Two seifim, a single principle. One does not attach to what the Torah forbids of itself. Pork cannot become more pork, the idol more idol; and the Rambam's rule formulates it exactly: that to which one attaches must be something a vow could have produced. Hence: “like the flesh of a pig”, “like my mother”, “like יין נסך” — nothing takes hold. But the Shulchan Arukh does not stop at the law. For an עם הארץ it requires a שאלה, with a פתח and not a mere חרטה, so that vows not be treated lightly — and the Rama adds the sentence that changes everything: nowadays all are so judged. One case remains on which the authorities divide: the formulation said בדרך קנס, where one no longer attaches but imposes a stringency on oneself — יש אוסרים ויש מתירים.
  1. Why does “this loaf is upon me like the flesh of a pig” create no prohibition?
  2. What is the general rule the Rambam formulates, which the Shach copies at ס״ק א?
  3. If nothing took hold, why does the Shulchan Arukh nonetheless require a שאלה of an עם הארץ?
  4. What is the difference between a חרטה and a פתח, and why does the seif here require the latter?
  5. What limit does the Ran set on the פתח, according to the Shach (ס״ק ג)?
  6. What is the ma'hloket between the Bach and the Shach (ס״ק ד) about?
  7. Why is an utterance said בדרך קנס treated differently — and what reasoning does the Rivash bring to it?
  8. What does the Pitchei Teshuva report in the name of the Ralbach, and why does the question stay open?
