✦ ❖ ✦

A first approach to Siman 208, five seifim at the heart of the laws of נדרים. The previous siman asked whether a deformed word binds; this one asks what becomes of an imprecise one. Someone says: “these fruits are upon me like salted meat” — but which salted meat? That of the altar, which is a vowed thing and makes the vow effective; or that of an idolatrous cult, which is merely a forbidden thing and does not? The Shulchan Arukh answers: סתם נדרים להחמיר, it is taken stringently. Then it moves to the man who backtracks afterwards — “I only vowed by the net of the sea” —, to what is required of him, and to the penalty of one who has transgressed his vow. These are rules למעשה: every real case is put to a Rav.

📑 Plan of study

1. What is this siman about? The imprecise word, and what is done with it
2. The five seifim, one after another, clause by clause
4. Where these seifim come from: the Mishnah, Gemara Nedarim, the Rambam, the Tur, the Beit Yosef
5. The apparatus of the siman: the thirty-seven entries, quoted one by one
6. The table of the five seifim
7. Practical cases
8. Comprehension questions

1. What is this siman about?

A vow is made by attaching one thing to another: I say of these fruits that they are to me like such a thing, and their status becomes that of the thing named. This is called מתפיס — “attaching”. But the device takes effect only if the thing attached to is itself vowed (דבר הנדור): an offering, a consecration. Attaching to something merely forbidden (דבר האסור) — pork, an idol — does nothing at all.

Hence the difficulty of the siman. Some expressions are ambiguous: “salted meat” denotes the meat of the altar (vowed) as well as that of an idolatrous cult (forbidden); “libation wine” likewise. The first seif decides: with no specification, it is taken stringently. The four that follow shift to another problem — the man who, after speaking, claims to have meant something else, and the man who has transgressed his vow and comes to have it released.

The siman in two halves. Seif 1: the ambiguous word is taken stringently, but one who explains himself is believed — unless the usage of the place contradicts him. Seifim 2 to 5: the man who backtracks by a far-fetched reading, what is required of him according to whether he is learned or not, and the penalty of days for one who has transgressed.

2. The five seifim, clause by clause

Here are the five seifim, each first in full — as the source gives it, including the parenthetical glosses and the Rama’s gloss —, then broken down.

Seif 1 — the ambiguous word is taken stringently

The seif lays down its title rule, gives the textbook case, and then its two limits: the man who explains himself is believed; but the usage of the place may contradict him.

Unspecified vows are taken stringently. How so? He said: these fruits are upon me like salted meat, or like libation wine — which may mean the salted meat of קדשים, or wine poured to Heaven, and then it is a vow
The textbook case is chosen for its ambiguity: each of the two expressions denotes two very different things.
for he attaches [his prohibition] to a vowed thing
Here is the mechanism: if the thing named is a דבר הנדור — made forbidden by a man’s word — the attachment takes effect.
and it may further mean the salted meat and libation wine of an idolatrous cult, and then it is not a vow
The other sense of the same expression. Note that the text here carries עבודת כוכבים, the spelling of censored editions: we copy it, and translate it “idolatrous cult”.
for he attaches [his prohibition] to a forbidden thing — [and] we construe him stringently
A דבר האסור is forbidden by the Torah itself: nothing can be attached to it, and the vow would fall. Since both senses are open, we take the one that makes the vow hold.
and if he says that his intent was the salted meat and libation wine of an idolatrous cult, he is believed
The stringency holds only in the absence of a statement. Once he states his meaning, we follow him — the rule is not a presumption against him but a rule for construing silence.
and he needs no שאלה, even if he is an עם הארץ
A sharp point: he need not even come to have his vow dissolved by a sage. This is precisely what the Bach will contest and the Shach defend at ס״ק ב.
and if most of the people of the place call the salted meat of קדשים simply “salted meat”, and wine poured to Heaven simply “[libation] wine” — he is not believed
The last clause turns everything round: if local usage has fixed the sense, the expression is no longer ambiguous, and the man’s statement can do nothing against it. The word רוב will be the subject of the longest discussion in the siman.
Seif 1 in a word. When a vow can be heard two ways, it is heard the way that makes it hold — so long as he has said nothing. Let him explain, and he is believed, without even needing a dissolution. But if the usage of his place has already fixed the sense, his statement no longer weighs.

Seif 2 — going back on one’s words, and the penalty of days

The longest seif of the siman, and it holds two matters. First, four men who, after speaking plainly, claim to have meant something else. Then, from “and if he transgressed the vow”, an entirely different subject: what is required of one who has transgressed before he can be released.

He vowed by חרם and said: I vowed only by the cherem of the sea (explanation: the net with which fish are caught in the sea)
The same word denotes the ban and the fisherman’s net. The man takes refuge in the second sense. The explanatory parenthesis is in the printed text; we copy it.
[he vowed] by קרבן, and said: I vowed only by the offerings of kings
The same device: קרבן denotes the offering of the altar, but also a gift made to a king.
“I myself am קרבן”, and he said: I vowed only by the bone I set aside to vow by
The play here turns on a single word: עצמי means both “myself” and “my bone”. The Shach, at ס״ק ז, spells out the shift.
“קונם, that my wife have no benefit from me”, and he said: I vowed only about my first wife, whom I divorced
The fourth case, and the weightiest in its consequences: the man claims to have spoken of a woman who is no longer his.
if he is a תלמיד חכם, he is believed and needs no התרה
The scholar is presumed to know what he says, and is not suspected of seeking a way out.
and if he is an עם הארץ, he needs a שאלה — so that vows not be treated lightly
The reason given is not suspicion but instruction: The Pitchei Teshuva, at ס״ק ג, will report an unexpected consequence of that reason.
however, regret suffices, and there is no need to open a door for him
Since the requirement is only pedagogical, the lightest form of dissolution suffices. The Shach, at ס״ק ט, reports that the Bach disagrees.
and if he transgressed the vow, he is not penalised to observe the prohibition for as many days as he transgressed the vow and conducted himself permissively
Here the second matter of the seif begins. The penalty consists in making up in days of prohibition the days of licence — and it does not apply to the vows of this chapter. The Shach gives the reason at ס״ק י: they are only rabbinic.
but one who made a full Torah vow and transgressed it (deliberately) — he is penalised, and is not released unless he observes the prohibition for as many days as he transgressed and conducted himself permissively
The penalty holds for a genuine vow knowingly transgressed. The word במזיד is parenthesised in the text; it is decisive.
and if there is a risk of stumbling — for instance if he vowed about something he cannot avoid, such as forbidding himself all the fruits in the world except grain, and transgressed — he is released at once
The exception: when the vow cannot be kept, keeping it manufactures sins. The Shach, at ס״ק י״א, spells out what “except grain” changes.
and he is not penalised to observe the prohibition for as many days as he transgressed, so that he not come to stumble
The reason is stated in as many words:
and there is one who says that all the same one should be strict with him: not to release him by regret but by a door
A minority view, which the seif reports without deciding. It will return at the Lamdan level.
and from this we learn about one who forbade himself meat and wine if he should commit a certain sin, and who committed it without keeping from meat and wine, and comes to have his vow released: he is released at once, and need not observe the prohibition for as many days as he conducted himself permissively, since there is a risk of stumbling
The principle applied to a frequent case: a vow taken as a fence against a sin, and transgressed twice over. The Shach, at ס״ק י״ב, sets the limit: one who seeks release in order to transgress.
Gloss of the Rama: however, if it appears to the sage that he can master himself and will not transgress again, he is not released until he observes the prohibition for as many days as he conducted himself permissively (Mordechai, beginning of שבועות שתים, and responsa of the Ramban § 225)
The Rama narrows the leniency: it is for one who cannot hold, not for one who will not. The judgement belongs to the sage — and so, by construction, it is a human judgement.
Seif 2 in a word. Two very different rules under one number. (1) One who takes refuge in a far-fetched sense: the scholar is believed, the common man comes to ask for a dissolution — and simple regret suffices. (2) One who has transgressed: nothing for the vows of this chapter, making up in days for a Torah vow deliberately transgressed, and immediate release when the vow cannot be kept.

Seif 3 — how many days

A single clause, and it caps the penalty of the preceding seif.

In what case must he observe the prohibition for as many days as he conducted himself permissively? When the days are few; but when they are many, thirty days suffice
The penalty is proportional but capped. Thirty days: the length of an ordinary נזירות, whence the comparison the Beit Yosef draws. The Shach, at ס״ק י״ג, will refuse this leniency.
Seif 3 in a word. The penalty of days is counted one for one while it is short, and caps at thirty days when it would be long. This is a point of open divergence: the Shach writes

Seif 4 — one who transgressed a נידוי

A second cap, by an argument from degree.

One who transgressed a נידוי need not observe the prohibition for as many days as he conducted himself permissively, because נידוי is rabbinic
The reasoning is simple: the penalty of days is owed only for what is of the Torah. Simple — and it is exactly what the Taz, at ס״ק ג, declares contradictory to siman 334, and what the Shach, at ס״ק י״ד, spends a full page resolving.
Seif 4 in a word. No penalty for a transgressed נידוי, since it is only rabbinic. The Taz writes that this ruling contradicts that of siman 334; the Shach distinguishes between neglecting the rules of נידוי and transgressing the thing one accepted under נידוי.

Seif 5 — one who swore not to marry, and married

The siman closes on a concrete case, drawn from the responsa, and turning on the exact wording of the oath.

He swore not to take a wife within three years, and transgressed and married
The facts: the oath was transgressed, and the marriage is done.
if he used a wording meaning “that he not perform the marriage with her”, it is like one who swore about a loaf and ate it: he asks, and is released
If the oath bore on an act, the act is past: there is nothing left to prevent, and the oath is dissolved like any oath already transgressed. The Shach, at ס״ק ט״ז, adds that he is then quit.
but if he used a wording meaning “that she not be his wife”, he is not released until he divorces her, for as many days as he treated his vow lightly
If the oath bore on a state, the state still stands, and the transgression continues each day. Hence the grave requirement of divorcing her for the making-up period.
(and it has already been explained that thirty days suffice)
A reference back to seif 3 — and that reference is precisely what the Shach contests: the Baer Hetev, at ס״ק י, says so expressly.
(responsa of the Rashba, responsa of the Ramban and of the Rivash, as to the halakha)
The source note of the printed text. We copy it as it stands.
Seif 5 in a word. Everything turns on the wording: an oath about an act is dissolved once the act is done; an oath about a state obliges one to undo the state. The Shach, at ס״ק ט״ו, opens a way out: if the oath does not take effect at all, because it voids פריה ורביה, there is no occasion to divorce.

3. The key concepts of this siman

This siman uses technical vocabulary it does not define. Here are the words one cannot do without.

מתפיס — “To attach”: the mechanism of the vow by comparison. I do not say “these fruits are forbidden to me”, I say “these fruits are to me like such a thing” — and their status aligns with that of the thing named. The whole of seif 1 turns on what the thing attached to is worth.
A vowed thing”: a thing made forbidden by a man’s word — an offering, a consecration. One may attach to it: that is what gives the vow effect.
דבר האסור — “A forbidden thing”: a thing forbidden by the Torah itself — pork, an idol. One may not attach to it: the vow does not take. That is why “like the libation wine of an idolatrous cult” does nothing, while “like the wine poured on the altar” does everything.
סתם נדרים להחמיר — “Unspecified vows are taken stringently”: the title rule of the siman. When an expression can be heard both ways, and the speaker specified nothing, we take the sense that makes the vow effective.
חרם — “Ban, anathema”: a consecration that withdraws a thing from use. The word has two very different uses — the חרם of the Temple (חרמי בדק הבית), which is a vowed thing, and the חרם given to the priests, which is simply their property. Hence its ambiguity, and hence seif 2, where the man claims to have spoken of the fishing net (חרמו של ים), which bears the same name.
חרטה · פתח — The two routes to dissolving a vow. חרטה is regret: the man declares that he regrets having vowed. פתח is an opening: the sage shows him a consideration he did not know of and which, had he known it, would have kept him from vowing. Seif 2 says that regret suffices here; the Shach reports that the Bach requires an opening.
תלמיד חכם · עם הארץ — The scholar and the common man. The siman treats them differently: the first is believed on his word and needs nothing, the second must come to ask for a dissolution — not because he is suspected, but שלא ינהגו קלות ראש בנדרים, so that vows not be treated lightly. The Shach adds that today all are judged as עמי הארץ.
נידוי — “Excommunication”: a sanction of the court, distinct from a vow. Seif 4 uses it for an argument from degree: since נידוי is rabbinic, one who has transgressed it is not subject to the penalty of days. From there spring the Taz’s contradiction and the Shach’s long reply.
The key words in one line. One vows by attaching; one attaches effectively only to a דבר הנדור; when the expression is ambiguous, סתם נדרים להחמיר; one who explains himself is believed, unless the usage of the place contradicts him; and one who has transgressed pays in days. Every real case is put to a Rav.

4. Where these seifim come from

The five seifim condense two mishnayot of the second chapter of Nedarim, the Gemara that accompanies them, four halakhot of the Rambam, and the Beit Yosef’s discussion. Here they are, in order.

The Mishnah —

Seif 1 is a mishnah, word for word or nearly:

And here is how the Gemara gives it — with, in passing, a difference of nusḥa that must be seen:

Rabbi Yehudah’s mishnah, immediately following, grounds the last clause of seif 1: it is the usage of the place that decides, not an absolute meaning.

The Mishnah —

Seif 2 opens on the next mishnah, that of the four men who backtrack:

And the mishnah then gives the divergence from which the whole régime of the seif springs — Rabbi Meir against the Sages:

The Rambam — הלכות נדרים, chapter 2

The Rambam states the rule of seif 1 with a nuance of wording over which much ink will be spilled: ופרושן יש בו להקל ולהחמיר — “and its explication can go either way”.

He then gives the criterion of place, which grounds the last clause of seif 1:

And he treats the case of seif 2 — but his conclusion about the עם הארץ is not exactly that of the Shulchan Arukh, and from there springs the Bach’s question:

The Tur and the Beit Yosef

The Tur gives seif 1 almost word for word, and adds a clause the Shulchan Arukh did not take over:

The Beit Yosef goes back to the mishnah, gives the reason for the ambiguity, and then reports the two readings of the Rosh — this is the heart of the Lamdan level:

And he concludes, on this point, with a sentence the Shach will contest:

On the clause of the רוב, the Beit Yosef himself raises the difficulty that will occupy the Taz and the Shach:

Finally, on the penalty of days and on seif 5, it is he who supplies the conclusion and the source:

5. The apparatus of the siman, entry by entry

The apparatus of this siman is dense: thirty-seven entries — sixteen ס״ק of the Shach (seventeen paragraphs: the first holds two), four of the Taz, ten of the Baer Hetev, five of the Pitchei Teshuva, one of the Nekudot HaKesef. We quote them all, in order, without summarising any.

The Shach (ש״ך) — sixteen ס״ק

This is the siman’s principal commentary, by far. Three of his notes are genuine essays: ס״ק ג on the רוב, ס״ק י״ג on the thirty days, ס״ק י״ד on נידוי.

ס״ק א — what “unspecified” means, the תימה against the Beit Yosef, and one who has forgotten whether he vowed or swore

ס״ק י״ד — the contradiction about נידוי, and its resolution

The Taz (ט״ז) — four ס״ק

The Taz writes only four notes, but the first is the longest page in the whole siman: in it he takes up the Beit Yosef’s difficulty about the רוב and offers a comprehensive solution, resting on a passage of Kiddushin.

ס״ק א — the difficulty of the רוב, and the Taz’s overall solution

ס״ק ב — where פתח and חרטה are treated

ס״ק ג — the ruling of siman 334 contradicts this one

ס״ק ד — and if there was an oath

The Baer Hetev (באר היטב) — ten ס״ק

The Baer Hetev follows the seif step by step and abridges the Shach; indeed he names him almost every time. He is the best thread for a reader in a hurry.

ס״ק א — the rule of “unspecified”, and the Mabit

ס״ק ב — the Bach and the Shach on the עם הארץ

ס״ק ג — the ת״ח, the רוב, and the lenient side

The Pitchei Teshuva (פתחי תשובה) — five ס״ק

The Pitchei Teshuva brings what the others do not: the responsa of the Acharonim. Here, the Radbaz, the Chavot Yair, the Noda BiYehuda, the Avodat HaGershuni and the Zikhron Yosef — and one of these cases became famous.

ס״ק א — the Radbaz: a conditional oath, and the child who died

ס״ק ב — the Chavot Yair against the Shach on the ת״ח

ס״ק ג — if the reason is credibility alone, what of doing it in secret?

ס״ק ד — is the חרם from the Torah? the Noda BiYehuda’s change of mind

ס״ק ה — the rabbi appointed despite the חרם, and the Sulzbach Talmud

The Nekudot HaKesef (נקודות הכסף) — one entry

The Nekudot HaKesef are the Shach’s reply to the Taz. Here they run to one line, and that line sends the reader back to the Shach himself.

The single entry — it refers to the Shach

6. The table of the five seifim

The whole siman in one grid: the seif, the decisive clause, and what it settles.

SeifThe clause of the Shulchan ArukhWhat it settles
א « סתם נדרים להחמיר כיצד אמר פירות אלו כבשר מליח או כיין נסך שיש במשמעו מליח של קדשים או יין נסך לשמים שהוא נדר » (שו״ע יו״ד ר״ח:א) The textbook case is chosen for its ambiguity: each of the two expressions denotes two very different things.
The stringency holds only in the absence of a statement.
א « ואם רוב אנשי המקום קורים לבשר מליח של קדשים בשר מליח סתם וליין נסך לשמים יין [נסך] סתם אינו נאמן: » (שו״ע יו״ד ר״ח:א) The last clause turns everything round: if local usage has fixed the sense, the expression is no longer ambiguous, and the man’s statement can do nothing against it.
The scholar is presumed to know what he says, and is not suspected of seeking a way out.
ב « ואם הוא עם הארץ צריך שאלה שלא ינהגו קלות ראש בנדרים » (שו״ע יו״ד ר״ח:ב) The reason given is not suspicion but instruction: שלא ינהגו קלות ראש בנדרים.
Since the requirement is only pedagogical, the lightest form of dissolution suffices.
No penalty of days for the vows of this chapter, which are only rabbinic.
ב « אבל הנודר נדר גמור דאורייתא ועבר עליו (במזיד) קונסין אותו ואין מתירין לו אלא א״כ ינהוג איסור כימים שעבר עליו ונהג בו היתר » (שו״ע יו״ד ר״ח:ב) The penalty holds for a genuine vow knowingly transgressed.
ב « ואם יש מכשול בדבר כגון שנדר בדבר שאינו יכול ליזהר בו כגון שאסר עליו כל הפירות שבעולם חוץ מדגן ועבר עליו מתירין לו מיד » (שו״ע יו״ד ר״ח:ב) The exception: when the vow cannot be kept, keeping it manufactures sins.
ב « הגה מיהו אם נראה לחכם שיוכל לעמוד על עצמו ולא יעבור עוד אין מתירים לו עד שינהוג איסור כימים שנהג בהן היתר (מרדכי ריש שבועות שתים ובתשובת הרמב״ן סי׳ רכ״ה): » (רמ״א יו״ד ר״ח:ב) The Rama narrows the leniency: it is for one who cannot hold, not for one who will not.
The penalty is proportional but capped.
The reasoning is simple: the penalty of days is owed only for what is of the Torah.
ה « אם אמר לשון שמשמעו שלא יעשה נישואין עמה הוה ליה כנשבע על הככר ואכלה דנשאל ומתירין לו » (שו״ע יו״ד ר״ח:ה) If the oath bore on an act, the act is past: there is nothing left to prevent, and the oath is dissolved like any oath already transgressed.
» (שו״ע יו״ד ר״ח:ה) If the oath bore on a state, the state still stands, and the transgression continues each day.

7. Practical cases

Five situations, taken in the order of the siman. Each closes on the same referral: the actual conduct belongs to the Rav.

Case 1 — an ambiguous formula

Someone uses an expression that can be heard two ways, one of which gives the vow effect and the other not. The rule of seif 1 applies: סתם נדרים להחמיר, the stringent sense is taken. But if he declares what he had in mind, he is believed — and that without needing a dissolution. It remains to be seen whether the usage of his place does not contradict his declaration; that is a fact, and it is established before a Rav.

Case 2 — backtracking after having spoken

Someone used an expression plain to everyone, and afterwards declares that he meant it otherwise. This is exactly seif 2 — and the siman is harder here: this is no longer an ambiguity, it is a way out. The scholar is believed without formality; one who is not must come before a sage. The Shach adds that today everyone is judged as an עם הארץ — so one comes before a sage.

Case 3 — having transgressed one’s vow, and seeking release

The siman distinguishes. For the vows of this chapter, which are only rabbinic, no penalty. For a full Torah vow deliberately transgressed, one is required to observe the prohibition for as many days as one behaved permissively. How many days at most? Seif 3 says thirty; the Shach, at ס״ק י״ג, writes אין להקל and requires the full count. This is a point on which the decisors openly diverge: ask your Rav.

Case 4 — a vow impossible to keep

Someone has forbidden himself something he cannot do without, and has transgressed. Seif 2 expressly provides for this and rules for immediate release, כדי שלא יבא לידי מכשול — so that he not come to stumble. But a יש מי שאומר maintains that one must then go by a פתח and not by mere regret. The Shach, at ס״ק י״ב, adds a severe limit: one who seeks release in order to transgress.

Case 5 — an undertaking taken on by a community

The Pitchei Teshuva, at ס״ק ה, reports two cases in which a community had decreed a חרם and someone went ahead regardless. The question put to the Acharonim is not “did he sin?” but “what is to be done with what now exists?” — and the answer rests on a rule of strict reading: the חרם bears only on what it named. This is responsa material, and transposing it to a present-day situation is not done without a Rav.

8. Comprehension questions

  1. What is מתפיס, and why does the vow not take when one attaches to a דבר האסור?
  2. Why is “salted meat” an ambiguous expression? Give the reason the Beit Yosef offers.
  3. One who declares that he had the lenient sense in mind is believed. In what case is he not, and why?
  4. Seif 2 requires a שאלה of the עם הארץ, and gives a reason. What is it, and what does it change about the status of the vow?
  5. What is the difference between חרטה and פתח, and who requires the latter here?
  6. Why is one who transgressed the vows of this chapter not penalised, and who is penalised?
  7. Seif 3 says thirty days suffice. Which commentator refuses this leniency, and on which Rishonim does he rely?
  8. Seif 4 exempts one who transgressed a נידוי. What contradiction does the Taz raise, and how does the Shach resolve it?
  9. What is the subject of seif 5, and what distinction does it draw between two wordings of the oath?
  10. The Pitchei Teshuva, at ס״ק ד, reports a change of mind by the Noda BiYehuda. What does it concern, and what practical consequence does he draw from it?
