1. סתם ופירושם — the Rosh’s two readings

↩ Detailed explanation (level 1)
The starting text, and its ambiguity The Mishnah states two rules, not one: סתם נדרים להחמיר — unspecified, stringently — and ופירושם להקל — specified, leniently. But the second seems obvious: if the man says what he meant, what is the word “leniency” doing here?
The Rosh’s two readings, as the Beit Yosef reports them (א) The first יש מפרשים holds that stringency prevails even where the explication would be lenient: so long as he has said nothing, we go stringently. The Rosh rejects this on two counts: why then did the Mishnah need its second clause, and what “leniency” is there, since a man is bound by whatever comes out of his mouth?
The second reading, which the Rosh adopts (ב) The second יש מפרשים shifts the sense of סתם. “Unspecified” does not mean “he said nothing at all”, but “he refuses to say what was in his heart, and says only: I vowed as the Sages explained it”. Then we construe stringently. But if he states what was in his heart, we follow his statement, leniently included. The Beit Yosef notes that the Tur follows this second reading, which the Rosh took as principal.
And here the Shach contests the Beit Yosef The Beit Yosef adds one further sentence: but the Rambam’s words, in chapter 2, follow the first reading. The Shach opens his ס״ק א with that same second reading, ascribes it to the Rosh, and adds that the Rambam holds likewise — Rabbenu Yeroḥam having already said so. Then he writes the word: ותימה. He does not say the Beit Yosef is wrong on the ruling; he says he misreads the Rambam.
Nafka mina — and the Rambam’s text before us The Rambam writes ופרושן יש בו להקל ולהחמיר — “and its explication can go either way” — and then: they say to him: and what was in your heart? The phrase אומרין לו ומה היה בלבך is exactly what the second reading presupposes: the vower is questioned. The reader may judge whether the Shach is right that the Rambam is on that side.

↩ Detailed explanation (level 1)
The yesod of the siman The seif gives the reason twice, in two symmetrical limbs: שהרי הוא מתפיס בדבר הנדור on one side, שהרי הוא מתפיס בדבר האסור on the other. The whole siman rests on this opposition. A vow by comparison takes effect only if the term of comparison is a vowed thing; a thing forbidden by the Torah transmits nothing.
Why precisely salted meat and libation wine The Beit Yosef gives the reason for the choice, and it is textual: salted meat evokes the offerings, for of them it is written “with all your offerings you shall offer salt” — and it evokes idolatry just as well. The example is not chosen at random: it is built so that both senses are equally available.
The Rambam and the form of the questioning The Rambam does not present the alternative as an ambiguity to be resolved, but as a question put to the man. If he answers “of the offering”, it is forbidden; if he answers “of idolatry”, it is permitted. Stringency enters only in the absence of an answer. This is a difference of procedure, and it may explain why the Beit Yosef and the Shach do not read the Rambam the same way.
Nafka mina — what the Shach draws from it for the עם הארץ The Shach, at ס״ק ב, relies precisely on this point to distinguish our siman from siman 205. There, the man does not know whether attaching to a forbidden thing makes a vow; here he does know, and has simply spoken without specifying. Once he specifies, there is no doubt left to remove — and so no dissolution to seek.

3. נאמנות עם הארץ — the Bach against the Mehaber

↩ Detailed explanation (level 1)
The seif is categorical The seif writes ואין צריך שאלה ואפי׳ הוא עם הארץ, and the Tur before it likewise. This is a strong position: even the common man need not come before a sage.
The maḥloket: the Bach against the Mehaber The Bach is astonished — ויש לתמוה. This permission, he says, holds only according to the Rosh and the Tur; but according to the Rambam, whom the Mehaber himself followed at the beginning of siman 205, an עם הארץ needs a שאלה when he attaches to a forbidden thing — and the same should apply here. His practical conclusion is plain: The Shach answers with the distinction reported above.
Ḥakira: what is the שאלה an answer to? (א) To a doubt about the ruling. One comes before the sage because one does not know whether the vow took effect — and then, once the doubt is removed, there is no occasion to come. This is the Shach’s reading. (ב) To a demand for seriousness. One comes before the sage שלא ינהגו קלות ראש בנדרים — and then the coming is owed regardless of any doubt. This is what seif 2 says expressly, and it is what the Bach relies on.
Nafka mina — and the Shach’s reversal at ס״ק ח The Baer Hetev, at ס״ק ב, sums up both voices and leaves the reader before them. But the Shach adds elsewhere a clause that changes everything: at ס״ק ח he recalls that today everyone is judged as an עם הארץ. The debate of seif 1 therefore turns on a distinction that in practice no longer separates anyone — and the Baer Hetev repeats it at ס״ק ד, in the Shach’s name.

4. הליכה אחר הרוב — one difficulty, two answers

↩ Detailed explanation (level 1)
The clause, and the Beit Yosef’s reading of it The last clause of seif 1 makes the man’s credibility depend on what most of the people of his place call things. The Beit Yosef draws from this a general rule: one follows the majority and does not worry about the minority, as is established everywhere.
Kushya: but in matters of vows one does not follow the majority The Beit Yosef raises the objection against himself: at siman 217, one who vows off “oil” is forbidden both kinds when both are drawn upon, even though most of the supply comes from one. His answer: there, all draw on both — the majority bears only on quantities.
The Shach’s teirutz: it is not the same question The Shach rejects that answer: the reason at siman 217 is the principle ספק נדרים להחמיר, and siman 217:3 says expressly that in matters of vows one does not follow the majority. He therefore adopts the Prisha’s answer: here the man has explicated his words, and that is what changes everything. So long as the majority does not contradict him, we do not go stringently; but if he vowed and went off without saying anything, we do.
Nafka mina The Shach’s rule works both ways. At ס״ק ד he writes that the same holds for leniency: if the majority call the idolatrous kind simply “salted meat”, we go leniently. The criterion is therefore not “we go stringently”, but “we follow majority usage, once the man has spoken”.
The Taz takes up the difficulty, and finds it wider The Taz judges the Beit Yosef’s answer תמוהים: if we take account of the majority, let us take account of it here too. Then he widens the question — there are three places, not two: here, siman 220:14 where the majority is followed even leniently, and siman 217:3 where it is not. He examines the Bach’s answer and concludes:
The Taz’s ḥakira: where does the doubt lie? His solution is a distinction of principle. (א) If the doubt bears on the very object of the prohibition (גוף הנאסר), we go stringently, and follow even a minority: this is the severity proper to vows. (ב) If the doubt bears only on the sign the man gave in order to be understood, then we construe it by the language of the majority — for one who gives a sign means to be clear: לא מחית אינש נפשיה לספיקא.
Yesod — and the proof from Kiddushin The Taz grounds his principle on a passage of Kiddushin: one who said “I have betrothed my elder daughter” without knowing which — Rabbi Yosé permits all but the eldest of the elder group, and the Gemara gives the reason that a man does not put himself into doubt; it adds that the same holds for vows. The Taz concludes that his distinction is נכון וברור, and notes that others have given forced answers here.

— three voices

↩ Detailed explanation (level 1)
The clause at issue Seif 1 closes on three words: אינו נאמן. Of whom does it speak? Of the עם הארץ only, or of every man, the scholar included?
The maḥloket: the Hagahat Prisha against the Shach The Hagahat Prisha holds that the clause concerns only the עם הארץ: the ת״ח is believed — and a fortiori, since seif 2 believes him in a far more far-fetched case. The Shach answers that the plain sense of the decisors does not suggest this: at seif 2 the scholar is believed because the expression carries two senses and only its plain one is stringent; here local usage has fixed a single sense, and there is no room left for belief.
The Pitchei Teshuva reopens the file At ס״ק ב the Pitchei Teshuva recalls the divergence and adds a third voice: the Chavot Yair, siman 15, to whom the Hagahat Prisha seems principal — ולא כש״ך. The question thus remains open in the apparatus itself.
Nafka mina — and a consequence the Chavot Yair draws from the reason At ס״ק ג the same Chavot Yair observes that, according to the Rosh and most decisors, the reason for the requirement at seif 2 is not levity but credibility: it is the עם הארץ who is not believed. And he draws a consequence to be read with due caution — if his heart knows that the truth is with him. The Pitchei Teshuva refers to the השמטות.

6. חרטה או פתח — the form of the dissolution

↩ Detailed explanation (level 1)
The rule of the seif The seif requires a שאלה of the עם הארץ, but at once lightens its form: ומיהו בחרטה סגי, and there is no need to open a door for him. The Mishnah, for its part, has the Sages say that a door is opened for them from another place — so the seif’s wording is not that of its source.
The maḥloket: the Bach requires the פתח The Shach, at ס״ק ט, reports that the Bach rules otherwise: regret does not suffice, one must open a door for him from another place, as at the beginning of siman 205. The Baer Hetev, at ס״ק ה, says the same. The disagreement bears on the form of the dissolution, not on its necessity.
Nafka mina — and what the Taz refers elsewhere The Taz, at ס״ק ב, does not decide: he notes that the matter of פתח and חרטה is treated at siman 228. The Rambam, for his part, writes expressly that a door is opened for the עם הארץ from another place — which again places the source on the Bach’s side.

7. קנס הימים — thirty days, or the whole count

↩ Detailed explanation (level 1)
The cap of seif 3 The penalty is counted day for day while it is short, and caps at thirty days when it would be long. The Beit Yosef concludes to that effect:
The Shach’s kushya: the Beit Yosef did not look at everything The Shach begins by explaining the seif, then adds a reservation: this holds according to what the Beit Yosef wrote — but he did not attend to Tosafot at the end of the second chapter of Nedarim, to the Rosh there, and to Rabbenu Yeroḥam.
Teirutz — or rather refusal Those Rishonim, he writes, ruled that even for many days one must observe the prohibition for as many days as one conducted oneself permissively. And such too appears to be the Tur’s position, who writes without distinguishing. He adds the Raavad and the Rivash, and concludes in a word: אין להקל.
Nafka mina — and the trace of the divergence elsewhere in the apparatus The Baer Hetev records it twice: at ס״ק ח he notes that the Shach’s position inclines to Tosafot; at ס״ק י he refers back to that note to warn that seif 5’s reference to the thirty days is not the Shach’s view. The reader therefore has, in seif 5 itself, a parenthesis that the apparatus contests.

8. נידוי דרבנן — the contradiction, and its resolution

↩ Detailed explanation (level 1)
The reasoning of seif 4 The seif exempts one who transgressed a נידוי, and gives its reason: מפני שנידוי הוא דרבנן. The Shach, at ס״ק י, had given the same reason for seif 2.
The Taz’s kushya: the Shulchan Arukh contradicts itself The Taz first notes the agreement of the sources — the Tur, the Beit Yosef in the name of the Rivash — and then opens: ותימה על הש״ע בסי׳ של״ד סעיף כ״ח, where it is ruled that even one who has scorned a נידוי must observe the prohibition for as many days as he conducted himself permissively. And he writes the hardest word in the whole siman:
The Bach’s answer, and why the Taz rejects it The Bach distinguishes: here we deal with a man who could not keep his vow — like one who vowed off grain without which he cannot live — and who is therefore somewhat like one under compulsion; there, with a man who could keep it and scorned it. The Taz rejects this: if the man is under compulsion, even a Torah vow does not require the penalty, as the seif says expressly regarding the מכשול.
The Shach rejects it too, by another route The Shach opposes two internal proofs: the seif treats the case of מכשול separately, and it gives as its reason that נידוי is rabbinic — which shows that it speaks of a man who could have kept it. Otherwise even a Torah vow would be exempt.
Yesod: the Rivash’s distinction His own answer goes back to the source: this ruling is taken from the Rivash quoted in the Beit Yosef. The Rivash distinguishes two things. (1) One who has neglected the rules of נידוי — has not conducted himself as an excommunicate must: those conducts are only rabbinic, and there is no penalty. (2) One who has accepted something under נידוי or חרם and transgressed that thing: there it is of the Torah, for the נידוי and the חרם themselves are of the Torah, and he is not released before the penalty. Siman 334 deals with the second case.
Nafka mina — and the Nekudot HaKesef’s reference The Nekudot HaKesef have only a line here, and it is exactly in place: on the Taz’s ותימה at ס״ק ג, they refer to the Shach ס״ק י״ד, where the answer lies. The Taz, for his part, adds at ס״ק ד a limit in the other direction: if there was an oath there, the penalty is owed again.

9. החרם — of the Torah, or of the words of the prophets

↩ Detailed explanation (level 1)
The premise, laid down in passing The Shach, in resolving the contradiction about נידוי, laid down a weighty premise: שהרי נידוי וחרם גופיה דאורייתא הוא. The Baer Hetev takes it over as it stands at ס״ק ט. On it rests the whole second branch of the distinction.
The maḥloket the Pitchei Teshuva opens At ס״ק ד the Pitchei Teshuva first refers to the Baer Hetev for this premise, then quotes the Noda BiYehuda, who had proved the same thing from the Ran. So far everything agrees.
Ḥakira: of what rank is the חרם? Then the Pitchei Teshuva reports the change of mind: in the second collection, Yoreh De’ah § 146, the Noda BiYehuda writes that he later considered it — the חרם, though it is not rabbinic and is more severe, is not exactly of the Torah: it belongs to the דברי קבלה. Three ranks, then, and not two.
Nafka mina — and it is practical The consequence is drawn by the Noda BiYehuda himself: ולענין ספיקא נראה לי דספיקו לקולא — a doubt about a חרם is decided leniently. The Pitchei Teshuva, at ס״ק ה, gives it the most concrete application in the whole siman: the חרם bears only on what it named, and what was done in transgressing it remains usable — down to that Talmud printed at Sulzbach during a printing חרם, from which it is concluded that one may study from it.

10. שבועה שלא ישא אשה — the act, the state, and פריה ורביה

↩ Detailed explanation (level 1)
The case, and its source Seif 5 distinguishes two wordings of the same oath, and the distinction carries everything: an oath about the act of the marriage, and an oath about the state of her being his wife. The Beit Yosef gives the source, the Rashbatz.
The implicit maḥloket: what the source adds The Beit Yosef reports the responsum in full, and in it appears a clause the seif did not take over: ואח״כ ישאנה ומתירין לו — after which he will marry her again and be released. The seif stops at the divorce; the source goes as far as the remarriage.
The Shach’s ḥakira: did the oath take effect at all? The Shach, at ס״ק ט״ו, raises the underlying question: does this oath take effect, given that it voids the mitzvah of פריה ורביה? He refers to siman 239:8, in the gloss, and recalls that he wrote there himself, in the name of the Or Zarua, that the oath does not take effect. And from this he draws, cautiously, a consequence for our seif.
Nafka mina — and it lightens everything אפשר להקל כאן שאין צריך לגרשה: if there is no oath, there is no occasion to divorce. The Baer Hetev, at ס״ק י, transmits the matter as it stands and at once adds the reservation about the thirty days. And the Pitchei Teshuva, at ס״ק א, opens the file further with the Radbaz’s responsa on conditional oaths of this kind.
