Siman 208 — The unspecified vow, and the חרם
Five seifim, reduced to two questions: what does this word mean, and what does transgressing it cost?
1. The axiom: one attaches, and the term of the attachment decides
The axiom. A vow by comparison is worth only what the thing it compares to is worth. Attaching to a vowed thing (דבר הנדור) produces a vow; attaching to a merely forbidden thing (דבר האסור) produces nothing. Hence the whole siman: since some expressions denote both, a rule of construction is needed — and that is
Three consequences. (1) With no specification, we take the sense that makes the vow hold. (2) With a specification, we follow the man — unless the usage of his place has already fixed the sense. (3) One who takes refuge afterwards in a far-fetched sense is treated more severely: this is no longer an ambiguity but a way out.
2. The three reflex questions
1. To what did he attach? To a vowed thing — it is a vow. To a forbidden thing — it is nothing. To both at once — next question.
▼
2. Did he specify, and does the usage of the place allow it? He specified and nothing contradicts him — he is believed. He said nothing, or the majority of the place says the opposite — stringently.
▼
3. Did he transgress? A vow of this chapter — no penalty. A Torah vow, deliberately — the penalty of days. An unkeepable vow — immediate release.
3. Master table — the five seifim clause by clause
| Seif | The clause of the Shulchan Arukh | What it settles |
The title rule, and its textbook case |
The mechanism: attaching to a vowed thing |
Attaching to a forbidden thing produces nothing |
One who explains himself is believed |
And without needing a dissolution |
Unless the usage of the place has fixed the sense |
The man who takes refuge in the cherem of the sea |
The scholar is believed without formality |
The common man must ask for a dissolution |
And regret suffices |
No penalty for the vows of this chapter |
Penalty for a Torah vow knowingly transgressed |
Immediate release when the vow cannot be kept |
Thirty days cap the penalty |
| ד | « מי שעבר על נידוי אין צריך לנהוג איסור כימים שנהג בהם היתר מפני שנידוי הוא דרבנן: » (שו״ע יו״ד ר״ח:ד) | No penalty for a נידוי, which is rabbinic |
Oath about an act: he is released |
Oath about a state: he must divorce |
4. Is the man who explains himself believed? — the grid of four cases
| The case | Verdict | Source |
| He specified the lenient sense, and nothing contradicts him | Believed — and without dissolution |
| He specified, but the majority of the place says otherwise | Not believed |
| He takes refuge afterwards in a far-fetched sense — and is a ת״ח | Believed, without התרה | שו״ע יו״ד ר״ח:ב |
| The same, and he is an עם הארץ | Must ask for a dissolution | שו״ע יו״ד ר״ח:ב |
| And today?
| Is the ת״ח believed in the case of the רוב?
5. The penalty of days — when it is owed, and how much
| The case | Verdict | Source |
| A vow of this chapter, transgressed | No penalty |
| A Torah vow, deliberately transgressed | As many days as he was permissive |
| An unkeepable vow (all fruits except grain) | Immediate release |
| But if he seeks release in order to transgress | Some do not release him | ש״ך יו״ד ר״ח ס״ק י״ב |
| If he can master himself and will not transgress again | The penalty is owed (Rama’s gloss) |
| Many days | Thirty days suffice |
| Many days — according to the Shach | The whole count:
| A transgressed נידוי | No penalty — it is rabbinic | שו״ע יו״ד ר״ח:ד |
| But if there was an oath | The penalty is owed |
6. The open maḥlokot of the apparatus
Five points on which the apparatus does not speak with one voice. To know them is to know what must be asked of a Rav.
Does the עם הארץ need a שאלה at seif 1? The Mehaber says no. The Bach says yes, after the Rambam and after siman 205. The Shach defends the Mehaber by distinguishing the two situations. Shach ס״ק ב · Baer Hetev ס״ק ב.
Is the ת״ח believed against majority usage? The Hagahat Prisha says yes, a fortiori from seif 2. The Shach says no. The Chavot Yair, reported by the Pitchei Teshuva, holds the Hagahat Prisha to be principal. Shach ס״ק ה · Pitchei Teshuva ס״ק ב.
Does regret suffice, or is a door required? The seif says regret suffices. The Bach requires a door from another place. The Rambam, the source of the ruling, opens a door.
Thirty days, or the whole count? Seif 3 and the parenthesis of seif 5 say thirty. The Shach cites Tosafot, the Rosh, Rabbenu Yeroḥam, the Raavad and the Rivash, and writes אין להקל.
Is the חרם of the Torah? The Shach lays it down as a premise, and the Baer Hetev takes it up. The Noda BiYehuda, in the second collection, changes his mind: it is מדברי קבלה, and a doubt about it is decided leniently.
7. The vocabulary of the siman
| Term | Meaning |
To attach: the vow made by comparing one thing to another |
A vowed thing — forbidden by a man’s word; one may attach to it |
A thing forbidden by the Torah; one may not attach to it |
An unspecified vow is taken stringently |
The two ambiguous expressions of seif 1 — of the altar, or of idolatry |
The “cherem of the sea”, that is, the fishing net |
Regret, and the opening — the two forms of dissolution |
| שלא ינהגו קלות ראש בנדרים | The reason for the requirement laid on the עם הארץ |
The risk of sin that an unkeepable vow would create |
Excommunication — rabbinic, whence the exemption of seif 4 |
8. Golden rules, mnemonic and classic pitfalls
Two questions, three answers, one cap. Two questions: to what did he attach, and did he specify? Three answers: stringently if he kept silent, by his word if he spoke, by usage if the place has settled it. One cap: thirty days — which the Shach contests.
The golden rules
- A vow by comparison is worth what the term of the comparison is worth.
- The stringency of seif 1 is not a presumption against the man: it is a rule for construing silence.
- The usage of the place prevails over the individual’s declaration — the same logic as in siman 207.
- Seif 2 is harsher than seif 1 because it is no longer an ambiguity but a way out.
- The penalty of days is owed only for what is of the Torah — save the Taz’s reservation about an oath.
The classic pitfalls
- Thinking that סתם נדרים להחמיר means “he is never believed”: he is believed as soon as he specifies.
- Confusing דבר הנדור and דבר האסור, and so reversing the outcome of the vow.
- Reading seif 2 as a continuation of seif 1: they are two régimes, and the second is harsher.
- Taking the thirty days of seif 3 as settled: the Shach writes
- Counting seventeen ס״ק for the Shach: Sefaria addresses sixteen, the first holding two paragraphs.
- Ascribing to the Shach the Beit Yosef’s position on the Rambam: that is precisely what he contests, and he writes
