1. שני הכתובים — speech and thought

↩ Detailed explanation (level 1)
Shmuel, and the braita that contradicts him Shmuel requires speech and anchors it in לבטא בשפתים. A braita at once opposes a second verse, which seems to let bare thought in. The whole sugya is decided between these two verses.
Rav Sheshet’s answer, and it is our seif The second verse does not open the door to naked thought. It opens it to thought covered by speech: that is the difference between barley bread, which has nothing to do with the wheat he had in mind, and plain bread, which contains it.

2. פת סתם — why this case is decided differently

The ḥakira In the first case the thought lies outside the speech; in the second it lies inside it. What the seif decides, then, is not that thought counts, but that it counts on one condition: that the mouth does not contradict it. The Taz writes the condition out — כל שפיו אינו מכחיש.
The principle, and the Beit Yosef’s formula The Rosh reasons from the names of things: “wheat bread” is called “bread”. Thought therefore adds nothing to the sense of the word; it narrows it within what the word already covered.
What it changes The Beit Yosef asked whether the reasoning runs both ways — wheat in mind, yes, since plain “bread” is wheat; but barley in mind? — and left it in צ״ע. The Shach writes the symmetry without hesitation and refers to siman 217.

3. בכוונה או בשוגג — the central dispute of the siman

The Ba’h’s difficulty If the man said “bread” on purpose, reserving “wheat” in his heart, what becomes of the principle that things of the heart are not things? An inward reservation cannot narrow a word deliberately chosen.
The two camps, and they are named (a) The Ba’h, backed by the Shach with all the decisors and the Mordechai in the name of Ravyah, and by the Maharshal: done on purpose, he is forbidden in all bread. (b) The Beit Yosef, who rejects that reading of the Mordechai as not fitting the plain sense of the gemara. The Shach writes expressly ודלא כב״י.
The Taz reaches the same place by another road He reads the Tur as speaking of a word that came out unintentionally, and closes with the Maharshal. The position is therefore not peculiar to the Ba’h: it belongs to the reading that makes error the condition of the seif.
And the Chavot Yair, who doubts in the other direction His own view is that even done on purpose the barley would stay permitted — but he draws back before the number and the standing of those who follow the Ba’h. He adds the reverse case, which he takes as obvious.

4. האנס — the Rosh’s difficulty and its two answers

The difficulty The mishnah permits vowing before an extortioner while reserving one’s thought — and there the inward reservation does count. If it counts there, why does the seif here require mouth and heart to agree? And if it counts only under duress, then the general rule is the opposite.
The Ramban’s answer, reported by the Taz There, the mouth made no mistake: he meant to say what he said, and thought something else. In that case the mouth prevails, for things of the heart are not things. Here, by contrast, the mouth slipped.
The Tosafot’s answer, and what became of it The Tosafot distinguish by the person: there a common man, here a scholar. That is the view the Tur reports as וי״א — and at once notes is not the Rosh’s. The Mehaber does not adopt it.
What it changes It is visible in the Tur’s own text: on the Tosafot’s view, a common man who says “bread” while thinking “wheat” is forbidden in all bread — not because he said it on purpose but because he is not believed. On the Rosh’s view the line does not run there. The Beit Yosef gives the reason in one word: מהימנינן ליה.

5. על דעת אחרים — another man’s heart in place of his own

The principle, in a formula of Rambam’s The condition is not abolished: it is displaced. The mouth must still agree with a heart — but it is other men’s hearts, for
What it changes A man who swore in this way can no longer say “this is what I had in mind”. The argument seif 1 gave him in the case of the slipped word is taken from him here. The Ba’er Hetev sums it up in a bracket:

6. נדר בחלום — the Rosh against the Rashba

What the gemara said, and what it did not It speaks of a ban pronounced in a dream, and requires ten men who know halakha. It says nothing about a vow. The whole question is whether one learns from the one to the other.
The Rosh’s position One does not learn, and the reason is a difference of kind: a ban distances from Heaven and calls for a bringing near; a vow requires mouth and heart to agree — and a dream has neither.
The Rashba’s position, as the Taz characterises it It is not a position of law but of חשש: as a precaution one should be strict, even for an oath made in a dream. The Beit Yosef gives his text, and there one sees that the Rashba is content with three where it is mere precaution.
Two consequences, and they were disputed (1) A release performed inside the dream: the Shach says it is worth nothing on this view, since no dream is free of idle words. (2) A woman: the Ba’h requires ten for her too and denies the husband the power to annul; the Taz writes that this vow, being only a stringency, cannot be stronger than an oath made awake.
And a find of the Taz’s, which the Ba’er Hetev takes up The Maharal of Prague answered in practice like the Rosh: no release at all. The Shach, by contrast, writes והכי נהוג for the requirement of ten. Both formulas are read in the same siman.

7. תוך כדי דיבור לנדרו — the Raavad’s objection, the Rama’s answer

The Raavad’s objection, and the Beit Yosef who does not see it Rambam writes that another man’s protest, accepted within the interval, undoes the vow. The Raavad objects: the others are not parties to the vow, so their protest cannot join the vow to the retraction. The Beit Yosef replies that he does not understand the objection, since it is the acceptance that releases, not the protest.
The Rama’s resolution, in three words The interval is not counted from the protest: it is counted from the vow. Protest and acceptance must both fall inside it. The Raavad’s objection falls away, and the Beit Yosef is set aside by name.
The Shach says the same, and extends it He expressly refuses to count from the protest, credits the reasoning to the Raavad, and adds that Rambam and the Tur themselves concede it — along with the Darkei Moshe, the Derisha, the Ba’h and the Kesef Mishneh.
What it changes, and it is measured in seconds The interval is the time to say If another man’s protest lasts longer than that, no retraction is possible any more, even if he accepts it on the instant. And the Ba’er Hetev writes it in one line, in both their names.
