Siman 211 — The condition made in advance

Four seifim: the man who annuls his vows before making them, and what that annulment can do

✦ ❖ ✦

This is the siman of the condition laid down before the vow. A man first declares that what he is about to vow shall not be a vow — and then vows. What is his vow worth? The Shulchan Arukh answers in four seifim, and it is from this siman that the Rama’s gloss draws what it says about כל נדרי. Note well: what the siman establishes is precise, and so is what the Acharonim draw from it. These are rulings למעשה: every real case goes to your own Rav.

📑 Plan of study

1. What is this siman about? Annulling in advance what has not yet been said
2. The four seifim, clause by clause
3. Key concepts:
4. Where these seifim come from: the mishnah and gemara in Nedarim, Rambam, Tur, Beit Yosef
5. The commentators: all eighteen entries, quoted one by one
6. Table of the four seifim
7. Practical cases
8. Review questions

1. What is this siman about? (four seifim)

The preceding simanim said what makes a vow and what prevents it at the moment it is made. This one steps back further: it speaks of what was said beforehand. A man declares that his future vows shall be void — and then vows. Two situations, and the siman keeps them carefully apart.

The first (seif 1): the declaration and the vow are in the same breath. The second (seif 2): the declaration was made long before, and the vow comes later. The result reverses according to the case, and the reason is that a man who remembers his condition and vows anyway has undone his condition. Seif 3 deals with the case in between — he remembers there is a condition but has forgotten what it covered — and seif 4 sets the limit of the whole structure.

Four seifim, one hinge. Seif 1: said in the same breath and aloud, the disavowal carries off the vow. Seif 2: laid down long before, it works only if the man does not remember it when he vows. Seif 3: if he remembers it without knowing what it covered, the formula “by my first intention” saves him. Seif 4: none of this applies to a vow another man imposed on him.

2. The four seifim, clause by clause

Here are the four seifim, each first in full — as the source gives it, the Rama’s gloss included — and then broken down.

Seif 1 — the disavowal said in the same breath

The seif sets out the case, then its formal condition, then the contrary view — and the Rama adds to it the best-known gloss in the siman.

One who stipulates that his vows shall not be vows. And it contains four seifim
The heading announces the subject: this is not about releasing a vow but about preventing it from arising.
One who says: the vow I wish to vow shall not be a vow — and he vowed — it is not a vow
The simplest and strongest case: here the vow does not take hold, and the Shach will stress that this holds even if he remembered his condition while vowing.
In what case? When he first articulated with his lips that it should not be a vow
The formal condition: the disavowal follows the same rule as the vow — it goes through the lips.
but if he only thought it in his heart, these are things of the heart, and they do not annul the vow he articulated with his lips
The rule is symmetrical to the one in the previous siman: thought no more undoes than it makes.
and some say that even if he said it in a whisper, these are things of the heart
One requirement more, and it is the sharpest dispute in the siman: what does “in a whisper” mean here? The Taz and the Shach do not hear it the same way.
Gloss: and what we say as כל נדרי on the night of Yom Kippur is as though they had stipulated expressly
This is the only line of the Shulchan Arukh about כל נדרי, and it expressly attaches it to our siman: it is a prior stipulation, of the kind discussed here.
and nevertheless we do not rely on this to permit without a request to a sage, save for a great need
The second half of the gloss matters as much as the first, and it is the half that is forgotten: the declaration does not dispense with release. The Shach will add that this gloss belongs to seif 2.

Seif 2 — the condition laid down long before

Here the condition and the vow are separated in time, and the result reverses: it is remembering that decides.

One who stipulated and said: all the vows I shall vow until such a date shall be void — and he vowed within that time
This is the classic form of the prior condition, the one the gemara sets at Rosh Hashanah.
if he remembers his condition at the time of the vow, his vow stands — for he annuls his condition by vowing
The reason is given in the seif itself, and it is the principle of the whole subject: to vow while knowing oneself exempt is to withdraw the exemption.
and if he does not remember his condition at the time of the vow, the condition stands and the vow is void
The exact reverse. And note that this is the ordinary case: a man who made a condition a year earlier usually does not have it in mind.
and some say the condition avails to annul the vow only if he recalls it within the time of an utterance from the vow and says in his heart that he relies on the condition — and one should take their words into account
A heavy requirement, and it is this that the Taz will contest at length. The Shach, for his part, proposes a textual correction.

Seif 3 — he remembers the condition but not its object

The case in between, and it is the gemara’s: he knows he made a condition, he no longer knows about what.

If he stipulated about certain things that his vow should be void in them, and he does not know about what he stipulated — whether about eating meat or drinking wine
Rava’s case in the gemara: he remembers having made a condition, but its object escapes him.
if he says at the time of the vow: it is by my first intention that I vow, so that if I recall what I stipulated about I shall follow the condition — and he recalled what he had stipulated — the condition stands and the vow is void
The formula is everything: it prevents the vow from being read as a withdrawal of the condition. The Taz explains why it is indispensable here.
and if he did not say “it is by my first intention that I vow” — the condition is void and the vow stands
For he knew there was a condition and vowed without saying anything: this is exactly what seif 2 calls annulling one’s condition.

Seif 4 — what the disavowal cannot do

Two lines, and they bound the whole siman.

These things are said only of an oath or a vow that he swore and vowed for himself
First thing to notice: the seif places the oath on the same footing as the vow. The Geonim, as Rambam reports them, were not all of that view.
but one whom his fellow put under oath or on whom his fellow imposed a vow — this annulment avails him nothing
The limit, and it is absolute. The Beit Yosef gives its reason in the name of the Ran and the Tosafot: it is on the other man’s intention that he swears.
The four seifim in one line. A man may guard himself in advance against his own vows, provided he says so. But that guard does not survive remembrance: a man who vows knowing he has guarded himself has given up his protection — unless he says so expressly. And none of this touches a vow another man imposed on him.

3. The key concepts of this siman

ביטול — annulment. Not the release of a vow already made, but the declaration that prevents it from arising. That is the whole object of the siman, and it is why seif 1 insists on the lips.

עקריה לתנאיה — “he uprooted his condition”. The gemara’s word, and the hinge of seif 2: a man who vows while remembering his condition abolishes it by that very vow.

על דעת ראשונה אני נודר — “it is by my first intention that I vow”. The formula of seif 3, which prevents the vow from being read as a withdrawal of the condition.

בלחש — in a whisper. The word of the יש אומרים in seif 1, and the point on which the Taz and the Shach part: is it inaudibility to oneself, or the absence of an audience?

כל נדרי — the declaration of the night of Yom Kippur. The Rama’s gloss says two things about it: that it counts as an express stipulation, and that we do not rest on it to permit without a sage.

דברים שבלב — things of the heart. The principle that shuts the door on a purely inward annulment, and the link with the preceding siman.

4. Where these seifim come from

The mishnah and the gemara —

All the matter of the siman lies in two columns of Nedarim. The mishnah of Rabbi Eliezer ben Yaakov gives the formula; the gemara objects, emends the mishnah’s text, and then Rava offers another reading from which seif 3 comes.

Three points to keep. (1) The mishnah as printed says ובלבד שיהא זכור — “provided he remembers”. (2) Abaye emends and reads ובלבד שלא יהא זכור, which gives exactly seif 2. (3) Rava keeps the received text and explains it otherwise: he remembers, but no longer knows about what — and that is seif 3.
A sentence not to be passed over: the gemara reports that someone wished to expound this matter in public and was prevented — so that men should not treat vows lightly. The subject is one to be transmitted with care, and the Rama’s gloss on seif 1 says, in effect, the same thing.

Rambam — הלכות נדרים, chapter 2

Three halakhot of Rambam cover seifim 2, 3 and 4: the prior condition and remembrance, partial forgetting and the formula that saves, and the question whether all this applies to oaths as well.

The last halakha is worth pausing on: some Geonim held that all this applies only to vows and not to oaths. Our seif 4 writes בשבועה או נדר — it therefore follows the second view Rambam reports.

The Tur and the Beit Yosef

The Tur gives the first three matters, and places בלחש not as a יש אומרים but in the body of the rule itself. The Beit Yosef gives the source of each piece: Rabbenu Eliezer of Metz for the whispered disavowal, the Ran for the difference between seifim 1 and 2, the Raavad for the disagreement about the interval, and the Ran in the name of the Tosafot for seif 4.

The phrase of Rabbenu Eliezer of Metz, reported by the Beit Yosef, is the one the dispute of the siman will turn on: דברים שבלב דמוכחי — things of the heart that are manifest. It is having annulled in public that makes them manifest.

5. The commentators, entry by entry

Eighteen entries: five from the Shach, four from the Taz, four from the Ba’er Hetev, two from the Pitchei Teshuva, three from the Nekudot HaKesef. All are quoted here, in order.

The Shach (ש״ך) — five ס״ק

The Shach opens with a strong consequence: the nullity of seif 1 holds even if the man remembered his condition while vowing. The printed text carries a slip here — נוונא for גוונא — which we copy as it stands.
And the reason, taken from the Ran: here he stated the condition at the time of the vow.
In seif 2, by contrast, the two do not come together, and there is room to say he uprooted his condition.
The Shach then reports the Prisha, who proposes a quite different criterion: simultaneity is not what counts.
What counts, says the Prisha, is that the condition aimed at that particular vow expressly — “tomorrow, or in a year, I shall vow not to eat meat, and I annul it from now”.
Which is not the case of the general condition: “if I vow…”. The Taz will contest this distinction, and the Nekudot HaKesef will defend it.
The source of the יש אומרים: the Rosh, in the name of Rabbenu Eliezer of Metz.
The Ba’h restricts it: “in a whisper” counts as “things of the heart” only if he did not make himself audible to his own ear.
And he draws the comparison from the reading of the Shema and prayer, where making oneself audible suffices.
The Shach refuses: if that were so, the Rosh’s difficulty would return, and he could have answered that the man made himself audible without his fellow hearing.
And the Rosh’s own language says it: it is in public that the annulment avails, because then things of the heart are manifest.
Rabbenu Yeruḥam is quoted in full, and he writes בקול רם בפרהסיא — aloud and in public.
The Shach’s conclusion, in four words.
An editorial remark, and a first-rate one: the Rama’s gloss on כל נדרי, printed at seif 1, belongs to seif 2. The Ba’er Hetev will repeat it.
Then an extension, in the name of a responsum: the declaration works for nezirut as well, although nezirut is not named there — for it is included among vows.
A textual correction, and the Shach writes it out: כצ״ל — this is how it should read. The words he adds, אחר הנדר, change the sense of the requirement.
And the last entry, brief and practical: for an oath taken while holding an object, it is not established to us that כל נדרי avails.

The Taz (ט״ז) — four ס״ק

The Taz begins by noting a word in the Tur: ודאי — assuredly. Why the insistence?
He goes back to the mishnah, which he quotes.
Then to the gemara’s objection: if the other man hears him, he will not come to eat.
And to the answer, which splits the mishnah into two teachings.
The second being the Rosh Hashanah one, that is, our seif 2.
From this the Taz draws what the Tur meant by ודאי: for the one who raised the objection, the nullity of the vow was obvious.
The difficulty remains: why does seif 2 say the opposite? The Ran’s answer, reported by the Beit Yosef.
There the two do not come together, and one may say he uprooted his condition.
The Taz softens this: he need not say expressly that he vows upon his condition — proximity suffices.
He then explains the point of the scene: the man wants to make a proper vow in front of his fellow in order to mislead him.
And that is why the annulment must be express.
The Taz then turns on the Prisha: her distinction has no place.
For here, he says, we are dealing precisely with a condition made at the time of the vow, as the Ran and the Darkei Moshe write.
On בלחש the Taz is on the Ba’h’s side: it means inaudible to his own ear. And he brings the proof from the Shema and prayer.
On seif 2 he first notes that the Tur attributes the requirement to Rambam and points out that the Rosh did not draw that distinction.
Then he raises his difficulty: in seif 3 a late recollection suffices; why should an immediate one be required here?
He then copies out Rambam, whose own text it is.
Including the closing clause, the one that carries the contested requirement.
Then the Raavad, who approves the position — but reads it differently.
For the Raavad the interval does not run from the vow but from the recollection: it is the acceptance of the condition that must follow immediately.
The Taz concludes that this is indeed the Raavad’s intention, and that Rambam himself meant it so.
Hence his objection to the Shulchan Arukh, in so many words.
And the close of his comment: וצריך עיון. He does not rule — he notes that the matter requires study. The Nekudot HaKesef will answer him point by point.
On seif 3 the Taz pins down the case and distinguishes it from seif 2: here he does remember the condition, and it is only its object he does not know.
Hence the necessity of the formula: without it, vowing while knowing there is a condition amounts to withdrawing it.
And if he did not remember at all? Then it is seif 2, and the vow falls as soon as he remembers.

The Ba’er Hetev summarises the Shach.
Then the Taz’s objection to the Prisha.
And he notes in small type that the Nekudot HaKesef side with the Prisha — leaving the reader before a divergence, not before a conclusion.
On בלחש he gives the Ba’h first.
Then the Shach, with Rabbenu Yeruḥam: he must have annulled it aloud and in public.
On seif 2 he gives the Taz’s objection in brief.
Then he repeats, like the Shach, that the gloss on כל נדרי belongs here.
And he takes up the extension to nezirut.
Finally, the reservation about an oath taken while holding an object.

The Pitchei Teshuva adds only one entry on this point, and it is decisive: the Levushei Serad brings a clear proof in the Ba’h’s favour, against the Shach, and concludes for practice that one may be lenient once he made himself audible, even if nobody else heard.
And on seif 3, a reference to a responsum that raises the question of a vow made in a dream — thereby joining the previous siman.

Nekudot HaKesef (נקודות הכסף) — three entries

First entry: against the Taz, in favour of the Prisha. Her distinction does have its place — once the condition specifies the vow aimed at, it is as though it were made at the time of the vow.
And the Ran himself, they say, spoke of simultaneity only in the case of a general condition.
Second entry: two words against the Taz on בלחש — ז״א, it is not so, as he wrote in ס״ק ב.
Third entry, and it is a complete refutation of the Taz’s long study. First answer: in seif 3 he expressly says “by my first intention”.
Second answer: there, if he does not remember at once, it is not that he uprooted his condition, but that he does not know what it covered — which is not our case.
Third: the forced reading the Taz gives of Rambam is to be set aside — the plain sense of his words is that of the Tur and the Shulchan Arukh.
And the conclusion, which also explains why the Shulchan Arukh adds the clause about the heart:

6. Table of the four seifim

SeifThe clause of the Shulchan ArukhWhat it decides
A disavowal said in the same breath carries off the vow
Provided it left the lips
Merely thought, it undoes nothing
Contrary view: said in a whisper, it is still a thing of the heart
Gloss: but one does not release without a sage, save for a great need
A condition laid down for a period, and a vow made within it
If he remembers while vowing, the vow stands: he uprooted his condition
If he does not remember, the condition stands and the vow falls
ב« ויש אומרים שאין התנאי מועיל לבטל הנדר אלא אם כן יזכרנו תוך כדי דיבור לנדר ויאמר בלבו שהוא סומך על התנאי ויש לחוש לדבריהם » (שו״ע יו״ד רי״א:ב)Contrary view: he must recall it at once and rely on it in his heart
He remembers having stipulated, without knowing about what
The formula “by my first intention” saves the condition
Without that formula, the condition falls and the vow stands
All this applies only to a vow or oath he imposed on himself
A vow imposed by another is untouched by this annulment

7. Practical cases

Case 1 — annulling in advance, aloud

This is the case of seif 1, and it is simple provided the declaration left the lips. But one must still know whether “in a whisper” suffices: the Ba’h, the Taz and the Levushei Serad accept it once he made himself audible; the Shach requires an audience.

Case 2 — a condition made long ago

It works only if the man did not have it in mind when he vowed. If he did and vowed anyway, the seif says he undid his condition.

Case 3 — remembering there was a condition, without knowing which

This is seif 3. The formula על דעת ראשונה אני נודר preserves the benefit of the condition; its absence loses it.

Case 4 —

The Rama’s gloss says two things, and they must be held together: the declaration counts as an express stipulation, and we do not rest on it to permit without going before a sage, save for a great need. The Shach adds that the gloss belongs to seif 2, and that it applies to nezirut as well.

Case 5 — an undertaking made to someone else

Seif 4 is plain: prior annulment does nothing there. The Shach adds a particular case — an oath taken while holding an object — of which he writes that it is not established to us that כל נדרי avails.

8. Review questions

  1. What is the difference between the case of seif 1 and that of seif 2, and why does the result reverse?
  2. What does עקריה לתנאיה mean, and in which of the four seifim does that reasoning operate?
  3. The Shach, in ס״ק א, draws a strong consequence from seif 1. What is it?
  4. The Prisha proposes a criterion other than simultaneity. What is it, and who approves it, who rejects it?
  5. What does בלחש mean according to the Ba’h and the Taz, and according to the Shach?
  6. What proof does the Ba’h draw from the reading of the Shema, and how does the Shach push it back?
  7. The Pitchei Teshuva reports a ruling for practice on this point. Whose, and in which direction?
  8. The two halves of the Rama’s gloss on כל נדרי: what does each one say?
  9. Where does the Shach say this gloss should have been printed, and who repeats him?
  10. What requirement does the יש אומרים of seif 2 add, and how does the Shach correct the text?
  11. What is the Taz’s וצריך עיון about, and what do the Nekudot HaKesef answer him?
  12. Seif 4 bounds the whole siman. What is its reason, and who gives it?
