1. הדין העולה — the line of psak of the siman

The line of psak. The siman reduces to four decisions. (1) Vowing by a Sefer Torah, without more, produces no vow. (2) A release is nonetheless required of one who is not a scholar — and the Shach will add that this today concerns everyone. (3) Naming what is written in it, or holding the scroll, makes a true vow. (4) And an oath by the Torah requires a release in every case — that is the seif’s parenthesis, taken from the Beit Yosef.
This siman does not apply itself, and for a reason it states: its variables are facts — what was said word for word, whether the scroll was held, whether it was a vow or an oath. None of these questions is decided from memory. For application to your own situation, consult your Rav.

2. דעתיה אגוילי — why the vow does not take effect

What is decided. The three entries say one thing in three formulations: the mind of one who points at the scroll rests on the parchments, and parchment is not a vowed thing. The vow therefore has no object. This is not a leniency: it is a finding.
Note the sense of “he has said nothing”: it means that nothing is forbidden, not that nothing is to be done. The seif immediately goes on to the release. For application to your own situation, consult your Rav.

3. במה שכתוב בה ונטלה בידו — the two ways of making it take effect

What is decided. Two acts tip the case, and they are independent: saying “by what is written in it,” or holding the scroll. Either suffices. And the Shach, resting on the reason of the Raavad and the Ran, extends further: one who vows expressly by the Names has vowed all the more so, and one who vows by sheets bearing offerings or Names has vowed even if the word of prohibition is not written on them.
The Shach’s extension rests on the reason of the Raavad and the Ran, not on the one the Mehaber gives. It is therefore not a simple development of the seif, and is a point to put to a Rav rather than settle alone. For application to your own situation, consult your Rav.

4. ת״ח ועם הארץ — and what the Shach says for today

What is decided. The seif exempts the ת״ח and requires of the עם הארץ a release, whose reason it gives: כדי שלא ינהגו קלות ראש בנדרים. But the Shach refers to siman 205 and writes that today all are judged as עמי הארץ; the Ba’er Hetev repeats it in his name.
In practice, therefore: one comes before a sage, and does not invoke the seif’s exemption. That does not dispense with the prior question — does what was said constitute a vow? For application to your own situation, consult your Rav.

5. הנשבע בתורה — the point that admits of no leniency

The point, and the dispute behind it. The seif decides: for an oath, a release is required in every case. But the Taz notes that the clause follows the Rambam, and that according to the Tosafot, the Rosh and the Tur one could say, even of an oath, that his mind was on the parchment. The Beit Yosef does not debate: he writes that in our day nothing is relaxed — held or not, formula said or not, scholar or layman.
The seif itself refers to siman 237 for the matter of oaths: this siman does not claim to settle it. An oath sworn on a Sefer Torah is therefore not handled here. For application to your own situation, consult your Rav.

6. לדיינים — the form of a judicial oath according to the Taz

What is decided. The Taz addresses a rule to judges: do not administer an oath in the form “I swear by the Sefer Torah,” lest the one swearing afterwards declare himself permitted by saying his mind was on the parchment — unless he places his hand on the scroll, for then he falls under the seif. The Ba’er Hetev repeats it.
It is a rule of procedure, addressed to the court. It also explains the still-living custom of having the hand placed on the scroll. For application to your own situation, consult your Rav.

7. ספר פסול — what the Pitchei Teshuva concludes

What is decided. The Pitchei Teshuva reports two answers that point the same way. The Har HaCarmel: making the scroll defective is forbidden, and in any case avails nothing — it remains an oath on a Sefer Torah. The Noda BiYehuda: swearing falsely is forbidden even holding no book at all, and the book is there only to awe the one swearing.
Both answers are responsa, reported by the Pitchei Teshuva; they are not clauses of the seif. A question about an oath before a court is put to a Rav. For application to your own situation, consult your Rav.

8. מה שאין בסימן זה — what is not found here, and what will not be written

What is not in this siman. The Nekudot HaKesef write nothing on this siman; they are read on the neighbouring simanim — 209, 210, 211, 215. The Taz, by contrast, is present here with two ס״ק, cited above. As for the Aruch HaShulchan, it is not accessible to us for this siman; none of its words is therefore reproduced here. None of this has been reconstructed or guessed: an entry that does not exist is not replaced by a paraphrase.

An undertaking made with the hand on a Sefer Torah

The act is precisely what the seif addresses: We are therefore in the case of the true vow, not of “he has said nothing.” And if a formula of oath rather than of vow was used, the closing parenthesis applies with still more force. For application to your own situation, consult your Rav.

An oath sworn before a civil court

The Taz gives the rule of form, and the Noda BiYehuda as reported by the Pitchei Teshuva gives the substance: swearing falsely is forbidden independently of the book. The question of what was sworn, and what follows from it, is put to a Rav — and the seif itself refers to siman 237. For application to your own situation, consult your Rav.

“I said ‘I swear to you on the Torah’ and I regret it”

The seif leaves no doubt as to conduct: a release is needed, in every case. What remains is to establish what exactly was said, and whether it was a vow or an oath — two things that are determined, not assumed. For application to your own situation, consult your Rav.

A holy book that is not a Sefer Torah

The siman speaks of the Torah scroll. The Rambam, in הלכות שבועות, expressly distinguishes the other holy writings — and the seif refers for that to siman 237. Do not transpose the rule from one book to another on your own authority. For application to your own situation, consult your Rav.
