Siman 213 — What a vow does not take hold of

Three seifim: a vow fastens onto things, not onto acts — and everything depends on the word used

✦ ❖ ✦

A first approach to Siman 213, three seifim that set the boundary of the tractate of vows. An oath may bear on anything, including what I shall or shall not do; a vow may not. A vow renders a thing forbidden, and so it needs a thing. Saying “let it be forbidden to me to speak with you” produces nothing, because speech is not a thing. But saying “let my mouth be forbidden to me for speaking with you” produces a full vow, from the Torah — for the mouth does exist. The siman adds two things: a vow that does not take effect still calls for a rabbinic release, and “I shall study this chapter” is an undertaking that is kept. These are rulings למעשה: any real case is brought to a Rav.

📑 Plan of study

1. What is this siman about? The thing, the act, and the limb
2. The three seifim, clause by clause
3. The key concepts:
4. Where these seifim come from: the mishnah, the gemara Nedarim, the Rambam, the Tur, the Beit Yosef
5. The commentators: the eighteen entries, cited one by one
6. The table of the three seifim
7. Practical cases
8. Comprehension questions

1. What is this siman about? (three seifim)

There are two ways of binding oneself by speech, and they do not reach equally far. An oath (שבועה) binds the man: I forbid myself to do such a thing. A vow (נדר) forbids a thing: this object is henceforth to me like an offering. Hence a difference the mishnah states: an oath takes hold of what has no substance, a vow does not.

The siman draws the consequence, word by word. Saying קונם שאני מדבר עמך — “qonam, that I speak with you” — makes no vow: speech has no substance. But saying קונם פי מדבר עמך — “qonam my mouth from speaking with you” — makes a vow from the Torah: the mouth is a thing. One word moved, and everything changes. Seif 2 adds a case of another kind — “I shall study this chapter” — and seif 3 a case of a conditional vow.

The siman in three points. Seif 1: a vow wants a thing; naming the act does not suffice, naming the limb does — and even what does not take effect calls for a rabbinic release. Seif 2: “I shall study this chapter” stands, like a vow of charity. Seif 3: in a conditional vow, one fears forgetting the condition, never forgetting the prohibition.

2. The three seifim, clause by clause

Here are the three seifim, each first in full — exactly as the source gives it, including the parenthetical glosses and the gloss of the Rama — and then broken down.

Seif 1 — the vow wants a thing

The seif states its rule, gives its paradigm case in both formulations, then adds the rabbinic clause — and the Rama’s gloss opens an intermediate case.

Vows do not take hold of a thing that has no substance
This is the title rule, and it is a limit: the siman does not say what a vow does, it says what it cannot do. The word ממש — substance, materiality — is the criterion of the whole siman.
How so? He said: qonam that I speak with you, that I work for you, that I walk for you, that I sleep with you — it is not a vow
Four examples, and the same defect in all four: speaking, doing, walking, sleeping are acts. A vow does not fasten onto them. The Shach, at ס״ק א, dwells on the very spelling of שאני — without a yod — and draws a point of substance from it.
and likewise if he said: my speech, my doing and my walking are forbidden to you, and sleep is forbidden to me — it is not a vow
The wording changes, the result does not. Naming the act as a noun — “my speech” — does not make it any more substantial. The Rambam says so expressly:
but rabbinically a שאלה is needed
And here is the seif’s reversal: what does not take effect is not therefore without sequel. The reason is in the Rambam, whom the Shach cites at ס״ק ג: since the man believed his vow took effect, he is not taught that he is free — a door is opened for him and it is released.
explanation: to ask about his vow and to find a door to release it
This parenthesis is an editorial gloss inserted into the text of the seif; it defines the word שאלה. We copy it as it stands, as the source gives it.
therefore Reuven who forbids himself to hear Shimon’s prayer needs a שאלה rabbinically
The case is a responsum of the Rashba, reported by the Beit Yosef: hearing is an act, hence no Torah vow — but the rabbinic release remains due. It is the concrete application of the preceding clause.
but if he said: qonam my mouth from speaking with you, qonam my hands from working for you, qonam my feet from walking for you, qonam my eyes in sleep — it is a full vow, from the Torah
The reversal turns on one word: the mouth, the hands, the feet, the eyes are things. The Shach, at ס״ק ד, puts it in five words. And he adds, at ס״ק ה, that קונם עיני בשינה holds only if a duration was stated.
and all the more so if he said: let my mouth be forbidden to you for my speech, my hands for my work and my feet for my walking
Here the prohibition bears explicitly on the limb, and the act is only the motive. The Taz, at ס״ק ב, explains why this is an a fortiori: in the previous formulation there was a doubt as to what the qonam was aimed at.
Gloss: one who says “the speech of my mouth is upon you” or “the taking of a stone is upon me” — some say it is a vow, since he mentioned the mouth and the stone
The Rama’s gloss opens the intermediate case: neither the bare act nor the limb alone, but the act named together with its object. The Shach, at ס״ק ו, gives the reason. It is the finest point of the seif.
Toledot Adam veChava, netiv 14; and so it appears from the Ran in the name of the Tosafot cited in the Beit Yosef at the end of siman 239
The attribution is part of the printed text of the gloss, and we copy it. It shows that the י״א is not an anonymous opinion but an identifiable position.

Seif 2 — “I shall study this chapter”

A one-line seif, and a parenthetical gloss that extends it.

One who says “I shall study this chapter” — it is as though he had vowed to give charity
The case is of another kind: study is not a thing, and yet the undertaking stands. The reason is that this is not a vow of attachment but an undertaking of בפיך זו צדקה — the Rosh says so in so many words, as the Beit Yosef reports.
or to do the other mitzvot, and his vow stands
The parenthetical gloss extends the case to all the mitzvot. The Shach, at ס״ק ז, comments on it, referring to siman 258.
and so it appears from the Tur, the Rosh and the decisors
The attribution is part of the printed text. The Tur in fact writes הוי נדר גמור and gives a slightly different reason — כיון שנדר דבר מצוה — which level 2 examines.

Seif 3 — the conditional vow, and the forgetting one fears

Two symmetrical formulations, and opposite verdicts. The whole reason lies in what a man forgets.

He said: qonam my eyes in sleep today if I sleep tomorrow — he shall not sleep today, lest he forget and sleep tomorrow
The vow is conditional, and the condition lies in the future. He is therefore forbidden from now what would only become forbidden retroactively — because it is feared he will forget his condition. The Taz, at ס״ק ג, gives the reason for that fear.
but if he said: qonam my eyes in sleep tomorrow if I sleep today — he may sleep today, and we do not fear that tomorrow he will forget his vow and sleep
The symmetrical case yields the opposite verdict, and the reason is psychological: A man is careful about what is forbidden; he is not careful about a condition which merely brings about the prohibition.

3. The key concepts of this siman

דבר שאין בו ממש — the thing without substance — An act, a state, an abstraction: speaking, walking, sleeping, hearing. A vow does not fasten onto them, because it works by rendering a thing forbidden, and there is no thing there. An oath does fasten onto them: it binds the man, not the object. The Rambam gives the reason for the division.
קונם — qonam — A substitute for the word קרבן: to say of a thing that it is qonam to me is to render it forbidden like an offering. It is the vow-word par excellence, and it is the one the siman uses in all its examples.
בל יחל מדרבנן — the rabbinic “he shall not profane” — The verse לא יחל דברו grounds the prohibition of transgressing one’s vow. The gemara, in Ravina’s answer, admits a בל יחל that is only rabbinic — and that is where the seif’s requirement of a release comes from.
נדר שוא — the vain vow — A vow impossible to keep. The Shach, at ס״ק ה, applies it to sleep: vowing without fixing a duration amounts to vowing never to sleep, and vowing not to sleep for three days is likewise — the vow does not take effect at all. He refers to siman 236.
תנאי — the condition — A vow may be suspended on a future fact. Seif 3 draws a rule of vigilance from it, and the reason is given by the gemara and then by the Rambam: a man guards himself against what is forbidden, not against what is merely a condition.

4. Where these seifim come from

The three seifim condense two mishnayot of the second chapter of Nedarim, the sugya that accompanies them, a saying of Rav Gidel in the first chapter, five halakhot of the Rambam and the discussion of the Beit Yosef.

The mishnah and the gemara —

The mishnah lists four formulations — sleeping, speaking, walking, serving one’s wife — and concludes But the next mishnah lays down the opposite rule: The gemara makes the contradiction its question, and from there the whole siman issues.

The gemara — בל יחל מדרבנן, and the conditional vow

Three elements of the sugya enter the siman directly. First Rabbi Yochanan’s rule on the oath not to sleep for three days, which grounds the Shach’s נדר שוא. Then Ravina’s answer: the בל יחל of the mishnah is rabbinic — that is the seif’s clause ומיהו מדרבנן צריך שאלה. Finally the phrase that decides seif 3.

The gemara —

Seif 2 comes from elsewhere: from a saying of Rav Gidel in the name of Rav, in the first chapter. It calls “a great vow” what is not an attachment, and the gemara at once explains why such an undertaking can take effect on one already bound to study.

The Rambam —

The Rambam is here the entire frame of the siman, and he further gives the reason for the division, which the siman does not: one who swears forbids himself, one who vows forbids the thing. Halakhot 10 to 12 of chapter 3 are seif 1; halakha 29 of chapter 1 is seif 2; halakhot 14 and 15 of chapter 4 are seif 3.

The Tur

The Tur follows the same order, but differs from the seif on a point of weight: for “I shall study this chapter” he writes הוי נדר גמור and gives as his reason כיון שנדר דבר מצוה — where the seif writes “as though he had vowed to give charity.” That is not the same construction.

The Beit Yosef

The Beit Yosef supplies three things that do not appear in the seif. The case of Reuven and Shimon, which is a responsum of the Rashba. The reason why “qonam my mouth” takes effect — the Rosh’s נעשה כאומר, and the Ran’s reasoning from סתם נדרים להחמיר. And the Ran’s reading of “I shall study this chapter,” which makes it an oath and not a vow.

5. The commentators, entry by entry

The apparatus of this siman numbers eighteen entries: eight ס״ק of the Shach, three of the Taz, six of the Ba’er Hetev, one of the Pitchei Teshuva. We cite them all, in order, without summarising any. The Nekudot HaKesef do not comment on this siman — they are found on the neighbouring simanim (209, 210, 211, 215); there is therefore nothing of theirs to cite here.

The Shach (ש״ך) — eight ס״ק

ס״ק א — the spelling שאני, and why siman 206 is no objection

ס״ק ב — what the rabbinic rank of the vow changes

ס״ק ג — the שאלה is due even upon what has no substance

ס״ק ד — the mouth and the hands have substance

ס״ק ה — a vow on sleep requires a duration, else it is a נדר שוא

ס״ק ו — the Rama’s gloss: mentioning the חפץ suffices

ס״ק ז — the other mitzvot, like “I shall study this chapter”

ס״ק ח — two cross-references on forgetting the condition

The Taz (ט״ז) — three ס״ק

7. Practical cases

Case 1 — “I swear never to speak to him again”

The first task is not to know how serious it is, but to know whether it is a vow or an oath: the mishnah sets the two against one another on precisely this point, and the siman has nothing to say about the oath. The formula used decides, word for word. A Rav is to be consulted.

Case 2 — an undertaking never to go to a certain place again

Walking is an act: on the letter of the seif, a vow does not take effect. But two clauses remain — the seif’s rabbinic release, and the possibility that the formula used named a limb or an object. Do not conclude to a permission on your own.

Case 3 — “I said I would finish this tractate”

Seif 2 deals with exactly this, and it does not deal with it as an ordinary vow: The Shach, at ס״ק ז, extends it to the other mitzvot. It therefore remains to determine whether the formula was a statement of intent or an undertaking — a question for a Rav.

Case 4 — a conditional undertaking

“If I do such a thing tomorrow, then such a prohibition takes hold of me today.” Seif 3 gives the verdict and its reason. The Shach, at ס״ק ה, adds the requirement of a duration for sleep, and refers to siman 236. None of these elements is judged from memory.

Case 5 — “I forbade myself to listen to that person”

This is literally the case of the seif, taken from a responsum of the Rashba: a rabbinic שאלה is needed. The seif does not say there is nothing to be done; it says what rank what was done has.

8. Comprehension questions

  1. What is the difference between a vow and an oath, and on what point does the mishnah set them against one another?
  2. Why does קונם שאני מדבר עמך not make a vow, while קונם פי מדבר עמך does?
  3. The Shach and the Taz both answer the same objection drawn from siman 206. What are their two answers, and how do they differ?
  4. A vow that does not take effect nonetheless calls for a release. Where does that requirement come from, and what is its rank?
  5. What difference does it make, according to the Shach at ס״ק ב, that the vow is rabbinic rather than from the Torah?
  6. What does the Rama’s gloss say, and what reason does the Shach give for it at ס״ק ו?
  7. Seif 2 says “as though he had vowed to give charity,” the Tur says “it is a full vow.” In what way do these two formulations not say the same thing?
  8. Why is forgetting the condition feared, and not forgetting the prohibition? Give the gemara’s phrase.
