1. חומר בשבועות מבנדרים — the boundary, and the reason the Rambam gives for it

↩ Detailed explanation (level 1)
The yesod, and the mishnah itself states it The mishnah states the rule as a comparison: there is a stringency of oaths over vows. And the gemara at once turns it into an objection against the preceding mishnah, which had nonetheless written הרי זה בלא יחל דברו of those very formulations. That tension engenders the siman.
And the Rambam gives the reason, which neither the mishnah nor the seif gives It is not a difference of degree but of mechanism. One who swears forbids himself — and he himself exists, whatever the object. One who vows forbids the thing — and so there must be a thing. The entire siman is a consequence of that sentence.

2. הקושיה מסימן ר״ו — two answers, and they do not coincide

↩ Detailed explanation (level 1)
The kushya: siman 206 seems to say the opposite At siman 206, one who says מודרני ממך שאיני אוכל לך is bound — and yet “eating” is an act, exactly like “speaking.” If an act carries no vow, how does that formula operate? The question stands already in the Tosafot at the beginning of Nedarim, and the Taz opens with them.
The first answer — the Tosafot’s: the object is there There it is not the act of eating that is forbidden but the food — and food has substance. The formula שאיני אוכל לך only describes the way the prohibition is realised. Here neither speech nor sleep has any object behind it.
The second answer — the Taz’s: the object does not yet exist The Taz raises a difficulty the Tosafot’s answer does not cover: שאני עושה לך does have a material result — the work done. He answers that at the moment of the vow that materiality is not present, whereas food already exists when one vows about it. This is no longer the same criterion: the first sorts by the nature of the object, the second by its presence.
Nafka mina — and it is clear-cut Take a vow bearing on a thing that does not yet exist but will: the fruit that has not grown, the object to be made. On the Tosafot’s criterion there is indeed an object, and the question becomes that of a vow on what has not yet come into the world. On the Taz’s criterion, absence at the moment of the vow is precisely what blocks it. The two answers do not cover the same ground, and that is what must be seen.

↩ Detailed explanation (level 1)
The seif’s reversal, and the exact word The switch turns on the position of one word: קונם שאני מדבר places the qonam on the act, קונם פי מדבר places it on the mouth. The Rambam puts it in two consecutive halakhot, and so does the Tur.
Two explanations of that switch, and they do not say the same thing (א) The Rosh: נעשה כאומר. Since his intention is to forbid, he is treated as though he had used the formulation that forbids — “let my mouth be forbidden for my speech.” This is a requalification of what he said. The formula קונם פי מדבר עמך is ambiguous — the qonam may aim at the speech or at the mouth — and since unspecified vows are taken stringently, we say it aims at the mouth. This is a rule of interpretation, not a requalification.
Nafka mina — and it is the Taz who brings it to light The Taz explains the seif’s וכל שכן precisely by the Ran’s reading: in the first formulation there was a doubt as to what the qonam aimed at, and stringency settled it; in the second, the prohibition bears explicitly on the mouth, and there is no doubt at all. On the Rosh’s reading, by contrast, the “all the more so” would be less clear: if the first is already requalified, the second adds nothing. It is a divergence of construction, and it can be read in the text.

4. בל יחל מדרבנן — what remains of a vow that did not take effect

↩ Detailed explanation (level 1)
The foundation: Ravina’s answer The gemara resolves the contradiction between the two mishnayot by admitting a בל יחל that is only rabbinic. From there comes the seif’s clause, and the Rambam gives its psychological reason: since the man believed his vow took effect, he is not taught that he is permitted.
Nafka mina — what depends on the rank of the vow The Shach, at ס״ק ב, gives one, in the name of the Bach, and it is very concrete: the penalty of days of siman 208 — observing the prohibition for as many days as one behaved permissively — is due only for a Torah vow. He proposes a second by referring to siman 205. And the Pitchei Teshuva adds yet another, drawn from what he wrote at siman 206 in the name of the Noda BiYehuda.
And the concrete case the seif draws from it The seif does not leave the clause hanging: it applies it at once to a responsum of the Rashba, that of Reuven who forbade himself to hear Shimon’s prayer. Hearing is an act; no Torah vow; and yet a rabbinic שאלה.

5. הגהת הרמ״א — the act named together with its object

↩ Detailed explanation (level 1)
The gloss, and what it comes to fill in Between the bare act (קונם שאני מדבר) and the named limb (קונם פי מדבר) there is an intermediate formulation: דבור פי עליך — the speech of my mouth. The act is named, but with its organ. And likewise נטילת אבן עלי, the taking of a stone.
Ḥakira: does mention suffice, or must the prohibition bear upon it? (א) The prohibition must bear on the thing. Then דבור פי should be worth nothing: grammatically it is the speech that is forbidden, the mouth being only its complement. That is why it is only a י״א. (ב) It suffices that the thing be mentioned. The Shach writes exactly that: although speech and taking have no substance, since he mentioned the object, the vow takes effect. The Ba’er Hetev repeats it in his name.

6. אשנה פרק זה — three readings of one undertaking

↩ Detailed explanation (level 1)
The source, and its embarrassing phrase Rav Gidel in the name of Rav calls “I shall study this chapter” a נדר גדול — a great vow. Yet this is plainly not a vow of attachment: nothing was compared to anything. And the gemara adds a difficulty: the man is already bound to study, so how can an undertaking bear on what he is already bound to?
Three readings, and the seif adopts one (א) The Rosh: it is a vow of charity. It is not a vow in the strict sense, but it is reckoned like one who vowed to give charity, from בפיך זו צדקה. This is the reading the seif adopts, word for word. (ב) The Tur: it is a full vow. And his reason is different — כיון שנדר דבר מצוה. (ג) The Ran: it is an oath. He reads the gemara as speaking of a שבועה, and his מסתברא לי even rejects the explanation of exemption by the recital of the Shema: what holds, he says, is that anything derived by a דרשה, not being explicit in the verse, admits an oath.
Nafka mina — and the seif’s extension The seif’s gloss extends the case to all the mitzvot, and the Shach, at ס״ק ז, confirms it by referring to siman 258 — the chapter of vows of charity. That reference is itself an argument: it places the case under the regime of צדקה, not of the vow of prohibition. The Rambam, for his part, writes that it is “like a vow” although he did not use the language of a vow.

7. קונם עיני בשינה — the condition, the forgetting, and the נדר שוא

↩ Detailed explanation (level 1)
The two formulations, and the principle that separates them The gemara gives the reason in six words, and it is observational: one is vigilant about a prohibition, one is not about a condition. The Rambam restates it plainly, and the Taz makes it the comment on the seif.
And what the Rambam adds, which the seif does not say The Rambam writes that the prohibition in the first case is a גזרה — a decree — and draws a consequence as to lashes: if he transgressed and ate today and then went tomorrow, he is flogged; if he did not go, he is not. The seif does not speak of lashes, but the distinction illuminates its verdict: what is forbidden today is not yet a prohibition, it is a precaution.
Nafka mina — the duration, and the נדר שוא The Shach, at ס״ק ה, sets a precondition to all the foregoing: a vow on sleep holds only if a duration was stated. Without a duration it is like vowing never to sleep — a נדר שוא, which does not take effect at all. And the same applies to a vow not to sleep for three days. The Beit Yosef says so too, in the name of Rabbenu Yerucham. In other words: before discussing the conditional, the vow must stand.
