1. The axiom: a vow forbids a thing, an oath binds a man

The axiom. A vow works by rendering a thing forbidden; it therefore needs a thing. An oath works by binding the man; it needs nothing else. From this comes the whole boundary of the siman, and its reason is given not by the seif but by the Rambam.
Three consequences. (1) Naming an act makes no vow. (2) Naming the limb makes one, from the Torah. (3) What does not take effect still calls for a rabbinic release — because the man believed he had vowed.

2. The three reflex questions

1. Vow or oath? An oath — this siman does not concern it. A vow — next question.
▼
2. What did he name? An act — no vow. A limb or an object — a Torah vow. The act with its object — machloket.
▼
3. And then? If it took effect: an ordinary release. If not: a rabbinic שאלה. If it is a נדר שוא: nothing at all — see siman 236.

5. The open machlokot

Why does “qonam my mouth” take effect? The Rosh: he is treated as though he had said “let my mouth be forbidden for my speech” — requalification. The Ran: the formula is ambiguous, and סתם נדרים להחמיר settles it toward the mouth — interpretation. Beit Yosef · Taz ס״ק ב.
What answers the objection from siman 206? The Tosafot: there is an object there, the food. The Taz: there the object exists at the moment of the vow. The two criteria do not sort the same cases. Shach ס״ק א · Taz ס״ק א.
Does mentioning the object suffice? The Rama reports a י״א holding “the speech of my mouth” to be a vow, and the Shach gives the reason: since he mentioned the חפץ. It is only a י״א, and the gloss does not decide. Rama · Shach ס״ק ו · Ba’er Hetev ס״ק ד.
What is “I shall study this chapter”? The Rosh, followed by the seif: like a vow of charity. The Tur: a full vow, because he vowed a thing of mitzvah. The Ran: an oath. Beit Yosef · Tur · Shach ס״ק ז.

7. Golden rules, mnemonic and classic pitfalls

The golden rules. (1) A vow wants a thing; it is the position of the word that decides, not the intention. (2) What does not take effect is not therefore without sequel. (3) A vow on sleep with no duration does not take effect at all. (4) In a conditional vow, one fears forgetting the condition, never forgetting the prohibition.
שאני מדבר → nothing · פי מדבר → vow · דבור פי → machloket · אין בו ממש → rabbinic שאלה
Pitfall 1 — believing intention suffices. It does not: the seif sets two formulas whose intention is identical and whose result is opposite. Even the Rosh, who invokes intention, makes of it a requalification of the speech, not a substitute for it.
Pitfall 2 — concluding from “it is not a vow” to “I am free.” The seif immediately goes on to ומיהו מדרבנן צריך שאלה, and the Rambam gives the reason: the man believed he had vowed.
Pitfall 3 — forgetting the requirement of a duration. The Shach, at ס״ק ה, sets it before everything else: without a duration the vow on sleep is a נדר שוא, and there is nothing to discuss.
