✦ ❖ ✦

A first approach to Siman 214, two seifim — and the most directly applicable siman of this whole block. It does not speak of a man uttering a formula, but of a man who, saying nothing at all, falls into the habit of abstaining from something permitted. The Shulchan Aruch decides that such a habit is worth a vow — and that three men are needed to release him from it. Then it distinguishes: one who abstained by mistake, believing the thing forbidden, is bound by nothing. The second seif moves from the individual to the community: the custom of a town binds its inhabitants, their descendants, and those who come to settle there. These are rulings למעשה, and of the kind met with every day: any real case is brought to a Rav.

📑 Plan of study

1. What is this siman about? Habit, the vow, and error
2. The two seifim, clause by clause
3. The key concepts:
4. Where these seifim come from: the gemara in Nedarim and Pesachim, the Yerushalmi, the Rosh, the Rashba, the Rivash, the Tur, the Beit Yosef
5. The commentators: the nineteen entries, cited one by one — and the Taz, who does not comment on this siman
6. The table of the two seifim
7. Practical cases
8. Comprehension questions

1. What is this siman about? (two seifim)

The preceding simanim asked what a word produces. This one asks what a practice produces. A man abstains from something he knows to be permitted — out of caution, out of asceticism, out of received usage. He has uttered nothing and promised nothing. The Shulchan Aruch nonetheless decides that it is כאילו קבלו עליהם בנדר, as though he had accepted it by vow.

But not everything binds, and that is the heart of the seif. He must have known the thing to be permitted: one who abstained believing it forbidden accepted nothing at all. He must also have intended from the outset to do so forever — and then a single occasion suffices. Hence the counsel the seif gives for the future: to say at the outset that this is neither a vow nor forever. Seif 2 extends the matter to the community: what a town has taken upon itself binds its inhabitants and their offspring, and binds also one who comes to settle there.

The siman in three points. (1) A permitted thing, known to be permitted, from which one has taken to abstaining with the intention that it be forever, is like a vow: three men and a חרטה are needed. (2) If the abstention came from an error, there is no vow — but the seif also reports a far more stringent opinion, which the Rama sets aside. (3) The custom of a community binds its members, their children, and those who come to settle there with no intention of returning.

2. The two seifim, clause by clause

Here are the two seifim, each first in full — exactly as the source gives it, including the Rama’s parenthetical gloss — and then broken down.

Seif 1 — the custom of an individual

The seif lays down its rule, gives two concrete applications, specifies the condition of intention, indicates the form of the release, gives the preventive counsel, then excludes the case of error — and ends on a stringent opinion which the Rama’s gloss sets aside.

Permitted things, and those who know of them that they are permitted have conducted themselves in them by prohibition — it is as though they had accepted it upon themselves by vow, and it is forbidden to permit them to them
The whole siman hangs on the condition It is not abstention that binds, but abstention knowingly: it manifests an acceptance. The Shach, at ס״ק א, specifies the motive one must see in it.
Therefore one who is accustomed to fast the fasts preceding Rosh Hashanah and those between Rosh Hashanah and Yom Kippur
The first example, and it is not chosen at random: these are fasts of custom, which the law does not impose. The seif takes them precisely because everyone knows they are not obligatory.
and one who is accustomed not to eat meat and not to drink wine from Rosh Chodesh Av or from the 17th of Tammuz, and wishes to go back on it because he is not in good health — he needs three men to release him
The second example, and here is the consequence: This is not a recommendation, it is the form of a release from a vow. And the reason for which he wishes to go back — health — does not by itself release him: this is what the Shach will discuss at length at ס״ק ב.
if, at the moment he began to conduct himself so, his intention was to do it forever, and he has so conducted himself even once — a release is required
Two conditions, and they do not weigh equally. The initial intention is decisive; repetition is not — a single occasion suffices. That is the exact opposite of what is usually assumed.
and one shall open with regret, that he regrets having conducted himself so as a vow
The form is given: חרטה, regret — and on its precise object, having conducted himself so as a vow. The Shach, at ס״ק ד, sets a decisive limit to this path, in the name of the Maharshal.
Therefore one who wishes to conduct himself in certain permitted things as a fence and an ascesis shall say at the beginning of his conduct that he does not accept it upon himself by vow
The seif is not content to describe: it gives a practical counsel, and this is the most often cited passage of the siman. It comes from the Rashba’s responsum, which the Beit Yosef reports immediately after the stringent opinion.
and he shall also say that he does not intend to conduct himself so save on that occasion, or on the occasions he shall wish, and not forever
Two declarations, and both are needed: the first removes the vow, the second removes the forever — that is, the condition of intention at the head of the seif. The Pitchei Teshuva, at ס״ק ג, refers on this point to the Magen Avraham.
but those who conduct themselves by prohibition in permitted things because they think them forbidden — it is not as though they had accepted them by vow
Here is the exclusion, and it is the practical half of the seif. One who believed the thing forbidden accepted nothing: he was mistaken. The Shach, at ס״ק ה, specifies the exact situation intended and extends it to a neighbouring case.
And there is one who says that if, being mistaken, he conducted himself by prohibition in a permitted thing, he asks and it is permitted to him before three, in the manner of a release of vows
The seif changes voice: This is the Rashba’s position, which the Beit Yosef reports, and it reverses the division. For him the one in error is released; it is conduct knowingly undertaken that cannot be released.
but if he knows that it is permitted and conducted himself in it by prohibition, it is not permitted to him even in the manner of a release of vows, for it is as though he had accepted upon himself like the prohibitions the Torah forbade, which have no release ever
This is the most stringent opinion in the siman, and one must measure what it says: not that the release is difficult, but that there is none. The Beit Yosef gives the reason in the name of the Rashba: such conduct is graver than a vow, precisely because vows can be released.
Gloss: and the custom is according to the first opinion
Five words of the Rama, and they decide. “The first opinion” is that of the body of the seif — the one that releases by regret and leaves error outside the vow. The Rashba’s stringency is reported, not accepted.

Seif 2 — the custom of a community

A short seif, and three decisions: the community binds, it binds the descendants too, and it binds one who comes to settle — who at the same stroke loses the customs of his former town.

The acceptance of the community takes hold upon them and upon their offspring, and even in things the townsfolk did not accept upon themselves by agreement but practise of themselves to make a fence and a hedge for the Torah
Two extensions in one sentence, and the second is the stronger: no decision of the community is needed, the practice alone suffices. The source is a responsum of the Rivash in the name of the Ramban, which the Beit Yosef cites at the end. The Pitchei Teshuva, at ס״ק ד and ס״ק ה, will discuss the reach of the word זרעם.
and likewise those who come from outside the town to dwell there are as the townsfolk, and they are bound to act according to their institution
The newcomer is absorbed into the custom of the place. The Shach, at ס״ק ז, brings here the most discussed distinction of the siman: that between a מנהג חשוב and a מנהג גרוע.
and even in things they were forbidden in their own town because of their custom, and which the custom of the town where they have come to dwell does not forbid — they have become permitted in them, if they have no intention of returning
The most contested clause of the siman: settling releases from the customs of the former town. The Shach opens his ס״ק ח with the word תימה and raises a contradiction with Orach Chayim 468 — then, at the end of his discussion, gives his own opinion.

3. The key concepts of this siman

מנהג — custom — A conduct taken up and repeated, with no word and no formal undertaking. The siman gives it the force of a vow — but only on two conditions, which the seif states: that one knew the thing to be permitted, and that one intended from the outset to do it forever.
סייג ופרישות — the fence and the ascesis — The two legitimate motives for a voluntary abstention: keeping far from a prohibition, or restraining oneself out of piety. The Shach names them as early as his ס״ק א as the motive of the custom that must be supposed, and the seif takes them up when giving its preventive counsel.
התרה — the release — The seif requires ג׳ שיתירו לו — three men to release him. This is not one more formality: it is the very form of a release from a vow, and it says what the siman thinks of custom.
חרטה — regret — The path of release the seif indicates: he regrets having conducted himself so as a vow. The Shach, at ס״ק ד, gives its limit in the name of the Maharshal — and that limit is the most practical point of the whole siman.
קבלת הרבים — the acceptance of the community — What a community has taken upon itself, even without deliberation. It binds its members, their offspring, and those who come to settle there. The Pitchei Teshuva discusses at ס״ק ה how far the word “offspring” reaches.

4. Where these seifim come from

The two seifim are an assembly of sources, and that is what explains their difficulty: a braita in Nedarim, the sugya in Pesachim that restricts it, a Yerushalmi which the Rosh and the Rashba read in opposite directions, a responsum of the Maharam of Rothenburg on fasts, another of the Rashba for stringency, and one of the Rivash in the name of the Ramban for the community.

The braita and the two sugyot

The braita is brief, and it is the foundation of the siman: one has no right to permit before them a thing others have made a prohibition for themselves, But the sugya in Pesachim at once restricts it to a particular case — בכותאי — and the Beit Yosef explains the reason for that restriction.

The case of Beit She’an, and that of the people of Beishan

Three narratives supply the siman with its limiting cases. At Beit She’an, Rabbi permitted the whole town on the testimony that Rabbi Meir had eaten a leaf of vegetable there — and his own brothers set against him the custom of the fathers. The people of Beishan, for their part, could not shed the custom of their fathers: And Rabbi Zeira, having gone up to the Land of Israel, ate what his place of origin forbade, because he had no intention of returning — this is the direct source of the last clause of seif 2. To which is added the principle running through the chapter:

The Yerushalmi, and the two ways of reading it

The entire division of seif 1 comes from the Yerushalmi, and from the way the Rosh reads it. The Yerushalmi sets two men against one another: he who did not know and erred — נשאל ומתירים לו — and he who knew — נשאל ואין מתירים לו. The Rosh explains that “it is not permitted to him” means: not of itself; but the sage may release him by regret, as for other vows. That is, word for word, the body of the seif.

The Maharam’s responsum — the fasts

The two examples of the seif — the fasts of the ten days, the meat and wine of the three weeks — do not come from the Talmud: they are the very terms of a responsum of the Maharam of Rothenburg, in the name of Rabbi Yehuda HaKohen, reported by the Mordechai and the Hagahot Maimoniyot. From there too come the condition of intention and the “even a single time.”

The Rivash in the name of the Ramban — the community

The end of seif 1 and all of seif 2 issue from two responsa which the Beit Yosef cites one after the other. That of the Rashba gives the stringent opinion — such conduct is graver than a vow — and, on the same page, the preventive counsel which the seif repeats word for word. That of the Rivash, in the name of the Ramban in his Mishpat HaCherem, gives the three decisions of seif 2.

The Tur

The Tur gives the matter of seif 1 in three sentences, and one must note what he does not say: he mentions neither the fasts of the ten days nor the three weeks — he writes “at a known time” — and he does not report the Rashba’s stringent opinion. The seif is therefore, here, fuller than its Ashkenazi source.

The Beit Yosef

The Beit Yosef finally adds a distinction that does not appear in the seif but which the Shach will introduce into it: the Rosh’s distinction between an important custom, taken up by the people of the place with a talmid chacham among them, and an inferior custom, which the people of the country took up of themselves. The Ran, cited immediately after, says something further: a talmid chacham may act leniently in private, within his own house.

5. The commentators, entry by entry

The apparatus of this siman numbers nineteen entries: eight ס״ק of the Shach, six of the Ba’er Hetev, five of the Pitchei Teshuva. We cite them all, in order, without summarising any. Two absences must be noted, and stated exactly. The Taz does not comment on this siman: his commentary on Yoreh De’ah passes from siman 213 to siman 215, and his words on these matters are to be found in those two neighbouring simanim. The Nekudot HaKesef do not comment on it either; they are read on simanim 209, 210, 211 and 215. Nothing here has been reconstructed to fill those absences.

The Shach (ש״ך) — eight ס״ק

ס״ק א — what motive must be supposed for the custom

ס״ק ב — the contradiction with Orach Chayim 568, and its resolution

ס״ק ג — the reference for the three weeks

The Taz (ט״ז) — he does not comment on this siman

The Taz, present on almost all of Yoreh De’ah, has no commentary on this siman: his text goes from siman 213 to siman 215. No entry of his will therefore be found here, and none has been fabricated. What he says on related matters is read at siman 213 (three ס״ק, on what a vow takes hold of) and at siman 215 (seven ס״ק, on vows bearing upon a mitzvah). On the neighbouring question of customs from place to place, the Shach himself refers to his commentary on Orach Chayim, at the beginning of siman 574.

7. Practical cases

Case 1 — a practice taken up years ago

Three preliminary questions, and none of them is settled alone: did he know the thing to be permitted? Did he, at the outset, intend to keep it forever? And what custom is this — his own alone, his community’s, or all Israel’s? The third question decides the very possibility of a release, according to the Shach at ס״ק ד.

Case 2 — health

This is the very example of the seif, and the Shach devotes his longest ס״ק to it. Health is not, in itself, a door: a release is needed. But the Pitchei Teshuva, at ס״ק א, reports from the Dagul Mervava a decisive distinction — giving it up for good, or suspending once with the intention of resuming.

Case 3 — taking a good resolution

The seif gives the procedure, and it is the most useful thing in the whole siman: to say at the outset that this is not a vow, and that it is not forever. Both, for these are two distinct conditions. The Pitchei Teshuva, at ס״ק ג, refers to the Magen Avraham on the formula.

Case 4 — a family custom

Seif 2 says that the acceptance of the community binds “them and their offspring.” But the Pitchei Teshuva, at ס״ק ה, reports from the Zikhron Yosef that the son is bound only by what he himself practised since coming of age, his parents having accustomed him to it. It is a sourced answer to a frequent question, and it does not extend of itself.

Case 5 — moving house

Seif 2 deals with exactly this: one adopts the custom of the new place, and is released from that of the old — if one has no intention of returning. But the Shach opens his ס״ק ח with תימה, raises a contradiction with Orach Chayim 468, and concludes only at the end of his discussion. And he adds a reservation that holds everywhere: where there is fear of dispute, nothing is changed.

8. Comprehension questions

  1. What are the two conditions for a custom to bind like a vow? Which of the two is the more surprising?
  2. The seif requires “three men.” Why three, and what does that teach us about what a custom is?
  3. The Shach, at ס״ק ב, sets our siman against a gloss in Orach Chayim. What is the contradiction, and how does he resolve it?
  4. What limit does the Shach place, at ס״ק ד, on release by regret — and in whose name?
  5. The seif reports an opinion refusing any release. Who holds it, and on what reasoning? What does the Rama’s gloss say?
  6. What is the difference between a מנהג חשוב and a מנהג גרוע, and who contests that division?
  7. Seif 2 releases one who settles elsewhere. Why does the Shach write תימה, and what does he conclude?
  8. Is a son bound by his father’s practices? Cite the entry that answers, and its reservation.
