1. נדר ושבועה — why the one passes and the other does not

The foundation of the siman lies in one sentence of the Taz: the vow forbids the object, the oath binds the person. One cannot bind oneself where the Torah has already bound; one can, however, make an object forbidden, and one does not feed a man what is forbidden to him.

The Gemara grounds it in the verse. One does not swear to transgress mitzvot — לא יחל דברו — but one may profane his word for the things of Heaven.

The Rambam makes this one of the four differences between vow and oath, and the Shakh recalls it in his first word on the siman: it is the vow that is spoken of, and it alone.

An immediate practical consequence: faced with an undertaking against a mitzva, the first question is not “how serious is it?” but “was it a vow or an oath?”. The Shakh refers for this to siman 239, where oaths are treated.

If the vow forbids the object, why would it not suffice to forbid the benefit of the sukkah? The question is the sharper since the seif’s formula — קונם סוכה שאני יושב — names the sitting, not the bare object.
The answer is a Talmudic axiom: What is done out of obligation is not, in law, a benefit. One who forbids himself the benefit of the sukkah has forbidden nothing of what belongs to the mitzva. The Ba’h extends the reasoning to the shofar from Ora’h Ḥayim 586.
The nafka mina is precisely a question of wording, and that is what makes this siman formidable in practice: two sentences the speaker thinks equivalent — one produces a prohibition, the other nothing.

3. דבר שאין בו ממש — the mitzva is an act, not a thing

Siman 213 lays down that a vow does not take on a thing without substance. But “sitting in the sukkah” is an act, not an object. How, then, can the vow of seif 1 take effect?
The Shakh answers in the name of the Ran, himself in the name of Tosafot: the formula names the forbidden object. It does not say “that I shall not sit”, it says “the sukkah in which I sit”. The word סוכה is the grammatical subject of the prohibition; the sitting is only its determination.

The Mishna, just before this passage, gives the contrast: קונם שאיני ישן — and there no object is named.

The ḥakira here: does the vow bear on the named object, or on the relation between the man and the object? If on the object, the Ran’s answer is complete. If on the relation, it remains to explain why naming the object suffices — and that is what leaves siman 213 an open matter.

4. מלקות בנדר שוא — the penalty, and what remains of it

The dispute. For the Mordechai in Rabbenu Ḥananel’s name, one who vowed against a mitzva is flogged. For the Mordechai in the name of the Raavia, the Ran and the Rosh, he is not: flogging for שוא applies only to an oath. The Rama rules וכן עיקר.
The Shakh notes that the Mordechai contradicts himself: he reports in the Raavia’s name that there is no flogging for a vow, and then reports that the same Raavia ordered a certain Rabbi Israel who had vowed to be flogged.
The Shakh’s resolution is a distinction of rank: biblical flogging is not in force today; what the Raavia ordered was rabbinic disciplinary blows (מכת מרדות), which the Rosh derives from the Yerushalmi. The two reports are thus compatible.

5. נדרים ותענית — two sugyot, three ways to reconcile them

Here is the contradiction, and it carries the whole middle of the siman. In Nedarim: vows take effect on a matter of mitzva. In Taanit, first chapter: one who accepted to fast Mondays and Thursdays all year, and days written in the מגילת תענית fall on them — his vow is void. Both cannot be true in the same sense.

The first way — the Ramban: two formulas

This is the way the Shulchan Arukh takes in seif 3, and the Tur already gives it in the Ramban’s name.

The second way — the Semak: aiming expressly, or falling within

The Taz notes in passing a misidentification by the Beit Yosef: the ספר המצות the Tur cites is the Semak (siman 81), not the Semag — whence the objection the Beit Yosef raises against him, which for the Taz falls of itself.

The third way — the Rambam: what is rabbinic needs reinforcement

The nafka mina is entire. For the Ramban only the formula counts — Ḥanukka is nothing special. For the Semak, express intention changes everything. For the Rambam, it is the rank of the day that decides. The Taz concludes that the halakha retains only the Ramban, and notes at the same time that seif 4 does not follow him.

6. The word אפילו — one word too many, or exactly right?

Seif 3 writes: “and even if he accepted to fast only on Shabbat and Festival”. The Ba’h objects on two counts: first, it should say “all the more so” — an undertaking aimed only at those days has even less substance; second, the Beit Yosef himself, in his larger work, wrote “all the more so”.
The Shakh defends the word. The אפילו is not measured as the Ba’h thinks: it bears on the second part of the case, where the man expressly aimed at Shabbat. Since in vow language express aim makes the prohibition take, one might have thought the same in acceptance language — and that is what the אפילו rules out.
Both answer in the same direction, but the Taz adds a barb: ובחנם כתב מו״ח ז״ל על לשון הש״ע כאן לא דק — in vain did his father-in-law (the Ba’h) write that the Shulchan Arukh “was not precise”. The Ba’er Hetev records objection and answer without deciding.

7. YD 215:4 against OḤ 570 — the longest note of the siman

Seif 4 rules the vow void when Ḥanukka and Purim fall on it — this is the Rambam’s view. But in Ora’h Ḥayim 418 the Mehaber first gives the contrary view, and in Ora’h Ḥayim 570 the Rama writes expressly that the custom is not as he “ruled in Yoreh De’ah siman 215”. The Shulchan Arukh itself flags the difficulty in seif 4, in small type.
The Shakh proposes a distinction of duration, and it is fine. The Sages’ power to annul a vow — that is, to uproot a Torah word by a positive act — is exercised only where there is מיגדר מילתא. Here, in seif 4, the man vowed to fast that weekday all his days: the lapse at Ḥanukka would be perpetual, and the rabbinic institution would be uprooted. In Ora’h Ḥayim the vow covers only a closed period: he would fast once or twice on Ḥanukka, and nothing is uprooted.
The Shakh supports his distinction with an internal proof: seif 3 expressly includes Ḥanukka and Purim among the days that mere acceptance does not override — implying that vow language does override them. But seif 4 says the opposite. The Mehaber would thus contradict himself, unless seif 3 speaks of a vow of finite duration.

The Nekudot HaKesef, on this very point, send the reader of the Taz to the Shakh: there the difficulty finds its answer.

In practice the Shakh’s distinction is a proposal, not a consensus: he himself writes כן נ״ל. The Ba’er Hetev reports it in his name and recalls that the Rama, in Ora’h Ḥayim 570, had not considered it. A real case therefore goes to a Rav.

8. דברים שבלב — the Maharshal’s gloss and the Taz’s measure

The dispute. The Maharshal, cited by the Derisha, holds that a man who vowed to fast a month and says he did not intend the Shabbatot needs no release at all: these are דברים שבלב that, being evident, count as words. The Taz objects that if we rule like the Ramban, vow language requires release in any event.
The Taz does not reject the gloss but narrows it. If the man states that he expressly had in view to fast only on weekdays, he is believed — for that does not contradict his formula, which said “a month” and no more. Seif 2 speaks of one who had not thought of it at all.
A nafka mina of wide practical reach: a declaration of intent is judged not in itself but against the formula used. It counts if it specifies it; it does not if it contradicts it. The Ba’h adds a last notch: for a vow formula, release remains required.

9. A vow on a forbidden thing — seifim 5 and 6 are a dispute

The dispute. Seif 5 says a vow does not take on what the Torah already forbids; seif 6, opened by וי״א, says it does. The Shakh identifies the camps: the first is the Rashba in his responsa (siman 615), the second Rashi, Tosafot and the Tur. The Ba’h prefers the second; the Shakh defends the first.
The Shakh replies on two levels. First on form: giving one view סתם and then a וי״א is the ordinary manner of the Shulchan Arukh everywhere — there is nothing to wonder at. Then on substance: the Ba’h would not have written so had he consulted the Rashba’s responsum, and the Piskei Tosafot in the chapter Shevuot Shtayim go expressly with the Rashba.
Two nafka minot the Shakh draws expressly from the view of seif 6. First: he swore not to eat this loaf, then said קונם ככר זה עלי — he is liable twice. Second: he swore to eat this loaf and then forbade it by קונם — he may not eat it, “because vows take effect on a matter of mitzva and on oaths”.
What is not disputed: one cannot use a thing forbidden by the Torah as an anchor. The Shakh notes it at ס״ק ט״ו — the clause of seif 6 holds for the second view too — and adds at ס״ק ט״ז that in matters of benefit some still require release, as in siman 205.

10. There is no sixth seif — a ו taken for a numeral

Here is one of the Taz’s most striking remarks, and it touches the very structure of the printed text. He maintains that one must read וי״א with a connective ו — “and some say” — which makes it the continuation of seif 5 and not a new seif. Whoever set the text took that ו for the numeral of the sixth seif, and so counted six seifim where there are five.
Three consequences. (1) “Seif 6” is not a new subject but the view contrary to seif 5 — that is how the Shakh reads it at ס״ק י״ב. (2) The count of this siman’s seifim is therefore disputed, and the printed heading — ובו ו׳ סעיפים — reflects the typesetting, not necessarily the structure. (3) We have reconstructed nothing: the source we cite does give six segments, and it is the source we follow; the Taz’s remark is reported as a reading, not as a correction.

11. איסור כולל — how can the nazir example be correct?

Seif 5 gives the example: he swore not to drink, then said “I am hereby a nazir”, and drank — he is liable only once. The Zikhron Yosef objects: nezirut is an איסור כולל, forbidding at one stroke wine, grape-seeds, impurity and cutting the hair. But an encompassing prohibition takes even on what was already forbidden. He should therefore be liable twice.
The Zikhron Yosef’s answer saves the text by narrowing the case: the Shulchan Arukh speaks only by way of example, of a man who, angry, in mourning or drunk, said “I am hereby a nazir from this cup”. Such a nezirut forbids only drinking that cup — Nazir 11 — and there is no איסור כולל.
The force of the remark: it recalls that the Shulchan Arukh’s examples are illustrations, not free-standing rules. One does not build a practical conclusion on the form of an example; that is exactly the kind of reasoning to bring before a Rav.
