  8. Golden rules, mnemonic and classic pitfalls

1. The axiom: the vow forbids the object, the oath binds the person

The axiom. A man cannot bind himself where the Torah has already bound him — hence an oath does not take against a mitzva. But he can make an object forbidden, and the object was not taken. Hence the whole rule:
Three consequences. (1) A vow naming the object of a mitzva holds — one does not override it, one has it released. (2) A vow forbidding only the benefit does not hold: מצות לאו ליהנות נתנו. (3) A vow does not hold on what the Torah already forbids — the object is taken.

2. The three reflex questions

1. Vow or oath? Vow (קונם + the object) — it takes on the mitzva. Oath (שבועה + the act) — it does not; see siman 239.
▼
2. Is the object free? A positive command — free, the vow takes. A Torah prohibition — taken, the vow falls (seif 5); one view says it takes (seif 6). A rabbinic prohibition — free, the vow takes and can serve as an anchor.
▼
3. Which formula for a fast? “קונם the eating of these days” — a vow, release required. “I accept a fast” — nothing took on the days one does not fast, nothing to release.

3. Master table — the six seifim clause by clause

SeifThe clause of the Shulchan ArukhWhat it says
Vows take effect on a matter of mitzva
He said: קונם — the sukkah I sit in, the lulav I take
א« אסור לישב בסוכה וליטול לולב » (שו״ע יו״ד רט״ו:א)he is forbidden to sit in the sukkah and to take the lulav
Gloss: and some say that he would be flogged for having vowed to annul the mitzvot
א« ומתירין לו נדרו ומקיים המצוה (מרדכי ריש שבועות שתים בשם ר״ח » (רמ״א יו״ד רט״ו:א)and his vow is released for him, and he performs the mitzva (Mordechai, beginning of Shevuot Shtayim, in the name of Rabbenu Ḥananel)
א« וי״א דאין מלקות בנדר שוא רק גבי שבועת שוא » (רמ״א יו״ד רט״ו:א)and some say there is no flogging for a vain vow, only for a vain oath
א« מרדכי מצא בשם ראבי״ה ור״ן ורא״ש בנדרים ועב״י סימן רל״ו) וכן עיקר » (רמ״א יו״ד רט״ו:א)(Mordechai, found in the name of Raavia, the Ran and the Rosh in Nedarim, and see Beit Yosef siman 236) — and this is the main [ruling]
He vowed to fast for a known period, and Shabbatot, Festival days and Rashei Ḥodashim fell within it
ב« מתירין לו נדרו ופותחין לו בהם » (שו״ע יו״ד רט״ו:ב)his vow is released for him, and they open [the door] for him with those very days
ב« שאומרים לו אילו שמת על לבך שיפגעו בתוך הזמן הזה אלו הימים לא היית נודר » (שו״ע יו״ד רט״ו:ב)for they say to him: had you borne in mind that these days would fall within this period, you would not have vowed
ב« והותר כל הנדר » (שו״ע יו״ד רט״ו:ב)and the whole vow is released
ג« במה דברים אמורים שצריך התרה כשקבלו בלשון נדר שאמר קונם אכילת ימים כך וכך עלי » (שו״ע יו״ד רט״ו:ג)In what case was it said that release is needed? Where they accepted it in the language of a vow, saying: קונם the eating of such and such days is upon me
ג« אבל אם לא הוציאו אלא בלשון קבלת תענית אינו דוחה לא שבת ויו״ט וראש חודש ולא חנוכה ופורים ואינו צריך התרה » (שו״ע יו״ד רט״ו:ג)but if he expressed it only in the language of accepting a fast, it overrides neither Shabbat nor Festival nor Rosh Ḥodesh, nor Ḥanukka and Purim — and he needs no release
ג« ואפי׳ לא קבל עליו להתענות אלא בשבת ויום טוב בלבד » (שו״ע יו״ד רט״ו:ג)and even if he accepted upon himself to fast on Shabbat and Festival only
ג« ועיין בא״ח סימן תי״ח » (שו״ע יו״ד רט״ו:ג)(and see Ora’h Ḥayim siman 418)
One who accepts upon himself, in the language of a vow, to fast on Shabbat and Festival — the vow takes effect
ד« וכן הנודר לצום יום ראשון או ב׳ כל ימיו ופגע בהם יו״ט או ערב יום כפור חייב לצום ואין צריך לומר ר״ח » (שו״ע יו״ד רט״ו:ד)and likewise one who vows to fast on Sunday, or Monday, all his days, and a Festival or the eve of Yom Kippur falls on them: he must fast — and needless to say, Rosh Ḥodesh
ד« אבל אם פגע בהם חנוכה ופורים נדרו בטל » (שו״ע יו״ד רט״ו:ד)but if Ḥanukka and Purim fall on them, his vow is void
ד« ועיין בא״ח סי׳ תק״ע דלא פסק כן » (שו״ע יו״ד רט״ו:ד)(and see Ora’h Ḥayim siman 570, which did not rule so)
That vows take effect on a matter of mitzva — that is specifically in a positive command
ה« בין שיש בה עשה גרידא בין שיש עשה בקיומה ולא תעשה בביטולה » (שו״ע יו״ד רט״ו:ה)whether it contains a bare positive command, or a positive in its fulfilment and a prohibition in its annulment
ה« ואין הפרש בזה בין איסור הבא מאליו לאיסור הבא ע״י עצמו » (שו״ע יו״ד רט״ו:ה)and there is no difference in this between a prohibition that comes of itself and one he brought upon himself
ה« אבל על מצות לא תעשה דעלמא אינו חל בין בביטולו בין בקיומו » (שו״ע יו״ד רט״ו:ה)but on an ordinary prohibition it does not take effect — neither in annulling it nor in fulfilling it
He said: eating נבילה is upon me — the vow does not take effect upon him
ה« והוא הדין לאיסור הבא ע״י עצמו כגון שאמר שבועה שלא אוכל ככר זה וחזר ואמר ככר זה עלי אינו חייב אלא אחת דהיינו משום בל יחל דשבועה » (שו״ע יו״ד רט״ו:ה)and the same for a prohibition he brought upon himself: e.g. he said “an oath that I shall not eat this loaf”, then went back and said “this loaf is upon me” — he is liable only once, namely for בל יחל of the oath
ה« וכן אם אמר שבועה שלא אשתה וחזר ואמר הריני נזיר ושתה אינו חייב אלא אחת דהיינו בל יחל דשבועה אבל דנזירות לא » (שו״ע יו״ד רט״ו:ה)and likewise if he said “an oath that I shall not drink”, then said “I am hereby a nazir”, and drank: he is liable only once, for בל יחל of the oath — but not for the nezirut
ה« אא״כ נשאל על השבועה שאז חל הנזירות עליו » (שו״ע יו״ד רט״ו:ה)unless he is released from the oath — for then the nezirut takes effect upon him
ה« והנדר חל על מי שנשבע שיישן או שישתה ואע״פ שיש בביטולו לא תעשה » (שו״ע יו״ד רט״ו:ה)and the vow does take effect on one who swore that he would sleep or that he would drink — even though its annulment involves a prohibition
ו« וי״א שאם נדר מדברים האסורים כגון נבילות וטריפות חל הנדר ואם אוכל מהם עובר בלא יחל » (שו״ע יו״ד רט״ו:ו)And some say that if he vowed [to abstain] from forbidden things — such as נבילות and טריפות — the vow takes effect, and if he eats them he transgresses בל יחל
ו« אבל אם התפיס בהם דבר אחר אינו נתפס שאינו דעתו אלא בעיקר האיסור דהוי ליה מתפיס בדבר האסור » (שו״ע יו״ד רט״ו:ו)but if he attached another thing to them, it is not caught — for his intent is only the original prohibition, since he is “one who attaches to a forbidden thing”
ו« אבל דבר שאסור מדרבנן ואסרו עליו בלשון נדר והתפיס בו דבר אחר נתפס בנדר ואסור » (שו״ע יו״ד רט״ו:ו)but a thing forbidden by rabbinic law, which he forbade upon himself in the language of a vow and to which he attached another thing — that one is caught by the vow and forbidden
ו« הגה הנודר או הנשבע שלא לאכול מצה בליל פסח אין מצה עשירה בכלל » (רמ״א יו״ד רט״ו:ו)Gloss: one who vows or swears not to eat מצה on the night of Pesa’h — מצה עשירה is not included
(ריב״ש מביאו ב״י ס״ס רל״ו » (רמ״א יו״ד רט״ו:ו)but if he vowed not to eat מצה all year, it is possible that מצה עשירה is included (Rivash, brought by the Beit Yosef at the end of siman 236)

4. The two formulas — the decisive grid

What was saidDoes the vow take?Source
קונם the sukkah I sit inYes — forbidden to sit in itשו״ע יו״ד רט״ו:א
הנאת סוכה עלי — the benefit of the sukkahNo — he may sit in itש״ך יו״ד רט״ו ס״ק ב
An oath not to perform the mitzvaNo — see siman 239
קונם the eating of such days (a fast)Yes — release requiredשו״ע יו״ד רט״ו:ג
“I accept a fast” (Shabbat, Festival, Rosh Ḥodesh, Ḥanukka, Purim)No — and no release
A vow to fast that weekday all his days — and Ḥanukka falls on itThe seif: void — but Ora’h Ḥayim 570 does not so rule
Seif 5: no — seif 6: yes.
Attaching another thing to that נבילהNo — מתפיס בדבר האסור, on both viewsשו״ע יו״ד רט״ו:ו · ש״ך ס״ק ט״ו
Attaching to a rabbinically forbidden thing vowed in vow languageYes — caught and forbidden

5. The vowed fast — what to do, day by day

The day that falls withinIn vow languageIn acceptance language
Shabbat, FestivalThe vow takes; it is released, the door being the honour of the day (seif 2)Does not take, no release (seif 3)
Rosh ḤodeshThe vow takes — ואין צריך לומר ר״ח (seif 4)Does not take (seif 3)
The eve of Yom KippurThe vow takes, he must fast (seif 4)Not expressly treated by seif 3
Ḥanukka, PurimSeif 4: נדרו בטל — but Ora’h Ḥayim 570 does not so rule. An open disputeDoes not take (seif 3)
The month of Nissan and days without taḥanunThe Shakh: treated as rabbinically forbidden days, and release is still requiredThe Ba’h: nothing to release
« שמותר בכל הימים דנדר שהותר מקצתו הותר כולו » (ש״ך יו״ד רט״ו ס״ק ו)
« מפני שהם מדבריהם וצריכין חיזוק » (ש״ך יו״ד רט״ו ס״ק י)
Pitfall. The Ḥanukka and Purim line is the only one in the table where the Shulchan Arukh knows itself to be at odds with itself — it says so in the seif. Never treat it as settled.

6. The open disputes among the commentaries

The questionThe two voicesWhere
Flogging for a vain vow?Rabbenu Ḥananel: yes · Raavia, Ran, Rosh: no — and the Rama rules no. The Shakh maintains
Is the word אפילו in seif 3 right?Ba’h: it should read “all the more so” · Shakh and Taz: the word is exactש״ך ס״ק ח · ט״ז ס״ק ד · באר היטב ס״ק ה
Ḥanukka and Purim: is the vow void?Seif 4 (Rambam): void · Ora’h Ḥayim 418 and 570: no. The Shakh distinguishes perpetual from fixed-term — but writes
Does his statement “I did not intend them” exempt him?Maharshal, via the Derisha: דברים שבלב מוכחים, nothing to release · Taz and Ba’h: in vow language, release is requiredט״ז ס״ק ד · באר היטב ס״ק ז
Does a vow take on a Torah prohibition?Rashba (seif 5): no · Rashi, Tosafot, Tur (seif 6): yes. Ba’h for the second, Shakh for the first, Ran for the second
Is there a sixth seif? The Taz: no — the ו of וי״א was taken for the numeral. The printed source nonetheless gives sixט״ז ס״ק ז

7. The vocabulary of the siman

TermMeaning
נדרA vow — it forbids a thing, like an offering
An oath — it binds the person to an act
קונםThe word of the vow: “this is to me as an offering”
Mitzvot were not given for enjoyment — hence the outcome of ס״ק ב
A thing without substance — siman 213; set aside here because the object is named
פתחThe door the sage opens to release, here the honour of the day
Released in part, released in whole — ס״ק ו
What needs reinforcement: Ḥanukka and Purim — ס״ק י
To make a fence — the condition of the power to annul, per ס״ק י״א
מכת מרדותRabbinic disciplinary blows, distinct from flogging — ס״ק ה
A prohibition from the Torah · one made for oneself by an oath
Attaching to a forbidden thing — of no effect, on both views
An encompassing prohibition, taking even on what was forbidden — the Pit’hei Teshuva’s difficulty
Matza kneaded with juice, outside the mitzva of the night — the Rama’s closing gloss

8. Golden rules, mnemonic and classic pitfalls

The word, the object, the day. The word used tells whether it is a vow. The object named tells whether the vow has anything to bite on. The day tells whether the Sages shielded it.
Golden rules. (1) A vow against a mitzva is not void: it is released. (2) What is already forbidden cannot be vowed — and cannot serve as an anchor. (3) What is forbidden only rabbinically remains available. (4) The formula decides before the intention. (5) The Shakh, at ס״ק ט, writes that it is right to compel one who vowed to seek release rather than let him transgress the mitzva.
« מיהו יש להתיר כמ״ש בס״ק ד׳. לקמן סימן רל״ט ס״ק י״ט כתבתי דאע״ג דחל הנדר ראוי לכופו שישאל על נדרו ולא יעבור על המצוה » (ש״ך יו״ד רט״ו ס״ק ט)
Classic pitfalls. (1) Thinking the vow “does not count” because it aims at a mitzva — it counts, and must be released. (2) Confusing “forbidding the sukkah” with “forbidding the benefit of the sukkah”. (3) Treating the Ḥanukka line as settled. (4) Taking for an obligatory fast what was only an acceptance. (5) Relying on a declaration of intent that contradicts the formula used.
All the above is a study summary. Actual conduct — whether what was said constitutes a vow, what form of release suits, and what to do where the Shulchan Arukh differs from itself — belongs to the Rav.
