1. הולכין אחר הלשון — the rule that governs the siman, and its division

The whole siman reduces to one sentence of the Tur, and that sentence has two branches. Where the language used is the Torah’s, one follows what the word conveys of itself. Where it is men’s, one follows local and contemporary usage and the vower’s intention. Our siman develops the first; siman 217 will develop the second.
The ḥakira to pose at once: are the two branches two rules, one applying according to the nature of the term used — or one rule in two applications, usage always prevailing and “the language of the Torah” being merely usage in default of another? The Rambam, at the head of his chapter 9, writes בנדרים הלך אחר לשון בני אדם without dividing — which inclines to the second reading.
The nafka mina is not theoretical. The Shakh, at ס״ק כ״ב, reports precisely this objection of the Rabbi Eliya Mizrahi against the reading rule for “so-and-so and so-and-so”: דבנדרים הלך אחר לשון בני אדם — in vows the exegetical rule yields to usage. It is the same question, reposed at the foot of the siman.

2. חילופיהן — forbidden to whom, exactly?

The dispute. The Rosh, in the chapter “one who vows from vegetables”, narrows: the exchanges are forbidden only to the one who exchanged; to a third party they are permitted, and if a third party exchanged them they are permitted to the vower. The Ran forbids in every case, treating designated fruits as הקדש. Tosafot, in the chapter “the partners”, follow the Rosh.
The ḥakira is clean. For the Ran, designation works a change in the thing’s status: the fruits have become something like a consecration, and what is taken from them bears that mark objectively. For the Rosh, designation creates only an extended personal prohibition: it touches only the one who contracted it, and by his own act of exchange.
Three nafka minot: an exchange made by a third party; a third party’s use of an exchange made by the vower; and, further on, the case of seif 2 where the vow is imposed on another — for if the prohibition is objective it follows the thing even where the one bound cannot release it. The Ran is moreover the voice the Mehaber follows here, as the Shakh notes.

3. גידולי גידולין in the first clause — a clause the Ba’h would erase

The Ba’h holds that the Rambam, the Rosh and the Tur forbid growths of growths only in seif 2 — in the formula “what I eat of them” — and not in seif 1, והכי נקטינן. The Mehaber, on his view, has thus extended a rule beyond its sources.
The Shakh answers on textual ground. That these Rishonim wrote it in the latter clause proves nothing: the Ran explains that the Mishna of the latter clause bears on the former too. The Kesef Mishneh so reads the Rambam, the Derisha so the Tur, and the Mishna as the Rosh gives it has the same structure.
The Taz reaches the same conclusion by quite another road: a קל וחומר. In seif 2 the formula is lenient — it permits exchanges and growths where the seed perishes — and yet it forbids growths of growths where the seed persists. In seif 1 the formula is stringent — it forbids exchanges and growths even where the seed perishes. All the more will it forbid growths of growths where the seed persists.

4. חילופי חילופין — a reading of the Rosh, and a copyist’s error

The Taz notes that the Rosh, in his rulings on the chapter “one who vows from vegetables”, writes expressly that even the exchanges of exchanges are forbidden — against the Ran whom the Beit Yosef reports, and against the seif.
The Nekudot HaKesef answer without softening: שגג בזה. The Gemara in the chapter “the partners” (Nedarim 46b) shows plainly that exchanges of exchanges are permitted, and the Rosh himself says so at the end of the chapter “one who betroths”. What stands in the rulings is a copyist’s error: he was copying the Mishna, and the Mishna does not read so.
The decisive argument is literary, and deserves admiration: had the Rosh really held that exchanges of exchanges are forbidden, he would not have interrupted his list with the growths — he would have written “forbidden in their exchanges, and in the exchanges of their exchanges, and in their growths”. The word order betrays the copying.

5. דבר שיש לו מתירין — the prohibition that does not dilute

The difficulty is the Rambam’s own, and it is stated outright: why is the forbidden original not nullified in the growths that have exceeded it in quantity? A small amount of prohibition is normally lost in a large amount of permitted matter.
The answer is Rabbi Abba’s in the Gemara, and it is of general reach: a vow can always be released, so it is a דבר שיש לו מתירין — a thing that has means of being permitted — and such a thing is not nullified in a majority of its own kind. Seif 10 will make this an explicit rule.
The Pit’hei Teshuva, at ס״ק א, turns this argument against seif 2 itself. R. Shmuel Eiger, son of R. Akiva Eiger, objects: the ground of דבר שיש לו מתירין presupposes that the one bound can release. But when the vow is imposed on a third party, that party has no such power — דאין ביד פלוני להתיר — and the growths ought therefore to be nullified.
The objection is the stronger for meeting the ḥakira of section 2: if the prohibition on exchanges rests on a change in the thing’s status, as the Ran holds, the question of the power to release does not arise. If one reasons, as here, in terms of nullification in a majority, it arises fully. The Pit’hei Teshuva does not decide and refers to the Brit Avraham.

6. So-and-so’s fruits, not figs — designating is not naming

The Rama’s gloss on seif 1 extends designation to owner and place. The Shakh, at ס״ק ד, at once sets the bound in the Ran’s name: “so-and-so’s fruits” designates, “figs” does not. And he gives the reason — one who forbids himself a whole species לא עשאם עליו כהקדש; his intent was only to abstain from eating of that species.
The Shakh concludes כן הוא בר״ן ודלא כהעט״ז: the Levush held otherwise. The Ba’er Hetev, at ס״ק ד, reproduces the Shakh’s note as it stands, including the rejection of the Levush.
The Taz, at ס״ק ג, brings a substantive refinement drawn from the Ran himself, cutting the distinction in two: saying “olives and grapes are קונם to me” does not forbid exchanges, but does forbid the growths, since the growths are themselves fruits of that species. The Ran, writing “neither exchanges nor growths”, spoke שלא בדקדוק.

7. On so-and-so — can one forbid another what does not yet exist?

The Taz sets out the Gemara’s question in both its terms. On one side: can one make forbidden to another a thing that has not yet come into the world, when one cannot even forbid him the fruits that are already his? On the other: exchanges and growths are all one — whether for oneself or for another. The Gemara does not decide; the siman goes stringently.
It is precisely on these words of the Shakh — בכל אופן שנתבאר — that the objection reported by the Pit’hei Teshuva bears. For one of the cases “set out” is that where, the seed perishing, growths of growths are permitted but the growths themselves forbidden; and that last prohibition rests only on the ground of דבר שיש לו מתירין, inapplicable when it is another who is bound.
The Pit’hei Teshuva does not decide: he refers to the Brit Avraham and the Bnei Ahuva, and closes with ודו״ק. The question remains open, and it is directly applicable: an undertaking made for another is not modelled on one made for oneself.

8. Two languages — when one formula contains two

The Taz poses the difficulty with great clarity. In “what I eat of your handiwork”, ממעשה ידיך counts as designation — that is exactly why the first half of the seif forbids exchanges and growths. And שאני טועם pulls toward permission. Two languages that contradict: why not go stringently, as the Tur does in seif 6 for “this house of yours”?
For the Ran there is no difficulty: he holds that the last term prevails, leniently as stringently, and he indeed arranged the two halves in the order that yields this result. But for the Tur, who goes stringently in seif 6, the difficulty stands.
The Taz’s answer for the Tur is very fine, and it changes the nature of the problem. There are “two contradictory languages” only where each could stand without the other: “this house” is said without “of yours”, and conversely. But one cannot say “what I eat” without saying of what, nor “of your handiwork” without saying what one does with it. The two terms do not compete: they complete each other, and the verb remains the principal term.
The nafka mina is methodological and holds for the whole siman: the stringency rule of seif 6 applies only to formulas whose two terms are separable. A formula whose terms are grammatically interdependent is not ambiguous but complex, and one of its terms is principal.

9. This house of yours — when the two terms really are separable

Here is the true ambiguity, where each of the two terms would stand alone. לביתך follows ownership: sold, it leaves; rebuilt, it stays. זה follows the stones: sold, it stays; rebuilt, it leaves. The two cross exactly.
Three positions. The Mehaber first: we do not know which prevails, so both stringencies are kept. The first יש מי: the first term governs, the house leaves on sale and stays after rebuilding. The second יש מי: the last term governs, and the reverse. The Taz, at ס״ק ט, presents them in one movement.
The Shakh applies this doubt in the opposite direction at seif 8 and wonders: why is “my loaf” permitted there without reserve, when the doubt of seif 6 ought to operate? He concludes וצ״ע. That is the link the next section examines.

10. בחיי ובמותי — why the specification is required, and for what it is not

The Tur requires, for the prohibition to survive, that one specified “in my life and after my death”. The Beit Yosef wonders: if he did not specify, then even “this house” would be permitted per the Rosh; and if he did, why does the end of the passage permit?
The Taz’s answer is psychological, and that is what makes it remarkable. Why must one add “and after my death” even having said “this house”? Because a man ordinarily does not set his mind on forbidding his house after his death: what concerns him is not to see his enemy in his house during his life. The demonstrative therefore does not suffice to carry the prohibition past death.
Hence the Taz draws a distinction the Beit Yosef had not considered: the specification is required only for death, not for sale. For as to sale, the same reason — not to see his enemy enjoying this house — holds fully, and “this house” suffices. Besides, what would “in my life” mend as to a sale? He should have said “whether it be in my hand or another’s”.
The Taz concludes that all this is for understanding the Tur, but that the halakha is already settled: the Shulchan Arukh does not require the specification here, and “this house” forbids even after death or sale — דכיון דאמר זה אסרו לעולם. The Shakh confirms it at ס״ק י״ח.

11. ככרי — one word, and the whole of seif 8 turns

The Shakh wonders at seif 8: why write without reserve that the loaf is permitted? On the view of seif 6 that doubts which term prevails it should be forbidden; and all the more on the view that takes the last term. He proposes an escape — here the vower speaks to a third party — rejects it from a reading of the Beit Yosef, and concludes וצ״ע.
The Taz unties it with a textual reading, and the knot falls at once. The Beit Yosef found in his copy of the Tur ככרי זו; but the older Turim have only ככרי, without the demonstrative, and so too the Rosh in his commentary on Nedarim. And it is precisely the absence of the demonstrative that explains the permission — otherwise the case would be that of seif 7.
The Ba’er Hetev, at ס״ק ט״ז, reports both — the Shakh’s wonder and the Taz’s reading — without deciding. For study the lesson is twofold: a halakhic difficulty may be no more than a textual variant; and the printed Shulchan Arukh does read ככרי זו, which we copy and do not correct.

12. פלוני ופלוני — does “and” mean “together”?

The Rama’s gloss lays down the rule: wherever “so-and-so and so-and-so” is said, it means even one of them, unless Scripture specifies “together”. The Taz gives its source: Rabbi Yonatan, in the chapter “the borrower”, on “his father and his mother he cursed” — meaning both at once and each separately, until Scripture specifies יחדיו, as it does for the ox and the ass.
The challenge. The Rabbi Eliya Mizrahi holds that this exegetical dispute does not apply here: in vows one follows the language of men, and usage shows that one who accepts two judges does not mean that one may judge alone. The Shakh reports the objection without deciding.
The Pit’hei Teshuva, at ס״ק ב, adds the decisive restriction in R. Akiva Eiger’s name: where the rule serves to relieve — one who swore not to do this and that, or not to eat this and that — one does not rely on the Rabbi Eliya Mizrahi to be lenient, and it is forbidden even for one of the two.
This last restriction closes the siman on its opening question: the exegetical rule of “the language of the Torah” applies only in default of a contrary usage, and never to relieve against it. One may read the whole siman as a progressive demonstration of this point.
