DAAT · LEVEL 3 — SYNTHESIS

Siman 217 — Synthesis: forty-eight seifim arranged by mechanism

Revision: seven mechanisms, a master table in the order of the book, and the pitfalls
יורה דעה · סימן רי״ז
כיצד הולכין בנדרים אחר לשון בני אדם
✦ ❖ ✦

A siman of forty-eight seifim is not revised by reciting them. This synthesis arranges them by mechanism — seven families of reasoning that recur from beginning to end — then restores them, in chapter 8, to the exact order of the Shulchan Arukh, clause by clause, so that a seif can be found. Chapters 9 to 12 give the open disputes, the vocabulary, the golden rules and the pitfalls.

  12. Golden rules, mnemonic and classic pitfalls

1. The axiom: place, tongue, period

The axiom. The Tur opens siman 216 with the general rule: all vows follow the language. Siman 216 develops the branch of לשון תורה; this one develops that of לשון בני אדם, and states it in three cumulative conditions, given in the opening line: that place, that tongue, that period.
« נדר או נשבע מהמבושל אם דרך אותו מקום באותו לשון ובאותו זמן שקוראין מבושל » (שו״ע יו״ד רי״ז:א)
1. The place — אותו מקום. The same word does not have the same reach from one town to another: at seif 8, “meat” covers fish where the agent consults, and not elsewhere.
▼
2. The tongue — אותו לשון. A biblical word spoken in the vernacular does not keep its biblical reach: seif 16, תירוש.
▼
3. The period — אותו זמן. The Chakh at ס״ק ט״ו and the Taz at ס״ק ט themselves date two of the siman’s rules: nowadays it is otherwise.
▼
And failing all three — if there is no language of men, the Chakh at ס״ק א, in the name of Rabbenu Yeruham: follow the tongue of the Torah.

2. Mechanism A — what the word names in usage, and how one measures it

The principle. One does not ask the word what it means; one asks people what they call by that name. And the siman supplies an observable measuring instrument: the question the agent asks.
« שכל דבר שהשליח נמלך עליו הוא בכלל המין ההוא » (שו״ע יו״ד רי״ז:ד)
The applications. Seif 1: the cooked, the smoked, the fried, the waters of Tiberias. Seif 3: the salted, the pickled. Seif 8: meat and fish. Seif 17: oil, according to what one supplies oneself with. Seif 24: “summer” means figs. Seif 29: the city stops at seventy cubits. Seif 37: “the black-headed” means men. Seif 47: “the festivals” may include Hanukkah and Purim.
The bound. Not everything depends on usage. The Chakh, at ס״ק א, lays down that what is over-cooked is included in “cooked” in every place; seif 8 lists what is “meat” in every place; seif 27 excludes sacking from “clothing” without condition. Usage decides in the interval those cores leave, not everywhere.

3. Mechanism B — the foods and their preparations

The principle. To name a dish takes what people mean by it; to name a vessel takes everything that passes through it; to name an act of cooking takes what that act produces. And grammatical number is itself an index of usage.
« נדר מהיורד לתוך התנור אינו אסור אלא בפת » (שו״ע יו״ד רי״ז:ב)
« ואם אמר כל מעשה תנור עלי אסור בכל הנעשה בתנור » (שו״ע יו״ד רי״ז:ב)
The three formulas of vegetable (seif 4), from narrowest to widest: ירק — what is eaten raw; ירקי קדירה — with the pickled; ירק המתבשל בקדרה — with the gourds. The Taz, at ס״ק ג, contests the second and gives a different division.
Grammatical number (seifim 20 and 21), and it cannot be deduced. For wheat, the singular aims at the grain — so the vow bears on bread — and the plural at the substance — so it bears on chewing. For groats it is the reverse. Saying both forms takes both states.
« גריס גריסין שאני טועם אסור לאכלם חיים ומבושלים » (שו״ע יו״ד רי״ז:כ״א)

4. Mechanism C — principal and subordinate: what falls in, what does not fall out

The principle, and it is asymmetrical. The subordinate is included in the principal; the principal is not included in the subordinate. One rule, eight applications.
The counter-test. When neither name encompasses the other, the rule becomes symmetrical: seif 45 permits levi’im to one who vows off kohanim and conversely. The asymmetry is therefore not a formal rule but an observation about the content of names. And seif 9 shows the same on a dish: broth and sediment do not take one another.
The pitfall. Seif 7 was printed מותר בגידים in the editions before the Chakh and the Taz, and both declare it false. Sefaria today carries the correction in brackets. Check your edition before citing this seif.

5. Mechanism D — the accompanied name, the change of form, and the by-product

The principle. A qualified word is another name, and the bare word does not reach it. This is the שם לווי of seif 10, and it governs four consecutive seifim.
« מהירק מותר בירקות שדה מפני שהוא שם לווי » (שו״ע יו״ד רי״ז:י)
« הנודר מדבש מותר בדבש תמרים » (שו״ע יו״ד רי״ז:י״ד)
But bearing a name does not suffice either. Seif 13 shows it from the other end: date honey bears the name of dates and remains permitted. The Rama gives two reasons — the form has changed; and the name serves to distinguish, not to attach — and the Taz, at ס״ק י״ז, a third: the food has become a drink.
The reservation the text does not state, and it is the most practical in the siman. Seifim 11, 12 and 13 permit a by-product. The Chakh, at ס״ק י״ח, and the Taz, at ס״ק ט״ז, impose a condition absent from the text: it holds only for what had separated before the vow, and only if the formula neither designated nor named an act.
« היינו דוקא מה שכבר יצא מהם קודם שנדר אבל מה שיצא מהן לאחר שנדר אסור » (ש״ך יו״ד רי״ז ס״ק י״ח)

6. Mechanism E — place, measure and moment

The principle. The spatial and temporal notions of the siman are not taken in their usual halakhic definition: they are taken from ordinary speech. It is here that the siman is most surprising.
« הנודר מהעיר אסור ליכנס לעיבורה דהיינו תוך שבעים אמה ושירים » (שו״ע יו״ד רי״ז:כ״ט)
« שאני הכא בנדרים דהלך אחר לשון בני אדם שאינו אלא תוך שבעים אמה ושירים » (ש״ך יו״ד רי״ז ס״ק ל״ה)
The siman’s measures. The city: seventy cubits and a remainder (seif 29). The house: from the closing of the door inward (seif 30) — and the reverse for one who undertakes to stay in it (seif 31). The dweller: thirty days; the son of the city: twelve months (seif 32) — but the Rama at once overturns this by usage, and the Chakh, at ס״ק ל״ז, reports from the Mabit that six months are required in his day.
The moment. Seif 35 lays down a rule that holds for the whole tractate: when a vow names a category and takes effect later, the category is fixed at the moment of speech. The Chakh, at ס״ק ל״ט, extends it to all similar cases and refers to siman 234.
« מי שאינו מיורדי הים בשעת הנדר מותר בו אע״פ שלאחר ל׳ יום כשחל הנדר הוא מיורדי הים » (שו״ע יו״ד רי״ז:ל״ה)

7. Mechanism F — categories of persons

The principle. Fourteen seifim, from 33 to 46, and one rule: an appellation of persons is read neither by genealogy, nor by physical description, nor by the act performed alone. It is read as people say it — and what they say follows sometimes one of these criteria and sometimes another.
The four criteria, and one must see that they take turns. Obligation: seif 38, the Kutim are “those who rest on Shabbat” because they are commanded in it. The act: seif 39, they are not “those who go up to Jerusalem” because they do not go up, though commanded. Belonging: seifim 41 and 42, “the uncircumcised” names the nations and “the circumcised” Israel, whatever the bodily state. Pure usage: seif 37, “the black-headed” names men, the bald included.
« נדר מהערלים אסור במולי אומות העולם ומותר בערלי ישראל » (שו״ע יו״ד רי״ז:מ״א)
The pitfall. “Israel” here does not mean what it means in terumah or in marriage: at seif 44 it includes kohanim and levi’im. The Chakh says as much of the word “city” at ס״ק ל״ה, and the remark holds for this whole block: a word does not have the same extent from one tractate to another.

8. Mechanism G — when language does not suffice: doubt, intention, the impossible vow

Three exits, and the siman uses all three.
1. Doubt — when usage is divided (seif 3) or double (seif 17), or when the source itself hesitates (seif 6): ספק נדרים להחמיר. And the majority avails nothing.
▼
2. Intention — when circumstances show it (seif 8), or when the one who vows declares it (seif 47): it retracts the prohibition. The Chakh, at ס״ק ג, admits it even against divided usage. But seif 36 sets the limit: הואיל והלשון ודאי כך הוא.
▼
3. Impossibility — when the vow cannot be kept (seifim 19 and 22, per the Chakh at ס״ק כ״ט and ל״א): there is no vow at all, and one is referred to siman 232.
« ומיירי שלא אסר אלא לזמן שיוכל לעמוד בו דאל״כ הוי כנודר מכל פירות שבעולם דאינו נדר כלל » (ש״ך יו״ד רי״ז ס״ק כ״ט)
And the last word. The siman’s final seif hands the sequel over to intention, and refers by name to siman 218: וכדרך שיתבאר בסימן רי״ח. The Pit’hei Teshuva, at ס״ק ט״ו, at once puts up the railing in the name of the Veshav HaKohen: intention serves only to narrow.

9. Master table — the forty-eight seifim in the order of the book

The seven preceding sections arrange the material by mechanism; this one restores it to the order of the Shulchan Arukh, clause by clause, so that a seif can be found.

SeifThe clause of the Shulchan ArukhWhat it says
א« דין הנודר מהמבושל מהמליח ממעשה קדירה ודומיהם וכיצד הולכין בנדרים אחר לשון בני אדם. ובו מ״ח סעיפים » (שו״ע יו״ד רי״ז:א)The laws of one who vows [to abstain] from the cooked, from the salted, from pot-work and the like, and how in vows one follows the language of men. And it contains forty-eight seifim:
א« נדר או נשבע מהמבושל אם דרך אותו מקום באותו לשון ובאותו זמן שקוראין מבושל אפי׳ לצלי ולשלוק הרי זה אסור בכל » (שו״ע יו״ד רי״ז:א)He vowed or swore off “the cooked”: if the usage of that place, in that tongue and at that time, is to call “cooked” even what is roasted and what is boiled down, he is forbidden in all of them.
א« ואם אין דרכם לקרות מבושל אלא לבשר שנתבשל במים ובתבלין הרי זה מותר בצלי ובשלוק » (שו״ע יו״ד רי״ז:א)And if their usage is to call “cooked” only meat cooked in water and spices, he is permitted in the roasted and in what is boiled down.
א« וכן המעושן והמטוגן והמבושל בחמי טבריא וכיוצא בהם הולכים בו אחר הלשון של בני העיר » (שו״ע יו״ד רי״ז:א)And likewise the smoked, the fried, and what is cooked in the hot springs of Tiberias and the like: in this one follows the language of the townsfolk.
ב« הנודר ממעשה קדירה אינו אסור אלא מדברים שמרתיחים אותם בקדירה כגון ריפות ולביבות וכיוצא בהם » (שו״ע יו״ד רי״ז:ב)One who vows off pot-work is forbidden only in those things that are brought to a boil in a pot, such as crushed groats and fritters and the like.

ג« ואם אין דרכם לקרות מליח אלא לדג מליח בלבד אינו אסור אלא בדג מליח » (שו״ע יו״ד רי״ז:ג)And if their usage is to call “salted” only salted fish, he is forbidden only in salted fish.

ג« נדר או נשבע מן הכבוש אם דרכם לקרות כבוש לכל הכבושים הרי זה אסור בכל » (שו״ע יו״ד רי״ז:ג)He vowed or swore off the pickled: if their usage is to call “pickled” all pickled things, he is forbidden in all of them.
ג« ואם אין דרכם לקרות כבוש אלא לירק כבוש בלבד אינו אסור אלא בכבוש של ירק » (שו״ע יו״ד רי״ז:ג)And if their usage is to call “pickled” only pickled vegetable, he is forbidden only in pickled vegetable.
ג« וכן כל כיוצא בזה » (שו״ע יו״ד רי״ז:ג)And likewise everything similar to this.
ג« היו מקצת בני המקום קורין לו כך ומקצתן אין קורין » (שו״ע יו״ד רי״ז:ג)Some of the people of the place called it so and some did not call it so:
ג« אין הולכין אחר הרוב אלא הרי זה ספק נדרים וכל ספק נדרים להחמיר » (שו״ע יו״ד רי״ז:ג)one does not follow the majority; rather it is a doubt in vows, and every doubt in vows [is resolved] stringently.

10. The open disputes of the apparatus

ירקי קדירה (seif 4)

The Maharshal and the Ba’h: forbidden raw, pickled and cooked. The Chakh, at ס״ק ו: forbidden in vegetables eaten only pickled, cooked included. The Taz, at ס״ק ג: forbidden raw and pickled, permitted cooked. The Nekudot HaKesef, at their first entry, defend the Chakh against the Taz. The Baer Hetev, at ס״ק ד, reports both without deciding.

קומא דחלבא (seif 11)

The Ran, reported by the Beit Yossef, makes the gloss work both ways. The Beit Yossef himself rejected it; the Tur, Rashi and most poskim say the contrary. The Chakh, at ס״ק י״ז, restricts it to one direction: it holds only for one who vows off milk.

קונדיטון (seif 15)

The Mehaber permits, then reports without deciding: ויש מי שאוסר. The Taz, at ס״ק כ, sets out the reason of the permitting view in the name of the Ran. The Chakh, at ס״ק כ״ג, discusses only the definition of the word.

פת חטים ושעורים (seif 20)

The Ran: the word “bread” governs the whole list, and only the bread of each cereal is forbidden. Others are more stringent and forbid barley and spelt entirely — unless intention is declared or local usage is established. The Rama reports both.

גידולי קרקע (seif 23)

The Ba’h: “growths of the ground” takes kids and lambs too. The Taz, at ס״ק כ״ט: no, for in the language of men they are not so called. The Baer Hetev, at ס״ק י״ט, reports the Taz.

רואי החמה ורואים החמה (seif 36)

The Mehaber follows the Tur and distinguishes. The Taz, at ס״ק ל, and the Ba’h, reported by the Chakh at ס״ק מ״א, do not. The Baer Hetev, at ס״ק כ״ו, decides for practice: one does not rely on this permission.

פקדון ומשכון (seif 48)

The Maharil forbids lending on a pledge to one who vowed not to receive a deposit. The Chakh, at ס״ק מ״ה, refuses the proof — I do not know what proof this is — and concludes, with the Rama, that one follows intention. The Pit’hei Teshuva, at ס״ק ט״ו, bounds that conclusion.

11. The vocabulary of the siman

מונחMeaning
לשון בני אדםthe language of men — the spoken usage of a place, a tongue and a period
שליח נמלךthe agent who comes back to consult — the test of usage (seif 4)
ספק נדרים להחמירa doubt in vows is conducted stringently (seifim 3, 6, 17)
שם לוויthe accompanied name — a qualified word is another name (seifim 10, 13, 14)
מעשה קדירהpot-work, as against “what goes down into the pot” (seif 2)
מבושל · צלי · שלוקcooked, roasted, boiled down — and שלוק here means “half-cooked”, against its ordinary sense (Taz ס״ק א)
קיפה · רוטבsediment and broth — two parts of one dish, which do not take one another (seif 9)
עיבורה של עירseventy cubits and a remainder — the city in the language of men (seif 29)
אגףthe line where the door shuts — the boundary of “the house” (seifim 30 and 31)
בתר שעת אמירהwe follow the moment of speech, not that of effect (seif 35)
מראים הדבריםthe manifest circumstances, which retract usage (seif 8)
דין הנודר ונשבע אחד הואthe law of one who vows and one who swears is one (Chakh ס״ק מ״ג, in the name of the Rambam)

12. Golden rules, mnemonic and classic pitfalls

Golden rules. (1) The question is never “what does this word mean?” but “who said it, where, when, in what tongue?”. (2) Divided usage is not settled by majority — it is a doubt, and it goes to stringency. (3) The subordinate enters the principal, never the reverse. (4) A qualified word is another word. (5) A by-product is permitted only if it already existed before the vow. (6) The siman’s measures — seventy cubits, thirty days, twelve months — are those of ordinary speech, not those of other tractates. (7) Part of the siman’s rulings are dated, and two commentators say so expressly.
Place · tongue · period. Three words, and the whole siman fits inside them. What the fourth adds — intention — already belongs to siman 218.
Classic pitfalls. (a) Transposing a ruling of the siman to another town or another century — which is exactly what the siman forbids. (b) Taking “permitted” in a seif as unconditional: three seifim on by-products carry a reservation only the apparatus states. (c) Reading “Israel”, “city”, “שלוק” with the sense they have elsewhere in halakhah. (d) Citing seif 7 from an old edition, where it says the opposite. (e) Trusting the cross-reference in seif 47: the Chakh, at ס״ק מ״ג, corrects it. (f) Forgetting that seif 36 sets aside a declared intention, whereas seif 8 lets it prevail.
Everything above is a study summary. Actual conduct — knowing which words were said, in what tongue, in what place, and what today’s usage makes of them — belongs to the Rav.
