A first approach to Siman 220, twenty-three seifim. Simanim 216 and 217 asked how far a word reaches into matter — which fruits, which meat, which dish. This one asks the same question of time: when a vow begins, when it ends, and what the word used encloses between the two. Two matters follow one another, and the heading names both: the span, from the day to the shemitta; then the vow bearing on דבר שאינו קבוע, that whose time is not fixed. These are rules למעשה: every real case is put to a Rav.

📑 Plan of the study

1. What is this siman about?
2. The seifim, one after another, clause by clause
3. The key concepts
4. Where these seifim come from: the mishna, the gemara, the Rambam, the Tur, the Beit Yosef
5. The apparatus of the siman, cited entry by entry
6. The table of the seifim
7. Practical cases
8. Comprehension questions

1. What is this siman about?

The preceding siman asked what a word carries in matter: “the cooked”, “the salted”, “the pot dish”. This one asks exactly the same question of time. One man says “קונם, the wine I taste today”; another says “one day”. Both spoke of a day. They are not bound for the same span.

The siman’s heading names two matters, and they must be kept apart. The first is the span: חילוק שבין קונם יין להיום או לזמן — the difference between a vow on “today” and a vow on a named period. It occupies seifim 1 to 10, and proceeds by a single opposition repeated on five scales: a demonstrative (“this month”) aims at a terminus, the end of the period under way; a numeral (“one month”) counts a span from the moment of the vow.

The second matter is announced in the heading’s last words: At seifim 11 and 12 it opens a second axis, no longer span but crossing: does the vow stop at the entry of the named terminus, or at its exit? There everything turns on the verbal form — עד or עד שיהיה — except for what has no fixed time. Harvest, summer and rains have no date: then the distinction vanishes and every formula stops at arrival.

The siman in four blocks. Seifim 1–10: the demonstrative and the numeral, from the day to the shemitta. Seifim 11–19: the crossing, and the Seif 20: the language of men, and Shemini Atseret. Seifim 21–23: two words of time in one formula.

2. The seifim, clause by clause

Here are the twenty-three seifim, each first in full — as the source gives it, source parentheses, editorial brackets and Rama glosses included — then broken down clause by clause.

Seif 1 — “today” or “one day”: two words, two durations

The siman opens with the opposition that founds it, and everything else follows. Two formulas the ear cannot tell apart — יום אחד and היום — do not enclose the same span. The first counts twenty-four hours from the moment of the vow; the second ends at nightfall, however near. And because the two resemble each other too closely, the halakha adds a precaution that has nothing to do with the span itself.

קונם — wine that I taste one day, or: קונם — wine that I taste a day [unspecified]: he is forbidden in it from the hour to the hour
Two formulas, one result: יום אחד and bare יום. The Chakh fixes the starting point at ס״ק א — not the morning, but the very hour of the vow. The Rambam is more explicit still: מִשְּׁעַת נִדְרוֹ.
and if he said: קונם — wine that I taste today, he is forbidden only until nightfall, whether he stands at the beginning of the day or at its end
The last clause is the decisive one: whether he stands at the beginning of the day or at its end. The word היום names not a duration but a terminus — the end of this day. One who vows a minute before nightfall is bound for a minute.
and he needs to ask a sage — a decree, lest another time he forbid [wine] upon himself for one day, and not know how to distinguish between “today” and “one day”, and come to drink at night
The whole precaution rests on the resemblance of the two formulas. The Chakh, at ס״ק ג, draws two practical consequences: here the שאלה needs no פתח, and it is only rabbinic — whereas for יום אחד it is de-oraita.
and some say that if it was a vow of a mitzva — such as to study or to perform some mitzva — he needs no release
A first exception to the decree, and a reasonable one: we do not fear a man confusing the spans when what he vowed is a mitzva he has no reason to cut short.
Gloss: however, in a mere acceptance of a fast, it is permitted to eat immediately at night, and no release by a sage is needed
The Chakh gives the reason at ס״ק ד, and it is a fine one: the fast has its measure fixed by the sages themselves, שכבר קבעו לו חכמים זמן — so there is no risk of confusing it with an ordinary vow. The case is a common one.
Seif 1 in a word. יום אחד = twenty-four hours from the moment of the vow. היום = until nightfall, however near. And in that second case a שאלה is required before drinking at night — except for a vow of mitzva, and except for an accepted fast.

Seif 2 — the day named by an event, and the night in between

The seif applies the rule of seif 1 to a formula in which the day is not named but described: “on the day I do such a thing”. The answer is that the description is worth the word היום. Then comes an addition, and it is that addition which teaches something new: when two days are vowed together, the night between them is caught inside.

If he said: “on the day I do such a thing I will not eat” — that day, its law is like “today”, so that he is permitted at night
The Chakh, at ס״ק ה, fills in the missing half: the act must of course have been done on some given day — and then he is permitted at night, but with a שאלה, exactly as in seif 1.
and if he said: “that day and the next” — he is forbidden that day and the next, and the night between them
The Chakh gives the reason at ס״ק ו in five words: דכיון שהתחיל נדרו לא פקע — the vow has begun, it does not lapse in between. And he at once draws the mirror case: one who begins at night is bound for that night, the next day, the following night and the day after. The Taz reports it at ס״ק א in the name of a responsum of the Rosh.
Seif 2 in a word. A described day is worth a named day: “the day I do X” reads as “today”. But once the vow spans two days it does not break at night: what has begun continues.

Seif 3 — “this week”: the Shabbat caught inside, and the floating week

The same opposition as seif 1, carried from a day to a week. שבוע זה names the current week and runs to its end; שבוע אחד counts seven days from hour to hour. Two further points: the Shabbat that closes the week is caught in the prohibition, and — this is the Rama’s gloss — no release is required here.

If he stood in the middle of the week or before it and said: קונם — wine that I taste this week — he is forbidden until the completion of the whole week, and the coming Shabbat day is forbidden as well
Two remarks from the apparatus. The Taz, at ס״ק ב, warns that in the middle of the week is not exclusive — it excludes only one standing on the Shabbat day itself; and he notes that the Tur, the Rambam, the Ran and the Rosh read שבת זה where the Shulhan Arukh writes שבוע זה. The Chakh confirms it at ס״ק ח.
Gloss: and he is permitted afterwards without a sage’s release
Here seif 3 parts from seif 1. The Taz explains why at ס״ק ג: דחילוק שבין שבוע זה לשבוע סתם הוא הפרש גדול והכל יודעים ההפרש — the gap is too plain for anyone to mistake it. The Chakh, at ס״ק י, reports that the Bah nonetheless requires the שאלה, following the Raf and the Bartenura.
and if he said: “one week”, or “a week” without more — he is forbidden from the hour to the hour
The Chakh sets out the count at The mechanism is exactly that of seif 1: the demonstrative points at a period under way, the numeral at a duration.
Seif 3 in a word. שבוע זה: to the end of the current week, Shabbat included, and without a שאלה. שבוע אחד: seven full days from the hour of the vow.

Seif 4 — “this month”: and the Rosh Hodesh that belongs to the new month

The mechanism is in hand; the seif applies it to the month and draws from it a consequence nothing foretold. A two-day Rosh Hodesh raises a calendar problem: its first day is, by the reckoning, the thirtieth of the month just ended. The Shulhan Arukh nonetheless rules it permitted — and the reason he gives is the founding principle of the laws of vows.

If he stood within the month or before it and said “this month” — he is forbidden until the completion of the month, and permitted on the day of Rosh Hodesh
Rosh Hodesh is not the end of the old month: it is the head of the new one. The vow, which aimed at “this month”, therefore stops at its door.
even a two-day Rosh Hodesh, whose first day is [in truth] the completion of the month gone by — even so he is permitted on it, since in the language of men they call it Rosh Hodesh
It is the principle בנדרים הלך אחר לשון בני אדם that decides, against the calendar. The Chakh draws the reverse consequence at ס״ק י״ב, and it is striking: one who vows on the first day of Rosh Hodesh saying “this month” is forbidden from that day on — since in the language of men he is already in the new month.
Gloss: and all the more so if he vowed to do [something] before Rosh Hodesh, that he must fulfil it before the first day
The Pit’hei Teshuva, at ס״ק א, cites the Radbaz for the reverse on an oath to pay: one who swore to pay before Kislev came in and paid on the first day of Rosh Hodesh has not transgressed — for though it is called Rosh Hodesh Kislev, it is not counted as part of Kislev. The Radbaz adds that the Ran’s language does not suggest this, and that one who is stringent is to be blessed.
Seif 4 in a word. “This month” stops at Rosh Hodesh, even when that Rosh Hodesh lasts two days and the first belongs to the month gone by. The language of men overrides the reckoning.

Seif 5 — “one month”: from date to date

A one-line seif, and yet the site of a dispute no word of the text betrays. Is the phrase מיום ליום — “from day to day” — a calendar month, even a defective one of twenty-nine days, or thirty full days?

If he said: “one month”, or “a month” without more — he is forbidden from day to day
The Chakh gives the example at ס״ק י״ג: a vow on the fifteenth of Tammuz at midday is forbidden until the fifteenth of Av at midday — although that is only twenty-nine days, Tammuz being defective. He there sets the Rosh against the Rambam, the Semag and Rabbenu Yeruham, who count thirty full days, and reconciles them: those speak of a full month.
Seif 5 in a word. “One month” is counted from date to date — and a defective month suffices, according to the Chakh citing the Rosh. The Baer Hetev repeats the proof from the mishna at ס״ק ז.

Seif 6 — “this year”: the year is counted from Tishrei

The scale shifts again, and with it the question of the starting point. For the week and the month the terminus was obvious; for the year one must say which Rosh Hashana is meant. The Shulhan Arukh says it, and draws the limiting case: one who vows on the twenty-ninth of Elul is released the next day.

If he stood within the year or before it and said “this year” — he is forbidden until the completion of the year, and is permitted on the day of Rosh Hashana
⚠️ Sefaria here reads השנה זו, with the definite article, where the parallel seifim write חדש זה and שבוע זה without it. We copy the source’s spelling. The Chakh treats precisely this equivalence between the article form and the demonstrative at ס״ק ט.
and “this year” is counted from Tishrei: so that even if he stands on the twenty-ninth of Elul, once Tishrei has come he is permitted
The exact limiting case of seif 1 — “whether he stands at the beginning of the day or at its end” — transposed to the year. The Rambam says it in the same terms:
Seif 6 in a word. “This year” runs to Rosh Hashana and no further — even if the vow lasted but a single day.

Seif 7 — “one year”: the leap year, and the month that is added

Three propositions, and the third is the difficult one. A vow of “one year” counts twelve months from hour to hour; if it falls in a leap year, thirteen. What remains is to know what becomes of a שנה זו pronounced in winter in a year that will have thirteen months.

If he said: “one year”, or “a year” without more — he is forbidden from the hour to the hour
The Chakh at ס״ק י״ד, in two words: משעה שנדר. The same starting point as in seif 1.
and if the year was intercalated, he is forbidden in it and in its intercalation
The Chakh’s ס״ק ט״ו is the longest disquisition in his apparatus on this siman. There he holds, with the Sma and the Ran, that the clause applies only to one who stood mid-year or before it: one who vows “one year” on Rosh Hashana day is bound only twelve months. He concludes against the Bah, and re-establishes that השנה is equivalent to שנה זו.
and if he stands in winter and said “this year” and it is intercalated — he is forbidden until Tishrei, and we do not say that Adar II counts for him in place of Elul
The consequence is plain: שנה זו counts no months, it aims at a terminus, and that terminus is Tishrei whatever the number of months in between. It is the logic of seif 6.
Seif 7 in a word. “One year” = twelve months from hour to hour, thirteen if the year is intercalated. “This year” = until Tishrei, and the thirteenth month does not stand in for the twelfth.

Seif 8 — Adar: which Adar, when there are two

The seif is written telegraphically: four formulas, four answers, without a conjunction. It then sets the Rambam against the Mehaber on the case of one who knew the year was intercalated. It is the seif of this siman with the widest reach beyond vows: the Chakh treats of documents, of bills of divorce, and of how the month is announced.

If he said “until Rosh Hodesh of Adar” — until Rosh Hodesh of Adar I; “until the end of Adar” — until the end of Adar II
The Taz explains the asymmetry at ס״ק ד: the one follows Rabbi Yehuda, for whom סתם אדר is the first; the other holds that the two Adars count as one month when its end is meant. He infers that “until mid-Adar” means mid-Adar I; the Chakh, at ס״ק ט״ז, cites the Bah for the opposite — “until mid-Adar” reads as “until Adar” — and extends it even to “the twentieth” or “the twenty-first”.
and according to the Rambam, if he knew the year was intercalated and said “until Rosh Hodesh of Adar”, he is forbidden until Rosh Hodesh of Adar II
The Taz clarifies the Rambam’s position at ס״ק ה: he follows Rabbi Meir, for whom סתם אדר is the second, and holds that one who did not know of the intercalation meant the Adar adjoining Shevat. The Chakh, at ס״ק י״ז, wonders (וצ״ע) that the Rama did not bring this position in Hoshen Mishpat, Orah Hayyim and Even HaEzer — and concludes that in vows, a Torah prohibition, one must be stringent like the Rambam.
Seif 8 in a word. “Until Rosh Hodesh of Adar” = Adar I; “until the end of Adar” = the end of Adar II. But if he knew the year was intercalated, the Rambam reads Adar II, and the Chakh inclines to stringency.

Seif 9 — “this cycle”: the shemitta and its seventh year

The largest of the scales, and the seif is built exactly like seifim 3, 4 and 6: a period under way, a terminus at its end. A single clause is added, and it settles the one ambiguity of the word: does שמיטה mean the seven-year cycle or the seventh year alone?

If he stood within the shemitta or before it and said “this shemitta” — he is forbidden until the end of the shemitta, and is forbidden in the seventh year as well
The word therefore names the whole cycle, seventh year included — exactly as שבוע זה carried the Shabbat at seif 3. The Rambam puts it in parallel and adds the jubilee:
Seif 9 in a word. “This shemitta”: the whole cycle, through the end of the seventh year.

Seif 10 — “one shemitta”: seven years from hour to hour

The counterpart of seif 9, and the last link of the chain opened at seif 1. The numeral, here as everywhere, counts a span from the vow; and the chain closes on the longest span the tractate knows.

If he said: “one shemitta”, or “a shemitta” without more — he is forbidden seven years from the hour to the hour
The Rambam writes שֶׁבַע שָׁנִים גְּמוּרוֹת מִיּוֹם לְיוֹם — seven complete years, from date to date. The vocabulary is that of seif 5: מיום ליום for a counted span, מעת לעת for the same thing seen from the hour of the vow.
Seif 10 in a word, and the whole chain with it. A demonstrative aims at a terminus; a numeral counts a span. Day, week, month, year, shemitta: five scales, one rule.

Seif 11 — “until Pesah”: the threshold, and what crosses it

The siman’s second axis, and it is distinct from the first. Until now the question was what span the word encloses. It becomes: does the vow stop at the entry of the named terminus, or at its exit? The answer turns on the verbal form used — עד or עד שיהיה — and Pesah is the textbook case, its time being fixed.

One who forbids himself a thing “until Pesah”, or who said “until the face of Pesah” — he is forbidden only until it arrives, no more
The Chakh explains at ס״ק י״ח why the text says a thing and not “wine”: the Bah infers that this seif does not apply to a vow from wine, where even עד שיהא would stop at the festival’s entry. The Chakh answers that the Mehaber omitted this below, a sign that he holds like the Rambam.
and if he said “until Pesah shall be” — he is forbidden until Pesah goes out
The whole difference lies in the verb. עד הפסח aims at the instant; עד שיהיה aims at the festival’s being, hence at its whole length. The Rambam makes it the general rule in chapter 10:
and some say that “until the face of Pesah” is forbidden until it goes out
The phrase עד פני הפסח is the point of disagreement: the first view assimilates it to עד הפסח, the second to עד שיהיה. The Chakh, at ס״ק י״ט, cites the Bah that wherever the vow stops at arrival a שאלה is nevertheless needed, lest the formulas be confused — the very motive of seif 1.
Seif 11 in a word. עד stops at the threshold; עד שיהיה crosses the festival. Between them, עד פני is disputed.

Seif 12 — the harvest, the vintage: that whose time is not fixed

Here is the second matter the heading announced: And the rule is disarmingly simple — for that whose time is not known, the distinction of seif 11 vanishes. Whatever the formula, one stops at arrival.

If he said “until the harvest” or “until the vintage”, or said “until the vintage shall be” or “the harvest” — he is forbidden only until it arrives
The Chakh supplies the agricultural vocabulary at And at ס״ק כ״א, the decisive precision in the Bah’s name: it is the harvest in fact that releases, not the season of harvest if no one is reaping.
for anything whose time is not known, in whatever formula he says it, is forbidden only until it arrives
The Taz gives the reason at ס״ק ו in the Ran’s name, and it is worth keeping: דלא מחית אינש נפשיה לאסור בספיקא — a man does not put himself into a doubtful prohibition, whether the beginning or the length is unknown. The Chakh adds at ס״ק כ״ב that “in whatever formula” means: even if he said שיהי׳.
Seif 12 in a word. What has no fixed time is never crossed: עד and עד שיהיה both stop at arrival. And arrival means the work actually begun.

Seif 13 — the place of the vow fixes the calendar, for better and worse

Seif 12 made the terminus depend on an agricultural usage; seif 13 says which usage. And it closes the natural escape: one does not change the reach of one’s vow by changing country.

In every place, the time of the vow is according to whether they are early or late in reaping there
The Rambam gives the image in chapter 10: one who vowed in the valley and went up the mountain does not look to the summer of the place he is now in, but to that of the place where he vowed — וְעָלָיו הוּא סוֹמֵךְ.
and we follow the place where the one vowing stands at the time of the vow, even if he afterwards went to another place
The moment of the vow fixes the reach of the word once and for all. The Chakh will repeat the same rule for the rains at ס״ק ל״ג in the name of the Rosh, the Tur and Rabbenu Yeruham: והכל לפי המקום שנדר בו.
whether to be stringent — as where he went to a place [in which] they are early with the harvest — or to be lenient, where he went to a place [in which] they are late with it
⚠️ Two observations on this clause. The square brackets are the edition’s, and we copy them as they stand. And the Taz notes at ס״ק ז that one should read ממקום, not למקום, in both halves. The Chakh, at ס״ק כ״ג, restores yet another reading and concludes כצ״ל.
Seif 13 in a word. The place of the vow, at the time of the vow, fixes the calendar — whether it costs him or suits him. Moving does not release.

Seif 14 — “the harvest”, plainly: wheat, unless local usage says otherwise

The seif settles the content of the word, as seif 13 settled its geography. And it does something the preceding siman refused in a neighbouring case: it follows the majority.

“The harvest” plainly is the wheat harvest; and if the place where he vowed is mostly a barley harvest, we follow it
The Chakh explains at ס״ק כ״ד why the majority decides here, whereas at siman 217 it left a doubt: there we hesitate over the man’s very intention, here it is certain he spoke his town’s language. The Taz, at ס״ק ח, adds a sharp limit: all this holds for the beginning of the harvest; one who says “until the end of the harvest” waits until even the barley is in.
Seif 14 in a word. “The harvest” = wheat, save where barley dominates. And “the end of the harvest” is not the end of the wheat: it is the end of everything.

Seif 15 — the son’s wedding feast: a time one holds in one’s own hand

The longest seif of the siman, and the richest in consequences. The father has fixed the date of the feast; is that time זמן קבוע in the sense of seif 11, or not, since he can himself postpone it? The Mehaber leaves the doubt and rules stringently. The Rama then hangs four developments on it, the last two reaching far beyond the calendar: the tacit condition of a vow, and the conditional vow unfulfilled.

If he fixed a time for his son’s feast and vowed “until the time of my son’s feast” — it is doubtful to us whether its time counts as fixed, and in this we go stringently
The Taz gives the root of the doubt at ס״ק ט in one line: כיון שבידו לדחות החתונה יש סברא דלא הוה זמנו קבוע. The Chakh is shorter still at The Pit’hei Teshuva, at ס״ק ג, cites the Tiferet LeMoshe that the fixity must attach to the feast’s length too — seven days — failing which the vow stops at arrival whatever the start.
Gloss: and even if the son died before his feast arrived, he must wait until that time
Here is the most contested point of the siman. The Chakh devotes ס״ק כ״ז to it, among his longest, to dispute the Rama: the vow aimed at the feast, not the date, and the feast has become impossible. He concedes only that כבר הורה זקן for the bar-mitzva case, and refuses to extend the stringency to the feast. The Taz, at ס״ק י, recalls that the Terumat HaDeshen himself concluded permissively, and forbade only by a גזירה.
Gloss: and likewise if he vowed to do a thing “until my son is bar mitzva” and he died — he must wait until he would have been fit to be bar mitzva
The Chakh himself concedes the distinction at Thirteen years no one can hasten or delay — that is a genuinely fixed time, and the son’s death does not erase it. The Baer Hetev reports the Chakh’s objection at ס״ק ט״ו.
Gloss: and see Orah Hayyim siman 569 — an individual or a community that accepted a fast upon themselves because of some distress, and it has passed: must they complete their fast? And the same law applies to a vow — he vowed to give charity, or other vows
The Rama moves from the calendar to the vow’s motive: when the reason is gone, does the undertaking fall? The source parenthesis answers for the simple case —
Gloss: and it seems to me that all this speaks of those who accepted without specifying; but if he made his words explicit — as one who vowed and said “if so-and-so the sick man lives, I will fast such and such, or give such and such to charity” — if that man died, he is exempt from his vow, for he stipulated explicitly
The general rule the Rama draws is set down immediately after, and it holds for the whole tractate: ולא בעינן תנאי כפול בנדרים דלא גרע דבורו מכוונת הנודר, with references to siman 218 and to the end of siman 232.
Gloss: and all the more one who says “I will give a sela to charity so that my son may live, and if he does not live I will not give” — although he serves in order to receive a reward, he is nonetheless exempt if the son does not live
The Taz, at ס״ק י״א, restores the reading and gives its sense in eight words: כן צ״ל ופירושו וכ״ש אם אומר תנאי כפול. The all the more therefore rests on the condition being here doubled, stated both ways.
Seif 15 in a word. A time one can oneself postpone may not be fixed: doubt, and stringency. The Rama makes him wait even when the event can no longer occur, and the Chakh disputes it for the feast, not for the bar mitzva. And from it comes a rule for the whole tractate: a condition stated explicitly need not be doubled.

Seif 16 — “until the summer”: the baskets of figs

A word of season, not of calendar: קיץ is read not on an almanac but on a task. The seif says which.

“Until the summer” — until they cut many and they bring the figs in in baskets
The Rambam is exactly parallel: הָאוֹסֵר עַצְמוֹ בְּדָבָר עַד הַקַּיִץ הֲרֵי אָסוּר עַד שֶׁיַּתְחִילוּ אַנְשֵׁי הַמָּקוֹם שֶׁנָּדַר בּוֹ לְהַכְנִיס כַּלְכָּלוֹת תְּאֵנִים — and he expressly names the place of the vow, which is seif 13.
Seif 16 in a word. Summer begins when the fig-picking becomes heavy and they are brought in in baskets — an observable fact, not a date.

Seif 17 — “until the summer passes”: when the knives are put away

The counterpart of seif 16, and the same principle: a gesture marks the end, not a date. The symmetry is perfect — the knife taken up opens the season, the knife put away closes it.

“Until the summer passes” — until they store away the knives with which the figs are cut
The Chakh explains at ס״ק כ״ח, and the Baer Hetev repeats it at ס״ק ט״ז: פי׳ שכבר עבר כל זמן קציצתו. To put the tool away is to declare the season closed.
Seif 17 in a word. The end of summer is when the fig-knives are no longer needed. The Rambam gives a neighbouring sign: when the drying mats are folded up.

Seif 18 — “the rain” in the singular, “the rains” in the plural

The most technical seif of the siman, and the one that drew the Chakh’s longest disquisition. Two formulas one letter apart — עד הגשם and עד הגשמים — yield two regimes: the first is released by the arrival of a season, the second requires the rain actually to fall. The dates remain, and they are an open dispute.

One who forbids himself a thing “until the rain” — he is forbidden until the time of the rains, which in the Land of Israel is Rosh Hodesh Kislev
The Chakh, at ס״ק כ״ט, at once sets out the opposing view: the Rosh, the Tur and the Raavad forbid only until the first revi‘a, and that is Rashi’s explanation too. At ס״ק ל he names the text’s position: רביעה שלישית להרמב״ם והמחבר. The Taz explains it at ס״ק י״ב.
Once the time of the rains has come, he is permitted, whether rains fell or not; and if they fell from the seventeenth of Marheshvan, he is permitted
The Chakh’s ס״ק ל״א, among the longest of the siman, starts from this date. He lays out the view of the Rosh and the Tur — first revi‘a on the seventh of Marheshvan, second on the seventeenth — wonders at the Beit Yosef’s question, and presses an objection on the Rambam himself: in Hilkhot Tefila he fixes the request for rain on the seventh of Marheshvan, and here the first revi‘a on the seventeenth. He concludes וצ״ע, and draws a consequence for the custom of fixing the בה״ב fasts.
and if he said “until the rains” — he is forbidden until the rains fall, and provided they fall from the time of the second revi‘a, which in the Land of Israel and the places near it is from the twenty-third of Marheshvan onward
The Taz explains the plural at ס״ק י״ג: משמע לשון רבים ומיעוט רבים שנים, hence two revi‘ot. And he adds a remark that ties this seif to seif 12: even עד שיהיו הגשמים does not extend it, since the length of the rains is not fixed.
Gloss: and in the diaspora the time of the rains is sixty days after the tekufa, when the request [for rain] begins then; and the time of the second revi‘a is seventy days after the tekufa
The Chakh, at ס״ק ל״ב, shows that this ten-day gap follows precisely the Rosh and the Tur — and that on the Rambam’s and the Mehaber’s view the gap would be only six days. He ends with a difficulty on the Rama, who set the Rosh’s view after the Rambam’s: וצ״ע. The Taz, at ס״ק י״ד, explains that the gloss concerns one who vowed in the diaspora.
Seif 18 in a word. עד הגשם: released by a date, rain or no rain. עד הגשמים: the rain must fall, and from the second revi‘a. The dates themselves are disputed, and the Chakh inclines to the Rosh.

Seif 19 — “until the rains cease”: Pesah closes the season

A one-line seif, and it closes the series on rain. A season that begins with a fact — rain falling — ends with a date. It is the one place in the siman where a natural event is given a calendar terminus.

If he said: “until the rains cease” — he is forbidden until Pesah has passed
The rainy season of the Land of Israel closes at Pesah: it is the very usage by which, at Pesah, one ceases to mention rain in the prayer. The seif is thus the exact mirror of seif 17 — a season opened by a gesture and closed by a public marker.
Seif 19 in a word. “Until the rains cease” does not wait for the last shower: it waits for Pesah.

Seif 20 — “during the festival”: is Shemini Atseret inside?

A six-word seif, and it raises the most debated question of the siman outside the law of vows: is Shemini Atseret “the festival”? The halakha treats it as a festival in its own right — the famous פז״ר קש״ב. And yet the vow reaches it.

קונם — wine that I taste during the festival: he is forbidden on the last festival day
The Chakh gives the reason at ס״ק ל״ד in a line: אף על גב דהוא חג בפני עצמו לענין פז״ר קש״ב מ״מ בלשון בני אדם הוא בכלל החג. The Taz, at ס״ק ט״ו, goes further: he reports that a proof was drawn from here for saying in the Shemini Atseret prayer את יום חג שמיני עצרת הזה, rejects that proof — vows follow the language of men — and then offers another he holds unanswerable, from Sota 41.
Seif 20 in a word. “The festival” takes in the last day, because that is how people speak — not because the Torah says so. The Pit’hei Teshuva at ס״ק ד refers to Orah Hayyim 668 and the Hatam Sofer for the rest of the debate.

Seif 21 — where “until Pesah” falls in the sentence

The last three seifim leave wine for the relations of husband and wife, but they do not leave the subject: they show that one and the same word of time says different things according to where in the sentence it is placed. Here two formulas made of the same words, in a different order, yield two opposite prohibitions.

One who says to his wife: “what you make is קונם, that I take no benefit from it, until Pesah” — [if] she made it before Pesah, he is permitted to benefit from it after Pesah
The word of time is placed at the end: it qualifies the benefit. The Taz dismisses the reverse reading at ס״ק ט״ז in one line: ולא אמרינן דהכי קאמר מה שאת עושה עד הפסח יהא קונם עלי לעולם.
but if he said: “what you make until Pesah is קונם, that I take no benefit from it” — he is forbidden to benefit forever from what she made before Pesah
The word of time is placed in the middle: it qualifies the work, and the prohibition upon that work is then without term. The Taz again rejects the mirror reading at
Seif 21 in a word. The same “until Pesah” bounds either the benefit or the work — and its place in the sentence decides which. Bounding the benefit releases after Pesah; bounding the work forbids forever.

Seif 22 — two termini in one formula, and the retroactive fear

The vow here carries two words of time at once: the prohibition runs “until Pesah”, the condition “until the festival”. And because the condition may be fulfilled after the prohibition has lapsed, the halakha forbids by precaution from the first day.

If he said to his wife: “קונם — that you have benefit from me, from today until Pesah, if you go to your father’s house until the festival” — [if] she went before Pesah, it is forbidden to have benefit from her until Pesah
⚠️ The text is difficult and we copy it as it stands: the vow bears on what she derives from him (שאת נהנית לי), but the conclusion speaks of benefit from her (ליהנות ממנה). Seif 23, by contrast, writes אסורה ליהנות in the feminine, and so does the Rambam in chapter 10: הֲרֵי זוֹ אֲסוּרָה לֵהָנוֹת לוֹ מִיָּד. We do not decide it here. The Chakh, at ס״ק ל״ו, reads the clause as printed and adds: אבל לאחר הפסח מותר אפי׳ הלכה.
and even if she did not go, it is forbidden to have benefit from her until Pesah — lest she go afterwards and it turn out, retroactively, that he transgressed
The Taz specifies at ס״ק י״ח that even if she did not go means one who שאינה רוצה לילך. And at ס״ק י״ט he cites, from the Maharshal via the Perisha, why this fear applies to vows and not to bills of divorce: דוקא בנדרים דקילי הוא דאמרינן בתנאי לא מזדהרי אינשי. He adds a distinction of his own, then expounds at length two ways of understanding the Rambam.
Seif 22 in a word. When the condition outlives the prohibition, we forbid at once — for a man guards a vow but does not guard the condition of a vow. And the prohibition itself does not outlast Pesah.

Seif 23 — the two termini reversed, and who takes the lashes

The last seif repeats the construction of seif 22 with the two termini exchanged: the prohibition runs longer than the condition. Consequently transgression becomes really possible, and the siman closes on the only sanction it names — and on a dispute as to who bears it.

If he said to her: “קונם — that you have benefit from me until the festival, if you go to your father’s house until Pesah” — she is forbidden to benefit immediately
The Chakh gives the reason at ס״ק ל״ז in four words: שמא תלך ותעבור למפרע — the same fear as in seif 22. The Baer Hetev repeats it at ס״ק כ״א.
and if she went before Pesah and he is found to be giving her benefit — he is liable to lashes, in the time of the Sanhedrin, and she is forbidden in his benefit until the festival
The Taz closes the siman at ס״ק כ on a precise dispute: for the Ran it is the woman who takes the lashes, for though she vowed nothing she has transgressed לא יחל; the Rambam reads that he is flogged if he gives her benefit. The Pit’hei Teshuva, at ס״ק ו, refers to the Mishkenot Yaakov, who resolves the Ran’s objection to the Rambam.
and she is permitted to go to her father’s house once Pesah has come
The Chakh closes his apparatus at ס״ק ל״ח on the reason that governs the last two seifim, and it is the phrase to carry away from the siman: דאדם נזהר בנדר ואינו נזהר בתנאי נדר. Once Pesah has passed, going to her father’s house is no longer a condition of the vow: the journey is free again, and he alone remains bound not to give her benefit.
Seif 23 in a word. When the prohibition outruns the condition, transgression is real: lashes in the time of the Sanhedrin, and prohibition until the festival. But the journey is free from Pesah — for the condition itself was bounded at Pesah.

3. The key concepts of this siman

מעת לעת — From the hour to the hour — twenty-four hours counted from the hour of the vow, not from the morning. The Chakh specifies this at ס״ק א and ס״ק י״ד. It is the measure every numeral triggers: a day, a week, a year, a shemitta.
מיום ליום — From date to date — the measure of seif 5. The Chakh shows at ס״ק י״ג that a defective month of twenty-nine days suffices, against the Rambam, the Semag and Rabbenu Yeruham, who count thirty full days.
זמנו קבוע — That whose time is fixed — Pesah, Rosh Hodesh, the bar mitzva. There, and only there, the distinction between עד and עד שיהיה has effect. The Rambam makes it the general rule in chapter 10 of Hilkhot Nedarim.
דבר שאין זמנו קבוע — That whose time is not fixed — the harvest, the vintage, the summer, the rains. The Taz gives the reason at ס״ק ו in the Ran’s name: דלא מחית אינש נפשיה לאסור בספיקא. And the uncertainty may lie in the start as much as in the length.
לשון בני אדם — The language of men. It decides at seif 4 that a first day of Rosh Hodesh belongs to the new month, and at seif 20 that Shemini Atseret is “the festival”. Against the astronomical reckoning, against the halakhic category — because a vow is read as the one who spoke it understood it.
רביעה ראשונה · שנייה · שלישית — The three “settlings” of rain upon the earth. The Taz gives the etymology at Their dates are disputed: the seventeenth and twenty-third of Marheshvan for the Rambam and the Mehaber, the seventh and seventeenth for the Rosh and the Tur.
שאלה לחכם · פתח — The request for release, and the “opening” that grounds it. The Chakh distinguishes the two at ס״ק ג: here the שאלה is made without a פתח, and is only rabbinic. It is the sole mention of this distinction in the whole siman, and it governs its practice.
אדם נזהר בנדר ואינו נזהר בתנאי נדר — A man guards a vow, but does not guard the condition of a vow. The Chakh’s formula at ס״ק ל״ח, taken from the Perisha. It explains, at seifim 22 and 23, why a benefit not yet forbidden is forbidden in advance.
פז״ר קש״ב — The mnemonic of the six titles by which Shemini Atseret is a festival distinct from Sukkot. The Chakh names it at ס״ק ל״ד only to say at once that it does not decide here: in vows it is the language of men that speaks.
סתם אדר — “Adar” unqualified, in a thirteen-month year. Rabbi Yehuda reads Adar I, Rabbi Meir Adar II. The Chakh devotes his longest comparative discussion to it at ס״ק י״ז: documents, bills of divorce, ketubot, and even how the month is announced in the synagogue.

4. Where these seifim come from

The Tur — the rule at the head of the siman

The Tur opens with the very formula the Mehaber will take over, and runs through all the scales in one stretch. The siman’s order comes from his text.

The mishna —

Seifim 1 to 11 are this mishna, almost word for word: the five scales with the demonstrative, then the line of the numeral, then the rule of crossing with the dispute over עד לפני הפסח.

The gemara —

The gemara supplies the reason for the decree of seif 1 and for the Rosh Hodesh of seif 4. That second reason is the key to the whole siman: we follow what people call things.

The gemara —

The rains block and the Adar block come from this page. There the second revi‘a is expressly given its function: לְנוֹדֵר — it serves vows, and nothing else.

The Rambam — הלכות נדרים, chapter 10

The whole chapter is the exact parallel of our siman, in the same order. It is he who states in so many words the general rule of the זמן קבוע, which the Shulhan Arukh leaves implicit.

5. The apparatus of the siman, entry by entry

The apparatus of this siman numbers eighty-seven entries — thirty-eight ס״ק of the Chakh, twenty of the Taz, twenty-one of the Baer Hetev, six of the Pit’hei Teshuva, two of the Nekudot HaKesef. We cite them all, in order, summarising none. The Arukh HaShulhan is not cited: it is not accessible to us for this siman. Neither are the Peri Hadash, the Biur HaGra and the Beer HaGola.

Thirty-eight entries, the largest apparatus of the נדרים block after siman 221. Four are genuine disquisitions: ס״ק ט״ו on “one year” said on Rosh Hashana, ס״ק י״ז on סתם אדר in documents and bills of divorce, ס״ק כ״ז against the Terumat HaDeshen, and ס״ק ל״א on the dates of the revi‘ot.

ס״ק ד — why the fast escapes the decree

ס״ק ה — permitted at night, but a שאלה is needed

ס״ק ט — “the week”, “the month”, “the year” with the article

ס״ק י — the Bah requires a שאלה even here

ס״ק י״ג — the Rosh against the Rambam on the defective month

ס״ק ט״ו — “one year” said on Rosh Hashana

ס״ק ט״ז — “until mid-Adar”, and the two Adars

ס״ק י״ז — the צ״ע on documents, and naming אדר א׳

ס״ק י״ח — why “בדבר” and not “wine”

ס״ק י״ט — the Bah requires a שאלה in all these

SeifFormulaWhat it carries
Until nightfall / twenty-four hours from the vow; a שאלה is required in the first case
Like “today”; and for two days the night between is included

Seif 4חדש זהUntil Rosh Hodesh, even a two-day Rosh Hodesh
From date to date; a defective month suffices
Seif 6השנה זוUntil Rosh Hashana — even said on 29 Elul
Twelve months, thirteen if intercalated; and “this year” does not pass Tishrei
Adar I / end of Adar II; and the Rambam reads Adar II if he knew
Seif 9שמיטה זוThe whole cycle, seventh year included

Seif 13לפי המקוםThe place of the vow at its time, for better and worse
Seif 14קציר סתםWheat, unless local majority usage says otherwise
Doubt as to fixity, and stringency; the Rama makes him wait even after a death

When the fig-knives are put away
A date, rain or not / actual rain from the second revi‘a

Seif 22עד פסח … Forbidden at once from retroactive fear; does not outlast Pesah
Seif 23עד החג … Forbidden at once; lashes if the condition is met; the journey free from Pesah

7. Practical cases

A man says at six in the evening: “קונם, I drink no wine today.”
He is bound until nightfall — perhaps an hour. But he will not drink tonight without asking a Rav for release: that is the decree of seif 1, and it has nothing to do with the span.
The same man says: “קונם, I drink no wine one day.”
He is bound until six the next evening. The count runs from the hour of the vow, not from the morning (Chakh
He accepts a fast “for today”.
He eats as soon as night falls, with no שאלה. The Rama says so, and the Chakh gives the reason at ס״ק ד: the fast has its measure fixed by the sages.
It is the 29th of Elul. He says: “קונם, no wine this year.”
He is bound for one day. Once Rosh Hashana comes, he is released (seif 6).
A leap year. Not knowing it is one, he says: “until Rosh Hodesh of Adar.”
Adar I (seif 8). Had he known, the Rambam reads Adar II, and the Chakh inclines to the stringency.
He says: “קונם, no meat until Pesah.”
He is released at the entry of Pesah — but he will ask for a שאלה, on the Bah’s view reported at Chakh ס״ק י״ט. Had he said “until Pesah shall be”, he would wait for the festival to go out.
He says “until the harvest”, and moves to a region where they reap earlier.
The place of the vow fixes the calendar, for better and for worse (seif 13). And he waits until reaping is actually done, not for the season (Chakh
A father vows until his son’s wedding, and the son dies beforehand.
The Rama makes him wait for the appointed date; the Chakh dissents at ס״ק כ״ז, holding the vow aimed at the feast and not at the date. An open case — to be put to a Rav.

8. Comprehension questions

  1. Why does one who said “today” need a שאלה, when his vow is already over? And why does one who said “this week” not need one?
  2. A first day of Rosh Hodesh belongs by the reckoning to the month gone by. Why does the vow not reach it — and what does the Chakh infer at ס״ק י״ב?
  3. What distinguishes עד הפסח from עד שיהיה הפסח? And why does that distinction not apply to the harvest?
  4. The Taz, at ס״ק ז, wishes to correct one word of seif 13. Which, and what does the correction change?
  5. Why does the majority decide at seif 14, when at siman 217 it left a doubt? Give the Chakh’s answer at ס״ק כ״ד.
  6. What is the difference, in seif 18, between עד הגשם and עד הגשמים — and why does the Chakh end with a וצ״ע at ס״ק ל״א?
  7. Seifim 21, 22 and 23 use the same words in different orders. Describe what each shift changes.
  8. Who takes the lashes at seif 23, according to the Ran and according to the Rambam? Where does the Taz report it?
