A first approach to Siman 221, fourteen seifim — and one hundred and sixty apparatus entries, the highest density in the whole tractate of nedarim. A man has forbidden another to benefit from him, or forbidden himself to benefit from him: the siman draws fourteen seifim of law from that — walking across a field, the debt, the household, the sick man, the table, the lease, the agency, the gift, speech, the book, the flame, the slaughter, the shofar and the lulav. These are למעשה rules: any real case goes to a Rav.

1. What is this siman about?

This is the siman one meets when a vow stops being a matter between a man and his own mouth and becomes a matter between two estates. A man has said: “let the benefit of my property be forbidden to you”, or: “let the benefit of your property be forbidden to me”. The words are brief. Their consequences run across fourteen seifim and touch on walking across a field, paying a debt, maintaining a wife, visiting the sick, sharing a bed, leasing a bathhouse, the agency given to a shopkeeper, the validity of a gift, the slaughter of a beast and the acquisition of a lulav.

The reason for this density is simple: every clause opens a question of law. That is why the Shakh has sixty entries here and the Taz forty-four — more than eleven entries per seif, the highest density in the whole tractate of nedarim. There is no symbolism here and no exegesis of words, but a run of civil questions: who is bound to pay? who holds the produce? from what point does a third party become an agent? does a conditional gift convey ownership?

Two principles recur throughout. The first is the original severity: אפילו ויתור אסור במודר הנאה — even the indulgence no one charges for is a benefit, which is why seif 1 forbids crossing a field. The second is the tempering brought by the three forms of benefit that escape: indirect benefit (the debt), benefit that comes of itself (the household fed), and benefit that is only the mitzva (the shofar, the lulav, the lost object).

The siman in four blocks. Seifim 1–5: the person — what the vow reaches in body, time and table. Seifim 6–7: the estate — what “my property” still covers, and what a קונם can no longer touch. Seifim 8–9: the third party — what may pass through another, and on what condition. Seifim 10–14: the particular cases — speech, the book, the flame, the slaughter, the shofar, the lulav.

2. The seifim, clause by clause

Here are the fourteen seifim, each first in full — as the source gives it, parentheses and the Rama’s glosses included — then broken down clause by clause.

Seif 1 — what the vow reaches, and what the wording narrows

The siman opens on the mishna of (Nedarim 32b) and unfolds it into four distinct formulas. A vow can be taken in two directions — I forbid my property to another, or I forbid myself his property — and in both the same man, הנאסר, is the one bound. Then come three ever narrower wordings: “food”, “the benefit of your food”, “a benefit that leads to food”. Each cuts the material at a different place, and the whole craft of the seif is to show where.

Reuven who forbade his property to Shimon, or who forbade himself Shimon’s property — the one to whom it became forbidden may not walk across the other’s field
Two arrangements, one word for both. The מדיר is the one who speaks, the הנאסר is the one bound — and he may be either, depending on which way the vow ran. The first consequence is already striking: a mere right of way.
even in an open plain, in the dry season, where people are not particular about the treading of feet in it
Here is the civil principle of the siman, and it is severe: אפי׳ ויתור אסור במודר הנאה — even the indulgence granted without a thought is a benefit. The Shakh, at ס״ק א, upholds this reading against the Ba’h, who wished to permit passage where it does not shorten the way; the Taz, at ס״ק א, reaches the same conclusion from Rashi, and the Nekudot HaKesef concur.
and it is forbidden for him to borrow from him any vessel in the world
The mishna sets this case against a vow bearing on food alone: what separates the two is precisely the right of way and the vessels not used to prepare food.
and if he vowed against him only food, he is forbidden only to eat of what is his.
First contraction. The word “food” is read strictly: the act of eating, and nothing beyond it.
If he said: “the benefit of your food is upon me” — he is forbidden to eat of what is his
and it is forbidden for him to chew wheat to place on his wound
The formula bears on the benefit derived from the food, not on the act of eating: hence the wound. The Shakh, at ס״ק ב, says it in a line — אע״ג דאינו אוכל מ״מ הנאה מגוף המאכל היא.
but to borrow from him a sieve or a sifter is permitted
The sieve is not the food: it prepares it. This formula therefore does not reach it — and that is exactly what the next one will reach.
If he said: “a benefit that leads to food is upon me” — he is forbidden to eat of what is his
and it is permitted for him to chew wheat and place it on his wound
The exact reversal of the previous case, and it is the demonstration of the seif: two neighbouring formulas produce opposite results on the very same fact. A wound is not a road to a meal.
and it is forbidden for him to derive benefit from anything the like of which is rented out
The criterion is economic: if the thing is rented out, lending it free is equivalent to remitting the rental price, and that price could have bought food. The Shakh at ס״ק ג and the Taz at ס״ק ב give the same reason, in the name of the Rosh.
and that the like of which is not rented out is permitted, if it bears no relation to food
but if it does bear a relation to food, such as a sieve and a sifter
and even a sack in which to carry fruit, and a donkey on which to carry fruit
A double criterion takes shape: either the thing is rented out, or it bears on food. The sack and the donkey are not necessarily rented, but they carry the meal — and that suffices. This is Rav Papa, Nedarim 33a.
and likewise a horse to ride to the wedding feast, and a ring to be seen with at the wedding feast
Here the Mehaber resolves a בעיא the gemara had left open. And the Taz, at ס״ק ג, explains how the ring leads to food: שיהא נראה חשוב ויתנו לו חלק טוב — to look important, so that he be served a good portion.
and to cross his field on the way to the wedding feast — although the like is not rented out, it is forbidden
The Taz, at ס״ק א, had noted the tension: Rashi explained the forbidden passage at the head of the siman by the shortening of the road, whereas this passage is forbidden only because it leads to the meal. The Shakh at ס״ק א rules that in the opening clause passage is forbidden in every case.
and likewise it is forbidden for him to buy for him the needs of a meal
The Taz, at ס״ק ד, asks: the Tur reports this as a בעיא of the Yerushalmi — why hesitate here more than elsewhere? His answer: in all the other cases he benefits from a thing he does not have, whereas here he could buy the food himself.
and likewise it is forbidden for him to warm his hands at his loaf.
A clause contested by both of its commentators at once. The Shakh, at ס״ק ד, writes תמיה לי מנ״ל הא: the Yerushalmi raises the doubt only for one who vowed against the loaf, not for the formula “a benefit that leads to food”. The Taz at ס״ק ד says the same, and both note that the Levush placed this clause higher up.
Gloss: an axe with which one splits wood to cook food is called a benefit that leads to food; but an axe with which one weeds, it is permitted to borrow it for him.
The Rama sets the criterion of the causal chain: the woodcutting axe enters into the preparation of the meal, the weeding axe does not. The Shakh, at ס״ק ה, develops a long note from the Yerushalmi — cups, bowls and platters are permitted because the food is already prepared, while pots and pans are forbidden because the food is cooked in them.
(Beit Yosef in the name of Rabbenu Yeruḥam)
Seif 1 in one sentence. A vow of benefit reaches everything, down to the right of way no one charges for — that is the rule of ויתור, the customary indulgence, which is likewise forbidden. But once the one who vowed used a narrower word, that word is read as it stands: “food” covers only the act of eating, “the benefit of your food” adds any benefit from the body of the food, “a benefit that leads to food” adds the implements that make the meal — and nothing more.

Seif 2 — what passes despite the vow: the debt, the household, the teaching

Having shown what the vow reaches, the siman shows what it does not — and here it becomes a siman of civil law. To pay the debt of a man who forbade him his benefit: the benefit is real, and yet permitted, because it is גרמא and not a gift. To feed his wife and children: permitted, because the benefit is דממילא. To feed his beast: forbidden. And teaching, where the whole question is whether instruction is paid for — a question the seif itself notes has changed its answer over time.

One from whom benefit of his fellow has been vowed away may pay his debt
The mishna, Nedarim 33a, permits, and the gemara gives the reason — אברוחי ארי בעלמא הוא, he merely drives off a lion. But the Shakh, at ס״ק ו, at once restricts: היינו דוקא שלא מדעתו, only without the debtor’s knowledge. And he reports the Ba’h, who forbids where the debt carries a deed or a pledge.
and even if he had a pledge in the lender’s hands, and this one paid on his behalf and took back the pledge
The Taz, at ס״ק ו, gives the reason the pledge is not counted a benefit: משום דא״ל הייתי מפייס ליה ויהיב לי משכוני — the debtor can say he would have appeased his creditor and got his pledge back himself.
he must return it to the borrower, the one to whom it is forbidden (the view of Rashi, the Rivash and the Rambam)
The Shakh, at ס״ק ז, adds that this holds even if the lender was pressing him to pay: we presume the debtor would have obtained a remission. The Pitḥei Teshuva, at ס״ק א, refers to the responsum Mishkenot Yaakov.
and he may feed his wife, his children and his slaves, even Canaanite ones
The Shakh, at ס״ק ח, gives two reasons, the second the subtler: this benefit דממילא היא, it comes of itself — and moreover they could have economised and lived on their own labour. The Taz, at ס״ק ז, devotes his longest note in the seif to the debate between Rabbenu Tam, the Rosh and the Tur on the scope of this permission.
but it is forbidden for him to feed his beast, whether unclean or clean
Why the beast and not the wife? The baraita of Nedarim 38b says it: servants למנחרותא עבידן, a beast לפטומא עבידא — it is kept for fattening, and fattening it raises its value. The Shakh, at ס״ק ט, spells it out: שהרי מעלה בדמיה וה״ל הנאה גמורה.
and it is forbidden for him to teach him Scripture, since it is permitted to take a fee for it, and he teaches him free — so that he is found to benefit him
The reasoning is constant throughout the siman: what is paid for is a benefit when given free. The Taz, at ס״ק ט, specifies which fee — שכר פיסוק טעמים, the fee for teaching the cantillation, which is not of the Torah.
but he may teach him midrash, halakhot and aggadot
and that provided the one forbidden does not ask the one who forbade to teach him
Saying “teach me” would make the teacher an agent, and an agent confers a direct benefit. This is already the question of seif 8 — שליחות — raised here for the first time.
and nowadays, when it is permitted to take a fee even for midrash, all of it is forbidden
A remarkable clause: the Shulḥan Arukh acknowledges that a new economic practice has reversed the law. The Taz, at ס״ק י, refers to siman 246 where the permission is set out. It is the point in the siman where the rule most explicitly depends on the state of the world.
but to teach his son, even Scripture, is permitted
and it is permitted to serve him with the cup of the house of mourning and the cup of the bathhouse
These two cups come from Rabbi Yoḥanan, Nedarim 38b, under the name The Shakh, at ס״ק י״א, notes the cup is the vower’s own and that the service is no great benefit; the Taz, at ס״ק י״א, brings from the Rosh that the bathhouse cup is hot water, taken as a remedy.
Gloss: and some dispute and permit even if he asked him to teach him (the Rosh and the Tur)
The Rama brings the opposing view. The Shakh, at ס״ק י״ב, bounds it: today’s permission holds only gratis, for a fee it is permitted; and if each one’s property is forbidden to the other, it is forbidden in every case. ס״ק י״ג adds that the Ba’h rules like the first view.
and the same for any matter of mitzva; provided, however, that in a matter requiring an agency — such as separating his teruma — it is forbidden for him to be his agent. (Beit Yosef in the name of the Rosh and Rabbenu Yeruḥam)
The Rama’s dividing line is שליחות. The Shakh, at ס״ק י״ד, insists the permission holds only for a matter of mitzva, with the Levush’s reason: דמצות לאו ליהנות ניתנו. The Taz, at ס״ק י״ב, defines what “requires an agency”: what one has no right to do unless instructed.
Seif 2 in one sentence. Three dividing lines, and they will return throughout the siman: between direct and indirect benefit (the debt); between intended benefit and benefit that comes of itself (the wife and children, against the beast one fattens); and between what is paid for and what is not (teaching, then and now).

Seif 3 — the daughter, and the lost object: two transfers that are not alike

The seif takes two transfers — marrying off a daughter, returning a lost object — and shows that they follow opposite logics. To marry off one’s minor daughter is to hand over a person still under one’s authority: that is a genuine conferral of benefit, and the direction of the vow decides. To return a lost object is to perform a mitzva: the benefit is permitted both ways — but as soon as a fee is customary, the question turns civil again, and the seif treats it as such.

Reuven who forbade his property to Shimon: it is forbidden for him to give him in marriage his minor or na‘ara daughter, because she is still under his authority, and behold he is handing him a maidservant to serve him
The reasoning is that of Rabbi Zeira, Nedarim 38b: The minor daughter is still within the father’s property, and to give her is to give. The Shakh, at ס״ק ט״ו, and the Ba’er Hetev, at ס״ק י״ב, add the consequence: a בוגרת may be given him, for she is no longer under his authority.
and if it is Shimon’s property that is forbidden to him, he is permitted to marry his daughter, although he has released him from the obligation of her maintenance
The Taz, at ס״ק י״ג, devotes a long note to this clause: why did the Tur need to write it, when the gemara answers פשיטא? Because one might have thought that where dowering a daughter is customary, taking a wife without a dowry is an immense benefit. The Tur answers with a קל וחומר drawn from maintenance: if a strict obligation does not count as benefit, a mere custom all the less. The Shakh at ס״ק ט״ז and the Ba’er Hetev at ס״ק י״ג note that this holds even for the minor.
and he returns to him his lost object, whether the property of the owner of the lost object is forbidden to the returner, or the property of the returner is forbidden to the owner
The Rambam, at the head of chapter 7, gives the reason: The Taz, at ס״ק י״ד, sets aside the objection one might have drawn from פריטי דרב יוסף — while busy with the lost object the returner is exempt from giving to the poor, and that is a gain.
and in a place where a fee is taken for returning a lost object: if the property of the owner is forbidden to the returner, it is forbidden for him to receive it; he therefore returns it to him free
The Shakh, at ס״ק י״ז, completes the Meḥaber on a point he left open: the benefit need not fall to hekdesh in this case — but if the owner refuses a free return, then it does. The Taz, at ס״ק ט״ו, says the same.
and if the property of the returner is forbidden to the owner of the lost object, he may not return it to him free
A perfect symmetry: in one direction the fee is the benefit, in the other it is the gratuity. The Ba’er Hetev, at ס״ק ט״ו, brings from the Beit Yosef and the later authorities that if the returner refuses the fee, it falls to hekdesh.
and if the property of each is forbidden to the other, he may neither receive the fee — for then he benefits — nor leave it with him — for then he confers benefit; rather the fee shall fall to hekdesh
This is the mishna itself, Nedarim 33a: The solution is civil before it is ritual: since the money can go to neither, it leaves the estate of both.
Seif 3 in one sentence. Where the benefit is a person still under authority, the direction of the vow decides; where it is a mitzva, the mitzva passes — except where a price attaches, and then one looks for where the price can go without benefiting anyone: hekdesh.

Seif 4 — the sick man: visiting, healing, burying, testifying

The longest seif in the siman, and the most human. A man is bound by a vow towards another, and that other falls ill. Everything is measured by the same instrument — is this service paid for? — and the answer governs conduct throughout: to stand rather than sit, to heal the man but not his beast, to name the remedy rather than administer it. Then the second half reverses the direction of the vow, and it emerges that the right of way, so severe in seif 1, yields before life:

Reuven who forbade his benefit to Shimon, and Shimon fell ill: Reuven may enter his house to visit him
The Taz, at ס״ק ט״ז, immediately notes a decisive point of wording: the gemara says שאסר נכסיו, the Meḥaber says “his benefit”. Hence the lesson — saying “the benefit of my property is forbidden to you” also forbids benefit from his person, wherever a fee attaches to that service. The Taz at ס״ק י״ז adds the reason for the permission: it is the sick man’s property that is not forbidden, only the visitor’s.
and in a place where a fee is given to one who sits by the sick to keep him company, he shall not sit by him, but visits him standing
The Shakh, at ס״ק י״ח, and the Taz, at ס״ק י״ח, gloss the word לצוות — to keep company. And the Shakh, at ס״ק י״ט, adds the decisive qualification: Rashi forbids only sitting gratis; sitting for a fee is permitted, and the Levush, who forbids even for a fee, is set aside — which the Ba’er Hetev, at ס״ק ט״ז, relays.
and if it is not customary to give a fee to the physician, he may heal him, even with his hands, even if there is another physician who would heal him
The Shakh, at ס״ק כ׳, and the Taz, at ס״ק כ׳, give the same reason, of a reach beyond this siman: שלא מכל אדם זוכה להתרפאות — not from every man does one merit to be healed. The existence of another physician therefore does not make this treatment superfluous.
but if it is customary to give a fee to the physician, he shall not heal him free
It is therefore not the treatment that is at stake, but the gratuity.
and he shall not heal his beast, even if it is not customary to give a fee to the physician
The division is the same as in seif 2: healing a man is a mitzva, and גופיה מצוה קעביד; healing his beast enriches an estate. The Shakh at ס״ק כ״ב and the Taz at ס״ק כ״א say so in those words, drawn from the gemara.
but he may tell him: such-and-such a remedy is good for it — and he will do it himself
Advice is not treatment. The Shakh, at ס״ק כ״ג, and the Taz, at ס״ק כ״ב, lay down in the Ran’s name the material condition: שיהא הסם מבעל הבהמה, the remedy must belong to the beast’s owner.
and if he does not know how to do it, and it will die if he does not, it is permitted for the one who vowed to do it
The Taz, at ס״ק כ״ג, gives the key: דהוה ליה כמחזיר אבידתו — a beast at the point of death is a lost object, and seif 3 has already permitted returning it.
and if he died, he may bring a coffin and shrouds
The Taz, at ס״ק כ״ד, in six words: דאין הנאה למתים. The dead derive no benefit — the line of the siman is held to the end.
and if Shimon’s son fell ill, Reuven may enter, sit with him and visit him (standing)
Here a textual divergence noted by three commentators. The Shakh, at ס״ק כ״ד, and the Taz, at ס״ק כ״ה, hold the word מעומד to be a copyist’s error: the vow bore only on Shimon, not on his son, and one may therefore sit even where a fee is paid for it. The Ba’er Hetev, at ס״ק כ״א, relays this — הט״ז וש״ך מחקו תיבת מעומד. Our Sefaria edition nevertheless carries the word, in parentheses.
and if Shimon’s property is forbidden to Reuven, Shimon having vowed him away from his property, and Shimon fell ill: Reuven enters to visit him (Ran)
The direction of the vow reverses, and with it the difficulty: to enter the sick man’s house is to use his property. The Shakh, at ס״ק כ״ה, supplies the estimation of intent that unlocks it — אמדינן דעתיה דהחולה דמחיותיה לא אדריה: we estimate that the sick man did not mean to forbid what his life depends on. And he adds the limit: if it is the visitor who forbade himself the sick man’s property, he shall not enter at all. The Taz, at ס״ק כ״ו, and the Ba’er Hetev, at ס״ק כ״ב, say the same.
but not seated
The Shakh, at ס״ק כ״ו, restores the reading here — מעומד אבל לא מיושב כצ״ל — and at ס״ק כ״ז gives the reason, perfectly brief: כיון דאפשר בעמידה.
if his son fell ill, he does not enter at all, but inquires after him in the market
The presumption about life does not extend to the son. The Shakh, at ס״ק כ״ח, puts it: ונהי דמחיותיה לא אדריה מחיותיה דבריה אפשר דאדריה — of his own life he did not forbid himself; of his son’s, he may well have. The Taz at ס״ק כ״ז and the Ba’er Hetev at ס״ק כ״ג follow.
and Reuven may testify for Shimon, the one bound, whether in a monetary matter or a capital one
The Shakh, at ס״ק כ״ט, notes this holds in both directions of the vow. And at ס״ק ל׳ he enters a close argument against the Levush, who grounded the permission in the prohibition against withholding testimony: if so, why speak of testimony rather than of all prohibitions? His answer runs in two ways — the איסור כולל that makes the vow take effect even on a mitzva, or the case where he wishes to become a witness by going to see the deed.
Seif 4 in one sentence. The vow suspends neither visiting, nor healing, nor burial, nor testimony — but everywhere it imposes the posture that is not paid for. And where it is the sick man who forbade his property, we presume he did not mean to forbid what his life depends on; his house stays open for him, not for his son.

Seif 5 — sharing a bed, a bath, a table, a field

The seif descends to the most concrete: two men bound by a vow find themselves in the same bed, the same bath, at the same table, in the same vineyard. Each time the question is physical — does one of them receive something from the other? A small bed warms in winter, a large one does not; a small bath raises the water, a large one does not; a single dish lets one eat the other’s share, unless the host refills it. The end of the seif leaves the body for the estate: selling, buying, lending, borrowing — all forbidden, and by decree.

Reuven who forbade his benefit to Shimon: he may sleep (with him) in a small bed in the dry season, but not in the rainy season, because he confers benefit on him
The Shakh, at ס״ק ל״א, says exactly which benefit: שהגוף נהנה מהגוף בימות הגשמים — the body benefits from the body in the cold season.
and in a large bed it is permitted, both in the dry season and in the rainy season
and he bathes with him in a large tub, but not in a small one, because he benefits him by raising the water upon him
The criterion here is mechanically exact: the immersed body displaces water, and the water rises upon the other. In a large tub the rise is nil.
and he sweats with him even in a small one
The Shakh, at ס״ק ל״ב, settles the distinction: דבזיעה בעלמא ליכא תוספת חום — mere sweating adds no heat. The Ba’er Hetev, at ס״ק כ״ה, repeats it word for word.
and he reclines with him on a couch and eats with him at the same table
The Shakh, at ס״ק ל״ג, gives a psychological reason, rare in this siman: we do not fear he will fall asleep beside him, nor eat what is his, דכיון דהדירו מסתמא שונאים זה את זה — since he made him vow, they presumably dislike each other, more than two guests eating together.
but not from a single dish, lest he eat of his share
and if it is the householder’s practice to refill the dish after they have eaten all that was in it, it is permitted
The Shakh, at ס״ק ל״ד, gives a properly economic reason: דאפילו יאכל יותר מחבירו אינו נהנה דבלאו הכי נותנים להם כל שבעם — since they are sated in any case, eating more takes nothing from the other. The Ba’er Hetev, at ס״ק כ״ו, follows.
Gloss: or if there was from the outset so much in the dish that the remainder returns to the householder — it is permitted (Beit Yosef in the name of the Ran and the Raavad)
if the two of them were digging together in a vineyard, he shall not dig in the row near him, because he benefits him by loosening the ground before him; but far from him it is permitted
The Shakh, at ס״ק ל״ה, says what the loosened soil produces: ונוח לו לחרוש אחריו — it is easier for him to plough behind him. A benefit of labour, measurable and unintended.
and he shall not sell to him, nor buy from him, nor lend him an article, nor lend him money, nor borrow an article or money from him
The gemara, Nedarim 43a, had posed the difficulty: borrowing — how does that benefit the lender? The Shakh, at ס״ק ל״ו, develops it at length, and the Taz, at ס״ק כ״ח, sets out the economic analysis of sale: if the price is fair, both benefit; if there is a discount, one does. The Taz at ס״ק כ״ט and the Ba’er Hetev at ס״ק כ״ז give the decree.
Seif 5 in one sentence. Two criteria run through it: measurable physical benefit — warmth, water level, loosened soil — and גזירה, where a permitted act is forbidden because it resembles a forbidden one. Selling confers nothing, yet is forbidden lest one come to buy.

Seif 6 — the rented bathhouse and oil-press: what “my property” still covers

The siman’s first question of estate, and a purely civil one: a man rented out his bathhouse and his oil-press, then forbade his property to another. The tenant works them. Are they still “his property”? The answer turns on one phrase — תפיסת יד, a grip of the hand, a remnant of control. If some remains, they fall within the vow; if not, they fall outside.

One from whom benefit of his fellow was vowed away, and that other has a bathhouse and an oil-press rented out in the city
if he has a grip of the hand in them, it is forbidden
The Taz, at ס״ק ל׳, glosses in four words — פירוש איזה כח בעלמא, some residual power. The Shakh, at ס״ק ל״ז, cites the gemara and its two readings: for Rashi and the Rosh, the tenant undertook to pay the annual tax on it; for the Ran, the owner takes no share of the profit but a fixed sum.
if he has no grip of the hand in them, it is permitted
The Shakh, at ס״ק ל״ח, and the Taz, at ס״ק ל״א, give the same reason, and it is the reason of the whole seif: לפי שאין דעתו על מה שהשכיר ונסתלק ממנו — his mind was not on what he had relinquished. The Ba’er Hetev, at ס״ק כ״ח, takes it from the Taz.
but if he forbade them to him expressly, the prohibition takes effect on them too
This clause opens the great dispute of the next seif. The Shakh, at ס״ק ל״ט, here rejects the Perisha’s reading — which would have the dissenting view of seif 7 concede here — and shows the Ran rules the reverse: it is on the tenant that he can impose the prohibition, not on a third party.
Seif 6 in one sentence. A general word — “my property” — covers only what the vower’s mind was on; and on what he rented out without keeping a grip, it was not. But an express designation recovers everything: what he did not include, he may still name.

Seif 7 — can one forbid by vow a house he has rented out?

The legal heart of the siman. A house is let; the landlord wishes to forbid it to the tenant. He runs into a principle of property law: the tenant holds a שעבוד, a real right in the thing, and that right resists. The seif then reports three positions — the prohibition takes effect if expressly stated; it does not take effect save in the language of true consecration; and, in the reverse direction, the tenant himself may forbid, It is here that the Shakh places his two longest notes in the siman.

One who rents a house to his fellow, and afterwards the tenant forbade him his property: the prohibition did not take effect on the house he rented to him
The Shakh, at ס״ק מ׳, specifies the case: ואין לו בו תפיסת יד — he retains no grip in it. And at ס״ק מ״א he repeats the reason of the previous seif, word for word.
and if he specified the house expressly, some say the prohibition took effect on it too
The Taz, at ס״ק ל״ב, sets out the reasoning: the house is indeed encumbered for the tenant, but the gemara teaches that consecration displaces a real charge, and קונם כהקדש דמי. The second view disputes precisely that equation. The Shakh, at ס״ק מ״ב, here undertakes a long correction against the Tur: what is ascribed to the Rosh as his conclusion is in fact Rabbenu Tam’s view, and the Rosh concludes with him.
and some say that even if he specified it expressly, he cannot forbid it by the term konam, but only by the term of an actual consecration
Here the Shakh’s ס״ק מ״ג, the longest note in the siman. The Ba’h explained the difference by the power of consecration; the Shakh judges it ill-stated and re-grounds it from Ketubot and Nedarim: קונמות כקדושת הגוף דמי, yet only sanctity of the body displaces a charge, not sanctity of value — and nowadays every consecration is but sanctity of value. The Shakh at ס״ק מ״ד draws the practical consequence: one may consecrate only the portion exceeding the rent or the debt.
and the tenant may forbid it, since the produce is his
The Shakh, at ס״ק מ״ה, opens here his second great note: against apparent obviousness, Rabbenu Yeruḥam in the name of the Rashba and Rabbenu Yona holds that neither in a lease nor in a pledge can one consecrate, even the surplus; and he brings the Yerushalmi of פרק מקום שנהגו. ס״ק מ״ו brings the Ramban’s responsum. The Pitḥei Teshuva, at ס״ק ב, adds the Ḥatam Sofer and the Maharshal, who distinguish a vague formula from an express one.
and the pledgor’s status is that of a landlord, and the pledge-holder’s status is that of a tenant
The equation is structural: what counts is not the legal title but who enjoys the produce. Here the seif becomes a general rule of estate.
Gloss: one who lends a house to his fellow cannot forbid it to him for the duration of the loan (Hagahot Maimoniyot, chapter 6)
The Shakh, at ס״ק מ״ז, reads the gloss as a pure extension: the lender is in every respect like a landlord. The Taz, at ס״ק ל״ג, reads otherwise — this gloss is Rabbenu Tam’s view, hence the second opinion, and it holds even where he specifies expressly.
and the borrower may forbid it to another for the whole duration of the loan, for it is as his own (Beit Yosef, end of this siman, in the name of the Rashba)
Seif 7 in one sentence. A vow is not a consecration: it has not the force to extinguish a right already vested in another over the thing. Whoever holds the produce holds the power to forbid — hence the two closing equations: the pledgor is like a landlord, the pledgee like a tenant.

Seif 8 — going through a third party: how far without making him an agent

The most ingenious seif in the siman, and the most disputed in its detail. A man may give nothing to the one he bound — but he may address the world. He goes to the shopkeeper and says: “So-and-so vowed away benefit from me, and I do not know what to do.” The shopkeeper gives, then comes and collects. The whole device rests on one condition, and it is one of strict law: that the vower be under no obligation to pay. Once he is, the shopkeeper is his agent, and the benefit is direct. The seif then lists the formulas that cross the line — the imperative, and the singular.

One who gives a panel to a craftsman to paint, and forbade it to its owner after he had painted it, before he had paid him — it is permitted.
The question is אומן קונה בשבח כלי: does the craftsman acquire a share in the added value? The Shakh, at ס״ק מ״ח, and the Taz, at ס״ק ל״ד, answer that he does not, and that even for one who would say he does, the added value must be material — worked wood, not pigment. The Ba’er Hetev, at ס״ק ל׳, refers to Ḥoshen Mishpat 306.
One from whom benefit of his fellow was vowed away: the one who vowed may say to the shopkeeper — so-and-so is bound from benefit of me, and I do not know what to do; and the shopkeeper gives him, then comes and takes from the one who vowed
This is the mishna of Nedarim 43a. The Taz, at ס״ק ל״ה, notes that the gemara adds ואין לו מה יאכל — he has nothing to eat — but that the Rosh and the Tur write this is not restrictive: the permission holds even if he has plenty. The Shakh, at ס״ק מ״ט, and the Ba’er Hetev, at ס״ק ל״א, confirm; here the Meḥaber follows the Rishonim against the letter of the mishna.
if the one who vowed wishes to pay him (but he is not obliged to pay him)
The pivotal clause of the whole seif, and the Shakh, at ס״ק מ״ט, gives its reason in a line: דא״כ ה״ל שלוחו והיה חבירו אסור בו — otherwise he would be his agent. The Taz, at ס״ק ל״ו, makes a long demonstration of it against the Perisha, who claimed one could be obliged without being an agent; he argues from Ketubot 70 that the mishna would not have framed its לא מבעיא as it did were that so.
and likewise, if the bound man had a house to build, a fence to raise, a field to reap, he may say to the labourers: so-and-so is bound from benefit of me, and I do not know what to do; and they work with him, then come and take wages from the one who vowed, if he wishes to pay them
and likewise it is permitted to say: whoever feeds so-and-so, or works with him, will not lose by it
The Shakh, at ס״ק נ׳, brings from the Perisha that in this case one would have to repay in full, agency-language not applying in the plural; and at ס״ק נ״א he brings from the Ba’h that even said to an individual, “whoever feeds” remains permitted, since he did not use the singular “if you feed”. The Ba’er Hetev, at ס״ק ל״ב, sums up both.
but it is forbidden to say: let whoever hears my voice feed so-and-so — for, being a form of command, it is as his agent
The imperative creates agency even when addressed to all. The Taz, at ס״ק ל״ז, draws the civil consequence: here he is bound to pay even without adding “he will not lose”, since an agent cannot lose through his principal; and he sets the Perisha aside. The Ba’er Hetev, at ס״ק ל״ג, follows.
and likewise it is forbidden to say to his fellow: if you feed so-and-so, you will not lose — for since he says it to a single man, he looks like his agent
The Taz, at ס״ק ל״ח, notes the Meḥaber’s exact word — נראה כשלוחו, he appears as his agent — and explains it by law: פי׳ וצריך לשלם לו מן הדין, he is in fact bound to pay.
Seif 8 in one sentence. The border between permitted and forbidden is here exactly the border between what obliges and what does not: one may declare a distress, one may promise indemnity to the crowd; one may not command, nor address a single man.

Seif 9 — the gift to a third party, the declaration of ownerlessness, and the gift that is none

On the road, one of them has nothing to eat. The siman opens two ways: to give to a third party, who will then give; or, lacking a third party, to lay it on a rock and declare it ownerless. Then comes the counterpoint, and it is what gives the seif its value: the gift must be real. If it carries a condition, or if the circumstances show the giver never meant to divest himself, it is void — and the prohibition stands.

They were walking on the road and he has nothing to eat: he gives to another as a gift, and the latter is permitted in it
The Shakh, at ס״ק נ״ב, confines the permission to the mishna’s case: הכא דוקא משום דאין לו מה יאכל התירו, and the Rosh so rules. The contrast with seif 8 is worth weighing, where the same Shakh accepted the Rosh’s extension — the difference being that here the property actually passes from hand to hand.
and if there is no one else with them, he lays it on the rock and says: behold, it is ownerless for whoever wishes — and the other takes and eats
The Shakh, at ס״ק נ״ג, addresses the legal objection: by rabbinic law an abandonment is valid only before three. He answers that the food emergency makes us revert to Torah law — and adds a second answer. The Ba’er Hetev, at ס״ק ל״ה, reports the Shakh’s solution in another form: the rule of three applies only to real property.
To what does this apply? Where he gives to another as a gift, without qualification
but if he said to his fellow: the meal is given you as a gift, and let so-and-so, who is forbidden my benefit, come and eat with you at the meal — that is forbidden
A gift whose condition empties it never left the giver’s estate: the one who eats therefore still eats from his. This is the Rambam’s doctrine in chapter 7, and the siman takes it as it stands.
and more than that: even if he gives without qualification, then says to him — would you like so-and-so to come and eat with you? —, if the end proves the beginning, namely that he gave it only on condition that so-and-so come and eat, it is forbidden
The rule of proof here is הוכיח סופו על תחלתו: the later facts disclose the initial intent. One does not ask the giver what he meant; one reads it from the disproportion of the meal.
for instance where it was a large meal and he wants his father, or his teacher, or the like, who are forbidden his benefit, to eat of his meal — for behold his meal proves against him that he did not complete the conveyance. And so for all that resembles this
The examples are the Rambam’s: the father, the teacher. These are the people for whom one makes a large meal — hence the demonstration. The seif closes with a clause of extension, וכן כל כיוצא בזה, making it a general rule for reading gifts.
Seif 9 in one sentence. Property leaves an estate only where the will to divest is entire. A conditional gift is no gift; and a gift whose scope the circumstances belie is likewise none — שלא גמר להקנות.

Seif 10 — the vow not to speak: writing, and the third party

A seif of two lines, and two practical outlets: to write, or to speak to a third party whom the other hears. The difficulty appears only in the commentary — a vow does not take effect on a thing without substance, and speech has none. The Taz concludes that the seif concerns only an oath; the Nekudot HaKesef dispute it.

One who swore or vowed not to speak with his fellow may write him a writing
The Taz, at ס״ק ל״ט, confines the seif to an oath: זה קאי אנשבע דאילו בנדר אינו חל על דבר שאין בו ממש, referring to siman 213. The Nekudot HaKesef, at their sixth entry, reply that this is not so — a vow takes effect rabbinically even on what lacks substance, and one may in any case frame the vow upon the mouth itself.
(or) to speak with another, and he hears
The Shakh, at ס״ק נ״ד, sets the decisive limit: this holds only where he did not intend to be heard by him; if he did, even through a third party, לא יפה עשה. The Ba’er Hetev, at ס״ק ל״ו, brings it in the name of the Beit Yosef and the Geonic responsa.
Seif 10 in one sentence. What is forbidden is the named act — speaking — not the fact that the other receives the information. Writing and indirect speech fall outside the word used, unless he plainly meant to reach him.

Seif 11 — the forbidden book: why study is not the shofar blast

Nine words, and one of the subtlest questions in the siman: if the commandments were not given for benefit, why should studying in another’s book be forbidden, while blowing his shofar is permitted? Three different answers are offered by three commentators, and they do not coincide.

If he forbade his book to his fellow, it is forbidden for the latter to study in it
The Shakh, at ס״ק נ״ה, sets it squarely against the shofar of seif 13: כיון שיש להשכיר ספרו וזה לומד בו בחנם ה״ז נהנה — since a book can be rented, studying in it free is a benefit. The Taz, at ס״ק מ׳, answers differently: there is no obligation to lend one’s book, and borrowing wears it. The Ba’er Hetev, at ס״ק ל״ז, brings both, and stresses the wear — a shofar does not suffer. The Pitḥei Teshuva, at ס״ק ד and ס״ק ה, notes that the Peni Aryeh contests the Taz’s reason, and refers to the She’ilat Yaavetz.
Seif 11 in one sentence. The principle מצות לאו ליהנות ניתנו does not cover a benefit that accrues alongside the mitzva — a rental saved for the Shakh, a joy for the Taz, wear on the object in the answer the Ba’er Hetev brings from the Taz.

Seif 12 — the coal and the flame, the blast, and the beast one slaughters

The seif first states a classic and material distinction: a coal has substance, a flame has none. Then it gives a permitted case of mitzva. And it is the Rama’s gloss that sets off the sharpest dispute in the siman: to slaughter the beast of a man one is bound from — is it doing him a service or spoiling his property? The Taz opposes the Rama in exceptionally firm terms, the Nekudot HaKesef refute him point by point, and the Pitḥei Teshuva reports an intermediate position.

One from whom benefit of his fellow was vowed away is forbidden in his coal and permitted in his flame
The Shakh, at ס״ק נ״ו, refers to siman 141 ס״ק י׳; at ס״ק נ״ז he explains the permission: פי׳ מותר להדליק נר בשלהבתו דאין בה ממש. The Taz, at ס״ק מ״א, likens the rule to that of siman 142 on idolatry. The Ba’er Hetev, at ס״ק ל״ח, carries both references.
One from whom benefit of his fellow was vowed away blows for him a blast of mitzva
Gloss: one from whom benefit of his fellow was vowed away — it is permitted to slaughter for him a healthy beast, but not one in danger of death (so it appears from the Beit Yosef in the name of the Ohel Mo‘ed)
The Shakh, at ס״ק נ״ח, gives the Rama’s reason in a line — מפני שהוא מקלקל אבל לא במסוכנת שהוא מתקן — and refers to siman 10. The Taz, at ס״ק מ״ב, refuses: the permission to eat is a vast benefit, we hire a slaughterer every day, and the rule of the idolater’s knife does not extend. The Nekudot HaKesef, at their seventh entry, refute him in detail. The Pitḥei Teshuva, at ס״ק ו, brings from the Peni Aryeh a view following the Rama but hedged with conditions; at ס״ק ז, he treats the case where the endangered beast was slaughtered after the fact.
Seif 12 in one sentence. What has no substance is not owned, hence not lent; and an act whose damage exceeds its improvement is no benefit — but whether slaughter is such an act is precisely what remains open.

Seif 13 — the shofar and the spring: the mitzva is not a benefit

Two cases where the vow bears on the object itself — a shofar, a spring — and where performing the mitzva remains permitted. The rule is מצות לאו ליהנות ניתנו. But the spring shows its boundary at once: in summer, immersing is also a pleasure, and pleasure is not the mitzva. The seif closes with a compiler’s note that it duplicates siman 217.

One from whom benefit of a shofar was vowed away: it is permitted for him to blow with it a blast of mitzva
The Shakh, at ס״ק נ״ט, raises the difficulty: the text suggests he may blow it himself, whereas Oraḥ Ḥayyim 586:5 writes that another blows for him, and he ends וצ״ע; then he brings from the Ba’h that in pressing need he may blow himself. The Taz, at ס״ק מ״ג, explains why blowing is not study: the Torah gladdens the heart, as seen from its being forbidden in mourning. The Ba’er Hetev, at ס״ק מ׳, sums up both.
One from whom benefit of a spring was vowed away immerses in it an immersion of mitzva in the rainy season, but not in the dry season.
The seasonal division is the same as in seif 5, and says the same: in winter, the immersion is only the mitzva; in summer, it is also a refreshment, and refreshment was not given free of benefit.
(a duplicate of siman 217, seif 26)
A compiler’s note, present in the edition. It indicates that the same case is treated in siman 217 — the only note of its kind in our siman.
Seif 13 in one sentence. Performing a mitzva with the forbidden object is permitted; taking the pleasure the object otherwise affords is not. What remains open is whether the bound man may blow it himself.

Seif 14 — the borrowed lulav: the first day, and the rest

The siman closes on a case where two rules cross. The first is that of seif 13: performing a mitzva is not benefiting. The second comes from the verse — ולקחתם לכם, on the first day the lulav must be one’s own. And a thing whose benefit is forbidden cannot be acquired. On the first day, therefore, he does not fulfil his obligation; on the other days, he does.

One who vowed away benefit from his fellow, and the other gave him a lulav to fulfil his obligation on condition that he return it: on the second day, he has fulfilled it
The Shakh, at ס״ק ס׳, and the Taz, at ס״ק מ״ד, give the same reason: דמצות לאו ליהנות ניתנו. The Ba’er Hetev, at ס״ק מ״א, adds a reference — whether men bound by such a vow join for the zimmun, treated in Oraḥ Ḥayyim, end of siman 196.
but on the first day, he has not fulfilled it
The reason is scriptural: דבעינן ולקחתם לכם משלכם ולא משל אסורי הנאה, writes the Shakh at ס״ק ס׳; the Taz at ס״ק מ״ד adds ואינו קנוי לו לשום דבר. And the Taz closes the siman with an addition of his own: in his view one may not even give him paid work, since being preferred over others is already a benefit — he refers to siman 160 seif 23.
Seif 14 in one sentence. It is not the benefit that bars, but the ownership. A lulav given “on condition that it be returned” is a true gift for the purposes of the mitzva — but a thing forbidden in benefit is not acquired, and the first day requires that it be one’s own.

3. The key concepts of this siman

מודר הנאה · מדיר · נאסר — the one from whom benefit was vowed away; the one who spoke the vow; the one who ends up bound. The vow runs in both directions, and the siman uses these three words to keep the roles apart.
ויתור — the customary indulgence, what is granted without a thought and charged for by no one: passage across a field, the seller’s slightly generous measure. Rabbi Eliezer forbids it to the מודר הנאה, and from him the siman takes its initial severity.
הנאה המביאה לידי מאכל — a benefit that leads to food. The middle formula of seif 1: it does not reach the food itself outside the act of eating, but it reaches everything that prepares the meal — the woodcutting axe, the pot, the donkey that carries the fruit.
גרמא — the indirect effect. Settling a man’s debt spares him an outlay but gives him nothing; the gemara calls it אברוחי ארי, driving off a lion. It is the first breach the siman makes in its own severity.
הנאה דממילא — the benefit that comes of itself. Feeding a man’s wife and children spares him an expense, but that result is not given: it happens. The Shakh, at ס״ק ח, adds that those people could have lived otherwise.
מצות לאו ליהנות ניתנו — the commandments were not given for benefit. The principle that permits the shofar (seif 13) and the lulav (seif 14) — but which seif 11 bounds: studying in another’s book remains forbidden, and the three commentators explain the difference in three different ways.
תפיסת יד — a grip of the hand: a remnant of the owner’s control over a leased asset. It is the criterion of seif 6 for whether a leased asset still falls within “his property”. The Shakh, at ס״ק ל״ז, gives two competing definitions, Rashi’s and the Rosh’s, and the Ran’s.
שעבוד — the real charge on an asset in another’s favour — the tenant’s right, the pledgee’s. The whole of seif 7 turns on whether a קונם has the force to displace that charge, as a consecration does.
קדושת הגוף · קדושת דמים — sanctity of the body and sanctity of value. A distinction the Shakh, at ס״ק מ״ג, places at the heart of seif 7: only the first displaces a real charge, and nowadays every consecration is but the second.
שליחות — agency. The boundary of seif 8: a shopkeeper who gives of his own accord is a third party; one who gives on command is an agent, and his act is the principal’s. The workable criterion is not intent but the obligation to pay.
הוכיח סופו על תחלתו — the end proves the beginning. The rule of proof of seif 9: a gift made without condition but followed by a revealing request was never a true gift, and the disproportion of the meal is enough to establish it.
מחיותיה לא אדריה — “from his own life he did not bind him.” An estimation of intent the Shakh, at ס״ק כ״ה, applies to a sick man who had forbidden his property: his house stays open to the one who comes to visit. And its limit, at ס״ק כ״ח: as to his son’s life, he may well have bound him.

4. Where these seifim come from

The mishna — Nedarim 32b

The siman begins where the chapter אין בין המודר begins. The mishna sets out the comparison on which all of seif 1 rests: what separates a vow of benefit from a vow of food is exactly two things. And the gemara at once identifies whose teaching it is, and what follows from it.

The mishna — Nedarim 33a: the debt and the lost object

Seif 2 and seif 3 come out of this mishna almost word for word — and the gemara adds the reason that governs everything: the one who pays merely drives off a lion.

The gemara — Nedarim 38b: the daughter, the beast, the cup

Three of the clauses of seifim 2 and 3 come from this page: Rabbi Zeira’s objection about the maidservant, the baraita of Yehoshua of Uza on the beast kept for fattening, and Rabbi Yoḥanan’s cup of peace.

The mishna — Nedarim 43a: the shopkeeper, the labourers, the rock

Seifim 8 and 9 take up this mishna in its order. It gives the two formulas — the one addressed to the shopkeeper and the one to the labourers — then the gift to a third party and the laying down on the rock. The gemara adds Rabbi Yose’s view, and his reservation.

The Rambam — Hilkhot Nedarim, chapters 6 and 7

Chapter 6 treats the three formulas of seif 1; chapter 7 opens with the lost object and its reason. From the Rambam comes the doctrine of the conditional gift in seif 9, including the examples of the father and the teacher.

5. The apparatus of the siman, entry by entry

The apparatus of this siman is the densest of the whole undertaking: one hundred and sixty entries for fourteen seifim — sixty ס״ק of the Shakh, forty-four of the Taz, forty-one of the Ba’er Hetev, eight of the Pitḥei Teshuva, seven of the Nekudot HaKesef. We cite them all, in order, summarising none. The Arukh HaShulḥan is not cited: it is not accessible to us for this siman. Neither are the Peri Ḥadash, the Biur HaGra and the Be’er HaGolah.

The Shakh (ש״ך) — 60 ס״ק

Sixty entries, the largest apparatus any siman in this undertaking has received. Four are full dissertations: ס״ק מ״ג on sanctity of body against sanctity of value, ס״ק מ״ה on the Yerushalmi of מקום שנהגו, ס״ק ל׳ on testimony, and ס״ק ל״ו on the decree concerning sale.

ס״ק א — אפילו בבקעה — passage is forbidden even without a shortcut

7. Practical cases

Six situations, taken in the order of the siman. Each closes on the same referral: actual conduct belongs to the Rav.

Case 1 — a quarrel in which one bound himself from the other

Two people fell out, and one pronounced a formula forbidding benefit. The first thing to establish is not what he meant to forbid but which way the vow runs — did I forbid my property, or forbid myself his? The whole siman depends on it, and the answer changes even matters as slight as walking across a piece of land. Ask your Rav.

Case 2 — a debt to be settled for someone

Seif 2 permits it, and it is one of the most used permissions in the siman. But the Shakh attaches two conditions the Meḥaber does not write: that it be without the debtor’s knowledge, and — per the Ba’h he cites — that the debt carry neither a deed nor a pledge. Two conditions absent from the text: this is not decided alone.

Case 3 — a sick person to visit

Seif 4 permits the visit in both directions of the vow, but imposes a posture — standing — and a division: the man, yes; his beast, no; gratis, only where no one is paid. And the siman itself carries here a textual variant on the word “standing”, which the Shakh and the Taz hold to be an error. A real case goes to a Rav.

Case 4 — a leased asset, and an undertaking made after the lease

Seifim 6 and 7 are the civil heart of the siman, and they are not read apart: seif 6 says a general word does not reach what one has relinquished, seif 7 says that even an express designation runs into the tenant’s right — and reports two views on the extent of that limit, plus the Shakh’s position at ס״ק מ״ה which restricts further. Three layers of opinion: ask your Rav.

Case 5 — routing help through a third party

This is the commonest case today, and seif 8 gives the device. But the border is narrow: declaring a distress is permitted, promising to the crowd is permitted, commanding is forbidden, and addressing a single man is forbidden. The Taz, at ס״ק ל״ו, shows that everything turns on a question one does not think to ask — am I bound to repay? Ask your Rav.

Case 6 — performing a service that is normally paid for

The Rama’s gloss at seif 12 permits slaughtering a healthy beast; the Taz, at ס״ק מ״ב, writes that איסור גמור הוא; the Nekudot HaKesef refute him; the Pitḥei Teshuva, at ס״ק ו, brings from the Peni Aryeh a middle way with three conditions. This is the sharpest maḥloket in the siman, and it is open. Do not decide: ask.

8. Comprehension questions

  1. What are the two directions in which a vow forbidding benefit may be pronounced, and why does the siman use the word הנאסר rather than either man’s name?
  2. What is ויתור, and why does it forbid crossing an open field in the dry season?
  3. Set out the three formulas of seif 1 — “food”, “the benefit of your food”, “a benefit that leads to food” — and show where each one cuts, using the chewed wheat and the sieve.

  12. What is תפיסת יד, and what are the two definitions the Shakh brings at ס״ק ל״ז?
  13. Why can a קונם not reach a house already let, while a consecration could? Set out the Shakh’s distinction at ס״ק מ״ג.
  14. What is the condition on which the whole device of seif 8 rests, and why does the Taz, at ס״ק ל״ו, refute the Perisha on this point?
  15. Why is “let whoever hears my voice feed so-and-so” forbidden while “whoever feeds so-and-so will not lose” is permitted?
  16. What is the rule הוכיח סופו על תחלתו, and how does seif 9 establish it by means of a large meal?
