1. The axiom: every benefit, down to the one no one charges for

The axiom. The siman applies the mishna of אין בין המודר per Rabbi Eliezer, who holds that even ויתור is forbidden to the מודר הנאה. ויתור is the customary indulgence — the kind no one bills for. Hence the siman opens on the right of way, and the question, seif after seif, is never “is this a large benefit?” but “is this a benefit?”.
1. The vow runs both ways — “my property is forbidden to you”, or “your property is forbidden to me”. In both, the נאסר is the one bound and the מדיר the one who spoke.
▼
2. It reaches every benefit, including the kind no one bills for — passage, a vessel, a service.
▼
3. Except three: benefit merely avoided (גרמא), benefit that comes of itself (דממילא), and benefit that is only the mitzva.
▼
4. And the measure that decides everywhere: is this service normally paid for? If so, rendering it free is a benefit.

2. Mechanism A — what the vow reaches in the person

Seif 1 and seif 5 treat the same matter at two scales: what is borrowed, and what is shared. The rule is physical: if one man’s body receives something from the other’s body or property, it is forbidden. A small bed warms in winter; a small tub raises the water; a vine row dug ahead of him loosens his soil.
But the wording narrows. Seif 1 unfolds four ever narrower formulas, and here precision is needed: “benefit” reaches everything; “food” reaches only the act of eating; “the benefit of your food” adds any benefit from the body of the food — hence the wheat chewed onto the wound; “a benefit that leads to food” removes the wound and adds the cooking vessels.
The pitfall. The two clauses above are materially identical — the same wheat, the same wound — and they are opposites. It is therefore not the fact that decides but the formula spoken. Establishing which words were said comes before any application.

3. Mechanism B — what the vow does not reach: גרמא, דממילא, mitzva

First: benefit avoided. Paying a man’s debt gives him nothing; the gemara calls it אברוחי ארי, driving off a lion. The Taz supplies the phrase: it is only גרמא.
Second: benefit that comes of itself. Feeding the wife and children spares the husband an expense, but that result is not given, it happens. The Shakh adds that those people could have lived on their labour: so the expense spared was not even certain.
And its limit, at once. A beast is kept for its value: feeding it raises its price. The Ran goes further — even where over-feeding harms a working animal, it is forbidden. The criterion is therefore not actual benefit but the object’s destination.
Third: benefit that is only the mitzva. Returning a lost object is permitted in both directions of the vow, because it is a mitzva; blowing a forbidden shofar is permitted; discharging one’s obligation with a borrowed lulav likewise, save on the first day. The Rambam says it in three words at the head of his chapter 7.
And its limit. Seif 11 forbids studying in the book one has been barred from, and seif 13 permits immersion in the spring only in winter. The principle covers the mitzva, not the benefit that attends it — rent spared, joy, refreshment.

4. Mechanism C — the measure of the fee, which governs the whole siman

The measure. Everywhere in this siman the operative question is: is this service normally paid for? If so, rendering it free remits a price — hence confers benefit. If not, there is nothing to remit. This single measure explains the sieve, the visit standing, the physician, teaching nowadays, and the book.
Three applications to remember. (1) Visiting the sick: standing where one pays a companion who sits — but the Shakh specifies that sitting for a fee is permitted. (2) Healing: free where no physician’s fee is customary, for a fee elsewhere. (3) Teaching: the halakha here changed with practice, and the siman says so expressly.
The pitfall. The measure is local and temporal: “in a place where a fee is given”, “nowadays”. Conduct right in one place may be wrong in another, and the state of the market for services is a datum of the question, not a detail.

5. Mechanism D — what passes through a third party, and on what condition

Seif 8 permits declaring a distress to a shopkeeper or to labourers, and letting them act. The condition lies in a parenthesis: the vower is not obliged to pay. The Shakh gives the reason in a line — otherwise he would be his agent.
The two formulas that cross the line, and the seif itself gives them: the imperative — “let whoever hears my voice feed him” — because it is a command; and the singular — “if you feed so-and-so you will not lose” — because addressing a single man looks like agency.
Seif 9 adds the route of the property itself: to give to a third party, or to lay it down and declare it ownerless. But the gift must be entire: a condition empties it, and so do circumstances that belie it. This is the rule
And a difference not to be missed. In seif 8 the Shakh accepts the Rosh’s extension: the shopkeeper permission holds even if he has plenty to eat. In seif 9 he refuses it: there it was permitted only because he has nothing to eat. The reason is structural — in seif 8 nothing passes hand to hand, in seif 9 property changes owner twice.

6. Mechanism E — the estate: what “my property” covers, and what a vow can no longer reach

First storey: what the word covers. A leased asset leaves “my property” if the owner retains no תפיסת יד over it. The reason is one of intent, not of title: his mind was not on what he relinquished. But an express designation recovers the asset.
Second storey: what a vow can no longer reach. Even when expressly designated, the leased asset carries the tenant’s שעבוד. The seif reports two views, and the second — Rabbenu Tam’s, per the Shakh — denies the קונם the force to displace that charge. The Shakh gives the decisive reason: only sanctity of the body displaces a charge, and a consecration today is but sanctity of value.
Third storey: who holds the power to forbid. The tenant may forbid — דהא פירותיו הם. And the seif generalises in two equations: the pledgor is like a landlord, the pledgee like a tenant. What counts is not the title but the enjoyment.
The pitfall. The Shakh, at ס״ק מ״ה, restricts further what the seif seemed to concede: per Rabbenu Yeruḥam in the name of the Rashba and Rabbenu Yona, one may consecrate neither in a lease nor in a pledge, not even the surplus. A plain reading of the seif is therefore not enough.

7. Mechanism F — the mitzva performed with a forbidden object

Four cases, and a single principle: Blowing the forbidden shofar, immersing in the forbidden spring in winter, discharging one’s obligation with a borrowed lulav on the second day, blowing for the one you are bound from. In all of them the act performed is the mitzva, and nothing else.
Three limits, all of one kind: a benefit that accrues alongside the mitzva does not fall under the principle. (1) The book, because it can be rented — or because it is worn, or because the Torah gladdens; all three reasons circulate. (2) The spring in summer, because one is refreshed. (3) The lulav on the first day, where the bar is not benefit but ownership: ולקחתם לכם, and a thing forbidden in benefit is not acquired.

8. Master table — the fourteen seifim in the order of the book

The six preceding sections arrange the material by mechanism; this one restores it to the order of the Shulḥan Arukh, clause by clause, so that a seif can be found.

SeifThe clause of the Shulḥan ArukhWhat it says
א« ראובן שאסר נכסיו על שמעון או שאסר עצמו מנכסי שמעון הנאסר אסור לעבור על שדה האחר » (שו״ע יו״ד רכ״א:א)Reuven who forbade his property to Shimon, or who forbade himself Shimon’s property — the one to whom it became forbidden may not walk across the other’s field
א« אפילו בבקעה בימות החמה שאין בני אדם מקפידים על דריסת רגל שבה » (שו״ע יו״ד רכ״א:א)even in an open plain, in the dry season, where people are not particular about the treading of feet in it
א« ואסור לשאול ממנו כלים שבעולם » (שו״ע יו״ד רכ״א:א)and it is forbidden for him to borrow from him any vessel in the world
» (שו״ע יו״ד רכ״א:א)and if he vowed against him only food, he is forbidden only to eat of what is his.
If he said: “the benefit of your food is upon me” — he is forbidden to eat of what is his
א« ואסור ללעוס חטים ליתן על גבי מכתו » (שו״ע יו״ד רכ״א:א)and it is forbidden for him to chew wheat to place on his wound
א« אבל לשאול ממנו נפה וכברה מותר » (שו״ע יו״ד רכ״א:א)but to borrow from him a sieve or a sifter is permitted
If he said: “a benefit that leads to food is upon me” — he is forbidden to eat of what is his
א« ומותר ללעוס חטים וליתן על גבי מכתו » (שו״ע יו״ד רכ״א:א)and it is permitted for him to chew wheat and place it on his wound
א« ואסור ליהנות בכל דבר שמשכירין כיוצא בו » (שו״ע יו״ד רכ״א:א)and it is forbidden for him to derive benefit from anything the like of which is rented out
א« ומה שאין משכירין כיוצא בו מותר אם אין בו שייכות מאכל » (שו״ע יו״ד רכ״א:א)and that the like of which is not rented out is permitted, if it bears no relation to food
א« אבל אם יש בו שייכות מאכל כגון נפה וכברה » (שו״ע יו״ד רכ״א:א)but if it does bear a relation to food, such as a sieve and a sifter
א« ואפילו שק להביא בו פירות וחמור להביא עליו פירות » (שו״ע יו״ד רכ״א:א)and even a sack in which to carry fruit, and a donkey on which to carry fruit
א« וכן סוס לרכוב עליו לבית המשתה וטבעת להראות בו בבית המשתה » (שו״ע יו״ד רכ״א:א)and likewise a horse to ride to the wedding feast, and a ring to be seen with at the wedding feast
א« ולעבור דרך שדהו לבית המשתה אף על פי שאין משכירין כיוצא בו אסור » (שו״ע יו״ד רכ״א:א)and to cross his field on the way to the wedding feast — although the like is not rented out, it is forbidden
א« וכן אסור לקנות לו צרכי סעודה » (שו״ע יו״ד רכ״א:א)and likewise it is forbidden for him to buy for him the needs of a meal
א« וכן אסור לחמם ידיו בככר שלו: » (שו״ע יו״ד רכ״א:א)and likewise it is forbidden for him to warm his hands at his loaf.
» (רמ״א יו״ד רכ״א:א)Gloss: an axe with which one splits wood to cook food is called a benefit that leads to food; but an axe with which one weeds, it is permitted to borrow it for him.
(Beit Yosef in the name of Rabbenu Yeruḥam)

ב« ואסור ללמדו מקרא כיון שמותר ליטול שכר עליה והוא מלמדו חנם נמצא שמהנהו » (שו״ע יו״ד רכ״א:ב)and it is forbidden for him to teach him Scripture, since it is permitted to take a fee for it, and he teaches him free — so that he is found to benefit him

ב« והוא שלא יאמר הנאסר לאוסר שילמדנו » (שו״ע יו״ד רכ״א:ב)and that provided the one forbidden does not ask the one who forbade to teach him

(ב״י בשם הרא״ש ורבינו ירוחם): » (שו״ע יו״ד רכ״א:ב)and the same for any matter of mitzva; provided, however, that in a matter requiring an agency — such as separating his teruma — it is forbidden for him to be his agent. (Beit Yosef in the name of the Rosh and Rabbenu Yeruḥam)
ג« ראובן שאסר נכסיו על שמעון אסור להשיאו בתו קטנה או נערה לפי שעדיין היא ברשותו והרי מוסר לו שפחה לשמשו » (שו״ע יו״ד רכ״א:ג)Reuven who forbade his property to Shimon: it is forbidden for him to give him in marriage his minor or na‘ara daughter, because she is still under his authority, and behold he is handing him a maidservant to serve him

ה« ראובן שאסר הנאתו על שמעון יכול לישן (עמו) במטה קטנה בימות החמה אבל לא בימות הגשמים מפני שהוא מהנהו » (שו״ע יו״ד רכ״א:ה)Reuven who forbade his benefit to Shimon: he may sleep (with him) in a small bed in the dry season, but not in the rainy season, because he confers benefit on him

9. The open disputes of the apparatus

Seven disagreements the apparatus leaves open, and which no page can settle in a Rav’s stead.

1. Passage without a shortcut (seif 1). The Ba’h would permit where it does not shorten the road; the Shakh at ס״ק א, the Taz at ס״ק א and the Nekudot HaKesef forbid in every case. The Ba’er Hetev records ודלא כהב״ח.
2. A debt with a deed or a pledge (seif 2). The Meḥaber permits without distinction; the Ba’h, cited by the Shakh at ס״ק ו, forbids where the debt is certain. The Nekudot HaKesef refer to the author’s own commentary on Ḥoshen Mishpat 128, where he objects to the Sma on this point.
3. Asking to be taught (seif 2). The Meḥaber requires that the bound man not ask; the Rama, in the name of the Rosh and the Tur, permits even if he did; the Ba’h, cited at ס״ק י״ג, rules like the first view.
4. The word מעומד in seif 4. The Shakh at ס״ק כ״ד and the Taz at ס״ק כ״ה hold it a copyist’s error; the edition that reaches us carries it in parentheses. A question of text, not of opinion — yet it changes conduct.
5. The קונם against the שעבוד (seif 7). Three positions, plus a fourth in the apparatus: the prohibition takes effect if expressly designated; it takes effect only in the language of consecration; per the Shakh at ס״ק מ״ה one cannot even consecrate, not even the surplus; and the Pitḥei Teshuva at ס״ק ב reports that an express formula is required besides.
6. Slaughtering (seif 12). The Rama permits, the Taz at ס״ק מ״ב writes ואיסור גמור הוא, the Nekudot HaKesef refute him, and the Peni Aryeh — cited at Pitḥei Teshuva ס״ק ו — follows the Rama on three conditions.
7. Blowing oneself (seif 13). The Shakh, at ס״ק נ״ט, sets our seif against Oraḥ Ḥayyim 586:5 and concludes וצ״ע; the Ba’h permits in pressing need, as the Ba’er Hetev reports.

10. The vocabulary of the siman

TermSense
The one from whom benefit is withheld; the one who spoke the vow; the one bound by it
The customary indulgence no one bills for — and which is nevertheless forbidden (seif 1)
A benefit that leads to food: the middle formula of seif 1
The indirect effect — settling a debt, אברוחי ארי (seif 2)
Benefit that comes of itself — the wife and children fed (seif 2)
The commandments were not given for benefit — seifim 12, 13, 14
A remnant of control over a leased asset — the criterion of seif 6
The real charge of a tenant or pledgee — the obstacle of seif 7
Sanctity of body and sanctity of value; only the first displaces a charge (Shakh ס״ק מ״ג)
Agency — the boundary of seif 8, measured by the obligation to pay
The end proves the beginning — the rule of proof of seif 9
From his own life he did not bind him — the Shakh’s estimation at ס״ק כ״ה
Damage and improvement — the measure of slaughtering in seif 12

11. Golden rules, mnemonic and classic pitfalls

Everything · except three · measured by price. The vow reaches every benefit, down to the kind no one bills for. It leaves three breaches: what is merely avoided, what comes of itself, what is only the mitzva. And everywhere the same measure: is this service paid for?
Golden rules. (1) First establish which way the vow runs and which words were said: the siman changes entirely with each. (2) A benefit avoided is not a benefit received — but only if it was not certain. (3) What is normally paid for, given free, is a benefit. (4) A general word covers only what the mind was on; an express designation goes further, but runs into a third party’s right. (5) One may address the world; one may not command nor address a single man. (6) A gift is a gift only where the will to divest is entire.
Classic pitfalls. (1) Thinking the vow bears only on money: it bears on passage, service, speech and study. (2) Applying the debt-payment permission without checking the Shakh’s two conditions. (3) Taking the permission to feed the household as a permission to feed: the beast remains forbidden, even when one harms it. (4) Reading seif 8 without its parenthesis: once the vower must pay, the whole device collapses. (5) Treating seif 7 as a seif of vows: it is a seif of property law, and the Shakh expressly returns it there. (6) Deciding the slaughtering question on the Rama alone: the Taz opposes it in formal terms and the apparatus does not conclude.
All the above is a study summary. Actual conduct — knowing which way the vow was pronounced, which words were said, what the local practice pays for, and whether the vower owes anything — belongs to the Rav.
