1. The line of ruling, in five propositions

This level sets out the line of ruling as the decisors laid it down. It does not replace a Rav’s decision. A case of מודר הנאה touches both the vow and property law: it goes to a Rav, and the formula is pronounced under his direction.
1. For food, no formula is required: the husband is the debtor, he has nothing to acquire (Shakh ס״ק א, Taz ס״ק א, in the Ran’s name).
2. For money, the complete formula has three elements: the gift, the clause “your husband has no right in them”, and a designation.
3. The designation may be any named use — food, clothing, “the like”: that is the Ran’s widening which the Mehaber adopts.
4. Saying מה שתרצי עשי in place of the designation suffices per the Mehaber, does not per the יש אומרים: lekhatehila one specifies the use.
5. Saying nothing at all in place of the designation is the case the seif declares forbidden — and the Nekudot HaKesef, siding with the Raavad, are the only voice the other way.

2. The two open divergences

1. מה שתרצי עשי — the Mehaber against the יש אומרים

The Shakh gives both elements of the arbitration, and they do not point the same way. On one side, the same Mehaber writes at Even HaEzer 85:11 the first position without reservation. On the other, the Ba’h lays down that in a dispute of Rishonim one goes stringently in vows — but for money the holder prevails.

The conduct that emerges is simple to state and commits no one to a decision: specify the use. To say “for what you will eat and what you will wear” leaves the debate entirely, since all admit it. The מה שתרצי עשי should serve only where the use cannot be named — and that case goes to a Rav.

2. The designation without the clause — the Shakh against the Sha’ar HaMelekh

The Shakh writes פשיטא and the Taz writes that he sees no doubt in it. But the Pit’hei Teshuva gathers four Rishonim the other way, and they are no minor voices: the Ran, the Kitzur Piskei HaRosh, the Rashba, and a deduction of the Tosafot Yom Tov within the Rambam himself.

Here too, practical conduct sidesteps the debate rather than deciding it: say both. The clause costs one sentence, and places the gift on the side all recognise.

3. What must not be arranged — and why

The Perisha had proposed that the son-in-law vow himself off those assets: the father-in-law could then give with no formula. The Taz rejects the device, and the Ba’er Hetev expressly follows him.

The decisive reason deserves to be kept beyond this siman: a vow one takes on oneself can be released. An arrangement whose validity rests on a revocable undertaking is no arrangement. That is exactly why these situations are not settled between the parties alone.

The question the Pit’hei Teshuva leaves open

The money designated for the wife, from which the husband could draw nothing in her lifetime — does it come to him if she dies? The Pit’hei Teshuva refers to the Sha’ar HaMelekh without deciding. It is a question of inheritance as much as of vows, and today it is the likeliest of the five.
