Siman 222 — Providing for One’s Daughter When the Son-in-Law Is מודר הנאה

1. The mechanism, in three steps
the father-in-law gives to his daughter→the daughter acquires property→the husband eats its fruits→the son-in-law benefits from his father-in-law: forbidden
The solution is not to conceal the gift but to make it incomplete: what has not been transferred absolutely yields no fruits for the husband.
And a remark that saves many questions: for food, none of this arises. The husband is the debtor, so there is no right in him to come into being (Shakh ס״ק א, Taz ס״ק א, in the Ran’s name).
| What he says | The outcome | Who |
| “… as a gift, your husband has no right in them, they are for your food or your clothing” | permitted — all agree | mishna, Rambam, Tur, Mehaber, יש אומרים |
| “… your husband has no right in them, do with them what you wish” | disputed — permitted for the Mehaber (Shmuel, Rambam), forbidden for the יש אומרים (Rav, Tur, Rosh) | Taz ס״ק ב · Shakh ס״ק ג |
| “… your husband has no right in them”, and nothing more | forbidden per the Mehaber — the husband acquires to eat the fruits | but the Nekudot HaKesef hold with the Raavad: he does not acquire |
| “… for your food”, without saying “your husband has no right in them” | forbidden — פשיטא for the Shakh and the Taz; but the Sha’ar HaMelekh gathers Rishonim who permit | Shakh ס״ק ב · Taz ס״ק ב · Pit’hei Teshuva ס״ק א |
3. The seif, clause by clause, in the order of the book
| Seif | The clause of the Shulchan Arukh | What it says |
| א | « מי שהתנו מודר הנאה ממנו ורוצה ליתן טעות לבתו. ובו סעיף אחד » (שו״ע יו״ד רכ״ב:א) | One whose son-in-law is מודר הנאה from him, and who wishes to give money to his daughter — and it contains one seif |
| א | « המודר מחתנו והוא רוצה לתת לבתו מעות » (שו״ע יו״ד רכ״ב:א) | One who is מודר from his son-in-law and wishes to give money to his daughter |
| א | « כדי שתהא נהנית בהם ומוציאה אותם בחפציה » (שו״ע יו״ד רכ״ב:א) | so that she may enjoy them and spend them on her own needs |
| א | « הרי זה נותן לה ואומר לה הרי המעות הללו נתונים לך במתנה » (שו״ע יו״ד רכ״ב:א) | he gives her and says to her: behold, these coins are given to you as a gift |
| א | « ובלבד שלא יהא לבעליך רשות בהן » (שו״ע יו״ד רכ״ב:א) | provided only that your husband have no right in them |
| א | « אלא יהיו למה שאת נותנת לתוך פיך או למה שתלבשי וכיוצא בזה » (שו״ע יו״ד רכ״ב:א) | but let them be for what you put into your mouth, or for what you will wear, or the like |
| א | « ואפי׳ אמר על מנת שאין לבעליך רשות בהם אלא מה שתרצי עשי בהם » (שו״ע יו״ד רכ״ב:א) | and even if he said: on condition that your husband have no right in them, but do with them what you wish |
| א | « לא קנה הבעל ומה שתרצה תעשה בהם » (שו״ע יו״ד רכ״ב:א) | the husband has not acquired, and she will do with them what she wishes |
| א | « אבל אם נתן לה מתנה ואמר לה על מנת שאין לבעליך רשות בהם » (שו״ע יו״ד רכ״ב:א) | but if he gave her a gift and said to her: on condition that your husband have no right in them |
| א | « ולא פירש שתהא המתנה הזאת לכך ולכך או למה שתרצה תעשה בהם » (שו״ע יו״ד רכ״ב:א) | and did not specify that this gift should be for this and that, or for what she would wish to do with them |
| א | « הרי זה יקנה אותה הבעל לאכול פירותיה ודבר זה אסור » (שו״ע יו״ד רכ״ב:א) | then the husband will acquire it to eat its fruits — and that is forbidden |
| א | « שהרי הוא אסור בהניית חותנו » (שו״ע יו״ד רכ״ב:א) | for he is forbidden to benefit from his father-in-law |
| א | « ויש אומרים דאפי׳ באומר לה על מנת שאין לבעליך רשות בהם ומה שתרצי תעשי בהם » (שו״ע יו״ד רכ״ב:א) | and some say that even where he says to her: on condition that your husband have no right in them, and do with them what you wish |
| א | « קנה הבעל ואסור בהם » (שו״ע יו״ד רכ״ב:א) | the husband has acquired, and they are forbidden to him |
4. The vocabulary to hold
| Term | What it denotes |
| מודר הנאה | one to whom another’s benefit is forbidden by a vow — all of siman 221 |
| אכילת פירות | the husband’s right over the fruits of his wife’s property: it creates the difficulty |
| יד אשה כיד בעלה | Rabbi Meir’s position, to which the Gemara ties Rav — and from which the Nekudot HaKesef show Shmuel departs |
| מה שאת נושאת ונותנת בפיך | the mishna’s designation; the Mehaber adds clothing and “the like”, following the Ran |
| מה שתרצי עשי | the formula with no designation: the pivot between Shmuel and Rav |
| על מנת שאין לבעליך רשות בהן | the mishna’s clause; the Shakh holds it indispensable, the Sha’ar HaMelekh dispensable |
| מי שמוחזק המע״ה | the Ba’h’s monetary rule: the holder prevails, the claimant must prove |
5. The classic pitfalls
Do not suppose that naming the husband suffices. “Your husband has no right in them” alone is precisely the forbidden case of the seif. The clause works only together with a designation.
Do not confuse food with money. For מזונות no formula is required, and the Taz adds that the husband may even benefit. The whole difficulty arises from available capital.
Do not rely on the son-in-law’s goodwill. The Taz shows at ס״ק ג that the prohibition is complete at acquisition, before any benefit — and that a vow the son-in-law might take on himself does not help, since he could have it released.
Do not take the Shakh’s פשיטא for the end of the matter. The Pit’hei Teshuva gathers, at ס״ק א, four Rishonim who go the other way. This is one of those places where the most decided A’haron does not have the last word.
