What we shall ask of the text

  1. Who is the מדיר? An ambiguity in the gemara, and two Rishonim
  2. Two different reasons for two different permissions
  3. Seif ג: קני על מנת להקנות, and three readings of a single word
  4. Seif ד: giving without giving, paying without paying
  5. The Taz defends the Tur, and the Nekudot HaKesef catch up with him

1. Who is the מדיר? An ambiguity in the gemara, and two Rishonim

The whole first seif depends on a grammatical ambiguity the gemara did not resolve. המדיר בנו לתלמוד תורה: is בנו the object of the vow — “he who imposes a vow on his son” — or the source of the benefit forgone — “he who deprives himself of his son”? Both readings are grammatically possible, and they yield two opposite halakhic cases.
The Rambam takes the first reading, and spells it out: the father imposed the vow on his son because he does not occupy himself with Torah, and it is the father who is permitted to render the three services to the son.
The Ramban takes the other, and the Tur notes that the Rosh concluded like him: the father forbade himself his son’s benefit so that the son not lose his study time, and it is the son who may render the services.
The Shulḥan Arukh chooses — and both the Shakh and the Taz draw from it a consequence the text does not state. The Meḥaber wrote המדיר עצמו מהנאת בנו and מותר הבן: the Ramban’s reading, alone. But if the reason for the permission is that the father did not think of trifles, that reason does not hold in the other case. The Shakh reports from the Perisha, and the Ba’ḥ rules so: in the Rambam’s case — the father who imposes the vow because his son does not study — even these small services are forbidden. The Taz says the same by another route.
A note on the text, which we flag without resolving. The lemma of the Taz’s first ס״ק, in the edition available to us, reads « חבית של ימים » (ט״ז יו״ד רכ״ג ס״ק א) where the Shulḥan Arukh has חבית של מים, a jar of water. We copy the edition as it stands, according to our rule, and leave the reader to judge.

2. Two different reasons for two different permissions

Seif א contains two permissions, and they are read too quickly as one. The first — the three services — rests on smallness: the father did not aim at what costs almost nothing. The second — buying in the market — rests on impossibility: a man who never goes to market cannot have meant to deprive himself of someone going for him. The two reasons are distinct, and they do not extend in the same way.
The difference shows in the limit. The Beit Yosef, in the name of the Yerushalmi reported by the Rosh and the Ran, states the reverse: a man whose habit it is to go to market — on the contrary, we presume he did include that in his vow: The reason of smallness has no comparable reverse, because a jar of water is a jar of water for everyone.

3. Seif ג: קני על מנת להקנות, and three readings of a single word

The sugya is twofold, and both threads must be held. The first is a thread of קנין: can one acquire for the sole purpose of conveying? The sages of Pumbedita say no; Rav Naḥman says yes and invokes the סודר, the cloth taken in hand to effect a kinyan and which has no other function. Rav Ashi objects that the סודר acquires immediately, whereas in our case the acquisition is postponed to the day the grandson becomes a man of learning — and on that day, he says, הדר סודרא למריה, the cloth has already returned to its owner.
Rashi, whom the Taz reports, gives the reason for the detour: the grandson did not yet exist, and one cannot convey to an עובר. Hence the compulsory passage through the son. The Perisha adds that the operation is done מעכשיו, from now, by a קנין סודר.
The second thread is that of the word “מותר”, and the Shakh reports three readings. They do not say the same thing at all: the first makes the non-scholarly grandson forbidden, the second leaves him permitted in any event, the third denies him ownership while leaving him use.
The Taz explains the Rambam’s position, and his explanation is a fine one. Why should the grandson be forbidden when the grandfather said nothing about him? Answer: the clause “if my grandson becomes a talmid ḥakham” was uttered תוך כדי דיבור of the prohibition itself. It is therefore part of it, and reveals the intent: what the grandfather meant to cut off is everything descending through that son. And just as the end of his sentence operates in property law, it operates in the law of prohibition.

4. Seif ד: giving without giving, paying without paying

The Tur puts two questions to the Rambam, and both are commonsense. The first: how can a man discharge his own debt with property he has no right to benefit from — is he not precisely benefiting? The second: what is the point of the duty to inform?
The Ran’s answer, reported by the Shakh, takes the act out of the heir’s hands. He does not give and he does not pay: he shows the place. He says: this property my father forbade me, I do not know what to do with it, take it and do as you wish. And as for the debt and the ketuba, it is a collection made by the beit din without his knowledge — for if with his knowledge, it is forbidden, as at siman 221.
The Beit Yosef does not think so, and the Shakh says it at once. For him — at siman 216 — an actual gift to the sons and brothers is permitted, because the information strips the act of its character as a favour: they know the money is forbidden to him and that this is why he hands it over; and since they are his own sons and brothers, who themselves have a connection to this estate, he derives no טובת הנאה from them.
The Maharshal, reported at length by the Shakh, gives a complete course of action — and the order he sets out is instructive: to the father’s heirs, the nearest first, following the order of succession; to his own sons, nothing at all, for there is no greater benefit than that; if he has nothing to eat, he may borrow and his creditors will collect from his share; if he has, it is forbidden; if there are no heirs, to charity, without a duty to inform the charity; he may even destroy the property and throw it into the sea, and yet it is a mitzva to compel him to give it to charity.
And the distinction that governs everything, to close: לכתחילה or בדיעבד? The Prisha and the Ba’ḥ read the seif as a statement of fact and not as a permission: if he gave or paid, it is permitted after the fact, and he does not remain under the vow’s prohibition — but from the outset it is forbidden. The Taz, at the end of his fifth note, arrives at the same place.

5. The Taz defends the Tur, and the Nekudot HaKesef catch up with him

The Beit Yosef thought he had settled the Tur’s question in a word: it escaped him, he says, that the mishna of הגוזל קמא says exactly what the Rambam writes. The Taz refuses that answer, and his argument is philological: the mishna says ובאים בעלי חוב ונפרעים — the voice is passive, it is they who collect, and even against the man’s will. The Rambam writes אם פרעם, “if he paid them” — that is, the man himself. So the mishna does not cover the Rambam’s case, and the Tur’s question stands whole.
The Taz’s conclusion is a reconciliation. On the substance, he says, there is no disagreement: once the man himself makes the payment, it is forbidden, and informing changes nothing. What is at issue lies elsewhere — in giving the inheritance to his sons, where the Ran too holds that giving oneself is forbidden on account of the טובת הנאה, and where one must therefore come round to מראה להם מקום.
And the Nekudot HaKesef close the siman with a pinprick. The Taz had introduced his answer with ולענ״ד נראה, “it seems to me”. The Shakh, in his Nekudot HaKesef, does not discuss the substance: he merely notes that the Drisha and the Ba’ḥ had said it before him. Nine words.
