1. What this page does not permit

This page authorises no one to release a vow. It sets out what the Shulchan Arukh and its commentators teach, and nothing more. A release is made before three men who know, after the vower has set out his vow and its reason, and according to what a Rav has judged of his case. Every line below rests on a cited apparatus entry; none replaces asking.

The reason is not general prudence: it is in the siman. Seif 7 warns the vower against himself, and seif 4 says what it costs.

2. Before whom — three, and why three

The Ba’er Hetev, at ס״ק ג׳, reports from the Shakh the strict consequence, and it holds even after the fact.

What must these three know? The Shakh widens at ס״ק ב׳ — it is enough that they have been taught — and the Ba’er Hetev at ס״ק א׳ reports the Levush, who requires only partial understanding, and notes that such is the usage.

But they must know how to open a פתח, even for a release by mere חרטה. The Ba’er Hetev gives the reason at ס״ק ב׳.

And these three must not be interested in the vow. The Shakh, at ס״ק י״ב, goes so far as to reject a formal withdrawal.

3. The received procedure

Four acts, in this order, and each has its source.

1. Set out the vow and its reason

It is enough to tell one of the three, which allows discretion.

2. The חרטה, then the פתח drawn from it

The Taz, at ס״ק י״א, endorses this usage and says exactly what it covers — and what it does not.

3. Posture

4. The formula

Any language will do, but not any formula: the Taz, at ס״ק ד׳, rejects those that do not uproot.

4. What makes a release fail

The defectSourceConsequence
The vower lied to the sageseif 4The release is nothing
The vow was not set outseif 14Their release is no release
The release was obtained by compulsionseif 51It is nothing
Only two sages, however greatBa’er Hetev ס״ק ג׳One must repeat before three, even after the fact
The חרטה bears only on the presentseif 7It is not a חרטה; the vow is not uprooted
The vow has not yet taken effectseif 17There is nothing to release — even where transgression is feared

5. What is not released, and what is released only for a reason

A vow upon a prohibition

The Rama opens two ways out, and one of them is medical in the literal sense.

The vow על דעת רבים and its like

What the Rama ranks among mitzva grounds is broader than one would expect: public prayer, peace in the home, the needs of the public, and even livelihood. But with a firm condition.

The Rama applies the same regime to two very common vows: the one uttered in distress, and the ban one lays on oneself.

This ומיהו אם התירו בדיעבד מותר is a remedy, not a plan. The Rama writes at seif 21 in so many words, of the vow על דעת רבים, that one relies on it כי אם בשעת הדחק only.

6. A vow that engages a third party

The first question to ask is not “did he say on his opinion?” but “did he receive a benefit in exchange?”

And where there was a benefit, the Rama decides for the most demanding view.

It remains to know what counts as a טובה, and there the Shakh leaves the question open. At ס״ק מ׳ he requires the benefit to have been received on account of the oath, and on that ground rejects the Beit Yosef’s reasoning about the workman — then reports a contrary responsum and concludes וצ״ע. A case of this kind is not settled from a page: it is brought to a Rav.

Two practical points from the Shakh and the Rama, which come up often. An oath sworn before a man’s agent follows the regime of one sworn before him (Shakh ס״ק ל״ז); and when the release is made without him, he is informed, so that he not suspect him.

7. The time, the place, the person

On Shabbat

The condition is the need of Shabbat itself — the siman gives as examples a vow not to eat or to forgo the delight of Shabbat. Communal חרמות are an exception by usage.

When the vow takes effect

This seif and seif 17 differ by the structure of the oath: an oath that binds from today is released from today; an oath that forbids nothing before its term is not released before its term.

The person

How many releases

8. Table of rulings

The questionThe siman’s answerWhere
How many judges today?Three. Two do not suffice, even after the factseif 1 · Ba’er Hetev
Is a פתח needed, or does חרטה suffice?Usage joins both: the חרטה is made into a פתחseif 7 (Rama) · Taz ס״ק י״א
May one send someone in his place? No. An interpreter yes, an agent noseif 16
May one release before the vow begins? No, even where transgression is fearedseif 17
A charity vow partly paid?He may ask about the remainderseif 42
A vow uttered in distress?Only for a mitzva or a great needseif 45 (Rama)
A vow on the opinion of three named men?Not without them; Rama: not for an optional matterseif 21
A vow before three, without saying “on their opinion”?It has a release — but seif 21 reports a contrary viewseifim 23 and 21
May the creditor release his debtor himself?Yes, by holding himself paid — but he may not extendseif 39
A release obtained under pressure? It is nothingseif 51

9. What requires a Rav

The siman itself leaves open questions its commentators did not close. Naming them is more useful than deciding them.

The question left openWhere
What counts as a טובה — the Shakh concludes וצ״עShakh ס״ק מ׳
A vow for a silent fellow’s wish: is it a על דעת חבירו vow?Taz ס״ק כ״ז · Nekudot HaKesef
A gambling vow released after the fact: permitted or forbidden?seif 15
A community where each swore: may each regret alone?seif 30 (Rama)
Does an oath creating the obligation survive its breach?seif 41
Is a self-ban in the world to come released?seif 45
And last, what should have come first. Seif 7 addresses the vower, not the court: let him not say he regrets from the outset unless he is sure. This is not a formality a page can help fulfil — it is a question a man cannot decide about himself. Bring it to a Rav.
