The siman’s very title announces a difference: The lamdan’s question is why two are needed. If חרטה suffices — the vower says he would have wished never to have vowed, and the vow is uprooted — what is the פתח for? And if the פתח uproots, what does the חרטה do?
The Taz answers at ס״ק ז׳, and his answer is a theory of proof. The פתח is valid only if it carries a סברא חזקה — a motive strong enough that the man would have refrained — and he at once raises the difficulty: since we know the vower is still content with his vow, how are we to believe him?
The difference is therefore epistemic before it is juridical: in the חרטה we see the regret; in the פתח we must rely on a declaration about a hypothetical past. The Taz finds the guarantee in the sanction of seif 4 — and adds that the court makes it known to the vower.
The Mehaber closes seif 7 with a lone view: The Rama makes it the received usage. The Taz, at his ס״ק י״א, traces the chain and shows that this is not a stringency of propriety but the end of an old dispute, beginning in a reading of נדרים — the case of Rav Assi asking כדו תהית.
The Taz then reports the reversal of the Maharam of Rothenburg — he used to release by חרטה alone, as his masters did, and he retracted — and draws a conclusion in the form of a rhetorical question.
But the Taz does not stop at endorsing the Rama. He distinguishes: the usage the Rama reports — making a פתח of the חרטה — meets one precise fear, that of a חרטה dated today. It does not meet Rabbenu Yosef’s requirement, which was to know the motive of the change.
Seif 4 says one must be מיושב. Of whom does it speak? The Shakh, at ס״ק ט׳, decides: of the releasers, not of the vower. He then notes the opposite usage of his own day, and goes looking for a source for it in the Yerushalmi.
The Taz reaches the same rule by another route, and his formulation is drier: the vower’s posture is of no consequence, because the release is not a judgment.
The Pit’hei Teshuva, at ס״ק ג׳, takes up the Shakh and adds the Radbaz, who questions the very need for the petitioner to stand.
Seif 5 forbids asking for release from the sage of the town whose benefit one has forbidden oneself. Why? The Yerushalmi speaks of מפר נדרי עצמו, and the Beit Yosef objects that the comparison does not hold. The Taz, at ס״ק ח׳, answers that the objection misses — because the text says כמיפר, with a comparative kaf.
And then the Taz gives the true reason, which is not a formal prohibition but a rule of recusal: the sage would gain, hence he is נוגע בדבר, and it is feared he will not examine properly — precisely what seif 4 required.
The Shakh goes further still: the disqualification is not cured by adding two outside judges, nor by a formal withdrawal. He cites the responsum of the Mas’at Binyamin, whose conclusion is striking.
Here is the sharpest dispute of the siman, and it fits in one line on each side. The Taz, at ס״ק כ״ז, explains seif 20 in a way that narrows its reach — and dismisses the Prisha in rare terms.
The Shakh had set out the opposite reading already at his ס״ק ל״ז, and without polemic: he glosses על דעת חבירו as בשביל רצון חבירו. He then extends the rule to an agent.
And it is in the Nekudot HaKesef that the Shakh answers the Taz in so many words, on this very entry. His answer does not merely defend the Prisha: it gives the substantive reason.
The whole of seif 20 rests on one word: טובה. If there was a benefit, the other is a party; if not, not. But one must know what counts. The Taz, at ס״ק ל׳, gives two measures received from the Beit Yosef.
The Shakh, at ס״ק מ׳, examines the same matter and states the governing condition: not every benefit counts, but a benefit received on account of the oath. He draws it from the Rivash, and on that ground rejects the Beit Yosef’s reasoning about the workman.
But the Shakh does not close the matter: he reports a contrary responsum of Rabbi Moshe Alashkar about a house lease, and leaves the question expressly open.
And in the Nekudot HaKesef, on the Taz’s ס״ק ל׳, the Shakh refers to that same ס״ק מ׳ as his refutation — in a single image.
Seif 48 is one line: one who swore to pay בר״ח אדר pays on the first day. The Shakh attaches to it one of his longest ס״ק in the siman, and the discussion is about the ground: is this a doubt resolved stringently, or the very sense of the words?
In the Nekudot HaKesef — the last of the ten, and the only one aimed at the Shakh himself — the thesis is contested on its own ground: in ordinary speech the two days are one day.
