What we shall ask of the text
ביטול and התרה: two regimes that divide the timeline exactly
Why an annulment clause is worth nothing, and a vow for a term is worth everything
The Taz’s difficulty with the Rama’s gloss — and the Shakh’s two mechanisms
A vow hung on a vow that does not take effect: the case of the spouses
1. ביטול and התרה — two regimes that divide the timeline exactly
Set side by side two sentences written in two different places, and an architecture appears. Siman 228 says a vow is not released before it has taken effect; our siman says that once it has, there is nothing but release.
What the two sentences draw together. Before חלות: no התרה — but ביטול is possible, if the vow was hung on someone. After חלות: no ביטול — but התרה is possible. The two regimes follow one another without overlapping and without leaving a gap. This is a reading, and we give it as such: neither text states it, but neither contradicts it.
And there is a case where the window closes on both sides. Siman 228 says so expressly of the conditional vow:
A man has sworn that if such a thing happens, wine will be forbidden to him. So long as the condition has not been fulfilled he is not released: the vow has not taken effect. Nor can he annul it himself, since ביטול is not the vower’s to exercise but, where applicable, belongs to the man on whose consent the vow was hung. So all he can do is wait. One more reason not to attach a condition to a vow.
2. An annulment clause is worth nothing, a vow for a term is worth everything
The difficulty leaps out when the seif is read from end to end. It begins by refusing a clause — “ שאפילו פירש והתנה בשעת הנדר או השבועה אימתי שירצה שיבטלנו מעיקרו ” (שו״ע יו״ד רל״א:א) — and it ends by accepting one:
The answer lies in what the limit bears upon. In the first case the man sets a limit upon his vow: the vow itself is unlimited, and he reserves a power to erase it. That is a power of release, and it is not his. In the second case the limit is inside the vow: he never swore for more than thirty days, and on the thirty-first there is nothing to erase, because there is nothing left.
Another way of saying the same thing. A vow for a term is not a vow fitted with an escape clause: it is a smaller vow. What the man forbade is meat-for-thirty-days, not meat. Nothing needs uprooting, because nothing remains.
A practical nafka mina, and an everyday one. To someone who wishes to bind himself for a period, it is far better to advise saying “for such a time” than saying “and I shall be able to have it released”. The first wording leaves no question open; the second leaves one, and the answer is אינו כלום.
3. The Taz’s difficulty — and the Shakh’s two mechanisms
The Rama writes that if the third party did not confirm the vow and said at once that it should not be, the vow is void. The Taz is surprised, and his question is precise:
Reframed: where does the third party get that power? Does hanging one’s vow on someone’s consent amount to giving him a right of veto? The Taz answers no, and says the gloss must be read as presupposing a statement by the vower:
And his reading rests on a text. Siman 228:37 requires exactly that statement:
The Shakh, for his part, answers not with a statement but with a mechanism — two, in fact, and they are not the same:
Look at the difference between them. In the first, the vow was duly uttered and the third party annuls it on the instant: a genuine ביטול, acting on a vow that was about to take effect. In the second, the vow was framed so as to take effect only once heard — so there never was anything to annul. The Shakh closes on that: “ ומיד בשומעו הוא מבטלו א״כ לא חל הנדר כלל ” (ש״ך יו״ד רל״א ס״ק ב).
And already at ס״ק א the Shakh had laid down the distinction that governs everything: there are two ways of “hanging it on another”, and only one works.
4. A vow hung on a vow that does not take effect
The second paragraph of the Taz’s ס״ק ג — same ס״ק, second paragraph — reports a case that puts the rule to the test. A man asks his wife for a mutual undertaking: neither to remarry after the other’s death.
The husband’s vow does not take effect — the Taz takes that as given, and adds that this holds even if he has already fulfilled פרו ורבו. So far nothing that touches our siman. But what follows does:
Here is why this case belongs to this siman. The wife’s vow was not hung on her husband’s consent: it was hung on the existence of her husband’s vow. She undertook only “if he keeps his word”. And his word never took effect. So her vow never had anything to rest on — and it falls, not by annulment nor by release, but because its condition was missing from the start.
And yet the Taz adds a precaution, and it is the whole subject. A תקיעת כף — a solemn handclasp — does have a release; and he concludes “ ומעתה גם נדרה אינוחל כי לא נדרה אלא על דעת אם הוא יקיים נדרו ותקיעת כף יש לו התרה ולרווחא דמילתא יתירו לה ” (ט״ז יו״ד רל״א ס״ק ג), that is: for good measure, let it be released for her. The reasoning says nothing took effect; the practice says to perform a התרה all the same. That gap between what one proves and what one does is exactly what belongs to the Rav and not to the reasoner.
