1. How the siman is built

Twenty seifim, and a plan the first of them announces. They are arranged here by mechanism — each of the four families has its own, and one must know it in order to know what makes it fall. The master table in the last section restores the order of the book for finding a seif.

VIII19–20התולה בדבר — the suspended vow
The dividing line. Siman 228 teaches how a vow that took effect is dissolved; siman 232 teaches that there are vows that never took effect. That is why there is in it no court, no פתח, no חרטה — except at seif 2, where the Pit’hei Techouva recalls that a vow of urging that has become a vow again falls under the regime of 228.

2. נדרי זרוזין — urging: the mechanism and its three limits

The mechanism. One who vows to make another yield forbids himself nothing: his utterance aims at the other, not at himself. The Choulhan Aroukh says it in one clause, and the Taz draws from it at ס״ק ב that mouth and heart do not agree.

« לא נאסר שום אחד מהם שכן דרך התגרים לידור או לישבע כדי לזרז חבירו ואין בלבו לשום נדר » (שו״ע יו״ד רל״ב:ב)

The three limits. The same seif gives them in order, and each brings the vow back.

To remember. Sale concluded, no contrary declaration, a bargaining-sized gap: three cumulative conditions. If one is missing, the vow took effect and is undone only by a court. And the Rama forbids at seif 3 extending the rule to a neighbouring case.

The second case. Seif 3 sets side by side two identical sentences and two opposite regimes: the host who makes another vow has vowed nothing; the guest who asks to be bound is bound. Then the Rama closes off analogy.

« הגה ואין למדין מדיני נדרי זרוזין למקום אחר שאין לך בהם אלא מה שאמרו חכמים. (ב״י בשם רבינו ירוחם): » (רמ״א יו״ד רל״ב:ג)

3. נדרי הבאי and נדר שוא — two failures not to be confused

Exaggeration. The man swears on an image no one takes literally. The vow does not take effect because there was no assertion.

« שכן דרך העולם להפליג ולא כוון לשם נדר » (שו״ע יו״ד רל״ב:ד)

The Chakh adds, in the Ran’s name at ס״ק ז, that there are two kinds of exaggeration, and that the second — where hyperbole is not customary — falls for another reason: we assess the intent.

The vain vow. Seif 5 is not a case of exaggeration: here the object is genuinely impossible. Its technical name is נדר שוא, and seif 14 will live off it.

« אמר קונם כל פירות שבעולם עלי אינו נדר כיון שאי אפשר לו להיות בלא כל הפירות הוי ליה נדר שוא » (שו״ע יו״ד רל״ב:ה)
The difference, and why it matters. Exaggeration falls for want of an assertion; the vain vow falls for want of a possible object. The Taz teaches at ס״ק כ״ה that a vain vow leaves a prohibition standing — איסורא מיהא איכא — which is why seif 14 still requires an inner reservation.

Two views brought by the Rama narrow seif 5: in the future tense, and with a reservation that makes life possible. The Chakh concludes stringently at ס״ק י, and at ס״ק י״א excludes “except meat” and “except grain” from the vain vow.

4. נדרי שגגות — error: two moments, two locations

The mechanism. Two cumulative conditions, and seif 6 gives them in one sentence: error at the moment that counts, and the certainty that he would not have vowed had he known.

« כיון שהוא שוגג בשעת הוצאת הנדר מפיו או בשעה שיש לה לחול ואם היה יודע שהוא כן לא היה נודר אינו נדר » (שו״ע יו״ד רל״ב:ו)

Two moments. The seif names them: when the vow leaves the mouth, or when it should take effect. The first covers error about the past, the second about the future.

Two locations. The Chakh separates them at ס״ק ט״ז, and this is the key to the whole block: when the error is in the root of the vow, it falls of itself (seif 7); when it is in a secondary motive, it must have been stated (seif 6) — and it is not the Taz alone who requires this: the Chakh requires it at the end of that same ס״ק ט״ז in the name of the Ran, and the Taz cites the same Ran at his ס״ק י״ג.

« אע״פ שלא פירש כיון שהדבר מוכיח שאין אדם אוסר פירותיו על אביו ואחיו » (שו״ע יו״ד רל״ב:ז)

The formal limit. Seifim 8 and 9 lay down the same rule on two different objects: changing the wording brings everything down, widening it by an exception brings down only that exception.

« שלא החליף לשון הנדר בין שעת איסור לשעת חזרה לא הותרו האחרים: » (שו״ע יו״ד רל״ב:ח)
« אבל אם אמר אילו הייתי יודע הייתי אומר כל היינות אסורים עלי חוץ מן המיושן הרי זה מותר במיושן בלבד וכן כל כיוצא בזה: » (שו״ע יו״ד רל״ב:ט)
The counter-example to remember. An ugly woman made beautiful leaves the vow standing (seif 6); a father who died or repented brings it down (seif 19). The Chakh gives the reason at ס״ק מ״ה: a man is liable to die or to repent, an ugly woman is not liable to become beautiful.

Seifim 10 and 11 close the block with two cases of oath: the man who erred about the degree of a prohibition, and the man who was deceived.

« ואיגלאי מילתא שהשר פטרו לזה אין ממש באותה שבועה כיון שהטעהו: » (שו״ע יו״ד רל״ב:יא)

5. נדרי אונסין — duress: what it is, and what it is not

The mechanism. The Mehaber gives it in a line of mishnah, and the Chakh draws from it at ס״ק כ״א the consequence that governs everything: he did not vow for such a case, even without having stipulated it.

« נדרי אונסין כיצד הדירו חבירו שיאכל אצלו וחלה או שחלה בנו או שעכבו נהר הרי אלו נדרי אונסין: » (שו״ע יו״ד רל״ב:יב)
« משמע אע״פ שלא התנה בשעת הנדר על כל אונס שיולד אמרינן דאאונס כה״ג לא נדר » (ש״ך יו״ד רל״ב ס״ק כ״א)

What it is. The Rama gives four marks in his gloss: a heavy expense, an order of the authority even merely monetary, inability to pay at the term, and forgetfulness after a delay according to a first view.

« הגה ואם אירע לו אונס והיה אפשר לסלקו על ידי ממון הרבה שיתן מקרי אונס (ריב״ש סי׳ קפ״ו) » (רמ״א יו״ד רל״ב:יב)

What it is not. Three exclusions, and they matter as much as the marks: what can easily be removed, what one has manufactured oneself (seif 17), and what one was not obliged to accept (seif 18).

The decisive division. A duress that prevents the act releases; a duress that removes the creditor’s demand does not — the Rama lays it down at seif 12, adding that by all views payment must follow. And a duress of harm is not a missed gain: the Rama writes so in the same seif.
« ולא מקרי אונס בשבועה אלא א״כ היה מגיע לו איזה רעה אם לא היה נשבע אבל אם לא היה מגיע לו טובה ונשבע כדי שיהא לו טובה מזה אין מקרי אנוס בשבועה (מהרי״ק שורש קס״ז ופסקי מהרא״י סי׳ ע״ג) . » (רמ״א יו״ד רל״ב:יב)

Credibility. The Rama holds that a man is believed about his duress, and the Chakh, at ס״ק כ״ה, withdraws the case that matters: one who swore to another is not believed on his word alone, for duress is not common and everyone would say he was coerced.

6. The applications of duress — and their brakes

Seifim 14 to 18 apply duress to five situations. Two of them are often cited, and they are the ones the brakes surround.

Before the extortioner (seif 14). The permission, then its two brakes: the authority must act outside its right, and the truth must not become known.

A heavy brake. The Pit’hei Techouva, at ס״ק י״ב, reports that the She’ilat Yaavetz rebuked a teacher who invoked the gloss of seif 14 to permit an oath covering a true fact: the Rama there speaks of a false accusation, not of a fact. This seif grants no general permission.

Under blows (seif 15). Here no inner reservation is required — the Taz explains at ס״ק כ״ט by the difference between one who wants to snatch property and one who strikes without measure.

« מי שאנס את חבירו ויסרו במיני יסורים עד שנשבע לתת לו כך וכך מעות אין באותה שבועה או נדר או חרם ממש: » (שו״ע יו״ד רל״ב:טו)

The reservation that is forgotten. The Chakh gives it at his ס״ק מ׳, in the name of the Maharyu: this holds only where he was forced to give something; if he swore not to reveal a thing, the ban takes effect. The Baer Hetev repeats it at ס״ק ל״א. The Rama, for his part, sets aside that same responsum of the Maharyu on the neighbouring point of duress of death, at the end of his gloss to seif 15; a case of this order goes before a Rav.

« וכתוב בתשובת מהרי״ו ס״ס נ״ג דוקא אנסו ליתן לו שום דבר אבל נשבע לו שלא לגלות דבר חל החרם » (ש״ך יו״ד רל״ב ס״ק מ)

Ruin (seif 16). A much-quoted phrase, and the threshold the Chakh details at ס״ק מ״ב.

« ואחר כך נתקלקלו החובות שהיו חייבים לו אם אין לו ממה לפרוע לא חובות ולא קרקעות וחפצים חוץ מבית דירתו וכלי תשמישו פטור דאין לך אונס גדול מזה: » (שו״ע יו״ד רל״ב:טז)

7. התולה בדבר — the suspended vow, and the sentence that undoes it

The fifth case, announced at seif 1, returns at the end. The vow was true and its reason ceased — this is therefore not an error, and the Taz expressly distinguishes it from seif 6 at ס״ק ל״ב.

« מי שפירש בשעת נדרו על מה נדר הרי זה כתולה נדרו באותו דבר ואם לא נתקיים הדבר שנשבע בגללו מותר » (שו״ע יו״ד רל״ב:יט)
« דהוה כאלו פירש שנודר על זה התנאי וכיון שנתבטל נתבטל הנדר. » (שו״ע יו״ד רל״ב:יט)

Seif 20 gives a branch of it: the vow is undone by a sentence, and it is not the vower who speaks it. Two reservations frame it — the Chakh’s at ס״ק מ״ו, and the Rama’s controversy about abstention.

« ה״ז יכול להתיר נדרו שלא ע״פ חכם שיאמר לו כלום נדרת אלא לכבדני וזהו כבודי שלא אטול ממך » (שו״ע יו״ד רל״ב:כ)
« ואפילו אין המדיר אומר בפירוש שכך היתה כוונתו אלא מן הסתם » (שו״ע יו״ד רל״ב:כ)
To remember. These two seifim are not dissolutions: they record that there is nothing left to dissolve. That is why the siman can write שלא ע״פ חכם without contradicting itself — and why the Chakh at once closes the door as soon as the vower declares otherwise.

8. What the siman forbids nonetheless

Seif 13 governs the reading of the siman. It does not withdraw the permission; it withdraws the use one would make of it.

« אע״פ שארבעה נדרים אלו אינם צריכים התרה אסור לידור בהם » (שו״ע יו״ד רל״ב:יג)
« אם לא שרוצה לקיים דבריו: » (שו״ע יו״ד רל״ב:יג)

The Taz observes at ס״ק כ״ב that the prohibition can bear only on three of the four families: in a vow of duress, the man did not know at the time of vowing that duress would come.

« אע״ג דנקט כולהו ד׳ נדרים מ״מ הא דסיפא שאסור לידור בהם לא שייך רק על ג׳ דהא על נדרי אונסין לא שייך לו׳ כן דמתחלה כשנדר ודאי לא ידע שיהיה אח״כ אונס וא״כ מה איסור שייך בעת שנדר » (ט״ז יו״ד רל״ב ס״ק כ״ב)
The practical consequence. Siman 232 describes utterances that missed their effect; it does not teach one to speak them. Two barriers say so: the Rama at seif 3 — these rules are not extended to a new case — and the Mehaber at seif 13 — it is forbidden to vow thus, unless one means to keep one’s word. No real question is settled on this page; it goes before a Rav.

9. Master table: the twenty seifim in the order of the book

The preceding sections arranged the matter by mechanism; this table restores the order of the Choulhan Aroukh, clause by clause, for finding a phrase. The right-hand column gives the exact reference, Mehaber or Rama.

SeifThe clauseWhat it says
The law of vows of urging, of exaggeration, of error and of duress — and there are here twenty seifim
There are vows that need no dissolution
א « נדרי זרוזין נדרי הבאי נדרי שגגות נדרי אונסין » (שו״ע יו״ד רל״ב:א) vows of urging, vows of exaggeration, vows of error, vows of duress
א « והתולה בדבר ולא נתקיים: » (שו״ע יו״ד רל״ב:א) and one who makes [his vow] depend on a thing, and it was not fulfilled
He was selling an object to his fellow and said: “konam, this loaf be forbidden to me if I go below a sela”
ב « ואמר הלוקח קונם ככר זה עלי אם אוסיף על שקל ונתרצו שניהם בג׳ דינרים » (שו״ע יו״ד רל״ב:ב) and the buyer said: “konam, this loaf be forbidden to me if I add above a shekel” — and the two agreed on three dinars
Gloss: (or a little less, or a little more)
ב « לא נאסר שום אחד מהם שכן דרך התגרים לידור או לישבע כדי לזרז חבירו ואין בלבו לשום נדר » (שו״ע יו״ד רל״ב:ב) neither of them is bound — for such is the way of merchants: to vow or swear in order to urge one’s fellow, with no vow in his heart at all
ב « (וי״א אף על גב דאמרינן לזרוזי נתכוונו מכל מקום לא יוכל המוכר ליתנו בשקל ולא יוכל הלוקח לקנותו בסלע) (שם בשם י״א) (ויש מקילין) (שם) » (רמ״א יו״ד רל״ב:ב) Gloss: (and some say: although we say they intended urging, the seller may nevertheless not give it for a shekel, nor the buyer acquire it for a sela) … (and some are lenient)
ב « ודוקא כשאין מעמידים דבריהם אלא שניהם נתרצו בשלשה דינרים » (שו״ע יו״ד רל״ב:ב) and this only when they do not stand by their words, but both agreed on three dinars
ב « אבל אם לא נתרצו אלא זה בסלע וזה בשקל ונתבטל המקח ודאי לנדר גמור נתכוונו וחל הנדר וכל מי שיעבור על נדרו הרי חילל דבריו » (שו״ע יו״ד רל״ב:ב) but if they did not agree — this one at a sela and that one at a shekel — and the sale fell through, then they surely intended a full vow, the vow took effect, and whoever transgresses his vow has profaned his word
ב « ואם האחד העמיד דבריו והשני לא העמיד מתוך שנתבטל לאחד נתבטל גם לשני » (שו״ע יו״ד רל״ב:ב) and if one stood by his words and the other did not — since it is void for the one, it is void for the second as well
ב « וכל זה מיירי בסתם אבל אם אומרים שלנדר גמור נתכוונו הוי נדר » (שו״ע יו״ד רל״ב:ב) and all this speaks of an unspecified case; but if they say they intended a full vow, it is a vow
ב « ואם המוכר אמר קונם אם אפחות מיותר מסלע או שאמר הלוקח קונם אם אוסיף לך על מעט פחות משקל ונתרצו בג׳ דינרים הרי זה נדר שאין דרך לזרז כשמפליגין כל כך ולנדר גמור נתכוונו: » (שו״ע יו״ד רל״ב:ב) and if the seller said “konam if I go below more than a sela”, or the buyer said “konam if I add to you above a little less than a shekel”, and they agreed on three dinars — this is a vow: for it is not the way to urge when the gap is so great, and they intended a full vow
(ב״י בשם הר״ן בפי׳ הירושלמי): » (רמ״א יו״ד רל״ב:ב) Gloss: he vowed toward two men who wish to buy from him, and said to one of them “I intended a full vow” and to the other “it was to urge”: since the vow is void with regard to the one, it is void with regard to the second — for it is called one vow for both
ג « המזמין את חבירו שיאכל עמו ומסרב ומדירו אם אינו אוכל עמו או שאומר לו קונם שאני נהנה לך אם אין אתה מתארח עמי ואוכל פת חמה ושותה כוס של צונן וזה מסרב ה״ז נדר של זרוז » (שו״ע יו״ד רל״ב:ג) One who invites his fellow to eat with him, and he refuses, and he makes him vow if he does not eat with him — or says to him, “konam, may I derive no benefit from you if you do not lodge with me and eat a warm loaf and drink a cup of cold” — and the other refuses: this is a vow of urging
ג « אבל אם זימן ראובן לשמעון לאכול עמו והיו מזמינים אותו גם במקום אחר וחפץ לאכול יותר עם ראובן ואומר לו הדירני מנכסיך אם לא אוכל עמך כדי שלא יפצירו בי במקום אחר הרי זה נדר גמור: » (שו״ע יו״ד רל״ב:ג) but if Reuven invited Shimon to eat with him, and they were also inviting him elsewhere, and he prefers to eat with Reuven, and says to him, “make me vow from your property if I do not eat with you” — so that they should not press him elsewhere — this is a full vow
(ב״י בשם רבינו ירוחם): » (רמ״א יו״ד רל״ב:ג) Gloss: and one does not extend the laws of vows of urging to another case, for you have in them only what the Sages said
For instance he said: “konam, this loaf be forbidden to me if I did not see the likes of those who came out of Egypt”
ד « אם לא ראיתי נחש כקורת בית הבד או חומה גבוהה לשמים » (שו״ע יו״ד רל״ב:ד) “if I did not see a snake like an olive-press beam”, or “a wall high as heaven”
Gloss: (it is not a vow)
ד « שכן דרך העולם להפליג ולא כוון לשם נדר » (שו״ע יו״ד רל״ב:ד) for such is the way of the world, to exaggerate — and he did not intend a vow
(תא״ו ני״ג וכן משמע לקמן בטור סימן רל״ט גבי שבועה): » (רמ״א יו״ד רל״ב:ד) Gloss: (and if he stands by his words, saying that he intended a vow, it is a vow)
ה « אמר קונם כל פירות שבעולם עלי אינו נדר כיון שאי אפשר לו להיות בלא כל הפירות הוי ליה נדר שוא » (שו״ע יו״ד רל״ב:ה) If he said “konam, all the fruits in the world are forbidden to me” — it is not a vow, since he cannot survive without any fruit at all: it is for him a vain vow
ה « וכן אם אמר קונם כל פירות שבעולם עלי אם לא עשיתי דבר פלוני אינו נדר: » (שו״ע יו״ד רל״ב:ה) and likewise if he said “konam, all the fruits in the world are forbidden to me if I did not do such a thing” — it is not a vow
ה « הגה אבל אם אמר בלשון עתיד אם אעשה דבר פלוני יאסרו כל פירות עלי י״א דאסור (ב״י בשם סמ״ג ותוס׳ פ׳ המדיר ריש (כתובות דף ע״א) והג״א מהרי״ח) » (רמ״א יו״ד רל״ב:ה) Gloss: but if he spoke in the future tense — “if I do such a thing, all fruits shall be forbidden to me” — some say it is forbidden
(תשובות מיימוני סוף הל׳ נדרים): » (רמ״א יו״ד רל״ב:ה) Gloss: and likewise if he forbade himself all fruits except wheat, some say it is a vow — and others dispute
He said “konam, this loaf be forbidden to me if I ate and drank”, and he recalled that he had eaten and drunk; or “if I eat and drink”, and he forgot, and ate and drank
ו « כיון שהוא שוגג בשעת הוצאת הנדר מפיו או בשעה שיש לה לחול ואם היה יודע שהוא כן לא היה נודר אינו נדר » (שו״ע יו״ד רל״ב:ו) since he is in error at the moment he brings the vow out of his mouth, or at the moment it should take effect — and had he known it was so he would not have vowed — it is not a vow
ו « וכן אם אמר קונם אשתי נהנית לי שגנבה כיסי או שהכתה בני ונמצא שלא גנבה ושלא הכתה » (שו״ע יו״ד רל״ב:ו) and likewise if he said “konam, may my wife derive no benefit from me, because she stole my purse” or “because she struck my son”, and it turned out that she had not stolen and had not struck
ו « וכן אם אמר קונם שאיני נושא פלונית שהיא כעורה והיתה יפה בשעת הנדר שאם היה יודע שהיא נאה לא היה נודר » (שו״ע יו״ד רל״ב:ו) and likewise if he said “konam, that I shall not marry so-and-so, for she is ugly” — and she was beautiful at the time of the vow: had he known she was fair, he would not have vowed
ו « אבל אם היתה כעורה ויפוה חל הנדר: » (שו״ע יו״ד רל״ב:ו) but if she was ugly and they made her beautiful, the vow took effect
(מהרי״ו בדינים והלכות סימן נ״ט): » (רמ״א יו״ד רל״ב:ו) Gloss: and likewise one who says “if so-and-so was present at this matter, I will give a thousand zuz to charity”, and he was there — he is exempt, for it is a vow made in error
ז « וכן אם ראה מרחוק אנשים אוכלין פירותיו ולא הכירם ואמר הרי הם עליכם כקרבן » (שו״ע יו״ד רל״ב:ז) And likewise if he saw from afar people eating his fruits, and did not recognise them, and said “behold they are upon you as a sacrifice”
ז « וכשקרב אליהם ראה שהם אביו או אחיו שלא היה רוצה לאסרם עליהם אינו נדר » (שו״ע יו״ד רל״ב:ז) and on drawing near he saw they were his father or his brother, whom he would not have wished to forbid — it is not a vow
ז « אע״פ שלא פירש כיון שהדבר מוכיח שאין אדם אוסר פירותיו על אביו ואחיו » (שו״ע יו״ד רל״ב:ז) although he did not state [his reason] — since the matter is self-evident: a man does not forbid his fruits to his father and his brother
ז « ואפי׳ נמצאו עמהם זרים דכיון שבטל הנדר אצל אביו ואחיו בטל גם אצל אחרים: » (שו״ע יו״ד רל״ב:ז) and even if strangers were found with them — since the vow lapsed with regard to his father and brother, it lapsed also with regard to the others
Of one who changed his words: he first said “all of you are forbidden”, and afterwards said “had I known my father was among you, I would have said: so-and-so and so-and-so are forbidden, and my father permitted”
ח « או כשאמר תחלה כשראם מרחוק ולא הכירם יהו אסורים לזה ולזה ואחר כך החליף דבריו לומר אלו הייתי יודע שאבא ביניכם הייתי אומר כולכם אסורים חוץ מאבא » (שו״ע יו״ד רל״ב:ח) or when he said at first, seeing them from afar without recognising them, “let them be forbidden to this one and that one”, and afterwards changed his words to say “had I known my father was among you, I would have said: all of you are forbidden except my father”
ח « אבל אם בשעת האיסור אומר כולכם אסורים וגם בשעת חזרה אומר הייתי אומר כולכם אסורים חוץ מאבא » (שו״ע יו״ד רל״ב:ח) but if at the hour of the prohibition he says “all of you are forbidden”, and at the hour of retraction he also says “I would have said: all of you are forbidden except my father”
ח « או שאמר בשעת האיסור יהו אסורים לזה ולזה ובשעת חזרה אומר הייתי אומר פלוני ופלוני אסורים ואבא מותר » (שו״ע יו״ד רל״ב:ח) or if he said at the hour of the prohibition “let them be forbidden to this one and that one”, and at the hour of retraction says “I would have said: so-and-so and so-and-so are forbidden, and my father permitted”
ח « שלא החליף לשון הנדר בין שעת איסור לשעת חזרה לא הותרו האחרים: » (שו״ע יו״ד רל״ב:ח) — since he did not change the wording of the vow between the hour of the prohibition and the hour of retraction, the others are not released
ט « אמר היין עלי קרבן מפני שהוא רע למעים אמרו לו הרי המיושן יפה למעים אמר אילו הייתי יודע לא הייתי נודר » (שו״ע יו״ד רל״ב:ט) He said “wine is upon me as a sacrifice, because it is bad for the bowels”. They said to him: “aged wine is good for the bowels”. He said: “had I known, I would not have vowed”
ט « ואפי׳ אמר אילו הייתי יודע הייתי אומר החדש אסור והישן מותר מותר בישן ובחדש » (שו״ע יו״ד רל״ב:ט) and even if he said “had I known, I would have said: the new is forbidden and the old permitted” — he is permitted in the old and in the new
ט « אבל אם אמר אילו הייתי יודע הייתי אומר כל היינות אסורים עלי חוץ מן המיושן הרי זה מותר במיושן בלבד וכן כל כיוצא בזה: » (שו״ע יו״ד רל״ב:ט) but if he said “had I known, I would have said: all wines are forbidden to me except the aged” — he is permitted in the aged alone; and so in every like case
י « נשבע שלא יעשה כך מפני שהיה סבור שהוא איסור גדול ואח״כ נודע לו שאין בו איסור כל כך » (שו״ע יו״ד רל״ב:י) He swore not to do such a thing because he thought it a grave prohibition, and afterwards learned that there is not so much prohibition in it
י « לא חלה השבועה כלל כי היתה בטעות: » (שו״ע יו״ד רל״ב:י) the oath did not take effect at all, for it was in error
יא « מי שאמר לחבירו שהשר כלל אותו בפשרה שלו וע״י כך נשבע לתת לו כך וכך מעות » (שו״ע יו״ד רל״ב:יא) One who told his fellow that the lord had included him in his settlement, and who on that account swore to give him such and such money
יא « ואיגלאי מילתא שהשר פטרו לזה אין ממש באותה שבועה כיון שהטעהו: » (שו״ע יו״ד רל״ב:יא) and it was revealed that the lord had exempted this one — there is no substance in that oath, since he deceived him
His fellow made him vow to eat with him, and he fell ill, or his son fell ill, or a river held him back: these are vows of duress
יב « הגה ואם אירע לו אונס והיה אפשר לסלקו על ידי ממון הרבה שיתן מקרי אונס (ריב״ש סי׳ קפ״ו) » (רמ״א יו״ד רל״ב:יב) Gloss: and if a duress befell him that he could have removed by giving much money — that is called duress
יב « וכן אם צוה עליו השר שלא לקיים שבועתו ונדרו אפי׳ לא הוי הקנס רק ממון מקרי אונס (שם וב״י בשם תשובת הרשב״א) » (רמ״א יו״ד רל״ב:יב) Gloss: and likewise if the lord ordered him not to fulfil his oath and his vow — even if the penalty is merely monetary, that is called duress
יב « מ״מ אם בנקלה יכולים להשתדל לא מקרי אונס (שם ותשוב׳ הרשב״א) וע״ל סימן רכ״ח סעיף מ״ז בדין חרם שגוזר המושל לעבור עליו » (רמ״א יו״ד רל״ב:יב) Gloss: nevertheless, if one can easily make the necessary efforts, that is not called duress — and see above siman 228, seif 47, on the ban a governor decrees that one transgress
יב « מי שנשבע או נדר לעשות דבר ביום פלוני ונאנס כגון שנשבע לשלם וכשהגיע הזמן אין לו לשלם פטור משבועתו » (רמ״א יו״ד רל״ב:יב) Gloss: one who swore or vowed to do a thing on a given day and was prevented — for instance he swore to pay, and when the term came he had nothing to pay with — is quit of his oath

» (רמ״א יו״ד רל״ב:יב) Gloss: and if at the time of payment the lord compelled the lender to extend the term for the borrower, or exempted him entirely — the oath stands; and by all views he must pay him afterwards
» (רמ״א יו״ד רל״ב:יב) Gloss: a community that made a ban for five years [it has already been said that matters of community and ban are today void by the law of the kingdom] and set a term for the ban to begin, and at that term were under duress or in error and did not begin to keep the vow — must keep it afterwards, for it is not annulled thereby
יב « מי שנשבע או נדר לעשות דבר תוך שנה או ביום פלוני יש לו לעשותו מיד או בשחרית כשיגיע אותו היום שמא ישכח אחר כך ולא יעשנו ויעבור על נדרו ושבועתו » (רמ״א יו״ד רל״ב:יב) Gloss: one who swore or vowed to do a thing within the year, or on a given day, should do it at once — or in the morning, when that day comes — lest he forget afterwards, fail to do it, and transgress his vow and his oath
יב « ואם לא עשהו מיד כי אמר עדיין יש לי פנאי לעשותו ושכח או נאנס אח״כ ולא עשהו י״א דמקרי אונס (הר״ן פ׳ כיצד הרגל) ויש אומרים דלא מקרי אונס (חידושי אגודה פרק מי שאחזו) » (רמ״א יו״ד רל״ב:יב) Gloss: and if he did not do it at once, saying “I still have time to do it”, and then forgot or was prevented and did not do it — some say this is called duress, and some say it is not called duress
» (רמ״א יו״ד רל״ב:יב) Gloss: and it is not called duress, in the matter of an oath, unless some evil would have befallen him had he not sworn; but if no good would have come to him and he swore in order that good should come to him from it — that is not called being under duress in an oath
» (רמ״א יו״ד רל״ב:יב) Gloss: whatever is under duress in an oath — even though he said “on the opinion of the many” or “on the opinion of the Omnipresent” — is nothing
יב « נאמן אדם לומר ששבועתו היתה באונס או על תנאי כך וכך (שם) ודוקא קודם שעבר על שבועתו אבל אם כבר עבר אינו נאמן לפטרו ממלקות (בסי׳ רכ״ח דף רע״ד ע״א בב״י בשם הרשב״א) » (רמ״א יו״ד רל״ב:יב) Gloss: a man is believed to say that his oath was under duress, or on such and such a condition — and this only before he transgressed his oath; but if he has already transgressed, he is not believed to exempt himself from lashes
יב « וכן מי שהודה ברבים או כתב עליו שטר והודה בו שנשבע ואומר אחר כך שלא נשבע ונותן טעם למה אמר שנשבע נאמן וכ״ש אם האמת שלא נשבע שאין עליו איסור שבועה משום הודאתו (ת״ה סי׳ שכ״ו) : » (רמ״א יו״ד רל״ב:יב) Gloss: and likewise one who admitted in public, or wrote a document in which he admitted having sworn, and afterwards says he did not swear, giving a reason for what he said — is believed; and all the more so if the truth is that he did not swear, for no prohibition of an oath rests on him by reason of his admission
Although these four vows require no dissolution, it is forbidden to make them
יג « אם לא שרוצה לקיים דבריו: » (שו״ע יו״ד רל״ב:יג) unless he wishes to keep his words
One who vows or swears to an extortioner — it is neither a vow nor an oath
יד « לפיכך נודרין להרגים ולמוכסים אם הוא מוכס העומד בלא צווי המלך או שבא ליטול ממנו יותר מקצבתו יכול לידור או לישבע כדי ליפטר ממנו » (שו״ע יו״ד רל״ב:יד) therefore one vows to killers and tax-farmers — if he is a tax-farmer who set himself up without the king’s order, or who comes to take more than his fixed rate, one may vow or swear to be free of him
יד « ואומר יאסרו עלי כל פירות שבעולם אם איני מבית המלך ליפטר מן ההרג או אם אין מה שאני מביא מבית המלך ליפטר מן המכס » (שו״ע יו״ד רל״ב:יד) and he says: “let all the fruits in the world be forbidden to me if I am not of the king’s household” — to escape the killing; or “if what I bring is not of the king’s household” — to escape the toll
יד « וחושב בלבו יאסרו עלי רק היום אף על פי שמוציא מפיו סתם וקיימא לן דברים שבלב אינם דברים גבי אנס שרי » (שו״ע יו״ד רל״ב:יד) and he thinks in his heart: “let them be forbidden to me today only” — although he utters an unqualified formula with his mouth. And although we hold that things of the heart are not words, with regard to an extortioner it is permitted
יד « (ובלבד שלא יוציא בפיו דבר שהוא בפירוש נגד מה שבלבו) (בתוס׳ בנדרים ובפ׳ הגוזל בתרא ועוד הרבה פוסקים) » (רמ״א יו״ד רל״ב:יד) Gloss: (provided he does not utter with his mouth something expressly contrary to what is in his heart)
יד « ואפילו לא בקש ממנו שידור והוא נודר מעצמו או הוסיף לידור יותר ממה שביקש כגון שאמר לו אמור קונם שתהנה מאשתך אם אינו כדבריך והוא אומר קונם אשתי ובני נהנים לי » (שו״ע יו״ד רל״ב:יד) and even if he did not ask him to vow and he vows of himself, or added beyond what was asked — for instance he said to him, “say: konam, that you derive no benefit from your wife if it is not as you say”, and he says “konam, my wife and my children derive no benefit from me”
יד « או שבקש ממנו שידור והוא נשבע אינו כלום שכל מה שעושה אינו עושה אלא מחמת האונס ולחזק דבריו נגד האנס: » (שו״ע יו״ד רל״ב:יד) or that he asked him to vow and he swore — it is nothing: for all that he does, he does only because of the duress, and to strengthen his words against the extortioner
יד « הגה ודוקא כשנשבע לו בפיו אז צריך לבטל בלבו באיזה תנאי ודרך שלא יסתור מה שהוציא בפיו » (רמ״א יו״ד רל״ב:יד) Gloss: and that only when he swore with his mouth — then he must annul in his heart by some condition and in a manner that does not contradict what he uttered
יד « אבל אנסין שצוו להחרים על איזו דבר שלא כדין אין באותו חרם כלום ואפי׳ בטול בלב אינו צריך (הגהות מיי׳ פ״ב מהל׳ שבועות בשם הגאונים וכ״כ רבינו ירוחם) » (רמ״א יו״ד רל״ב:יד) Gloss: but extortioners who ordered a ban proclaimed over some matter, against the law — that ban is nothing, and not even annulment in the heart is needed
יד « וכל זה לא מיירי אלא כשאפשר לעבור על שבועתו ונדרו שלא יודע להאנסין אבל אם יודע להאנסין אסור מפני חלול השם ולכן נענש צדקיהו שעבר על שבועתו לנבוכדנצר (ד״ע) אע״פ שהיה בדרך אונס (תשובת הרא״ש כלל ט׳ ותשו׳ מ״ע סי׳ מ״ט ומהרי״ו סי׳ נ״ג) » (רמ״א יו״ד רל״ב:יד) Gloss: and all this speaks only of where he can transgress his oath and vow without the extortioners knowing; but if they come to know, it is forbidden because of the profanation of the Name — and therefore Tzidqiyahu was punished for transgressing his oath to Nevukhadnetzar, although it was under duress
יד « מיהו אם הודיע לאנס מיד שיצא מאנסו שהיה לו תנאי בלבו ולכן יעבור על שבועתו ליכא למיחש הואיל והיה אנוס מתחילה (כך משמע בפ״ב דיומא) מיהו הכל לפי צורך הענין (ד״ע) » (רמ״א יו״ד רל״ב:יד) Gloss: however, if he informed the extortioner, as soon as he was free of his duress, that he had a condition in his heart and will therefore transgress his oath — there is no cause for concern, since he was under duress from the start; yet all is according to what the matter requires
יד « אנסין שצוו לישבע להגיד על אחד אם בא על הכותית כדי להענישו מיתה מקרי שבועת אונס (ב״י בשם הרא״ש כלל ח׳) ויש לבטלה בלבם » (רמ״א יו״ד רל״ב:יד) Gloss: extortioners who ordered an oath to testify about someone, whether he had relations with a gentile woman, in order to punish him with death — this is called an oath of duress, and it is to be annulled in their heart
יד « וכן אם ראובן הפקיד ממון ביד שמעון וצוה הגמון אנס להחרים על מי שיודע מממון של ראובן אם העובד כוכבים רוצה ליקח ממון של ראובן באונס שלא כדין אין החרם כלום וכן יוכל הנפקד לישבע שאין לו משל ראובן (הכל בב״י בשם תשובת הרא״ש כלל ח׳ וט׳) ובלבד שלא יהא חלול השם בדבר (שם בתשובה) כמו שנתבאר » (רמ״א יו״ד רל״ב:יד) Gloss: and likewise if Reuven deposited money with Shimon, and an extortionate governor ordered a ban on whoever knows of Reuven’s money — if the idolater wishes to take Reuven’s money by force and against the law, the ban is nothing, and the bailee may even swear that he has nothing of Reuven’s … provided there be no profanation of the Name in it
יד « ב׳ יהודים שהכו זה את זה וגזר הגמון אחר עדות אם יענישו המכה יותר מדינו נקרא אונס ואם אינן יכולים להשמט וצריכין להגיד יעידו וישלמו לניזק נזקו ואל יצילו עצמן בממון חביריהם (חידושי אגודה פ׳ הגוזל בתרא ושם הג״ה במרדכי בשם מהר״מ) ועיין לקמן סי׳ רל״ט עוד מדינים אלו: » (רמ״א יו״ד רל״ב:יד) Gloss: two Jews who struck one another, and the governor decreed testimony — if they punish the striker beyond his due, that is called duress; and if they cannot evade and must speak, let them testify and pay the injured his damage — and let them not save themselves with another’s money
טו « מי שאנס את חבירו ויסרו במיני יסורים עד שנשבע לתת לו כך וכך מעות אין באותה שבועה או נדר או חרם ממש: » (שו״ע יו״ד רל״ב:טו) One who coerced his fellow and tormented him with various torments until he swore to give him such and such money — there is in that oath, vow or ban no substance at all
טו « (וכל שכן אם קבל חרם או שבועה עליהם מכח אונס מיתה דאינו כלום) (כן משמע במרדכי פ׳ הניזקין וכ״כ מהרד״ך בית י׳ תשו׳ י״ז ולא כתשו׳ מהרי״ו סי׳ נ״ג ופסקי מהרא״י סי׳ ע״ג): » (רמ״א יו״ד רל״ב:טו) Gloss: (and all the more so if he accepted upon himself a ban or oath by the duress of death — it is nothing)
One who betrothed his daughter and vowed to give with her a sum of money
Gloss: (and swore)
טז « ואחר כך נתקלקלו החובות שהיו חייבים לו אם אין לו ממה לפרוע לא חובות ולא קרקעות וחפצים חוץ מבית דירתו וכלי תשמישו פטור דאין לך אונס גדול מזה: » (שו״ע יו״ד רל״ב:טז) and afterwards the debts owed him collapsed: if he has nothing to pay with — neither debts nor lands nor goods, save his dwelling house and his household utensils — he is exempt, for you have no greater duress than this
טז « הגה ראובן ושמעון שהיו דרים בעיר אחת ונשבעו שניהם להשיא בניהם זה לזה ואחר כך יצא ראובן ובנו מן העיר שמעון פטור ואין צריך להוליך בתו אחריו » (רמ״א יו״ד רל״ב:טז) Gloss: Reuven and Shimon who dwelt in one city and both swore to marry their children to one another, and afterwards Reuven and his son left the city — Shimon is exempt and need not bring his daughter after him
טז « גם ראובן פטור אם הוצרך לצאת דמקרי אנוס וכן אם נשבע הבן ואביו הוצרך לצאת ואין לבן פרנסה זולת אביו (ב״י סי׳ רכ״ח דף רע״ד ע״ב בשם הרמב״ן סי׳ רע״ח) ועיין בח״ה סימן ע״ג סעיף ח׳: » (רמ״א יו״ד רל״ב:טז) Gloss: Reuven too is exempt if he had to leave, for that is called being coerced; and likewise if the son swore and his father had to leave, and the son has no livelihood other than his father
יז « מי שנשבע שידור במקום חמיו אם לא יעכבנו אונס אם סיבב הוא או אחרים בשבילו איום עליו שלא לילך למקום חמיו אין זה אונס: » (שו״ע יו״ד רל״ב:יז) One who swore to dwell in his father-in-law’s place unless duress prevent him: if he, or others on his behalf, contrived a threat against him so that he should not go to his father-in-law’s place — this is not duress
יז « הגה אשה שנדרה לבעלה בחליו שלא תנשא אחרי מותו או להפך (ר״ד כהן בית י״ז ובהרמב״ן סי׳ מ׳) או מי שנדר לחולה איזה דבר (תשובת הרשב״א) » (רמ״א יו״ד רל״ב:יז) Gloss: a woman who vowed to her husband in his illness not to remarry after his death, or the reverse — or one who vowed something to a sick person

יח « שותפים שבררו דיינים בכח חרם לקיים מה שגזרו עליהם ואחד מהם מסר מודעא שלא קבל עליו הנבררים אלא כדי שיתאמת מה שחייב לו שהיה ירא שמא יכחיש שהתחיל לומר שאין בידו כלום » (שו״ע יו״ד רל״ב:יח) Partners who chose judges under the force of a ban, to uphold what they would decree upon them, and one of them lodged a protest that he had accepted the chosen arbitrators only in order to establish what the other owed him — fearing lest he deny it, having begun by saying that he had nothing in hand
יח « ואחר שגזרו הנבררים הראה מודעא זו ואמר שאינו רוצה לקבל אלא מה שידין עליו דיין הקהל בדין תורה כיון שקבל עליו בחרם אסור לו לסתור דינם: » (שו״ע יו״ד רל״ב:יח) and after the arbitrators decreed, he showed this protest and said he wished to accept only what the community’s judge would rule upon him by Torah law — since he accepted it upon himself by a ban, he may not undo their ruling
יט « מי שפירש בשעת נדרו על מה נדר הרי זה כתולה נדרו באותו דבר ואם לא נתקיים הדבר שנשבע בגללו מותר » (שו״ע יו״ד רל״ב:יט) One who explained, at the time of his vow, on what he vowed — it is as if he hung his vow upon that thing; and if the thing on account of which he swore did not hold, he is permitted
יט « כגון שאמר שאיני נושא את פלונית שאביה רע ושמעו שמת או שעשה תשובה אין צריך התרה » (שו״ע יו״ד רל״ב:יט) for instance if he said “that I shall not marry so-and-so, for her father is wicked”, and they heard that he died or repented — he needs no dissolution
» (שו״ע יו״ד רל״ב:יט) for it is as if he had stated that he vows on this condition — and since it lapsed, the vow lapsed
Gloss: (and see above siman 220, seif 15, in the gloss)
כ « ועוד יש נדר שא״צ התרה כגון שאמר לחבירו קונם שאני נהנה לך אם אין אתה נוטל ממני כך וכך » (שו״ע יו״ד רל״ב:כ) And there is yet a vow that needs no dissolution: for instance if he said to his fellow, “konam, may I derive no benefit from you if you do not take from me such and such”
כ « ה״ז יכול להתיר נדרו שלא ע״פ חכם שיאמר לו כלום נדרת אלא לכבדני וזהו כבודי שלא אטול ממך » (שו״ע יו״ד רל״ב:כ) he may release his vow without a sage: he will say to him, “did you vow save to honour me? And this is my honour, that I take nothing from you”
כ « ואפילו אין המדיר אומר בפירוש שכך היתה כוונתו אלא מן הסתם » (שו״ע יו״ד רל״ב:כ) and even if the vower does not expressly say that such was his intention, but only by default
כ « וכן אם אמר לו קונם שאתה נהנה לי אם אין אתה נותן לי כך וכך יש לו היתר בלא שאלת חכם שיאמר לו הרי הוא כאלו קבלתי: » (שו״ע יו״ד רל״ב:כ) and likewise if he said to him “konam, may you derive no benefit from me if you do not give me such and such” — he has a release without asking a sage: he will say to him, “it is as though I had received”
Some say it is only for the performance of an act that he may say “as though you had done it”; but for the abstention from an act — for instance if he says “konam, my property be forbidden to you if you go to such a place” — he cannot say “go, and it is for me as though you had not gone”; and some say there is no distinction
כ « וכל תנאי שהיא לטובת הנודר יכול לומר הרי לי כאלו קיימת התנאי » (רמ״א יו״ד רל״ב:כ) Gloss: and every condition that is to the vower’s advantage, he may say “it is for me as though you had fulfilled the condition”
(ג״ז שם בשם הר״ן): » (רמ״א יו״ד רל״ב:כ) Gloss: one who said “konam, may you derive no benefit from me if you do not give my son such and such” — if the son depends on his father’s table, then the father intends his own advantage and may say “as though I had received”; if not, the father cannot say so, but the son alone
