1. Why annulling for a betrothed נערה takes two hands

The mishnah opens the chapter with six words — נערה המאורסה אביה ובעלה מפירין נדריה — and the next mishnah at once draws the consequence: one hand does not suffice. The lamdan asks why: does each hold half of one power, or are there two whole powers that must coincide?

The Shulchan Arukh, at seif 5, does not merely write that one man’s annulment does not stand: it adds that the other’s share remains weakened. An annulment producing nothing would leave everything as it was; this one leaves something less. So each holds a real share, and the seif says it in one word — קלוש.

On the day of hearing the Mechaber reports two views without deciding: the same day, or each on the day he heard. The Shakh brings the Bach’s ruling, and the way he argues it is worth reading — he draws it from the seif’s form, not its substance.

On the stringency, the father’s annulment made on a different day from the betrothed’s is never completed, and the vow stands. On the “some say” view, each annuls on his day and the vow falls. The Shakh himself refers to his ס״ק כ״ב, where he shows that seif 11 reads differently on each view.

2. מיגז גייז or מקליש קליש — what an annulment exactly does

The Gemara in Nedarim poses the question in the sharpest terms, and it governs the whole siman: when the husband annuls, does he cut the vow or thin it?

The Taz takes up this alternative at seif 36 and uses it to explain why the principle “a vow released in part is released in whole” does not pass from release to annulment.

The sage uproots, the husband cuts from now on. It is the same principle seif 51 will state in full, and from it flow these rules of the siman: the attached third party stays bound (51), the sage’s words do not avail here (37), the annulment formula holds only for the future (37), and one annuls on Shabbat because this is not a judgment (24).

The Taz himself returns to the apparent tension between seif 37, which demands a word that “uproots from the origin,” and seif 51, which denies the husband that uprooting. His answer distinguishes the word from the effect.

The word the husband utters speaks as if the vow had never been; its effect begins only today. The formula is that of an uprooting, the reach that of a cut.

3. The emptying of a domain runs one way only — and the Taz refuses to see a dispute there

Seifim 11, 15 and 16 pose the same question from three angles: when one of the two holders disappears, does his power return to the other? The Gemara answers for one case, and the Taz draws the asymmetry from it.

Seif 11 ends with a view of the Rambam which the Mechaber reports and which the Taz declares outright difficult. His difficulty is not substantive: it is a difficulty of reading — he holds that the Beit Yosef misquoted, and that quoting the Rambam word for word there would be no divergence at all.
If the Taz is right, the Rambam spoke only of the case where a second betrothed exists, and the father alone annuls when there is none. If the Beit Yosef is right, the father has no remedy at all. The Shakh, at his ס״ק כ״ג, takes a different path — he bounds the view by the order of the hearings.

The notion of קלוש returns here and explains seif 16: the husband’s share, once weakened by the father’s annulment, has nothing left to pass to the father.

4. A vow hanging on an act: the Rama of seif 28 against seif 69

Seif 28 permits annulling a vow that has not yet taken effect, and the Rama adds a restriction: only if the vow depends on a time, not on an act. Yet seif 69 annuls precisely a vow hanging on an act. The Shakh does not hide the difficulty.

The Rama’s gloss and seif 69 cannot both be true in the same terms. Either the criterion is not the act, or seif 69 is an exception that must be named.

The Shakh then reports Rabbenu Yeruham, whose words he finds exact: the criterion is not the nature of the condition but the category of the thing on which the vow hangs.

At seif 69 the vow hangs on work she would do for him — a matter between them; the gloss of seif 28 concerns only a vow hanging on an act outside the two categories. The difficulty falls, and the criterion remains that of seif 55.

But the Shakh does not stop there. Having reported the Ran, he weighs the practice and concludes against the stringency he had just set out.

The Shakh thus has two statements on this seif: he defends the gloss by a distinction, then sets the stringency aside in practice. Both must be held: the distinction explains the text, the conclusion settles the case. The Ba’er Hetev, at his ס״ק ל״ה, reports only the first half.

5. Annulling part: the Mechaber divides, the Rama does not

The Rama departs here from the Mechaber on the law, as he does elsewhere in the siman — at seifim 25, 28 and 40 among others. At seif 40 he decides for himself (וכן עיקר), which he does neither here, nor at seif 25, nor at seif 28. At stake here is a principle borrowed from siman 229: a vow released in part is released in whole. The Mechaber refuses to carry it over to annulment; the Rama reports those who do, without deciding, and with a formidable consequence — annulling part then annuls nothing.

For the Mechaber (and the Rambam), the principle belongs to the sage’s regime and has no place here: the husband cuts, and cuts what he named. For the Tur, the Rosh, the Ramban and the Ran, the verse יפירנו demands the whole — and a partial annulment is void.

The place where the dispute becomes palpable is seif 63, of the two loaves. There the Shakh shows that the seif does not read the same on either view: for the Mechaber there was no need to annul for both; for the disputants there was — and it had to be done without naming.

On the second view, the manner of speaking changes the result: annulling “for both” saves the afflicting part; naming the afflicting one brings everything down. The Shakh, after long examination, disputes that the Rosh meant this, and concludes that even where he named, it is annulled.

6. “It is annulled for you tomorrow” — the Taz against the Rama, and the Nekudot HaKesef’s reply

Seif 46 is short: “it is annulled for you tomorrow” does not annul. The Rama adds in parentheses the view that it is an upholding. The Taz wonders at this in two words, and his wonder is technical: he holds that the first view already says the same.

If “it is not annulled” already means that he will not be able to annul today, then saying “it is an upholding” adds nothing, and the two views are one. What would the dispute be about?

The Nekudot HaKesef answer the Taz with his own word. They take his לא דק and turn it back on him, then rebuild the Rambam’s reading step by step.

For the Nekudot HaKesef, the first view holds that “annulled for you tomorrow” is neither an annulment nor an upholding: he may still annul today. The dispute therefore bears on what happens tomorrow, and the Rama was right to mark it. The Ba’er Hetev, at his ס״ק מ״ד, reports only the Taz’s objection.

7. Seif 54: the Nekudot HaKesef against the Shulchan Arukh’s text

The third entry of the Nekudot HaKesef aims not at the Taz but at the Shulchan Arukh itself. Seif 54 carries, from the Rambam, that if the husband annuls his wife’s vow after saying to her “I am a nazirite, and what do you say?”, his own is void. Yet the mishnah in Nazir says the contrary — מפר את שלה ושלו קיים.

The Tosafot Yom Tov wondered at it: the Shulchan Arukh writes the reverse of a mishnah it does not dispute.
The Rambam did not contradict the mishnah: he read another version in his copy, the one the Yerushalmi still carries. The divergence is not of law but of text.

But the Nekudot HaKesef do not rest on this solution. They observe that the Tosafot and Rashi had the received version, and they leave the matter open.

What remains open is practical: does his own nazirite vow stand or not, if he annulled his wife’s? The Shulchan Arukh says it falls; the Nekudot HaKesef leave the matter בצריך עיון, and the Ba’er Hetev notes it at his ס״ק מ״ז. We report, and we do not decide.

8. רחיצה וקישוט, and the risk of divorce: places where the apparatus stops at a צריך עיון

Here the apparatus, having examined everything, stops at an admission of uncertainty. The first case is seif 59: are washing and adornment affliction, or matters between him and her? The Taz goes back to the mishnaic dispute.

The Bach holds that the seif’s text is faulty — it should read “painting and adornment,” since as to washing none disputes. The Shakh begins by contradicting him, then, having examined the Beit Yosef, ends on two words.

The second place is seif 73, and the question is whether one annuls as a precaution what there would be no need to annul. The Perishah and the Shakh say yes, against the possibility of divorce. The Taz devotes a long ס״ק to this and concludes otherwise.

The Taz distinguishes by the nature of what is owed: what is merely a claim — the work of her hands — can be reached by a consecration, and so can become a vow again after divorce; what engages the person herself cannot, and the vow never takes there, before or after.

The Nekudot HaKesef, in their fifth and last entry, here side with the Perishah against the Taz.

The Pit’hei Teshuva, at his ס״ק י, sums up each position without deciding; and at his ס״ק ט״ו, on seif 71, he poses a question which he leaves open.

If the ground of the annulment is only the possibility of divorce, it falls where that possibility is excluded — whence the Pit’hei Teshuva’s question about a כהן, which he ends with וצ״ע. It is reported here because it is posed, and it is not decided.
