1. The Central Axiom

Universal principle of Siman י״ט:

The siman fixes the time of the tsitsit berakha: tsitsit is חובת גברא — an obligation of the personולא חובת מנא, and not an obligation of the object (the garment). Hence, כל זמן שאינו לובש הטלית פטור מציצית — as long as one does not wear the talit, one is exempt from tsitsit. The consequence is immediate: אינו מברך על עשיית הציצית — one recites no berakha over the making of the tsitsit, שאין מצוה אלא בלבישתו — for the mitsva lies only in wearing the talit (seif 1). And a talit made לצורך תכריכין (to serve as a shroud) is פטור — exempt, even if one wears it at times in one's lifetime (seif 2).
💡 The universal key: the mitsva of tsitsit « follows » the man who dresses, not the garment — this is the yesod חובת גברא, of which the whole siman is but the application.

⚖ The structure of the siman at a glance

The ב׳ סעיפים of the Mechaber unfold a single yesod: ציצית חובת גברא ולא חובת מנא. (A) As long as one does not wear the talit, one is פטור; (B) therefore no berakha at the making of the tsitsit — שאין מצוה אלא בלבישתו, the berakha belongs to the levisha; (C) and the talit made לצורך תכריכין is exempt, even worn at times in one's lifetime. Q: Does a four-cornered talit lying in the closet « owe » tsitsit — and who is obligated?

The yesod of the חובת גברא

The siman opens with the definition that governs everything: tsitsit is חובת גברא — an obligation resting on the personולא חובת מנא, and not an obligation attached to the object. A four-cornered talit, as long as it stays folded in the closet, carries no « debt » of tsitsit, and neither does its owner: כל זמן שאינו לובש הטלית פטור מציצית. The mitsva is born only at the moment the man puts it on. In this the tsitsit differs from the mezuza and the maaka (the roof parapet), which are obligations of the house and of the one who dwells in it — hence a berakha at the affixing; the comparison is developed in Level 2, the psak in Level 4 (refer to the Rav). A related reminder: there is likewise no obligation to acquire a talit in order to become obligated — see siman 17.

Q: Does one recite a berakha when making the tsitsit or attaching them to the talit?

📚 The yesod of seif 1: since tsitsit is חובת גברא, the עשייה (making) is only a hechsher mitsva — a preparation: it triggers no berakha. It is the opposite of the mezuza and the maaka, where the affixing itself fulfils the obligation (of the house and its dweller) and carries a berakha. For tsitsit, שאין מצוה אלא בלבישתו: the mitsva — and therefore the berakha — belong to the moment the man wraps himself in the talit (siman 8). One who makes or repairs tsitsit therefore does not bless in the workshop: the berakha awaits him at the moment of the levisha. The question of the שהחיינו at the making, considered by some rishonim, belongs to Level 2; the psak, to Level 4.

5. טלית של תכריכין — the talit intended for shrouds is exempt

Q: Must a talit made for תכריכין (shrouds) bear tsitsit?
🟢 עשה טלית לצורך תכריכין — פטור — Made to serve as a shroud, it is exempt from tsitsit (seif 2).
🟢 אף על פי שלובשו לפעמים בחייוEven if one wears it at times in one's lifetime, it remains פטור (seif 2).
📚 הטעם — Its destination defines it: made for the dead, it is not the garment of use addressed by « אשר תכסה בה »; the connection to the dead (לועג לרש) is treated, with delicacy, in Level 2.

The yesod of the talit of תכריכין

Seif 2 applies the yesod to the limit case: one who makes a talit to serve as תכריכין — as a shroud — is פטור, and this even if he wears it at times in his lifetime. Since the mitsva addresses the garment with which one covers oneself for the use of the living, a garment intended for the dead does not enter the definition: the occasional, incidental wearing does not overturn its destination. Attached to this, in filigree, is the delicacy of the לועג לרש — not to « mock » the dead, who is henceforth free of the mitsvot — developed in Level 2. It is a sensitive subject, bound up with mourning: for any concrete situation (preparing takhrikhin, the talit of a deceased person), one consults one's Rav; the psak is set out in Level 4.

6. מן העשייה אל הלבישה — the ladder of situations

Q: Where does the obligation stand — from the workshop to the shoulder?
Making / repairing — One spins, one attaches the threads: no mitsva, no berakha (seif 1).
Talit stored away — Not worn: פטור מציצית — no obligation runs (seif 1).

📚 The yesod of the ladder: a single question governs every step — is the man covering himself, here and now, with a garment of use? In the workshop, no: the עשייה is only a preparation. In the closet, no: חובת גברא, the object owes nothing. On the shoulders, yes: the mitsva is there, and the berakha with it. For the תכריכין, no: the destination for the dead excludes the garment from the definition, even worn at times. And since no one is bound to buy a talit (siman 17), such is the greatness of the one who puts it on willingly — the value of the talit katan worn every day, developed in siman 24.
