1. The Central Axiom

Universal principle of Siman י״ד:

The siman treats who makes the tsitsit and whose is the talit. The עשייה demands a member of the Covenant: ציצית שעשאו עכו״ם — פסול, for « דבר אל בני ישראל » comes לאפוקי עכו״ם ; but האשה כשרה לעשותן (Rama: יש מחמירין — men, טוב לעשות כן לכתחלה). Tied by a Jew בלא כוונה (without לשמה), one relies in case of need on the רמב״ם who validates — but בלא ברכה. The borrowed talit without tsitsit is exempt for 30 days — « כסותך » ולא של אחרים — then חייב מדרבנן (it appears his own); borrowed already fitted with tsitsit → one blesses on it at once (Rama). Taking one's fellow's talit without his knowledge for the mitzvah is permitted — ניחא ליה דליעביד מצוה בממוניה — provided one folds it back; likewise the tefillin, but not the sefarim. And the partners' talit is חייבת — « על כנפי בגדיהם ».
💡 The universal key: the tsitsit requires a hand of Israel and a kavana לשמה; the talit requires being yours (כסותך) — yet the Torah loves that the mitzvah be done, even with another's property (ניחא ליה).
  • עכו״ם פסול / אשה כשרה → the עשייה demands a בן ברית; the woman is כשרה (Rama: men lechatchila)
  • בלא כוונה → in case of need, one relies on the Rambam — but בלא ברכה
  • טלית שאולה → exempt 30 days (כסותך); afterwards → חייב מדרבנן; already fitted → bless at once
  • ניחא ליה → a fellow's talit: permitted + fold it back; tefillin yes, sefarim no
  • שותפין → the jointly owned talit is חייבת (בגדיהם)

2. Master table of the ה׳ seifim

The ה׳ סעיפים of the Mechaber group into four axes: (A) who makes the tsitsit — the עכו״ם is פסול, the woman is כשרה, and tying בלא כוונה is validated (Rambam) only in case of need, without a berakha; (B) the borrowed talit — exempt 30 days (כסותך ולא של אחרים), then חייב מדרבנן; (C) the ניחא ליה — taking a fellow's talit for the mitzvah is permitted, provided one folds it back; tefillin yes, sefarim no; (D) the טלית של שותפין — חייבת (בגדיהם).

AxisSeifHeart of the halakhaMarker
A. עשיית
הציצית
① ציצית שעשאו עכו״ם — פסול, for it is written « דבר אל בני ישראל » — לאפוקי עכו״ם. האשה כשרה לעשותן. Rama: יש מחמירין — to require that men make them, and טוב לעשות כן לכתחלה. לאפוקי עכו״ם
② הטיל ישראל ציציות בבגד בלא כוונה (without kavana לשמה): if no other tsitsit are available to make the talit valid, יש לסמוך על הרמב״ם שמכשיר — one relies on the Rambam who validates — אבל לא יברך עליו (but one shall not bless on it). אבל לא יברך
B. טלית
שאולה
③ The borrowed talit without tsitsit is exempt from tsitsit for 30 days (ל׳ יום), for it is written « כסותך » — ולא של אחרים; after 30 days → חייב מדרבנן, for it appears his own (נראית כשלו). Rama: returned then borrowed again within the 30 days, it does not combine — one needs ל׳ יום רצופים (consecutive). Borrowed already fitted → מברך עליה מיד (one blesses on it at once). כסותך ולא של אחרים
C. ניחא
ליה
④ מותר ליטול טלית חבירו ולברך עליה — it is permitted to take one's fellow's talit (without his knowledge) and bless on it, for ניחא ליה — it pleases him that a mitzvah be done with his property — provided one folds it back if one found it folded (שיקפל אותה). Rama: likewise the tefillin; but it is forbidden to study from another's sefarim without his consent — שמא יקרע אותם בלמודו (lest one tear them while studying). ובלבד שיקפל
D. טלית של
שותפין
⑤ טלית של שותפין חייבת בציצית — the jointly owned talit is bound by tsitsit, for it is written « על כנפי בגדיהם » (in the plural: « their garments »). בגדיהם

⚖ The structure of the siman at a glance

The ה׳ סעיפים of the Mechaber decide making and ownership: (A) the עשייה — עכו״ם פסול (דבר אל בני ישראל), אשה כשרה (Rama: men lechatchila), and tying בלא כוונה validated in case of need (Rambam) but בלא ברכה; (B) the borrowed talit — exempt 30 days (כסותך), then חייב מדרבנן; already fitted → bless at once; (C) the ניחא ליה — a fellow's talit: permitted + fold it back; tefillin yes, sefarim no; (D) the טלית של שותפין — חייבת (בגדיהם). The Shulchan Aruch HaRav (the Alter Rebbe) unfolds this siman into ט״ו סעיפים: the invalidity of the non-Jew, the woman, tying בלא כוונה, the borrowed talit, a fellow's talit, the tefillin and sefarim, and the partners' talit.

3. עשיית הציצית — עכו״ם פסול, אשה כשרה, בלא כוונה

Q: Who may tie the tsitsit, and with what intention?
↓
🔴 ציצית שעשאו עכו״ם — פסול — « דבר אל בני ישראל » — לאפוקי עכו״ם (seif 1).
🟢 האשה כשרה לעשותן — The woman is fit to make the tsitsit (seif 1).
🟡 Rama — יש מחמירין — Some require men; טוב לעשות כן לכתחלה (seif 1).
🟡 הטיל בלא כוונה — With no other tsitsit available: one relies on the רמב״ם who validates — אבל לא יברך עליו (seif 2).

The yesod of the עשייה לשמה

The siman opens with the making: tsitsit tied by a עכו״ם are pesulim, for the parashah of tsitsit opens « דבר אל בני ישראל » — the עשייה belongs to the Bnei Israel, לאפוקי עכו״ם (Menachot 42a). The woman, by contrast, is fully כשרה to make them — she is of the Covenant, even though she is exempt from the mitzvah; the Rama, however, cites the יש מחמירין (that men should make them) and concludes: טוב לעשות כן לכתחלה. Second storey: the kavana לשמה. If a Jew attached the tsitsit בלא כוונה, this is the machloket between the Rambam (valid bedieved) and the Rosh / Tosafot (invalid — תעשה לך לשמה); the Mechaber rules as a compromise: in case of need (no other tsitsit), one relies on the Rambam — but without a berakha (ספק ברכות להקל). The detail of the machloket is developed in Level 2; the psak, in Level 4 (refer to the Rav).

4. טלית שאולה — « כסותך ולא של אחרים », the 30 days

Q: Must a borrowed talit carry tsitsit?
↓
🟢 Without tsitsit → פטור 30 days — « כסותך » — ולא של אחרים (seif 3).
🟡 After ל׳ יום → חייב מדרבנן — For it appears his own (נראית כשלו) (seif 3).
📚 Rama — ל׳ יום רצופים — Returned then borrowed again within the 30 days: אינו מצטרף — one needs 30 consecutive days (seif 3).
🟢 Rama — borrowed already מצוייצת — מברך עליה מיד: one blesses on it at once (seif 3).
📚 The yesod of seif 3: the Torah says « כסותך » — your garment — and not that of others: the borrowed talit is therefore exempt from tsitsit מדאורייתא (Chulin 136a). The Sages nevertheless fixed 30 days: beyond that, the talit appears his own (נראית כשלו) and becomes חייב מדרבנן. The Rama specifies (Nimukei Yosef) that the 30 days must be consecutive — returned and borrowed again, the count starts anew. And if one borrowed it already fitted with tsitsit, the Rama rules: מברך עליה מיד — one blesses on it at once, for he borrowed it for the mitzvah. Very concrete nafka mina: the synagogue talit, the talit lent to the chatan or to the guest — detail in Level 4 (refer to the Rav).

5. ניחא ליה — taking a fellow's talit

Q: May one take another's talit, without his knowledge, in order to pray?
↓
🟢 מותר ליטול טלית חבירו ולברך עליה — Permitted to take it and bless on it (seif 4).
📚 The טעם — ניחא ליה — It pleases him that a mitzvah be done with his property (ניחא ליה דליעביד מצוה בממוניה) (seif 4).
🟡 Condition — fold it back — ובלבד שיקפל אותה if one found it folded (seif 4).
🟢 Rama — וה״ה בתפילין — The same holds for the tefillin (seif 4).
🔴 Rama — but not the ספרים — Forbidden to study from another's books without his consent — שמא יקרע אותם בלמודו (seif 4).

The yesod of the ניחא ליה

Seif 4 states a remarkable permission: to take one's fellow's talit, without his knowledge, and bless on it. The foundation: ניחא ליה לאיניש דליעביד מצוה בממוניה — it is pleasing to a man that a mitzvah be accomplished with his property; there is thus a kind of presumed consent, and this is not an ordinary שואל שלא מדעת. But the permission has limits: one must fold the talit back if one found it folded (ובלבד שיקפל אותה) — cause the owner neither distress nor loss. The Rama extends the din to the tefillin (Nimukei Yosef, פרק הספינה) — see the laws of tefillin, סי׳ כ״ה; but stops it short before the sefarim: it is forbidden to study from another's books without his consent, for one fears he might tear them while studying (loss — Bava Metzia 29b): where there is a risk of loss, the ניחא ליה ceases. The fine limits (not taking the talit out of the house, repeated use) are developed in Level 2; the psak, in Level 4.

6. טלית של שותפין — the partners' talit

Q: Is a jointly owned talit bound by tsitsit?
↓
🟢 טלית של שותפין — חייבת בציצית — The partners' talit is bound by tsitsit (seif 5).
📚 The טעם — בגדיהם — It is written « על כנפי בגדיהם » — « their garments », in the plural (seif 5).
📚 The yesod of seif 5: one might have thought that the jointly owned talit resembles the borrowed talit — it is not wholly « כסותך ». The verse decides: « על כנפי בגדיהם » — their garments, in the plural — a garment owned by several is fully חייב בציצית. This is the fundamental difference from the טלית שאולה: the partner is an owner (in part), the borrower is not one at all. Its bearing on the communal talit of the synagogue: detail in Level 4 (refer to the Rav).

7. Golden rules — Memory Aid

The 5 golden rules of Siman י״ד
  • עכו״ם פסול / אשה כשרה — the עשייה demands a בן ברית (דבר אל בני ישראל); Rama: men lechatchila.
  • בלא כוונה — with no other tsitsit: one relies on the Rambam who validates — but לא יברך עליו.
  • טלית שאולה — exempt 30 days (כסותך ולא של אחרים); after ל׳ יום → חייב מדרבנן; already fitted → bless at once.
  • ניחא ליה — a fellow's talit: permitted + bless, provided one folds it back; tefillin yes, sefarim no.
  • שותפין — the jointly owned talit is חייבת: « על כנפי בגדיהם ».

8. Mnemonic — Memory Aid

Acrostic: L-S-N-S — the four markers of Siman י״ד
  • Lishmah (עשייה לשמה) — עכו״ם pasul, woman keshera; without kavana → Rambam, but without a berakha.
  • Sheula (טלית שאולה) — exempt 30 days (כסותך); already fitted → bless at once.
  • Nicha leih (ניחא ליה) — a fellow's talit: permitted + fold it back; tefillin yes, sefarim no.
  • Shutafin (טלית של שותפין) — חייבת: בגדיהם.
4 foundational formulas to memorize:
  • דבר אל בני ישראל — לאפוקי עכו״ם — the making belongs to the Bnei Israel
  • כסותך — ולא של אחרים — the borrowed talit is exempt (30 days)
  • ניחא ליה לאיניש דליעביד מצוה בממוניה — the owner's presumed consent
  • על כנפי בגדיהם — the partners' talit is חייבת

9. Pitfalls to Avoid

❌ Pitfall 1: Believing the woman is pesula for tying the tsitsit, like the עכו״ם.
→ The seif: האשה כשרה לעשותן; only the עכו״ם is פסול (דבר אל בני ישראל) — the Rama merely recommends men lechatchila (seif 1).
❌ Pitfall 2: Blessing on tsitsit tied בלא כוונה, since « the Rambam validates ».
→ The seif: one relies on the Rambam only in case of need — אבל לא יברך עליו (seif 2).
❌ Pitfall 3: Attaching tsitsit (or requiring tsitsit) on a borrowed talit from the very first day.
→ The seif: כסותך ולא של אחרים — exempt 30 days; only after ל׳ יום (consecutive — Rama) does it become חייב מדרבנן (seif 3).
❌ Pitfall 4: Hesitating to borrow a friend's talit at the synagogue — or leaving it in a heap after use.
→ The seif: מותר ליטול טלית חבירו ולברך עליה — permitted (ניחא ליה), provided one folds it back if it was folded (seif 4).
❌ Pitfall 5: Extending the permission of the ניחא ליה to one's fellow's books.
→ The seif: the tefillin yes (וה״ה בתפילין), but the sefarim no — שמא יקרע אותם בלמודו (seif 4, Rama).

10. Another's talit in practice

StepConductBase halakha
① Buying / having tied Tsitsit tied by a Jew, לשמה (certification); woman כשרה — custom: men lechatchila לאפוקי עכו״ם
② Tied without kavana Valid in case of need (Rambam) — but without a berakha אבל לא יברך
③ Borrowed talit Without tsitsit: exempt 30 days; already fitted (synagogue, aliyah to the Torah): bless at once כסותך · מברך מיד
④ Another's talit, without his knowledge Permitted for the mitzvah + fold it back; do not carry it off; tefillin likewise; sefarim no ניחא ליה · שיקפל
⑤ Past 30 days, partners, fine cases Long loan / rental, communal talit, שותפין: refer to the Rav SA HaRav — ט״ו סעיפים

11. Final Synthesis Table

AspectRuleMarker
עשאו עכו״ם / אשה עכו״ם → פסול (דבר אל בני ישראל); אשה → כשרה; Rama: men lechatchila Seif 1 (Rama)
הטיל בלא כוונה In case of need, one relies on the Rambam — but בלא ברכה Seif 2
טלית שאולה Exempt 30 days (כסותך); after ל׳ יום רצופים → חייב מדרבנן; already fitted → bless at once Seif 3 (Rama)
ניחא ליה A fellow's talit: permitted + bless + fold back; tefillin yes; sefarim no (שמא יקרע) Seif 4 (Rama)
טלית של שותפין חייבת בציצית — « על כנפי בגדיהם » Seif 5

✦ ❖ ✦ The 4 Practical Commandments of Siman י״ד in Brief

  1. Check who tied — tsitsit made by a Jew, לשמה; the עכו״ם is פסול; the woman is כשרה (custom: men lechatchila).
  2. Without kavana → without a berakha — in case of need one relies on the Rambam, but לא יברך עליו.
  3. The borrowed talit — exempt 30 days (כסותך); borrowed already fitted → bless on it at once.
  4. Another's talit — permitted for the mitzvah (ניחא ליה) + fold it back; tefillin yes, sefarim never (SA HaRav, ט״ו סעיפים).
