The previous siman closed the laws of Minha; this one opens the laws of the evening Shema — and opens them with a question of time. The Torah says ובשכבך: it must be night. But when does night truly begin, what should one do when the congregation prays before it, and how late can a delay still be made good? Four seifim for a single question: when? Hebrew text, English translation and explanation of the ד׳ seifim, with a section of practical cases.

The evening Shema is not a prayer one says whenever one likes: it is a testimony given at the hour when people lie down. The whole siman turns on that hour. It opens when three small stars appear; it is guarded by a half hour of restraint in which no meal is begun; it closes at midnight — a fence the Sages erected — and for one who has delayed too long it leaves only a corridor until dawn. Here we study the principle; for personal practice, one follows the ruling of one’s Rav.

A. צאת הככבים — when night begins
צֵאת הַכּוֹכָבִים — the emergence of the stars. The mishnah that opens tractate Berakhot speaks not of stars but of priests:
« מֵאֵימָתַי קוֹרִין אֶת שְׁמַע בָּעֲרָבִין? מִשָּׁעָה שֶׁהַכֹּהֲנִים נִכְנָסִים לֶאֱכוֹל בִּתְרוּמָתָן » (ברכות ב׳ ע״א). It is the Gemara that at once translates the image into a visible sign in the sky:
« מִכְּדִי כֹּהֲנִים אֵימַת קָא אָכְלִי תְּרוּמָה? — מִשְּׁעַת צֵאת הַכּוֹכָבִים » (ברכות ב׳ ע״א). The Shulchan Aruch begins directly from that sign — and adds caution to it.
Seif 1 — זמן קריאת שמע בלילה

Seif 1: the time for reading the Shema at night is from the hour when three small stars come out. And if the day is overcast, he shall wait until the doubt has left his heart. And if he read it before that, he goes back and reads it without the blessings. And if the congregation anticipates and reads the Shema while it is still day, he shall read the Shema and its blessings with them and pray with them; and when the time arrives, he reads the Shema without the blessings. Rama’s gloss: nevertheless he shall not repeat the Amidah at night, even though the congregation anticipates it by a great deal before nightfall — unless he is accustomed to other practices of abstention and piety, for then his repeating and praying does not look like arrogance.
Why night, and why stars.
« דכתיב ובשכבך וקודם לילה לאו זמן שכיבה הוא ולילה מקרי משנראו ברקיע ג׳ כוכבים בינונים » (משנה ברורה, מ״ב רל״ה:א). summary : the verse commands the reading “when you lie down”; before night, it is simply not the hour when people lie down
Why small stars, when the law would be satisfied with medium ones.
« אך מפני שאין הכל בקיאין ויבואו לטעות בגדולים » (משנה ברורה, מ״ב רל״ה:א) ;
« החמירו גבי ק״ש דאינו קורא עד שיראו ג׳ קטנים » (משנה ברורה, מ״ב רל״ה:א). summary : the measure of the law is the medium star; it is our inability to tell medium from large that made the small ones required
The overcast day: a doubt — and a doubt in a Torah obligation.
« דספק דאורייתא הוא » (משנה ברורה, מ״ב רל״ה:ג). summary : one does not settle a Torah doubt by approximation: one waits until the sky, or the clock, removes the hesitation
And for one who cannot see the sky — a measure of time.
« ואם הוא יודע מתי שקעה החמה ימתין כשיעור ד׳ מילין שהוא ע״ב מינוט » (משנה ברורה, מ״ב רל״ה:ד). summary : four mil from sunset, that is seventy-two minutes; the Mishnah Berurah refers to siman 293 for the details
Read too early: one reads again, but without the blessings.
« דהא כבר בירך אותם ואע״ג דלא יצא בק״ש שקרא קודם הזמן אעפ״כ לא הוי הברכות לבטלה » (משנה ברורה, מ״ב רל״ה:ז). summary : the blessings of the Shema are not so bound to the reading as to be lost: they have their own institution, and are not repeated
B. אם הצבור מקדימים — the congregation that anticipates nightfall
Seif 1 (continued) — יקרא עמהם ק״ש וברכותיה ויתפלל עמהם
Here the Shulchan Aruch is not legislating in a vacuum: it answers a widespread and awkward practice. Whole communities read the Shema and prayed arvit long before nightfall — not out of laxity, but because the public, once home, would no longer gather.
What drove them to anticipate the hour.
« והיו עושין כן מפני הדחק שכמה פעמים אלו היו ממתינין בתפלת ערבית עד צה״כ היה כ״א הולך לביתו ולא היו מתפללין בצבור » (משנה ברורה, מ״ב רל״ה:ח). summary : this was not slackness but arithmetic: to wait for night was to lose the minyan
The Mehaber’s solution: two readings, only one of which discharges the duty.
« ואם הצבור מקדימים לקרות ק״ש מבעוד יום יקרא עמהם ק״ש וברכותיה ויתפלל עמהם וכשמגיע זמן קורא ק״ש בלא ברכות » (שו״ע או״ח רל״ה:א). summary : one reads and prays with the public — for communal prayer and for joining redemption to prayer — then reads the Shema again alone, at its hour, without its blessings
What one must have in mind at the first reading.
« ולא יכוין אז לצאת ידי חובת ק״ש כ״א בקריאה שניה שקורא אח״כ בזמנה » (משנה ברורה, מ״ב רל״ה:ט). summary : the intention to discharge the obligation is reserved for the second reading, the one that falls in its proper time
Why not simply pray later, alone?
« כדי לסמוך גאולה לתפלה וגם להתפלל עם הצבור » (משנה ברורה, מ״ב רל״ה:י). summary : two reasons combine: joining redemption to prayer, and praying with the public
How much must one read again?
« ודי שיקרא שתי פרשיות הראשונות כיון שהזכיר יציאת מצרים בבהכ״נ » (משנה ברורה, מ״ב רל״ה:יא) ;
« אבל בשאגת אריה האריך ומסיק דירא שמים יש לו ליזהר לקרות כל השלש פרשיות של ק״ש אחר צאת הכוכבים » (משנה ברורה, מ״ב רל״ה:יא). summary : two paragraphs suffice according to the Magen Avraham, since the exodus has already been mentioned; the Shaagat Aryeh asks the God-fearing to read all three
And would the Shema said at bedtime not suffice?
« ואין כדאי לסמוך על הקריאה שקורא על מטתו אפילו אם מנהגו לקרות כל הג׳ פרשיות דהא צריך לכוין לצאת ידי מ״ע של ק״ש » (משנה ברורה, מ״ב רל״ה:יב). summary : the bedtime reading is not said with the intention of discharging the mitzvah; one therefore does not rely on it

C. חצי שעה סמוך לזמן — the meal one does not begin

אסור להתחיל לאכול חצי שעה סמוך לזמן קריאת שמע של ערבית ואם התחיל לאכול אחר שהגיע זמנה מפסיק וקורא קריאת שמע בלא ברכותיה וגומר סעודתו ואחר כך קורא אותה בברכותיה ומתפלל: הגה אבל אין צריך להפסיק לתפלה הואיל והתחיל לאכול אבל אם לא התחיל לאכול אע״פ שנוטל ידיו צריך להפסיק (ר״ן פ״ק דשבת) ואם אין שהות להתפלל מפסיק אף לתפלה (הראב״ד בהגהות פ״ג מהלכות ברכות):
Seif 2: it is forbidden to begin eating half an hour before the time of the evening Shema. And if he began to eat after its time had arrived, he interrupts and reads the Shema without its blessings, finishes his meal, and afterwards reads it with its blessings and prays. Rama’s gloss: but he need not interrupt for the Amidah, since he has begun to eat. If, however, he has not begun to eat — even though he has washed his hands — he must interrupt. And if there is not enough time to pray, he interrupts even for the Amidah.
The fear, in one sentence.
« והטעם שמא ימשך בסעודתו ופעמים ישתקע עי״ז גם בשינה וישכח לקרות שמע » (משנה ברורה, מ״ב רל״ה:טז). summary : it is not the meal that is feared but what follows it: the sleep that overtakes a man and carries off the whole night
The source, in the Gemara: the man returning from the field.
« חֲכָמִים עָשׂוּ סְיָיג לְדִבְרֵיהֶם, כְּדֵי שֶׁלֹּא יְהֵא אָדָם בָּא מִן הַשָּׂדֶה בָּעֶרֶב, וְאוֹמֵר: ״אֵלֵךְ לְבֵיתִי וְאוֹכַל קִימְעָא וְאֶשְׁתֶּה קִימְעָא, וְאִישַׁן קִימְעָא, וְאַחַר כָּךְ אֶקְרָא קְרִיאַת שְׁמַע וְאֶתְפַּלֵּל״, וְחוֹטַפְתּוֹ שֵׁינָה וְנִמְצָא יָשֵׁן כָּל הַלַּיְלָה » (ברכות ד׳ ע״ב). summary : the Sages erected a fence against a sentence every tired man says to himself
And what he should do instead.
« אֲבָל אָדָם בָּא מִן הַשָּׂדֶה בָּעֶרֶב, נִכְנָס לְבֵית הַכְּנֶסֶת, אִם רָגִיל לִקְרוֹת — קוֹרֵא. וְאִם רָגִיל לִשְׁנוֹת — שׁוֹנֶה, וְקוֹרֵא קְרִיאַת שְׁמַע וּמִתְפַּלֵּל, וְאוֹכֵל פִּתּוֹ וּמְבָרֵךְ » (ברכות ד׳ ע״ב). summary : enter the synagogue, read or study according to his habit, read the Shema, pray — and only then eat his bread
The Rambam makes this a halakhah in its own right.
« לֹא יָבוֹא אָדָם מִמְּלַאכְתּוֹ וְיֹאמַר אֹכַל מְעַט וְאִישַׁן קִמְעָא וְאַחַר כָּךְ אֶתְפַּלֵּל, שֶׁמָּא תֶּאֱנֹס אוֹתוֹ שֵׁנָה וְנִמְצָא יָשֵׁן כָּל הַלַּיְלָה » (רמב״ם הלכות תפילה פרק ו הלכה ז). summary : his wording is almost that of the baraita: the fault is not the eating, it is the postponing
A meal, no; a tasting, yes.
« ואפילו לאכול קמעא אסור ומ״מ טעימה בעלמא מיני פירות או אפילו פת בכביצה שרי » (משנה ברורה, מ״ב רל״ה:טז). summary : fruit, or bread the volume of an egg, is not a meal; the Magen Avraham and the Aruch HaShulchan hold likewise
What applies to eating applies to sleeping too.
« וכן לישן אפילו דעתו רק לישן קמעא » (משנה ברורה, מ״ב רל״ה:יז) ;
« אבל משהגיע זמן ק״ש אסור אף ללמוד כשהוא מתפלל בביתו ביחיד ואם אמר לחבירו שאינו לומד שיזכרנו שיתפלל מותר » (משנה ברורה, מ״ב רל״ה:יז). summary : even a brief nap is forbidden; and once the hour has come, even study is forbidden to one who prays alone at home — unless another has undertaken to remind him
The half hour, contested and then upheld.
« דעת הט״ז להקל בזה ולא בעי אלא שיעור מועט והאחרונים מסכימים לפסק השו״ע דכל דליכא אלא חצי שעה אסור להתחיל לאכול » (משנה ברורה, מ״ב רל״ה:יח). summary : the Taz judged the measure too broad; the Acharonim upheld the Shulchan Aruch’s half hour
One who began after the hour interrupts — for the Shema.
« מיד כיון דק״ש דאורייתא הוא והוא התחיל באיסור ואם התחיל בהיתר דהיינו לפני חצי שעה שסמוכה לצה״כ אפילו לק״ש אינו מפסיק כל שיש לו שהות לקרוא אחר גמר סעודתו » (משנה ברורה, מ״ב רל״ה:כא). summary : the interruption falls only on one who began unlawfully; whoever began lawfully, more than half an hour before, does not interrupt if time will remain
Why without the blessings?
« משום דברכות אינם אלא מדרבנן לא הטריחוהו להפסיק בשבילם » (משנה ברורה, מ״ב רל״ה:כב). summary : the blessings are of rabbinic institution: one does not burden a man at table with saying them mid-meal
Why one interrupts here, though at Minha one does not.
« ולא דמי להתחיל סמוך למנחה דאינו מפסיק בדיעבד אם כבר נטל ידיו כדמבואר לעיל בסי׳ רל״ב דבמנחה כיון דזמנה מועט מירתת ולא אתי למפשע משא״כ בערבית דזמנה בדיעבד כל הלילה גזרינן דלמא אתי למפשע ויסמוך על אריכותה של לילה » (משנה ברורה, מ״ב רל״ה:כד). summary : at Minha the time is short and a man stays alert; in the evening the night looks long, and that very length invites negligence
The case of hands already washed.
« ודוקא כשלא בירך עדיין ענט״י אבל אם כבר בירך ענט״י נכון שלא יפסיק אלא יברך המוציא ויאכל כזית ויפסיק סעודתו » (משנה ברורה, מ״ב רל״ה:כד). summary : if the blessing over washing has already been said, one does not cut between it and the bread: one blesses, eats a kazayit, and interrupts then
And when no time remains at all.
« ואם אין שהות להתפלל מפסיק אף לתפלה » (שו״ע או״ח רל״ה:ב) ;

D. עד חצות ועד עמוד השחר — the closing of the time

לכתחלה צריך לקרות ק״ש מיד בצאת הככבים וזמנה עד חצי הלילה ואם עבר ואיחר וקרא עד שלא עלה עמוד השחר יצא י״ח:
Seif 3: at the outset one must read the Shema immediately as the stars come out; and its time runs until the middle of the night. And if one transgressed and delayed, and read it before dawn rose, one has discharged the obligation.
Why “immediately”.
« דזריזין מקדימין למצות » (משנה ברורה, מ״ב רל״ה:כו). summary : the general rule that the zealous are early for mitzvot
What “midnight” means here.
« דרבנן גדרו שאסור להתאחר בקריאת שמע ביותר מחצות שלא לבוא לידי מכשול ואם מתאחר מקרי עובר על דברי חכמים » (משנה ברורה, מ״ב רל״ה:כז). summary : it is not the end of the Torah’s time but a rabbinic fence; one who let midnight pass without reading has transgressed the word of the Sages
And from the Torah’s standpoint?
« דמן התורה לכו״ע זמנה כל הלילה דובשכבך כ״ז שבני אדם שוכבין משמע » (משנה ברורה, מ״ב רל״ה:כח). summary : “when you lie down” denotes the whole span during which people are lying down — that is, the whole night
The halakhah as decided in the Gemara.
« אָמַר רַב יְהוּדָה, אָמַר שְׁמוּאֵל: הֲלָכָה כְּרַבָּן גַּמְלִיאֵל » (ברכות ח׳ ע״ב). summary : Rabban Gamliel says “until dawn rises”, and so the law was fixed
The Rambam, direct source of our seif.
« מִצְוָתָהּ מִשְּׁעַת יְצִיאַת הַכּוֹכָבִים עַד חֲצִי הַלַּיְלָה. וְאִם עָבַר וְאִחֵר וְקָרָא עַד שֶׁלֹּא עָלָה עַמּוּד הַשַּׁחַר יָצָא יְדֵי חוֹבָתוֹ שֶׁלֹּא אָמְרוּ עַד חֲצוֹת אֶלָּא כְּדֵי לְהַרְחִיק אָדָם מִן הַפְּשִׁיעָה » (רמב״ם הלכות קריאת שמע פרק א הלכה ט). summary : the Shulchan Aruch reproduces the Rambam almost word for word; the Beur Halakhah notes that other Rishonim held otherwise, and that the ruling here follows the majority
Seif 4 — הקורא לאחר שעלה עמוד השחר
הקורא קריאת שמע של ערבית אחר שעלה עמוד השחר קודם הנץ (פירוש יציאת החמה מענין הנצו הרימונים) החמה לא יצא ידי חובתו אלא א״כ היה אנוס כגון שכור או חולה וכיוצא בהן ואנוס שקרא אז לא יאמר השכיבנו דכיון שעלה עמוד השחר אינו זמן שכיבה: הגה אבל שאר הברכות דהיינו שנים שלפני קריאת שמע וברכת אמת ואמונה עד השכיבנו אומר (טור ומרדכי והגהות מיימוני וע״ל סי׳ נ״ח סעיף ה׳):
Seif 4: one who reads the evening Shema after dawn has risen, before sunrise (explanation: the coming out of the sun, from the same root as “the pomegranates have budded”), has not discharged his obligation — unless he was compelled, such as a drunk man or a sick man and their like. And a compelled man who read at that time shall not say השכיבנו, for once dawn has risen it is no longer the hour of lying down. Rama’s gloss: but the other blessings — that is, the two before the Shema and the blessing אמת ואמונה up to השכיבנו — he does say.
Why the negligent man loses out, though the Torah still left him time.
« היכא דלא איתנס בטלו חכמים ממנו מצות ק״ש על שאיחר כ״כ ואינו יוצא ידי חובתה שוב בקריאתה » (משנה ברורה, מ״ב רל״ה:ל). summary : the hour after dawn is still “night” for a few late sleepers; but the Sages withdrew the mitzvah from one who delayed so long without being compelled
The word that decides everything: אנוס.
« דבלא אונס אפילו קראה תיכף משעלה עה״ש ג״כ אינו יוצא ובאונס אפילו קראה אח״כ כל שלא הנץ החמה יוצא » (ביאור הלכה או״ח סימן רל״ה). summary : without compulsion, even a reading made at the very moment of dawn no longer counts; under compulsion, it counts until sunrise
The drunk man: how does he count as compelled?
« דְּהָהוּא זוּגָא דְּרַבָּנַן דְּאִשְׁתַּכּוּר בְּהִלּוּלָא דִּבְרֵיהּ דְּרַבִּי יְהוֹשֻׁעַ בֶּן לֵוִי » (ברכות ט׳ ע״א) ;
« כְּדַאי הוּא רַבִּי שִׁמְעוֹן לִסְמוֹךְ עָלָיו בִּשְׁעַת הַדְּחָק » (ברכות ט׳ ע״א). summary : two Sages became drunk at the wedding of Rabbi Yehoshua ben Levi’s son; he allowed them, under duress, to rely on Rabbi Shimon’s view
But not every drunk man is compelled.
« נ״ל באם נשתכר אדם אחר התחלת הזמן קריאת שמע לא מקרי אונס ואין לו שיעור לקרות רק עד שיעלה ע״ה ותו לא » (ט״ז או״ח סימן רל״ה) ;
« אבל בנשתכר זמן מועט קודם עלות השחר שאי אפשר בשעה קטנה כזו להפיג שכרותו לא הוי אונס ולא יצא ידי חובתו » (משנה ברורה, מ״ב רל״ה:לא). summary : the Taz distinguishes according to when the drunkenness began; the Mishnah Berurah follows that line for one who becomes drunk just before dawn
Why he does not say השכיבנו.
« אָמַר רַבִּי זֵירָא: וּבִלְבַד שֶׁלֹּא יֹאמַר ״הַשְׁכִּיבֵנוּ״ » (ברכות ט׳ ע״א) ;
« ר״ל אינו זמן שבני אדם הולכים לשכב שיהיה שייך לומר על זה השכיבנו » (משנה ברורה, מ״ב רל״ה:לג). summary : the blessing asks to lie down in peace; at dawn, that is no longer what one asks
Nor does he save it by beginning further on.
« מתבאר בפוסקים דאפילו אם ירצה לדלג תיבת השכיבנו ולהתחיל מן ותקננו בעצה וכו׳ נמי אינו נכון » (משנה ברורה, מ״ב רל״ה:לב). summary : the Tur reported that one might begin at ותקננו; the Mishnah Berurah rules that this too is not proper
What he does say.
« אבל שאר הברכות דהיינו שנים שלפני קריאת שמע וברכת אמת ואמונה עד השכיבנו אומר » (שו״ע או״ח רל״ה:ד) ;
« וגם שמ״ע לא יתפלל דתפלת ערבית נתקנה רק בשביל לילה ומכיון שעלה עה״ש יום הוא לכל דבר » (משנה ברורה, מ״ב רל״ה:לד). summary : the two blessings before, and אמת ואמונה up to השכיבנו — but, for the Mishnah Berurah, no longer the evening Amidah, dawn having made the moment day
Practical cases
Case 1 — The summer minyan that prays before nightfall
Situation: my congregation reads the Shema and prays arvit while it is still broad daylight. What should I do?
Practice: The answer of seif 1 is twofold, and it does not ask one to leave the public:
« ואם הצבור מקדימים לקרות ק״ש מבעוד יום יקרא עמהם ק״ש וברכותיה ויתפלל עמהם וכשמגיע זמן קורא ק״ש בלא ברכות » (שו״ע או״ח רל״ה:א). The first reading is therefore not the one that discharges the duty:
« ולא יכוין אז לצאת ידי חובת ק״ש כ״א בקריאה שניה שקורא אח״כ בזמנה » (משנה ברורה, מ״ב רל״ה:ט) — and one prays with them all the same for two reasons,
« כדי לסמוך גאולה לתפלה וגם להתפלל עם הצבור » (משנה ברורה, מ״ב רל״ה:י). For the second reading the Magen Avraham is lenient,
« ודי שיקרא שתי פרשיות הראשונות כיון שהזכיר יציאת מצרים בבהכ״נ » (משנה ברורה, מ״ב רל״ה:יא), while the Shaagat Aryeh asks for more:
« אבל בשאגת אריה האריך ומסיק דירא שמים יש לו ליזהר לקרות כל השלש פרשיות של ק״ש אחר צאת הכוכבים » (משנה ברורה, מ״ב רל״ה:יא). As for repeating the Amidah, the Rama rules it out:
« ומיהו לא יחזור ויתפלל בלילה אע״פ שהצבור מקדימים הרבה לפני הלילה אלא אם כן הוא רגיל בשאר פרישות וחסידות דאז לא מתחזי כיוהרא מה שיחזור ומתפלל » (שו״ע או״ח רל״ה:א); but re-reading the Shema raises no question of appearances,
« אבל מה שחוזר וקורא ק״ש לא מחזי כיוהרא דלענין ק״ש כמעט כל הפוסקים מסכימים דזמנה הוא מצה״כ » (משנה ברורה, מ״ב רל״ה:טו). summary: one prays with the public, re-reads the Shema alone at its hour, and does not repeat the Amidah. For practice, one follows one’s Rav.
Case 2 — The meal at the end of Shabbat, or a summer dinner
Situation: night is approaching and I am about to sit down to a meal before reading the Shema.
Practice: Seif 2 closes the half hour preceding it:
« אסור להתחיל לאכול חצי שעה סמוך לזמן קריאת שמע של ערבית » (שו״ע או״ח רל״ה:ב) — and the Mishnah Berurah explicitly extends the caution to motzaei Shabbat:
« היינו סמוך לצאת הכוכבים ומשמע ממ״א דאפילו במוצאי שבת יש ליזהר שלא להתחיל אז הסעודה » (משנה ברורה, מ״ב רל״ה:יט). The half hour before counts as the time itself:
« ובתוך חצי שעה סמוך לצאת הכוכבים נמי כאחר שהגיע זמן הוא » (משנה ברורה, מ״ב רל״ה:כ). A mere tasting remains permitted:
« ואפילו לאכול קמעא אסור ומ״מ טעימה בעלמא מיני פירות או אפילו פת בכביצה שרי » (משנה ברורה, מ״ב רל״ה:טז); the Aruch HaShulchan presses this as settled practice,
« ואפילו בהגיע זמן תפלת ערבית וגם אחר כך - מותר בטעימה, והיינו שלא בסעודה קבועה, וכן מנהג העולם » (ערוך השלחן או״ח סימן רל״ה). And the Magen Avraham adds the warning of short nights:
« וצריך ליזהר בימות הקיץ שלא לאכול בסעודה גדולה שיודע שתמשך » (מגן אברהם או״ח סימן רל״ה). summary: one does not settle down to a meal in the half hour before; tasting is permitted; and a meal likely to run long is preceded by prayer. For practice, one follows one’s Rav.
Case 3 — I fell asleep and woke after midnight
Situation: it is two in the morning and I have not read the evening Shema.
Practice: One reads, and discharges the obligation:
« ואם עבר ואיחר וקרא עד שלא עלה עמוד השחר יצא י״ח » (שו״ע או״ח רל״ה:ג) — for from the Torah’s standpoint,
« דמן התורה לכו״ע זמנה כל הלילה דובשכבך כ״ז שבני אדם שוכבין משמע » (משנה ברורה, מ״ב רל״ה:כח). The “midnight” of seif 3 was a fence, not an end:
« דרבנן גדרו שאסור להתאחר בקריאת שמע ביותר מחצות שלא לבוא לידי מכשול ואם מתאחר מקרי עובר על דברי חכמים » (משנה ברורה, מ״ב רל״ה:כז). But the door closes at dawn:
« לא יצא ידי חובתו אלא א״כ היה אנוס כגון שכור או חולה וכיוצא בהן » (שו״ע או״ח רל״ה:ד); and the Beur Halakhah notes that compulsion makes all the difference here,
« דבלא אונס אפילו קראה תיכף משעלה עה״ש ג״כ אינו יוצא ובאונס אפילו קראה אח״כ כל שלא הנץ החמה יוצא » (ביאור הלכה או״ח סימן רל״ה). summary: waking after midnight, one reads at once, with its blessings, as long as dawn has not risen. For practice, one follows one’s Rav.
