The previous siman dealt with the Shema recited upon one’s bed; this one remains in the same room and turns to what is lived there. It is a canonical siman of the Shulchan Aruch, and it is studied like any other. It first lays down a debt — the onah a husband owes his wife — then an intention, then a long series of conducts of restraint. The siman rests on two phrases the tradition set face to face. On one side the Torah permitted, and the Rambam says it plainly: אשתו של אדם מותרת היא לו. On the other, the Ramban warns that a permission abused makes a man a נבל ברשות התורה — a base man within the very bounds of the law. All of siman 240 stands in that interval: it does not restrict what the Torah permitted, it teaches how a בעל נפש lives within it. And it opens with the most concrete reminder of all: what happens in that room is first of all a debt owed to another person. We study here at the level of principle; for personal practice one follows one’s Rav.

A. העונה והכוונה — the schedule owed, and the intention that accompanies it
עוֹנָה — the word that opens the siman denotes not a permission but an obligation, stated in the Torah and quantified by the mishna: «הָעוֹנָה הָאֲמוּרָה בַּתּוֹרָה: הַטַּיָּילִין — בְּכׇל יוֹם.» (כתובות ס״א ע״ב). The Mehaber restates it as it stands: «אם היה נשוי לא יהא רגיל ביותר עם אשתו אלא בעונה האמורה בתורה» (שו״ע או״ח ר״מ:א) summary : the siman does not open on what is forbidden but on what is owed. Everything that follows is read from there.
Seif 1 — עונה האמורה בתורה, וכוונת הלב

Seif 1: if he is married, he should not be excessively frequent with his wife, but rather according to the onah (schedule) stated in the Torah. The tayalim, whose livelihood is assured and who pay no tax, their onah is every day; labourers who work in another town and sleep every night at home, once a week, and if they work in their own town, twice a week; donkey drivers, once a week; camel drivers, once in thirty days; sailors, once in six months. And the onah of Torah scholars is from Friday night to Friday night. And every man must visit his wife on the night of her immersion, and at the hour he sets out on a journey, if he is not going for a mitzva; likewise if his wife is nursing and he perceives that she is seeking to please him, appeasing him and adorning herself before him so that he should turn his mind to her, he is obliged to visit her. And even when he is with her, he should not aim at his own pleasure, but be like a man paying a debt that he owes her as her onah, and to fulfil his Creator’s command, that he may have children who study Torah and keep the mitzvot in Israel. And likewise if he aims at the benefit of the child — for in the last six months it is good for it, so that it comes out cleaner and more vigorous — that is proper. And if he aims to fence himself by her so as not to desire transgression, since he sees his urge prevailing and desiring that thing. Rema’s gloss: in this too there is reward, yet it would have been better for him to push off his urge and subdue it, for there is a small limb in a man: starve it and it is sated, sate it and it is starved. But one who has no need of the thing and stirs up his desire in order to fill it — that is the counsel of the evil urge, and from the permitted it will lure him to the forbidden; and of this our Rabbis said: one who deliberately arouses himself shall be under niddui.
The onah is a debt, not a favour. The siman opens with a measure: «אם היה נשוי לא יהא רגיל ביותר עם אשתו אלא בעונה האמורה בתורה» (שו״ע או״ח ר״מ:א). The mishna that fixes these schedules is in Ketubot: «הָעוֹנָה הָאֲמוּרָה בַּתּוֹרָה: הַטַּיָּילִין — בְּכׇל יוֹם. הַפּוֹעֲלִים — שְׁתַּיִם בְּשַׁבָּת. הַחַמָּרִים — אַחַת בְּשַׁבָּת. הַגַּמָּלִים — אַחַת לִשְׁלשִׁים יוֹם. הַסַּפָּנִים — אַחַת לְשִׁשָּׁה חֳדָשִׁים.» (כתובות ס״א ע״ב), and the Mehaber restates it trade by trade: «הטיילים שפרנסתן מצויה להם ואין פורעים מס עונתן בכל יום» (שו״ע או״ח ר״מ:א); «החמרים אחת בשבוע» (שו״ע או״ח ר״מ:א); «הגמלים אחת לשלשים יום» (שו״ע או״ח ר״מ:א); «הספנים אחת לששה חדשים» (שו״ע או״ח ר״מ:א). The Mishna Berura notes that the measure follows the body’s strength: «וכ״ז במי שגופו בריא אבל מי שאינו בריא אינו חייב אלא לפי מה שאומדין אותו שיכול לקיים» (משנה ברורה, מ״ב ר״מ:ג) summary : these figures are not permissions but obligations: the husband owes his wife a schedule, and that schedule depends on what his working life allows.
The onah of the Torah scholar. «ועונת תלמידי חכמים מליל שבת לליל שבת» (שו״ע או״ח ר״מ:א) — as in the Gemara: «עוֹנָה שֶׁל תַּלְמִידֵי חֲכָמִים אֵימַת? אָמַר רַב יְהוּדָה אָמַר שְׁמוּאֵל: מֵעֶרֶב שַׁבָּת לְעֶרֶב שַׁבָּת.» (כתובות ס״ב ע״ב). The Mishna Berura gives the reason: «שבחול צריכים לעסוק בתורה בלילה שתורתן אומנותן» (משנה ברורה, מ״ב ר״מ:ו), and it immediately warns that one does not award himself that title in order to lighten the burden: «ואל יאמר אדם אעשה עצמי כת״ח כי כתיב ועונתה לא יגרע» (משנה ברורה, מ״ב ר״מ:ו) summary : one whose Torah is his craft has a weekly onah; but that is a standing, not a loophole, and the verse וְעֹנָתָהּ לֹא יִגְרָע remains above it all.
Three moments when he must “visit” his wife. «וכל אדם צריך לפקוד את אשתו בליל טבילתה ובשעה שיוצא לדרך אם אינו הולך לדבר מצוה» (שו״ע או״ח ר״מ:א); and the third: «וכן אם אשתו מניקה והוא מכיר בה שהיא משדלתו ומרצה אותו ומקשטת עצמה לפניו כדי שיתן דעתו עליה חייב לפקדה» (שו״ע או״ח ר״מ:א). The source for the departure is in the Gemara: «וְאָמַר רַבִּי יְהוֹשֻׁעַ בֶּן לֵוִי: חַיָּיב אָדָם לִפְקוֹד אֶת אִשְׁתּוֹ בְּשָׁעָה שֶׁהוּא יוֹצֵא לַדֶּרֶךְ» (יבמות ס״ב ע״ב), with the qualification the Mehaber adopted: «וְהָנֵי מִילֵּי לִדְבַר הָרְשׁוּת, אֲבָל לִדְבַר מִצְוָה — מִיטְּרִידִי» (יבמות ס״ב ע״ב). And these three moments do not depend on the onah calendar: «ר״ל אפילו שלא בשעת עונתה» (משנה ברורה, מ״ב ר״מ:ח); «היינו אפילו שלא בשעת עונתה» (משנה ברורה, מ״ב ר״מ:יא). The Mishna Berura adds that the onah runs during pregnancy and nursing as well: «וצריך לקיים העונה גם כשהיא מעוברת או מניקה» (משנה ברורה, מ״ב ר״מ:ב) summary : the ordinary schedule is not enough: the night of the mikveh, the departure, and the sign she gives each create an obligation of its own.
What the Torah forbids to diminish is not left to his goodwill. «ולא יבטל עונתה אלא מדעתה כשהיא מוחלת לו וכבר קיים מצות פו״ר» (משנה ברורה, מ״ב ר״מ:ב). The Rambam had set out the same balance: «אֵין דַּעַת חֲכָמִים נוֹחָה לְמִי שֶׁהוּא מַרְבֶּה בַּתַּשְׁמִישׁ הַמִּטָּה וְיִהְיֶה מָצוּי אֵצֶל אִשְׁתּוֹ כְּתַרְנְגוֹל» (רמב״ם הלכות איסורי ביאה פרק כא הלכה יא), and yet: «אֶלָּא כָּל הַמְמַעֵט בַּתַּשְׁמִישׁ הֲרֵי זֶה מְשֻׁבָּח» (רמב״ם הלכות איסורי ביאה פרק כא הלכה יא). The image of the rooster comes from the Gemara: «שֶׁלֹּא יְהוּ תַּלְמִידֵי חֲכָמִים מְצוּיִים אֵצֶל נְשׁוֹתֵיהֶם כְּתַרְנְגוֹלִים» (ברכות כ״ב ע״א), and the Tur notes that it is not said of scholars alone: «ולאו דוקא ת״ח אלא ה״ה נמי כל אדם ונקט ת״ח שהפרישות מצויה בהם» (טור או״ח סימן ר״מ) summary : two demands meet: not to be “like a rooster”, and not to withhold what he owes her. Only her own waiver can lighten the second.
Four permitted intentions. «ואף כשהוא מצוי אצלה לא יכוין להנאתו אלא כאדם שפורע חובו שהוא חייב בעונתה» (שו״ע או״ח ר״מ:א); «ולקיים מצות בוראו שיהיו לו בנים עוסקים בתורה ומקיימים מצות בישראל» (שו״ע או״ח ר״מ:א); «וכן אם מכוין לתקון הולד שבששה חדשים אחרונים יפה לו שמתוך כך יצא מלובן ומזורז שפיר דמי» (שו״ע או״ח ר״מ:א); and the fourth: «ואם הוא מכוין לגדור עצמו בה כדי שלא יתאוה לעבירה כי רואה יצרו גובר ומתאוה אל הדבר ההוא» (שו״ע או״ח ר״מ:א). This fourfold division is the Raavad’s, quoted by the Tur: «ומצאתי תוכן מעשה הזה על ד׳ כוונות ג׳ מהם עיקר קבול השכר והד׳ קרובה לקיבול השכר ושכרה מועטת מן הג׳» (טור או״ח סימן ר״מ). And the Mishna Berura notes that the first remains available at all times: «וזה יכוין אפילו בעת עיבור ויניקה» (משנה ברורה, מ״ב ר״מ:יב) summary : the Shulchan Aruch does not ask that intention be abolished but that it be set right: paying a debt, serving the Creator, caring for the child, fencing off transgression.
The Rema’s gloss: the reward, and its limit. «גם בזה יש קבול שכר» (רמ״א או״ח ר״מ:א), but at once: «טוב היה לו לדחות את יצרו ולכבוש אותו כי אבר קטן יש באדם מרעיבו שבע משביעו רעב» (רמ״א או״ח ר״מ:א) — the phrase is Rabbi Yohanan’s: «אָמַר רַבִּי יוֹחָנָן: אֵבֶר קָטָן יֵשׁ לוֹ לָאָדָם, מַרְעִיבוֹ — שָׂבֵעַ, מַשְׂבִּיעוֹ — רָעֵב» (סוכה נ״ב ע״ב). And the boundary the Rema draws: «אבל מי שאינו צריך לדבר אלא שמעורר תאותו כדי למלאות תאותו זו היא עצת יצר הרע ומן ההיתר יסיתנו אל האיסור» (רמ״א או״ח ר״מ:א), whence: «ועל זה אמרו רבותינו ז״ל המקשה עצמו לדעת יהא בנדוי» (רמ״א או״ח ר״מ:א) — which is Rav’s statement: «אָמַר רַב: הַמְקַשֶּׁה עַצְמוֹ לְדַעַת — יְהֵא בְּנִדּוּי» (נדה י״ג ע״ב). The Mishna Berura refers, for this whole seif, to the Ramban on parashat Kedoshim: «עיין רמב״ן בחומש פרשת קדושים בראשו» (משנה ברורה, מ״ב ר״מ:א), where the phrase that governs the whole siman is found: «וְהִנֵּה יִהְיֶה נָבָל בִּרְשׁוּת הַתּוֹרָה» (רמב״ן על ויקרא י״ט:ב) summary : acting in order to fence oneself from sin is permitted and rewarded; stirring up a desire one did not need is not. That is the whole distance between using a permission and making an appetite of it.
B. נתינת הדעת — being present, and the nine conducts
Seif 2 — לא ישתה בכוס זה ויתן עיניו בכוס אחר
לא ישתה אדם בכוס זה ויתן עיניו בכוס אחר ואפילו שתיהן נשיו:
Seif 2: a man should not drink from this cup while setting his eyes on another cup — even if both are his wives.
An image, and its precise meaning. «לא ישתה אדם בכוס זה ויתן עיניו בכוס אחר ואפילו שתיהן נשיו» (שו״ע או״ח ר״מ:ב). The source is in Nedarim, resting on a verse: «מִכָּאן אָמַר רַבִּי: אַל יִשְׁתֶּה אָדָם בְּכוֹס זֶה וְיִתֵּן עֵינָיו בְּכוֹס אַחֵר» (נדרים כ׳ ע״ב), and Ravina extends it: «אָמַר רָבִינָא: לֹא נִצְרְכָא, אֶלָּא דַּאֲפִילּוּ שְׁתֵּי נָשָׁיו» (נדרים כ׳ ע״ב). The Mishna Berura removes any ambiguity about what “setting the eyes” means: «פי׳ שיתן מחשבתו בשעת תשמיש על האחרת» (משנה ברורה, מ״ב ר״מ:יג) summary : it is not about the gaze but about the mind: the prohibition is being with one while thinking of another.
Why this seif stands here. The previous seif set the schedule and the intention; this one closes the door the intention leaves open. The Rambam codified it in the same list as the nine conducts of the next seif: «וְכֵן אָסְרוּ חֲכָמִים שֶׁלֹּא יְשַׁמֵּשׁ אָדָם מִטָּתוֹ וְלִבּוֹ מְחַשֵּׁב בְּאִשָּׁה אַחֶרֶת» (רמב״ם הלכות איסורי ביאה פרק כא הלכה יב). And the Arukh haShulchan explicitly links the two: «ולא ישתה בכוס זה ויתן עיניו בכוס אחר, כלומר שלא יחשוב בשעת מעשה על אשה אחרת» (ערוך השלחן או״ח סימן ר״מ) summary : seif 2 is the hinge of the siman: after it come the nine conducts, all of which turn on an absence of presence.
Seif 3 — בני תשע מדות
וברותי מכם המורדים והפושעים בי אלו בני תשע׳ מדות בני אנוס׳ בני שנואה בני נידוי בני תמורה בני מורדת בני שכרות בני גרושת הלב בני ערבוביא בני חצופה:
Seif 3: “And I will purge out from among you the rebels and those who transgress against Me” — these are the children of the nine conducts: children of a coerced woman, of a hated woman, of one under ban, of substitution, of a rebellious woman, of drunkenness, of a woman already divorced in the heart, of confusion, of a brazen woman.
The verse, and the list. «וברותי מכם המורדים והפושעים בי אלו בני תשע׳ מדות» (שו״ע או״ח ר״מ:ג); then: «בני אנוס׳ בני שנואה בני נידוי בני תמורה בני מורדת בני שכרות בני גרושת הלב בני ערבוביא בני חצופה» (שו״ע או״ח ר״מ:ג). The source is in Nedarim: «אָמַר רַבִּי לֵוִי: אֵלּוּ בְּנֵי תֵּשַׁע מִדּוֹת» (נדרים כ׳ ע״ב), where the list reads: «בְּנֵי אֵימָה, בְּנֵי אֲנוּסָה, בְּנֵי שְׂנוּאָה, בְּנֵי נִידּוּי, בְּנֵי תְמוּרָה, בְּנֵי מְרִיבָה, בְּנֵי שִׁכְרוּת, בְּנֵי גְּרוּשַׁת הַלֵּב, בְּנֵי עִרְבּוּבְיָא, בְּנֵי חֲצוּפָה» (נדרים כ׳ ע״ב) summary : the Mehaber did not copy the Gemara’s list word for word: he set aside בני אימה and בני מריבה, putting בני מורדת in their place, to arrive at nine names. The Tur, moreover, records another reading.
What each name denotes. The Mishna Berura defines them one by one. Coerced: «אפילו אינה אנוסה רק שאינה מרוצה מפני כעס שיש לה עליו לכן יפייס ואח״כ יבעול» (משנה ברורה, מ״ב ר״מ:יד); hated: «בשעת תשמיש אבל אם היא אז רצויה אע״פ שהיא שנואה שרי» (משנה ברורה, מ״ב ר״מ:טו); substitution: «אפילו שתיהן נשיו וכגון שנתכוין לזו ונזדמנה לו אחרת» (משנה ברורה, מ״ב ר״מ:טז); rebellious: «דאמרה לא בעינא לך לבעל ואעפ״כ הוא משמש עמה» (משנה ברורה, מ״ב ר״מ:יז); drunkenness: «הוא או היא שכורה» (משנה ברורה, מ״ב ר״מ:יח); divorced in the heart: «שבדעתו לגרשה אע״פ שהוא אוהבה» (משנה ברורה, מ״ב ר״מ:יט); confusion: «כגון שנותן אז דעתו על אחרת» (משנה ברורה, מ״ב ר״מ:כ); brazen: «שתובעתו בפה» (משנה ברורה, מ״ב ר״מ:כא) summary : nearly all nine conducts reduce to two: either she is not willing, or he is not present.
The dividing line: the brazen woman and the one who adorns herself. The ninth name could seem to cancel the obligation of seif 1; the Mishna Berura expressly separates them: «אבל אי מקשטת עצמה ומרצה אותו שיתן דעתו עליה אדרבה אז חייב בעונה כדלעיל בס״א והו״ל בנים מהוגנים» (משנה ברורה, מ״ב ר״מ:כא). The Gemara itself says it in praise: «כׇּל אָדָם שֶׁאִשְׁתּוֹ תּוֹבַעְתּוֹ — הָוְיִין לוֹ בָּנִים שֶׁאֲפִילּוּ בְּדוֹרוֹ שֶׁל מֹשֶׁה רַבֵּינוּ לֹא הָיוּ כְּמוֹתָם» (נדרים כ׳ ע״ב), and it resolves the contradiction in a word: «הַהִיא דְּמַרְצְיָא אַרְצוֹיֵי» (נדרים כ׳ ע״ב). As to coercion, the Gemara is explicit: «וְאָמַר רַבִּי יְהוֹשֻׁעַ בֶּן לֵוִי: כׇּל הַכּוֹפֶה אִשְׁתּוֹ לִדְבַר מִצְוָה הָוְיָין לוֹ בָּנִים שֶׁאֵינָן מְהוּגָּנִין» (עירובין ק׳ ע״ב), and the Tur draws the rule: «נמצא כי האונס אסור אף באשתו אלא אם הוא צריך לאותו מעשה יפייס ואח״כ יבעול» (טור או״ח סימן ר״מ) summary : the list does not condemn the wife’s desire but the absence of consent: the one who makes herself pleasing is praised, the one who is coerced is the first of the nine names.
C. צניעות ודרך ארץ — restraint, place, hour and speech
Seif 4 — אסור להסתכל באותו מקום
אסור להסתכל באותו מקום שכל המסתכל שם אין לו בושת פנים ועובר על והצנע לכת ומעביר הבושה מעל פניו שכל המתבייש אינו חוטא דכתיב ובעבור תהי׳ יראתו על פניכם זו הבושה לבלתי תחטאו ועוד דקא מגרי יצר הרע בנפשי׳ וכל שכן הנושק שם שעובר על כל אלה ועוד שעובר על בל תשקצו את נפשותיכם:
Seif 4: it is forbidden to look at that place, for whoever looks there has no shame on his face and transgresses “and walk humbly”, and he removes shame from his face — for one who feels shame will not sin, as it is written “and that His fear may be upon your faces”, that is shame, “so that you do not sin”; and further, he provokes the evil urge within himself. And all the more so one who kisses there, who transgresses all of these, and further transgresses “do not make your souls abominable”.
The reason: shame as a safeguard. «אסור להסתכל באותו מקום» (שו״ע או״ח ר״מ:ד), and the Mehaber at once gives three reasons: «שכל המסתכל שם אין לו בושת פנים ועובר על והצנע לכת ומעביר הבושה מעל פניו» (שו״ע או״ח ר״מ:ד); «שכל המתבייש אינו חוטא» (שו״ע או״ח ר״מ:ד); «ועוד דקא מגרי יצר הרע בנפשי׳» (שו״ע או״ח ר״מ:ד). The second reason comes from a beraita in Nedarim: «מְלַמֵּד שֶׁהַבּוּשָׁה מְבִיאָה לִידֵי יִרְאַת חֵטְא» (נדרים כ׳ ע״א), and: «כׇּל אָדָם הַמִּתְבַּיֵּישׁ, לֹא בִּמְהֵרָה הוּא חוֹטֵא» (נדרים כ׳ ע״א). The Beit Yosef identifies the source as the Raavad’s words in his Shaar haKedusha: «וכתב הראב״ד ז״ל בשער הקדושה המסתכלים באותו מקום עוברים על והצנע לכת עם אלהיך ומעבירים הבושה מעל פניהם» (בית יוסף או״ח סימן ר״מ) summary : the Mehaber does not argue from disgust but from modesty: what is lost in looking is shame — and it is shame that holds a man back from sin.
The talmudic source, and its status. These conducts come from a beraita in the name of Rabbi Yohanan ben Dahavai: «אָמַר רַבִּי יוֹחָנָן בֶּן דַּהֲבַאי, אַרְבָּעָה דְּבָרִים סָחוּ לִי מַלְאֲכֵי הַשָּׁרֵת» (נדרים כ׳ ע״א); among them: «סוֹמִין מִפְּנֵי מָה הָוְיִין — מִפְּנֵי שֶׁמִּסְתַּכְּלִים בְּאוֹתוֹ מָקוֹם» (נדרים כ׳ ע״א) and «אִילְּמִים מִפְּנֵי מָה הָוְיִין — מִפְּנֵי שֶׁמְּנַשְּׁקִים עַל אוֹתוֹ מָקוֹם» (נדרים כ׳ ע״א). The Beur Halakha recalls these consequences: «והעובר ע״ז הויין ליה בנים סומין» (ביאור הלכה סימן ר״מ); «והעובר ע״ז הווין ליה בנים אלמים» (ביאור הלכה סימן ר״מ). Ameimar explains who those “ministering angels” are: «מַאן מַלְאֲכֵי הַשָּׁרֵת — רַבָּנַן» (נדרים כ׳ ע״ב) summary : the siman therefore codifies a beraita whose scope the Gemara itself debates — this is the central difficulty of the Lamdan level.
The other voice, which the siman does not cite here. The Gemara concludes in the name of Rabbi Yohanan: «אָמַר רַבִּי יוֹחָנָן: זוֹ דִּבְרֵי יוֹחָנָן בֶּן דַּהֲבַאי, אֲבָל אָמְרוּ חֲכָמִים: אֵין הֲלָכָה כְּיוֹחָנָן בֶּן דַּהֲבַאי, אֶלָּא כֹּל מַה שֶּׁאָדָם רוֹצֶה לַעֲשׂוֹת בְּאִשְׁתּוֹ — עוֹשֶׂה» (נדרים כ׳ ע״ב). The Rambam ruled accordingly: «אִשְׁתּוֹ שֶׁל אָדָם מֻתֶּרֶת הִיא לוֹ. לְפִיכָךְ כָּל מַה שֶּׁאָדָם רוֹצֶה לַעֲשׂוֹת בְּאִשְׁתּוֹ עוֹשֶׂה» (רמב״ם הלכות איסורי ביאה פרק כא הלכה ט), and he immediately added: «וְאַף עַל פִּי כֵן מִדַּת חֲסִידוּת שֶׁלֹּא יָקֵל אָדָם אֶת רֹאשׁוֹ לְכָךְ וְשֶׁיְּקַדֵּשׁ עַצְמוֹ בִּשְׁעַת תַּשְׁמִישׁ» (רמב״ם הלכות איסורי ביאה פרק כא הלכה ט). The Rema recorded this conclusion in Even haEzer: «ויכול לעשות עם אשתו מה שירצה» (רמ״א אה״ע כ״ה:ב), closing with the measure that applies here: «ואע״פ שמותר בכל אלה כל המקדש עצמו במותר לו קדוש יאמרו לו» (רמ״א אה״ע כ״ה:ב) summary : Orach Chaim 240 teaches the conduct of the בעל נפש; Even haEzer 25 states the din. Both stand together, which is why the poskim cross-refer from one to the other.
Seif 5 — דרך עזות ודרך עקש
הוא למטה והיא למעלה זו דרך עזות שמשו שניהם כאחד זה דרך עקש:
Seif 5: he below and she above, that is a way of brazenness; that they should act both together, that is a crooked way.
The text, and its source. «הוא למטה והיא למעלה זו דרך עזות» (שו״ע או״ח ר״מ:ה); «שמשו שניהם כאחד זה דרך עקש» (שו״ע או״ח ר״מ:ה). The Tur states where he took it from: «גרסינן במסכת כלה הוא למטה והיא למעלה זו דרך עזות שימשו שניהם כאחד זה דרך עיקש» (טור או״ח סימן ר״מ). The Arukh haShulchan states the conduct positively: «ובשעת מעשה יהיה הוא למעלה והיא למטה» (ערוך השלחן או״ח סימן ר״מ) summary : the seif’s two phrases are not named prohibitions; they are two characterisations — עזות, עקש — of conducts the Mehaber judges contrary to restraint.
Where this seif stands in halakha. It belongs to the same beraita as the previous seif: «חִיגְּרִין מִפְּנֵי מָה הָוְיִין — מִפְּנֵי שֶׁהוֹפְכִים אֶת שׁוּלְחָנָם» (נדרים כ׳ ע״א); and the Gemara answered it with the principle already cited: «אֵין הֲלָכָה כְּיוֹחָנָן בֶּן דַּהֲבַאי» (נדרים כ׳ ע״ב). The Rambam, ruling with it, nonetheless retained the measure of restraint: «וְלֹא יָסוּר מִדֶּרֶךְ הָעוֹלָם וּמִנְהָגוֹ» (רמב״ם הלכות איסורי ביאה פרק כא הלכה ט) summary : the seif describes a way that is not advised, not a formal prohibition; that is why the Mehaber uses here the words דרך עזות and דרך עקש, and not the word אסור he uses elsewhere.
Seif 6 — בפני כל אדם, ובבית שיש בו ספרים
אסור לאדם לשמש מטתו בפני כל אדם אם הוא נעור ואפי׳ ע״י הפסק מחיצה עשרה ובפני תינוק שאין יודע לדבר מותר בית שיש בו ס״ת או חומשים העשוים בגלילה אסור לשמש בו עד שיהי׳ בפניו מחיצ׳ [ולענין לעשותה בשבת ע״ל ריש סי׳ שט״ו] ואם יש לו בית אחר אסור עד שיוציאנו ואם יש בו תפילין או ספרים אפילו של גמרא אסור עד שיתנם בכלי בתוך כלי והוא שלא יהא השני מיוחד להם [וע״ל סי׳ מ׳ סעיף ב׳] אבל אם הוא מיוחד להם אפילו מאה כחד חשיבי ואם פירש טלית על גבי ארגז חשוב ככלי בתוך כלי:
Seif 6: it is forbidden for a man to have marital relations in the presence of anyone who is awake, even with a ten-handbreadth partition interposed; but in the presence of a child who cannot speak, it is permitted. A house containing a Sefer Torah or Chumashim made as scrolls: it is forbidden to have relations there until there is a partition before it; and if he has another room, it is forbidden until he removes it. And if there are tefillin or books there, even of Gemara, it is forbidden until he places them in a vessel within a vessel — provided the second is not designated for them; but if it is designated for them, even a hundred count as one. And if he spread a tallit over a chest, that counts as a vessel within a vessel.
In the presence of anyone awake. «אסור לאדם לשמש מטתו בפני כל אדם אם הוא נעור ואפי׳ ע״י הפסק מחיצה עשרה» (שו״ע או״ח ר״מ:ו); and the exception: «ובפני תינוק שאין יודע לדבר מותר» (שו״ע או״ח ר״מ:ו). The source is in Nidda: «אָמַר רַבִּי שִׁמְעוֹן בֶּן יוֹחַאי: אַרְבָּעָה דְּבָרִים הַקָּדוֹשׁ בָּרוּךְ הוּא שׂוֹנְאָן, וַאֲנִי אֵינִי אוֹהֲבָן» (נדה ט״ז ע״ב) — among them «וְהַמְשַׁמֵּשׁ מִטָּתוֹ בִּפְנֵי כָּל חַי» (נדה י״ז ע״א); and the Gemara there limits its reach: «אֲמַר לֵיהּ רַב יְהוּדָה לִשְׁמוּאֵל: וַאֲפִילּוּ לִפְנֵי עַכְבָּרִים? אֲמַר לֵיהּ: שִׁינָּנָא, לָא!» (נדה י״ז ע״א). Why does the partition not suffice? «הטעם דמרגיש הוא בעת שהלה משמש מטתו ואין כאן צניעות» (משנה ברורה, מ״ב ר״מ:כב), and if the other perceives nothing at all: «ואם הוא בענין שאין מרגישים כלל מותר ע״י הפסק מחיצה» (משנה ברורה, מ״ב ר״מ:כב) summary : the prohibition is not about being seen but about being sensed: what the partition does not remove is that someone knows.
The sleeper and the child. «ובפני ישן מותר אפילו בלא הפסק מחיצה» (ביאור הלכה סימן ר״מ), and the Beur Halakha nevertheless advises: «ומ״מ לכתחלה טוב במקום שבני אדם ישנים בבית שיעמיד מחיצה סביב המטה» (ביאור הלכה סימן ר״מ). Another halakha borders this seif: no one should sleep in a couple’s room — «אָמַר רַב בְּרוֹנָא אָמַר רַב: כׇּל הַיָּשֵׁן בְּקִילְעָא שֶׁאִישׁ וְאִשְׁתּוֹ שְׁרוּיִין בָּהּ» (עירובין ס״ג ע״ב), which the Mishna Berura brings here, adding: «ואפילו כשהיא נדה והובא בחידושי רע״א» (משנה ברורה, מ״ב ר״מ:נב) summary : the siman guards privacy from both sides: no witness in the room, and no third party lodged in the couple’s room.
A house containing a Sefer Torah. «בית שיש בו ס״ת או חומשים העשוים בגלילה אסור לשמש בו עד שיהי׳ בפניו מחיצ׳» (שו״ע או״ח ר״מ:ו); «ואם יש לו בית אחר אסור עד שיוציאנו» (שו״ע או״ח ר״מ:ו). The beraita is in Berakhot: «בַּיִת שֶׁיֵּשׁ בּוֹ סֵפֶר תּוֹרָה אוֹ תְּפִילִּין אָסוּר לְשַׁמֵּשׁ בּוֹ אֶת הַמִּטָּה עַד שֶׁיּוֹצִיאֵם אוֹ שֶׁיַּנִּיחֵם כְּלִי בְּתוֹךְ כְּלִי» (ברכות כ״ה ע״ב), and the requirement peculiar to a Sefer Torah: «אָמַר רַבִּי יְהוֹשֻׁעַ בֶּן לֵוִי: סֵפֶר תּוֹרָה — צָרִיךְ לַעֲשׂוֹת לוֹ מְחִיצָּה עֲשָׂרָה» (ברכות כ״ו ע״א). The Mishna Berura defines which Chumashim are meant: «ר״ל שהן כתובין בקלף כמו ספר תורה אלא שיש בהן רק חומש התורה» (משנה ברורה, מ״ב ר״מ:כג), rules out a curtain: «ומה שפרוש וילון סביב המטה אינה בכלל מחיצה» (משנה ברורה, מ״ב ר״מ:כה), and clarifies that “another house” means another room: «פי׳ חדר אחר» (משנה ברורה, מ״ב ר״מ:כו) summary : for a Sefer Torah a real, fixed ten-handbreadth partition is required; a curtain that stirs in the wind is not one, and mere covering does not suffice.
Tefillin and books: כלי בתוך כלי. «ואם יש בו תפילין או ספרים אפילו של גמרא אסור עד שיתנם בכלי בתוך כלי» (שו״ע או״ח ר״מ:ו); with the condition: «והוא שלא יהא השני מיוחד להם» (שו״ע או״ח ר״מ:ו), for «אבל אם הוא מיוחד להם אפילו מאה כחד חשיבי» (שו״ע או״ח ר״מ:ו); and the practical equivalence: «ואם פירש טלית על גבי ארגז חשוב ככלי בתוך כלי» (שו״ע או״ח ר״מ:ו). Why are printed volumes of Gemara included? «וממילא היום ה״ה כל הספרים הן בכתיבה או בדפוס יש בהן קדושה» (משנה ברורה, מ״ב ר״מ:כט). Two coverings count as two vessels: «וה״ה שני כיסויין» (משנה ברורה, מ״ב ר״מ:לא), but the Mishna Berura warns against a common practice: «ומה שנוהגין איזה אנשים שתולין נגד הספרים וילון לכסותם וסוברים שבזה לבד די לאו שפיר עבדי דזה הוי רק כיסוי אחד» (משנה ברורה, מ״ב ר״מ:לא) summary : a holy book in the room requires two distinct coverings, or a partition; the shelf alone, or a curtain alone, does not suffice.
Seif 7 — לא בתחלת הלילה ולא בסופה
לא ישמש בתחלת הליל׳ ולא בסופה כדי שלא ישמע קול בני אדם ויבא לחשוב באשה אחרת אלא באמצע הלילה:
Seif 7: he should not have relations at the beginning of the night nor at its end, so that he should not hear people’s voices and come to think of another woman, but rather in the middle of the night.
The reason is given in the text itself. «לא ישמש בתחלת הליל׳ ולא בסופה כדי שלא ישמע קול בני אדם ויבא לחשוב באשה אחרת אלא באמצע הלילה» (שו״ע או״ח ר״מ:ז). The source is Imma Shalom’s answer: «אָמְרָה לָהֶן: אֵינוֹ מְסַפֵּר עִמִּי לֹא בִּתְחִלַּת הַלַּיְלָה, וְלֹא בְּסוֹף הַלַּיְלָה, אֶלָּא בַּחֲצוֹת הַלַּיְלָה» (נדרים כ׳ ע״ב), and the reason there is already the Mehaber’s: «וְאָמַר לִי: כְּדֵי שֶׁלֹּא אֶתֵּן אֶת עֵינַי בְּאִשָּׁה אַחֶרֶת» (נדרים כ׳ ע״ב). The Rambam makes of it a way of holiness: «וְדֶרֶךְ קְדֻשָּׁה לְשַׁמֵּשׁ בְּאֶמְצַע הַלַּיְלָה» (רמב״ם הלכות איסורי ביאה פרק כא הלכה י) summary : the seif does not fix an hour for its own sake: it removes what, from outside, might turn the mind away.
A conduct, not an absolute stringency. «ואם רואה שיצרו מתגבר עליו ובא לידי הרהורים ויכול לבוא לידי טומאה עי״ז לא יחמיר בזה» (משנה ברורה, מ״ב ר״מ:לד). The Magen Avraham had said it in the name of the Yam shel Shelomo: «ואין זה אלא לפרושי׳ או למי שלבו נוקפו שיהרהר באחרת» (מגן אברהם או״ח סימן ר״מ). And the Arukh haShulchan rules for the ordinary case: «ואם אי אפשר לו באמצע הלילה, אין קפידא בזה» (ערוך השלחן או״ח סימן ר״מ) summary : the midnight hour is a recommended conduct; where it risks producing the opposite of what it seeks, one does not insist on it.
Seif 8 — באימה וביראה — מגלה טפח ומכסה טפח
וישמש באימה ובירא׳ כמ״ש על ר״א שהיה מגל׳ טפח ומכסה טפח ודומה כמי שכפאו שד פי׳ באימה וביראה כאלו כפאו שד ויש מפרשים מגלה טפח ומכסה טפח שלא היה ממרק האבר בשעת תשמיש כדי למעט הנאתו ודומ׳ כמו שכפאו שד שעושה הדבר באונס ויש מפרשים מגלה טפח שבאשה כלומ׳ עכשיו מגלה אותו לצורך תשמיש ועכשיו מכסה אות׳ כלומר שלא הי׳ מאריך באותו מעש׳ ודומ׳ לו כמו שבעתו השד ונבעת והניח המעש׳ כל כך היה מקצר בתשמיש ויש מפרשים מגלה טפח על הסינר שהית׳ חוגרת בו שאף בשע׳ תשמיש הי׳ מצריכה לחוגרו ומגלה רק טפח ממנה ומכס׳ מיד כדי למעט הנאתו וכולהו פירושי איתנהו וצריך בעל נפש ליזהר בהם:
Seif 8: let him act with awe and reverence, as was said of Rabbi Eliezer, that he would uncover a handbreadth and cover a handbreadth, and he was like one whom a demon had compelled — that is: with awe and reverence, as though a demon had compelled him. And some explain “uncovering a handbreadth and covering a handbreadth”: that he did not prolong the act, so as to lessen his pleasure, and he resembled one compelled by a demon, who acts under duress. And some explain: he would uncover a handbreadth of the woman, that is, he uncovered it for the need of the act and covered it again at once, meaning that he did not prolong it; so greatly did he shorten it. And some explain: he uncovered a handbreadth of the apron she wore girded, for even during the act he had her keep it on, uncovering only a handbreadth and covering it at once, so as to lessen the pleasure. And all these explanations hold together, and one who has care for his soul must be mindful of them.
The conduct, and its source. «וישמש באימה ובירא׳ כמ״ש על ר״א שהיה מגל׳ טפח ומכסה טפח ודומה כמי שכפאו שד» (שו״ע או״ח ר״מ:ח). The source is the same passage in Nedarim: «וּכְשֶׁהוּא מְסַפֵּר, מְגַלֶּה טֶפַח וּמְכַסֶּה טֶפַח, וְדוֹמֶה עָלָיו כְּמִי שֶׁכְּפָאוֹ שֵׁד» (נדרים כ׳ ע״ב). The first sense is given by the Mehaber himself: «פי׳ באימה וביראה כאלו כפאו שד» (שו״ע או״ח ר״מ:ח) summary : the phrase is not a technical prescription: it describes the disposition of one who does not act lightly.
Four readings, all retained. «ויש מפרשים מגלה טפח ומכסה טפח שלא היה ממרק האבר בשעת תשמיש כדי למעט הנאתו» (שו״ע או״ח ר״מ:ח); «ויש מפרשים מגלה טפח שבאשה» (שו״ע או״ח ר״מ:ח), and hence: «כל כך היה מקצר בתשמיש» (שו״ע או״ח ר״מ:ח); «ויש מפרשים מגלה טפח על הסינר שהית׳ חוגרת בו» (שו״ע או״ח ר״מ:ח). Then the Mehaber’s conclusion: «וכולהו פירושי איתנהו וצריך בעל נפש ליזהר בהם» (שו״ע או״ח ר״מ:ח), which the Arukh haShulchan restates with a practical reservation: «וכל הפירושים אמת, ויש לבעל נפש ליזהר בהם כשיש ביכולתו» (ערוך השלחן או״ח סימן ר״מ) summary : the Mehaber does not decide among the four explanations; he holds them all, and addresses them to the בעל נפש — not to everyone as a din.
The Raavad’s question, and the answer that governs the whole seif. If shortening is a virtue, how did the Sages praise one who waits? The Magen Avraham raises the difficulty and brings the Raavad’s answer: «כל המעשים שהם לש״ש טובים הן» (מגן אברהם או״ח סימן ר״מ) — the one who is master of himself and waits for her sake, and the one who shortens so as not to sin, both act for the sake of Heaven: «מי שיודע בעצמו שיאריך ולא תכנס בו מחשבה אחרת ומשהה עצמו כדי שתהנה האשה ממנו ותזריע תחלה הקדוש ברוך הוא משלם לו בנים זכרים ומי שאינו בוטח בעצמו וממהר כדי להנצל מן החטא גם הוא עושה מצוה» (מגן אברהם או״ח סימן ר״מ). The Arukh haShulchan closes the question with the general maxim: «וזו היא ששנינו וכל מעשיך יהיו לשם שמים» (ערוך השלחן או״ח סימן ר״מ) summary : what the seif demands is not a duration but a direction: the same intention justifies waiting and justifies shortening.
Seif 9 — לא יספר עמה בדברים שאינם מעניני תשמיש
לא יספר עמה בדברים שאינם מעניני תשמיש ולא בשעת תשמיש ולא קודם לכן שלא יתן דעתו באשה אחרת ואם סיפר עמה ושימש אמרו עליו מגיד לאדם מה שיחו אפילו שיחה קלה שבין אדם לאשתו מגידין לו בשעת הדין:
Seif 9: he should not speak with her about matters unrelated to the act, neither during the act nor before it, so that he should not set his mind on another woman. And if he spoke with her and then had relations, it was said of him: “He declares to man what his talk is” — even light talk between a man and his wife is declared to him at the hour of judgment.
The text, and the Gemara’s statement. «לא יספר עמה בדברים שאינם מעניני תשמיש ולא בשעת תשמיש ולא קודם לכן שלא יתן דעתו באשה אחרת» (שו״ע או״ח ר״מ:ט); then: «ואם סיפר עמה ושימש אמרו עליו מגיד לאדם מה שיחו אפילו שיחה קלה שבין אדם לאשתו מגידין לו בשעת הדין» (שו״ע או״ח ר״מ:ט). The phrase comes from Chagiga, in slightly different terms: «אָמַר רַב: אֲפִילּוּ שִׂיחָה יְתֵירָה שֶׁבֵּין אִישׁ לְאִשְׁתּוֹ מַגִּידִים לוֹ לְאָדָם בִּשְׁעַת מִיתָה» (חגיגה ה׳ ע״ב) summary : the Gemara says “at the hour of death” and “superfluous talk”; the Shulchan Aruch writes “at the hour of judgment” and “light talk”. The difference is real and worth noticing.
What is not forbidden. The Tur had already drawn the distinction: «אבל בעניני תשמיש יכול לספר עמה כדי להרבות תאותו» (טור או״ח סימן ר״מ), and he brings the account of Rav Kahana: «רַב כָּהֲנָא עָל, גְּנָא תּוּתֵיהּ פּוּרְיֵיהּ דְּרַב. שַׁמְעֵיהּ דְּשָׂח וְשָׂחַק וְעָשָׂה צְרָכָיו.» (ברכות ס״ב ע״א). The Gemara itself already divided between the two registers: «לָא קַשְׁיָא: הָא — בְּמִילֵּי דְתַשְׁמִישׁ, הָא — בְּמִילֵּי אַחְרָנְיָיתָא» (נדרים כ׳ ע״ב). The Mishna Berura nevertheless adds a personal limit: «ולפעמים אפילו מעניני תשמיש ג״כ יש ליזהר שלא לספר מתחלה כגון שהוא איש מחומם ויכול לבוא עי״ז לידי חטא» (משנה ברורה, מ״ב ר״מ:לח) summary : the required silence is not about speech between the spouses but about speech that carries them elsewhere; speaking of what concerns the two of them is expressly permitted.
Seif 10 — היה לו כעס עמה — עד שיפייסנה
אם הי׳ לו כעס עמה אסור לשמש עד שיפייסנה ויכול לספר עמה קודם תשמיש כדי לרצות׳:
Seif 10: if he was angry with her, it is forbidden to have relations until he has appeased her; and he may speak with her before the act in order to win her over.
A prohibition, and a permission that serves it. «אם הי׳ לו כעס עמה אסור לשמש עד שיפייסנה» (שו״ע או״ח ר״מ:י); and at once: «ויכול לספר עמה קודם תשמיש כדי לרצות׳» (שו״ע או״ח ר״מ:י). The Mishna Berura explicitly links this seif to the previous one: «ואם היה לו כעס עמה מותר לספר עמה מתחלה כל דברי ריצוי כדי לפייסה» (משנה ברורה, מ״ב ר״מ:לז) summary : seif 9 closed off speech; seif 10 reopens it exactly where it is needed. Appeasement is not an exception to the silence: it is what the silence was protecting.
Why this is a prohibition and not advice. Because without appeasement the case falls back under the first of the nine names of seif 3: «אפילו אינה אנוסה רק שאינה מרוצה מפני כעס שיש לה עליו לכן יפייס ואח״כ יבעול» (משנה ברורה, מ״ב ר״מ:יד). The beraita in Eruvin says it from the verse: «זֶה הַכּוֹפֶה אִשְׁתּוֹ לִדְבַר מִצְוָה» (עירובין ק׳ ע״ב) summary : unresolved anger turns the act into coercion even without force; the Mehaber therefore demands appeasement as a condition, not as a nicety.
D. אור, שני רעבון ואכסניא — light, famine, and another’s house
Seif 11 — לאור הנר וביום
אסור לשמש לאור הנר אע״פ שמאפיל בטליתו: הגה אבל אם עושה מחיצ׳ גבוה עשרה לפני הנר [הגהות מיי׳ פ״ג מה׳ י״ט] אע״פ שהאור נראה דרך המחיצה כגון שהפסיק בסדין שרי כן נ״ל מדברי רש״י בפרק ב׳ דמס׳ ביצה דף כ״ב גם אמרי׳ התם דשרי כשכופה כלי על הנר ואם מותר לעשות מחיצה זו בשבת ע״ל ריש סימן שט״ו וכן אסור לשמש ביום אא״כ הוא בית אפל: הגה ות״ח מאפיל בטליתו ושרי [טור]:
Seif 11: it is forbidden to have relations by lamplight, even if he darkens with his tallit. Rema’s gloss: but if he makes a partition ten high before the lamp, even though the light is seen through the partition — for instance if he interposed a sheet — it is permitted; so it seems to me from Rashi’s words in chapter 2 of tractate Beitza, page 22; it is also said there that it is permitted when one overturns a vessel upon the lamp; and as to whether this partition may be made on Shabbat, see below at the beginning of siman 315. And likewise it is forbidden to have relations by day, unless it is a dark house. Rema’s gloss: and a Torah scholar darkens with his tallit, and it is permitted.
The lamp. «אסור לשמש לאור הנר אע״פ שמאפיל בטליתו» (שו״ע או״ח ר״מ:יא). The source is in Pesachim: «הָעוֹמֵד בִּפְנֵי הַנֵּר עָרוֹם — הָוֵי נִכְפֶּה. וְהַמְשַׁמֵּשׁ מִטָּתוֹ לְאוֹר הַנֵּר — הָוַיִין לוֹ בָּנִים נִכְפִּין.» (פסחים קי״ב ע״ב), which the Beur Halakha recalls here: «ועבור זה הוויין ליה בנים נכפין» (ביאור הלכה סימן ר״מ). The Rambam ruled likewise: «אָסוּר לָאָדָם לְשַׁמֵּשׁ מִטָּתוֹ לְאוֹר הַנֵּר» (רמב״ם הלכות איסורי ביאה פרק כא הלכה י). The Mishna Berura extends it to moonlight: «וה״ה לאור הלבנה ג״כ אסור» (משנה ברורה, מ״ב ר״מ:לט) summary : it is not the lamp that is at issue but the light: any brightness that falls upon them is included, moonlight among it.
The Rema’s partition, and its condition. «אבל אם עושה מחיצ׳ גבוה עשרה לפני הנר» (רמ״א או״ח ר״מ:יא) — «אע״פ שהאור נראה דרך המחיצה כגון שהפסיק בסדין שרי» (רמ״א או״ח ר״מ:יא); and a second way: «גם אמרי׳ התם דשרי כשכופה כלי על הנר» (רמ״א או״ח ר״מ:יא). The Mishna Berura sets the condition of fixity: «ומיירי שקשר אותה מלמטה שלא ינוד ברוח מצויה דאל״ה אין דין מחיצה עליה» (משנה ברורה, מ״ב ר״מ:מ), and adds that the partition alone does not suffice: «וכ״ז דוקא כשמאפיל בטליתו אבל בלא״ה אסור דמאחר שהחדר מלא אור לא עדיף מביום» (משנה ברורה, מ״ב ר״מ:מא). The Taz, for his part, keeps a reservation: «ולפי הטעם דצניעות איני יודע למה יהא זה מותר» (ט״ז על שולחן ערוך אורח חיים, סימן ר״מ) summary : the Rema permits a lit room if a fixed screen separates the lamp from the bed; the Mishna Berura adds that the tallit’s darkening is still required, and the Taz doubts that a screen answers the reason of modesty.
By day. «וכן אסור לשמש ביום אא״כ הוא בית אפל» (שו״ע או״ח ר״מ:יא). The reason is given by the Rambam: «וְכֵן אָסוּר לְיִשְׂרְאֵלִי לְשַׁמֵּשׁ מִטָּתוֹ בַּיּוֹם. שֶׁעַזּוּת פָּנִים הִיא לוֹ.» (רמב״ם הלכות איסורי ביאה פרק כא הלכה י); the Mishna Berura says it in a word: «דאין זה דרך צניעות» (משנה ברורה, מ״ב ר״מ:מד). The Rema permits the Torah scholar: «ות״ח מאפיל בטליתו ושרי» (רמ״א או״ח ר״מ:יא), and the Mishna Berura gives both its reason and its limit: «שהוא צנוע בדרכיו ולא יבוא להסתכל ע״כ מותר ע״י האפלת טלית אבל מ״מ אין להקל בדבר זה אלא לצורך גדול דהיינו כשיצרו מתגבר עליו» (משנה ברורה, מ״ב ר״מ:מה). The Rambam stated the same measure: «וְאֵין נִזְקָקִין לְדָבָר זֶה אֶלָּא מִפְּנֵי צֹרֶךְ גָּדוֹל» (רמב״ם הלכות איסורי ביאה פרק כא הלכה י) summary : the permission granted to the Torah scholar is not an honorific privilege: it is a valve, opened for a real need and for someone known not to linger over it.
Seif 12 — בשני רעבון
אסור לשמש מטתו בשני רעבון אלא לחשוכי בנים [פירוש מי שאין לו בנים] הגה וע״ל סי׳ תקע״ד ס״ד וה״ה בשאר צרות שהם כרעבון [ירושלמי דתענית]:
Seif 12: it is forbidden to have marital relations in years of famine, except for those deprived of children [that is, one who has no children]. Rema’s gloss: and see further siman 574, seif 4; and the same applies to other troubles that are like famine.
The rule, and its source. «אסור לשמש מטתו בשני רעבון אלא לחשוכי בנים» (שו״ע או״ח ר״מ:יב). The source is in Taanit: «אָמַר רֵישׁ לָקִישׁ: אָסוּר לְאָדָם לְשַׁמֵּשׁ מִטָּתוֹ בִּשְׁנֵי רְעָבוֹן» (תענית י״א ע״א), with the exception the Mehaber adopted: «תָּנָא: חֲסוּכֵי בָּנִים מְשַׁמְּשִׁין מִטּוֹתֵיהֶן בִּשְׁנֵי רְעָבוֹן» (תענית י״א ע״א). The Arukh haShulchan gives the reason: «מפני שכל העולם בצער» (ערוך השלחן או״ח סימן ר״מ) summary : this is not a rule of temperance but of solidarity: one does not rejoice while the community suffers.
The scope of the exception, and the Rema’s extension. «ולכן אפילו יש לו בנים אם אין לו עדיין בת מותר» (משנה ברורה, מ״ב ר״מ:מז). And the Mishna Berura opens a further door: «ואם יצרו מתגבר עליו ויש חשש שיבוא לידי השחתת זרע» (משנה ברורה, מ״ב ר״מ:מו), where she brings those who are lenient. The Rema generalises the rule: «וה״ה בשאר צרות שהם כרעבון» (רמ״א או״ח ר״מ:יב). The Mishna Berura refers to siman 574, where the Mehaber himself is broader: «ר״ל דמתיר שם המחבר גם בליל טבילה» (משנה ברורה, מ״ב ר״מ:מח) summary : the prohibition is real but bounded on three sides: one who has not fulfilled פריה ורביה, the night of the mikveh, and the risk of a graver failing.
Seif 13 — אכסנאי
אכסנאי אסור לשמש ואם יחדו לו ולאשתו בית מותר ובלבד שלא יישן בטליתו של בעל הבית:
Seif 13: a guest lodging in another’s house may not have relations; and if a room was set aside for him and his wife, it is permitted, provided he does not sleep in the host’s tallit.
The rule, and its source. «אכסנאי אסור לשמש» (שו״ע או״ח ר״מ:יג). The source is in Ketubot, drawn from the account of Elkanah and Hanna: «דְּאָמַר רַב הוּנָא: מִנַּיִן לְאַכְסְנַאי שֶׁאָסוּר בְּתַשְׁמִישׁ הַמִּטָּה» (כתובות ס״ה ע״א). The Mishna Berura specifies that the household’s sleeping changes nothing: «היינו אפילו כשהבני בית כולם ישנים» (משנה ברורה, מ״ב ר״מ:מט) summary : the reason is not another’s gaze but another’s house: in a stranger’s home one is not at home, and the guest’s restraint is owed to the place.
What lifts the prohibition, and what remains. «ואם יחדו לו ולאשתו בית מותר ובלבד שלא יישן בטליתו של בעל הבית» (שו״ע או״ח ר״מ:יג). The Mishna Berura defines that “set aside for him”: «היינו שאין לבעה״ב עסק באותו מקום אלא מיוחד לשניהם לבדם דאז הו״ל הוא כבעה״ב» (משנה ברורה, מ״ב ר״מ:נ); and a room suffices: «וה״ה חדר» (משנה ברורה, מ״ב ר״מ:נא). As for the host’s tallit, the reason is simple: «שמא יראה קרי עליו» (משנה ברורה, מ״ב ר״מ:נב). The Magen Avraham raised a difficulty on the very wording: «צ״ע דגם בביתו אסור לשמש אם אין לו חדר מיוחד» (מגן אברהם או״ח סימן ר״מ) summary : a door is not enough: what is needed is a space the host no longer uses. And one does not, for this, make use of what belongs to the one who lodges you.
E. שמירת הגוף והמטה — the body’s measure, the child, and the bed
Seif 14 — שכבת זרע — כח הגוף
שכבת זרע הוא כח הגוף ומאור העינים וכל זמן שתצא ביותר הגוף כלה וחייו אובדי׳ וכל השטוף בבעילה זקנה קופצת עליו וכחו תשש ועיניו כהות וריח רע נודף מפיו ושער ראשו וגבות עיניו וריסי עיניו נושרים ושער זקנו ושחיו ושער רגליו רבה ושיניו נושרו׳ והרב׳ כאבים חוץ מאלו באים עליו אמרו חכמי הרופאים אחד מאלף מת משאר חלאי׳ והאלף מרוב תשמיש לפיכך צריך אדם ליזהר:
Seif 14: semen is the strength of the body and the light of the eyes; and whenever it is emitted excessively, the body wastes and his life is lost. Whoever is engrossed in this appetite, old age leaps upon him, his strength weakens, his eyes dim, a foul odour comes from his mouth, the hair of his head, his eyebrows and his eyelashes fall out, the hair of his beard, his armpits and his legs increases, his teeth fall out, and many pains besides these come upon him. The physicians said: one in a thousand dies of other illnesses, and the thousand of excess. Therefore a man must take care.
A seif taken over from the Rambam. «שכבת זרע הוא כח הגוף ומאור העינים וכל זמן שתצא ביותר הגוף כלה וחייו אובדי׳» (שו״ע או״ח ר״מ:יד). The Mehaber here copies the Hilkhot Deot: «שִׁכְבַת זֶרַע הִיא כֹּחַ הַגּוּף וְחַיָּיו וּמְאוֹר הָעֵינַיִם וְכָל שֶׁתֵּצֵא בְּיוֹתֵר הַגּוּף כָּלֶה וְכֹחוֹ כָּלֶה וְחַיָּיו אוֹבְדִים» (רמב״ם הלכות דעות פרק ד הלכה יט). The Beit Yosef says so expressly: «כתב הרמב״ם שכבת זרע הוא כח הגוף וכו׳ עד סוף הסי׳ בפ״ד מה׳ דעות» (בית יוסף או״ח סימן ר״מ) summary : the last two seifim of this stretch — 14 and 15 — are a chapter of the Rambam’s regimen of health carried over as it stands into Orach Chaim.
How to read a seif of ancient medicine. «אמרו חכמי הרופאים אחד מאלף מת משאר חלאי׳ והאלף מרוב תשמיש לפיכך צריך אדם ליזהר» (שו״ע או״ח ר״מ:יד) — the Mehaber himself attributes the datum to “the physicians”, not to tradition. The Beur Halakha, on this seif, refers to a medical work: «עיין בספר מזור ותרופה» (ביאור הלכה סימן ר״מ). The Arukh haShulchan, for his part, draws from the seif a lesson that depends on no medicine at all: «ויש לאדם להתבונן, שעניין תאוה זו לא בראה הקדוש ברוך הוא לשם תאוה אלא לקיום המין» (ערוך השלחן או״ח סימן ר״מ) summary : this is the only seif in the siman that argues from the body; and its own commentators refer its verification to the physicians, while keeping the lesson: not to be swept along.
Seif 15 — לא שבע ולא רעב, ולא ביום יציאה לדרך
לא יבעול והוא שבע או רעב אלא כשיתעכל המזון שבמעיו ולא יבעול מעומד ולא מיושב ולא בבית המרחץ ולא ביום שנכנס למרחץ ולא ביום הקזה ולא ביום יציאה לדרך או ביאה מן הדרך ולא לפניהם ולא לאחריהם: [והא דבריש הסימן שחייב לפוקדה איירי כשהוא רוכב או יושב בקרון וכאן איירי במהלך] [מהרש״ל]:
Seif 15: he should not have relations when sated or hungry, but when the food in his innards has been digested; and not standing nor sitting, nor in the bathhouse, nor on the day he enters the bathhouse, nor on the day of bloodletting, nor on the day of departure for a journey or return from a journey, neither before them nor after them. [And what is said at the beginning of the siman, that he must visit her, refers to when he is riding or seated in a wagon; and here it speaks of one who goes on foot.]
The list, and its source. «לא יבעול והוא שבע או רעב אלא כשיתעכל המזון שבמעיו» (שו״ע או״ח ר״מ:טו); «ולא יבעול מעומד ולא מיושב ולא בבית המרחץ ולא ביום שנכנס למרחץ ולא ביום הקזה» (שו״ע או״ח ר״מ:טו); «ולא ביום יציאה לדרך או ביאה מן הדרך ולא לפניהם ולא לאחריהם» (שו״ע או״ח ר״מ:טו). All of this is still the Rambam: «לֹא יִבְעֹל אָדָם וְהוּא שָׂבֵעַ וְלֹא רָעֵב אֶלָּא אַחַר שֶׁיִּתְעַכֵּל הַמָּזוֹן שֶׁבְּמֵעָיו» (רמב״ם הלכות דעות פרק ד הלכה יט). The Mishna Berura adds the convalescent: «מי שחלה ונתרפא יזהר מלשמש עד שיתחזק גופו כי יכאיבהו ויחליאהו ולא ידע כי בנפשו הוא» (משנה ברורה, מ״ב ר״מ:נג) summary : none of these clauses is a prohibition of principle: they are precautions of strength, listed by a physician who became a codifier.
The contradiction with seif 1, and its resolution. Seif 1 requires visiting his wife on the day of departure; seif 15 excludes it. The Taz raises the question and answers: «ונראה דבסעיף ט״ו מיירי בהולך ברגליו לדרך שצריך כח יותר וכאן מיירי בהולך על עגלה» (ט״ז על שולחן ערוך אורח חיים, סימן ר״מ). Another way is the Magen Avraham’s, brought by the Mishna Berura: «ומ״א כתב דכאן איירי מצד הרפואה ובס״א איירי מהדין» (משנה ברורה, מ״ב ר״מ:נד), and he gives the internal proof: «ותדע דהא קאמר נמי ולא ביום שנכנס למרחץ ולא לפניהם ולא לאחריהם וידוע דמצוה לרחוץ בכל ע״ש ועונת ת״ח משבת לשבת אע״כ דכל זה רק מצד רפואה הוא» (משנה ברורה, מ״ב ר״מ:נד) summary : the Magen Avraham’s proof is decisive: on Friday one bathes, and it is also the night of the Torah scholar’s onah. If the two contradicted each other at the level of din, the halakha would contradict itself — hence seif 15 speaks of health, not of obligation.
Seif 16 — מטה שתינוק ישן עליה
המשמש מטתו על מטה שתינוק ישן עליה אותו תינוק נכפה ולא אמרן אלא דלא הוי בר שתא אבל הוי בר שתא לית לן בה ולא אמרן אלא דגני להדי כרעיה [פי׳ שישן לרגליו] אבל גני להדי רישיה לית לן בה ולא אמרן אלא דלא מנח ידיה עליה אבל מנח ידיה עליה לית לן בה:
Seif 16: one who has relations upon a bed on which an infant is sleeping — that infant becomes epileptic. And this was said only when he is not a year old; but if he is a year old, there is nothing in it. And this was said only when he lies at his feet [that is, that he sleeps at his feet]; but if he lies by his head, there is nothing in it. And this was said only when he does not place his hand upon him; but if he places his hand upon him, there is nothing in it.
The text is a beraita taken over word for word. «המשמש מטתו על מטה שתינוק ישן עליה אותו תינוק נכפה» (שו״ע או״ח ר״מ:טז). The beraita is in Pesachim: «תָּנוּ רַבָּנַן: הַמְשַׁמֵּשׁ מִטָּתוֹ עַל מִטָּה שֶׁתִּינוֹק יָשֵׁן עָלֶיהָ — אוֹתוֹ תִּינוֹק נִכְפֶּה» (פסחים קי״ב ע״ב), and the three qualifications are already there: «וְלָא אֲמַרַן אֶלָּא דְּלָא הָוֵי בַּר שַׁתָּא, אֲבָל הָוֵי בַּר שַׁתָּא — לֵית לַן בַּהּ» (פסחים קי״ב ע״ב). The Mehaber copies them: «ולא אמרן אלא דגני להדי כרעיה» (שו״ע או״ח ר״מ:טז); «ולא אמרן אלא דלא מנח ידיה עליה אבל מנח ידיה עליה לית לן בה» (שו״ע או״ח ר״מ:טז) summary : the Mehaber added and removed nothing: he transcribed the beraita with its three limiting clauses, which greatly narrow it.
How the poskim read this seif. The Arukh haShulchan writes candidly what many feel: «ואף שאין אנו מבינין, אך כך היו רבותינו הקדושים מקובלים על פי החכמה האמיתית» (ערוך השלחן או״ח סימן ר״מ). And the Mishna Berura, on the following seif, ties the same matter to an internal cross-reference in the Shulchan Aruch: «עיין לעיל בסימן ג׳ ס״ו ובמ״ב שם» (משנה ברורה, מ״ב ר״מ:נה) summary : the Mehaber transmitted what he received without rationalising it; his commentators say as much, and do not turn it into a medical doctrine.
Seif 17 — מטה זה לצפון וזה לדרום
מטה שישן בה עם אשתו צריך שתהא ראשה ומרגלותיה זה לצפון וזה לדרום:
Seif 17: the bed in which he sleeps with his wife must have its head and its foot, the one to the north and the other to the south.
The text, and the statement that grounds it. «מטה שישן בה עם אשתו צריך שתהא ראשה ומרגלותיה זה לצפון וזה לדרום» (שו״ע או״ח ר״מ:יז). The source is in the first chapter of Berakhot: «כׇּל הַנּוֹתֵן מִטָּתוֹ בֵּין צָפוֹן לְדָרוֹם הָוְיִין לֵיהּ בָּנִים זְכָרִים» (ברכות ה׳ ע״ב). The Beit Yosef brings Rashi’s reason: «ונראה בעיני שהשכינה במזרח או במערב לפיכך נכון להסב דרך תשמישו לרוחות אחרות» (בית יוסף או״ח סימן ר״מ), and the Tosafot’s: «ודוקא כשישן עם אשתו מפני שהשכינה מצויה בין מזרח למערב» (בית יוסף או״ח סימן ר״מ) summary : the bed’s orientation is not a household custom: it is governed by the same modesty that commands the whole siman, referred here to the Presence.
The cross-reference that closes the siman. «עיין לעיל בסימן ג׳ ס״ו ובמ״ב שם» (משנה ברורה, מ״ב ר״מ:נה) — that is, siman 3, which deals with the same orientation in an entirely different context. The Arukh haShulchan closes the siman on the same halakha: «והמטה שישן עם אשתו צריך שתהא ראשה ומרגלותיה זה לצפון וזה לדרום» (ערוך השלחן או״ח סימן ר״מ), noting that its meaning is disputed: «ויש בזה פירושים שונים» (ערוך השלחן או״ח סימן ר״מ) summary : the siman opened on a debt owed to a person and closes on the orientation of a bed; between the two runs a single thread: what happens in that room is never a matter of indifference.
Practical cases
Case 1
Situation: A man whose work keeps him away — a long-distance driver, a sailor, an employee posted abroad. Do what the siman calls גמלים and ספנים still mean anything for him?
Conduct: the mishna classifies by trade, not by era: «הגמלים אחת לשלשים יום» (שו״ע או״ח ר״מ:א); «הספנים אחת לששה חדשים» (שו״ע או״ח ר״מ:א). But the Shulchan Aruch adds that the trade fixes only a floor: three moments obligate regardless of the calendar — «וכל אדם צריך לפקוד את אשתו בליל טבילתה ובשעה שיוצא לדרך אם אינו הולך לדבר מצוה» (שו״ע או״ח ר״מ:א), and the Mishna Berura recalls that health, not the profession alone, measures what may be required: «וכ״ז במי שגופו בריא אבל מי שאינו בריא אינו חייב אלא לפי מה שאומדין אותו שיכול לקיים» (משנה ברורה, מ״ב ר״מ:ג). And one decisive point: reduction is licit only with her agreement — «ולא יבטל עונתה אלא מדעתה כשהיא מוחלת לו וכבר קיים מצות פו״ר» (משנה ברורה, מ״ב ר״מ:ב) summary : the trade explains a rhythm; it erases neither the night of the mikveh, nor the departure, nor the fact that only the wife can waive what is owed to her. For practice, one follows one’s Rav.
Case 2
Situation: The couple quarrelled during the day and the matter was never taken up again. Evening comes.
Conduct: seif 10 is explicit: «אם הי׳ לו כעס עמה אסור לשמש עד שיפייסנה» (שו״ע או״ח ר״מ:י), and for that it reopens the speech that seif 9 had closed: «ויכול לספר עמה קודם תשמיש כדי לרצות׳» (שו״ע או״ח ר״מ:י). Otherwise the case falls under the first of the nine names: «אפילו אינה אנוסה רק שאינה מרוצה מפני כעס שיש לה עליו לכן יפייס ואח״כ יבעול» (משנה ברורה, מ״ב ר״מ:יד) summary : appeasement is not a preliminary courtesy: it is the condition that distinguishes consent from coercion. For practice, one follows one’s Rav.
Case 3
Situation: A small bedroom, a shelf of sefarim on the wall, tefillin on the chest of drawers, and a cradle at the foot of the bed.
Conduct: three distinct rules meet. For books and tefillin: «ואם יש בו תפילין או ספרים אפילו של גמרא אסור עד שיתנם בכלי בתוך כלי» (שו״ע או״ח ר״מ:ו), and two coverings suffice: «וה״ה שני כיסויין» (משנה ברורה, מ״ב ר״מ:לא), but a curtain alone does not: «ומה שנוהגין איזה אנשים שתולין נגד הספרים וילון לכסותם וסוברים שבזה לבד די לאו שפיר עבדי דזה הוי רק כיסוי אחד» (משנה ברורה, מ״ב ר״מ:לא). For a Sefer Torah or Chumashim in scroll form the requirement is different: «בית שיש בו ס״ת או חומשים העשוים בגלילה אסור לשמש בו עד שיהי׳ בפניו מחיצ׳» (שו״ע או״ח ר״מ:ו). For the cradle, seif 16 speaks of a child sleeping on the same bed: «המשמש מטתו על מטה שתינוק ישן עליה אותו תינוק נכפה» (שו״ע או״ח ר״מ:טז), and its scope is bounded by three clauses, among them: «ולא אמרן אלא דלא הוי בר שתא אבל הוי בר שתא לית לן בה» (שו״ע או״ח ר״מ:טז) summary : two coverings for books, a partition for a Sefer Torah, and seif 16 speaks only of the same bed.
