The preceding siman governed conjugal conduct. This one stays in the same chamber and keeps there but a single seif, a rule of restraint received from two beraitot — one speaking of what Heaven abhors, the other of what impoverishes. We shall then see what the word ערום covers, the two limits of the ruling and the conduct that follows, with practical cases.

A siman of one seif, wholly contained in its heading:
« שלא להשתין ערום בפני מטתו. ובו סעיף אחד » (שו״ע או״ח רמ״א:א). The seif consists of two clauses, received from two beraitot:
« אחד מהדברים ששונא הקב״ה המשתין בפני מטתו ערום » (שו״ע או״ח רמ״א:א), and
« המשתין לפני מטתו ערום מביא לידי עניות » (שו״ע או״ח רמ״א:א). He then at once marks its measure:
« ולא אמרן אלא דמהדר אפיה לפוריא » (שו״ע או״ח רמ״א:א). summary: the siman does not describe a transgression in the manner of the Torah's prohibitions — it governs the bearing of the body in the place where one sleeps. We study here at the level of principle; for personal conduct, one refers to the decision of one's Rav.

A. הסעיף — the seif and its single ruling
מִיאוּס — that which repels. This is not a prohibition in the manner of the Torah's prohibitions: it is a description of the place and of the conduct, from which halakhah draws consequences. The whole Mishnah Berurah of this siman lies in that word: where a man makes his surroundings a repellent place, he loses what ought to dwell there — and he draws to himself, as the Acharonim say in the Gemara's name, the one whose very name is נבל.
The seif — שלא להשתין ערום בפני מטתו
שלא להשתין ערום בפני מטתו. ובו סעיף אחד:
אחד מהדברים ששונא הקב״ה המשתין בפני מטתו ערום המשתין לפני מטתו ערום מביא לידי עניות ולא אמרן אלא דמהדר אפיה לפוריא [פי׳ למטה] אבל לבראי לית לן בה ודמהדר אפיה לפוריא נמי לא אמרן אלא בארעא אבל במנא לית לן בה:
That one should not urinate unclothed before one's bed. And it contains one seif: one of the things the Holy One, blessed be He, hates is one who urinates before his bed while unclothed. One who urinates before his bed while unclothed comes to poverty. And this was said only when he turns his face towards the couch [that is, towards the bed], but if he turns outward there is nothing in it for us. And when he turns his face towards the couch too, it was said only upon the ground, but into a vessel there is nothing in it for us.
Where are we? The preceding siman dealt with conjugal conduct —
« איך יתנהג האדם בתשמיש מטתו » (שו״ע או״ח ר״מ:א). This one does not leave the chamber, but its subject changes: it no longer governs the union, it governs the bearing of the body before the bed. And its heading is already the whole ruling:
« שלא להשתין ערום בפני מטתו. ובו סעיף אחד » (שו״ע או״ח רמ״א:א).
The whole seif Two clauses, and nothing else:
« אחד מהדברים ששונא הקב״ה המשתין בפני מטתו ערום » (שו״ע או״ח רמ״א:א), then
« המשתין לפני מטתו ערום מביא לידי עניות » (שו״ע או״ח רמ״א:א). summary: one and the same conduct is described twice, from two angles — what it is before Heaven, and what it brings upon the one who does it.
Its two roots The Be'er haGolah, beneath the seif, points to two places in the Talmud: נדה ט״ז י״ז and שבת ס״ב: (באר הגולה או״ח רמ״א). The Tur had already joined the two:
« לא ישתין בפני מטתו ערום דד׳ דברים הקב״ה שונאן ואחד מהן המשתין מים לפני מטתו ערום » (טור או״ח סימן רמ״א), then
« וגרסינן בשבת בפרק במה אשה אמר רבי אמי ואמרי לה במתניתא תנא ג׳ דברים מביאין האדם לידי עניות ואלו הן המשתין מים לפני מטתו ערום וכו׳ » (טור או״ח סימן רמ״א).
The last siman before Shabbat This siman closes the first part of Orach Chayim: after it the Hilkhot Shabbat begin. The Tur marks it with a closing formula:
« סליק סדר עבודת היום בעזרת צור נורא ואיום » (טור או״ח סימן רמ״א). And the Magen Avraham, in the last words of his commentary here, writes a prayer:
« והאלקים יזכני לסיים הלכות שבת ועד גמירא » (מגן אברהם רמ״א:ד).
B. ששונא הקב״ה — the beraita in Niddah, and the Mishnah Berurah's reason
The beraita It is taught in the name of Rabbi Shimon ben Yochai:
« ארבעה דברים הקדוש ברוך הוא שונאן ואני איני אוהבן » (נדה ט״ז ע״ב), and it lists the first of them:
« הנכנס לביתו פתאום ואין צריך לומר לבית חבירו והאוחז באמה ומשתין מים » (נדה ט״ז ע״ב), then:
« ומשתין מים ערום לפני מטתו והמשמש מטתו בפני כל חי » (נדה י״ז ע״א). summary: four conducts, all resting on the same defect — the absence of restraint where restraint is owed.
The reason The Mishnah Berurah gives it in her very first words on this siman:
« מפני שרצון הקב״ה שיהיה האדם מתנהג בדרך נקיות וקדושה וזה מתנהג עצמו בדרך מיאוס וטינופת ולא יוכל להשרות שכינתו אצלו » (משנה ברורה, מ״ב רמ״א:א). summary: the reason is not a penalty but an incompatibility — the conduct of מיאוס and the presence that should rest upon a man do not stand together.
The rule reaches beyond the bed The Mishnah Berurah extends it:
« ומכ״ש אם משתין מים לפני מקומות אחרים שצריכים להתנהג יותר בנקיות כגון לפני שלחנו וכיב״ז » (משנה ברורה, מ״ב רמ״א:ב). The Eliyah Rabbah had written it in the Maharsha's name:
« ומכל שכן במקומות אחרים כגון לפני שולחנו וכיוצא בו » (אליה רבה רמ״א:א), and the Kaf haChaim likewise:
« ומכ״ש במקומות אחרים כגון לפני שלחנו וכיוצא בו » (כף החיים רמ״א:ב).
C. מביא לידי עניות — the beraita in Shabbat, and the name of שרא דעניותא
The second beraita
« שלשה דברים מביאין את האדם לידי עניות ואלו הן המשתין מים בפני מטתו ערום ומזלזל בנטילת ידים ושאשתו מקללתו בפניו » (שבת ס״ב ע״ב). summary: three conducts, of which ours is the first; the other two are slighting the washing of the hands, and having one's wife curse him in his presence.
The Tur reports it
« וגרסינן בשבת בפרק במה אשה אמר רבי אמי ואמרי לה במתניתא תנא ג׳ דברים מביאין האדם לידי עניות ואלו הן המשתין מים לפני מטתו ערום וכו׳ » (טור או״ח סימן רמ״א). summary: the Tur cites it in the name of Rabbi Ami; the printed Gemara before us ascribes it to Rabbi Abbahu, and the beraita itself comes as a variant — ואמרי לה במתניתא תנא.
The reason for poverty The Beit Yosef reports it in Rashi's name:
« שרא דעניותא נבל שמיה ונבל קרו ליה ואוהב מקום מיאוס ומשתין מים לפני מטתו היינו מיאוס » (בית יוסף או״ח סימן רמ״א). The Magen Avraham condenses it:
« דשרא דעניותא נביל שמיה ושורה במקום מיאוס » (מגן אברהם רמ״א:ב). And the Mishnah Berurah:
« דאמרינן בערבי פסחים קי״א דשרא דעניותא נבל שמיה ואוהב לשרות במקום מיאוס » (משנה ברורה, מ״ב רמ״א:ה), then:
« ומשתין לפני מטתו היינו מיאוס » (משנה ברורה, מ״ב רמ״א:ה). The Arukh haShulchan says the same:
« דשרא דעניותא נבל שמיה ובכל מקום שמוצא מקום מטונף ושלא בנקיות שורה שם » (ערוך השלחן רמ״א:ב).
One thing, or two? The Eliyah Rabbah reports the Derishah's reading, which brings the two clauses back to one:
« והדרישה פירש ששנאת הקב״ה הוא מפני שקשה לעניות » (אליה רבה רמ״א:ב). summary: on that reading, what Heaven abhors and what impoverishes are not two reasons but one — and it is this question that Level 2 takes up.
What the Acharonim add here The Bach reports at this place another practice that impoverishes:
« שמעתי בשם חכמי צרפת ופרובינצ שהנוטל צפרניו כסדר קשה לעניות ולשכחה ולקבור בנים » (ב״ח או״ח סימן רמ״א). The Ateret Zekenim repeats it:
« וכן הנוטל צפורניו כסדר נמי מביא לידי עניות ולשכחה ולקבור בנים » (עטרת זקנים או״ח רמ״א). summary: these additions are not in the seif; the Acharonim attach them to it because they belong to the same beraita of עניות. In practice, one follows one's Rav.
D. ערום — לאו דוקא
What the Mishnah Berurah says
« לאו דוקא ערום אלא ה״ה אם היה לבוש אלא אורחא דמלתא נקט מתוך שהוא ערום אינו יוצא לחוץ להשתין » (משנה ברורה, מ״ב רמ״א:ג). summary: being unclothed is not the condition of the ruling; it is the ordinary circumstance in which the case arises.
The reason The Beit Yosef gives it in Rashi's name:
« ערום אורחא דמילתא נקיט מתוך שהוא ערום אינו יוצא לחוץ להשתין דטורח הוא לו ללבוש ולצאת » (בית יוסף או״ח סימן רמ״א). The Magen Avraham repeats it:
« לאו דוקא אלא אורחא דמלתא נקט מתוך שהוא ערום אינו יוצא לחוץ להשתין » (מגן אברהם רמ״א:א). And the Ateret Zekenim says it outright:
« אפילו אם הוא לבוש ומשתין לפני מטתו ונקט ערום אורחא דמילתא נקט » (עטרת זקנים או״ח רמ״א).
The same reading in the Arukh haShulchan
« ומשתין ערום לפני מטתו לאו דווקא ערום אלא אורחא דמילתא קתני דמתוך שהוא ערום מתעצל לילך לחוץ » (ערוך השלחן רמ״א:א), and he specifies what the verb covers:
« ומשתין פירושו על הקרקע » (ערוך השלחן רמ״א:א).
Why the word appears twice The seif writes ערום twice in succession. The Mishnah Berurah explains:
« קיצור לשון הוא וכונתו עוד אחז״ל המשתין וכו׳ » (משנה ברורה, מ״ב רמ״א:ד). summary: the second clause is not a repetition but a second source, abridged — the one in שבת, which speaks of עניות.
E. השיעורים — לפוריא ולבראי, בארעא ובמנא
The first limit
« ולא אמרן אלא דמהדר אפיה לפוריא » (שו״ע או״ח רמ״א:א), but
« אבל לבראי לית לן בה » (שו״ע או״ח רמ״א:א). summary: the ruling holds when one faces the couch; facing outward, it does not.
Its reason The Mishnah Berurah:
« שהקלוח הולך וניתז למרחוק וממילא באשה אסור אפילו בכה״ג » (משנה ברורה, מ״ב רמ״א:ו). The Beit Yosef had already given it in Rashi's name:
« שהקילוח ארוך וניתז למרחוק » (בית יוסף או״ח סימן רמ״א). The Arukh haShulchan condenses:
« ודווקא כשמחזיר פניו להמטה אבל אם מחזיר פניו לחוץ לית לן בה דהקילוח יוצא לחוץ » (ערוך השלחן רמ״א:ב). summary: it is not the direction of the gaze that counts, but the direction of the stream.
The case of a woman The Magen Avraham observes:
« משמע דבאשה אסור » (מגן אברהם רמ״א:ג). The Mishnah Berurah spells it out:
« שהקלוח הולך וניתז למרחוק וממילא באשה אסור אפילו בכה״ג » (משנה ברורה, מ״ב רמ״א:ו). In practice, one follows one's Rav.
The second limit
« ודמהדר אפיה לפוריא נמי לא אמרן אלא בארעא אבל במנא לית לן בה » (שו״ע או״ח רמ״א:א). The Arukh haShulchan:
« ודווקא כשמשתין על הארץ אבל כשמשתין בכלי לית לן בה » (ערוך השלחן רמ״א:ב). summary: the ground holds what repels; the vessel removes it.
A perforated vessel The Kaf haChaim enters a reservation:
« ומשמע מזה דאם משתין בכלי מנוקב נמי מביא לידי עניות כיון דשותת בארץ והוי מיאוס » (כף החיים רמ״א:ה), and at once gives the remedy:
« ומשמע נמי דאם מטיל לתוכו תיכף רביעית מים לית לן בה כיון דנתבטל המיאוס » (כף החיים רמ״א:ה).
The two limits in the Gemara There they are laid down as here:
« המשתין מים בפני מטתו ערום אמר רבא לא אמרן אלא דמהדר אפיה לפורייה אבל לבראי לית לן בה » (שבת ס״ב ע״ב), then
« ומהדר אפיה לפורייה נמי לא אמרן אלא לארעא אבל במנא לית לן בה » (שבת ס״ב ע״ב). And the Tur copies them:
« ולא אמרן אלא דמהדר אפיה לפורייא אבל לא מהדר אפיה לפורייא לית לן בה » (טור או״ח סימן רמ״א), then
« וכי מהדר אפיה לפורייא נמי לא אמרן אלא בארעא אבל במנא לית לן בה » (טור או״ח סימן רמ״א).
F. כפיית כלי ולאחר מעשה
The talmid chakham The Mishnah Berurah:
« ומ״מ ת״ח צריך שיכפה עליו כלי מלמעלה דא״א לו לת״ח בלא הרהור תורה » (משנה ברורה, מ״ב רמ״א:ז). The Magen Avraham had written it:
« ומ״מ ת״ח צריך שיכפה עליו כלי כמ״ש ססי׳ פ״ז דא״א לו בלא הרהור תורה » (מגן אברהם רמ״א:ד), and the Ba'er Hetev repeats it:
« ומ״מ ת״ח צריך שיכפה עליו כלי דא״א לו בלא הרהור תורה » (באר היטב או״ח רמ״א). summary: the matter here is no longer מיאוס but תורה — one cannot hold Torah in mind facing what is uncovered.
The general rule, at siman 87
« גרף של רעי ועביט של מי רגלים של חרס או של עץ צריך להרחיק מהם כמו מצואה אפי׳ הטיל בהם מים אבל אם הן של מתכת או של זכוכית או של חרס מצופה מותר אם הם רחוצים יפה » (שו״ע או״ח פ״ז:א), and:
« וכן אם כפה עליהם כלי אע״פ שהם עמו בבית הרי אלו כקבורים ומות׳ לקרות כנגדן » (שו״ע או״ח פ״ז:ג). summary: from there comes the remedy of the covered vessel.
The Arukh haShulchan and the Kaf haChaim
« ותלמיד חכם צריך שיכפה עליו כלי או שיטיל מים בהכלי שיהא מותר להרהר בדברי תורה שאי אפשר לו לתלמיד חכם בלא הרהור תורה » (ערוך השלחן רמ״א:ב). And the Kaf haChaim widens the measure:
« ונראה דת״ח לא דוקא אלא כל שהוא רגיל ללמוד צריך ליזהר בזה » (כף החיים רמ״א:ז). In practice, one follows one's Rav.
Afterwards — the blessing
« וכשרוצה לברך אח״כ ברכת אשר יצר יטול ידיו וגם יחגור עצמו כדי שלא יהא לבו רואה את הערוה וירחיק את עצמו כדין ממקום המי רגלים אם אין הכלי מכוסה כדין » (משנה ברורה, מ״ב רמ״א:ח). The Eliyah Rabbah had reported it in the Tashbetz's name:
« מי שמטיל מים בלילה צריך להרחיק ד״א משם וליטול ידיו ולחגור עצמו כדי שלא יהא לבו רואה את הערוה לברך אשר יצר » (כף החיים רמ״א:ג), and gave the dispensation:
« מיהו אם יש לו עביט של מי רגלים של מתכות או זכוכית ויטיל רביעית מים בכל פעם שישתין אין צריך להרחיק » (אליה רבה רמ״א:ד).
The Tur's closing The Tur ends here the whole order of the day, and returns to the morning:
« וקודם שיאיר הבוקר ימהר לקום בזריזות לעבודת הבורא יתעלה ולא יהא הבוקר מעירו אלא יעירו הוא וכו׳ » (טור או״ח סימן רמ״א). Then he sets aside a stringency:
« ויש חסידים ואנשי מעשה שהיו מחמירין על עצמן וטובלין לקירוין להתפלל וחומרא יתירה היא זו » (טור או״ח סימן רמ״א), and rules:
« ואני כתבתי למעלה שא״צ לא טבילה ולא רחיצה והמחמיר תע״ב » (טור או״ח סימן רמ״א). The Arukh haShulchan concludes likewise:
« ואני כתבתי למעלה שאין צריך לא טבילה ולא רחיצה וכבר נתבאר זה בסימן פ״ח והמחמיר תבא עליו ברכה » (ערוך השלחן רמ״א:ג).
Practical cases
Case 1 — Rising at night in the bedchamber
Situation: one rises at night and must relieve oneself, in the very room where one sleeps.
Conduct: The seif speaks of nothing else:
« אחד מהדברים ששונא הקב״ה המשתין בפני מטתו ערום » (שו״ע או״ח רמ״א:א), and:
« המשתין לפני מטתו ערום מביא לידי עניות » (שו״ע או״ח רמ״א:א). But it itself sets a limit:
« ולא אמרן אלא דמהדר אפיה לפוריא » (שו״ע או״ח רמ״א:א), and:
« אבל לבראי לית לן בה » (שו״ע או״ח רמ״א:א) — the Mishnah Berurah gives the reason:
« שהקלוח הולך וניתז למרחוק וממילא באשה אסור אפילו בכה״ג » (משנה ברורה, מ״ב רמ״א:ו). summary: the rule bears on what goes towards the bed, not on the act of rising. In practice, one follows one's Rav.
Case 2 — A vessel in the room
Situation: one cannot go out, and a vessel is at hand.
Conduct: The seif expressly allows it:
« ודמהדר אפיה לפוריא נמי לא אמרן אלא בארעא אבל במנא לית לן בה » (שו״ע או״ח רמ״א:א). The Arukh haShulchan:
« ודווקא כשמשתין על הארץ אבל כשמשתין בכלי לית לן בה » (ערוך השלחן רמ״א:ב). But the Kaf haChaim enters a reservation:
« ומשמע מזה דאם משתין בכלי מנוקב נמי מביא לידי עניות כיון דשותת בארץ והוי מיאוס » (כף החיים רמ״א:ה), and gives the remedy:
« ומשמע נמי דאם מטיל לתוכו תיכף רביעית מים לית לן בה כיון דנתבטל המיאוס » (כף החיים רמ״א:ה). And for one who studies, the Mishnah Berurah adds:
« ומ״מ ת״ח צריך שיכפה עליו כלי מלמעלה דא״א לו לת״ח בלא הרהור תורה » (משנה ברורה, מ״ב רמ״א:ז). In practice, one follows one's Rav.
Case 3 — Saying אשר יצר afterwards
Situation: one wishes to say the blessing אשר יצר, and the vessel is still in the room.
Conduct: The Mishnah Berurah gives the whole conduct:
« וכשרוצה לברך אח״כ ברכת אשר יצר יטול ידיו וגם יחגור עצמו כדי שלא יהא לבו רואה את הערוה וירחיק את עצמו כדין ממקום המי רגלים אם אין הכלי מכוסה כדין » (משנה ברורה, מ״ב רמ״א:ח). The Kaf haChaim reports it in the Tashbetz's name:
« מי שמטיל מים בלילה צריך להרחיק ד״א משם וליטול ידיו ולחגור עצמו כדי שלא יהא לבו רואה את הערוה לברך אשר יצר » (כף החיים רמ״א:ג), and the Eliyah Rabbah gives the dispensation:
« מיהו אם יש לו עביט של מי רגלים של מתכות או זכוכית ויטיל רביעית מים בכל פעם שישתין אין צריך להרחיק » (אליה רבה רמ״א:ד). The general rule of distancing is at siman 87:
