Siman פ׳ · One who cannot restrain himself

דין מי שאינו יכול להישמר מהפיח — one who is certain that he cannot restrain himself from הפיח (passing gas) until he finishes the ק״ש and the תפלה: better to let the זמן pass than to pray בלא גוף נקי; if he let the time pass, he is אנוס and prays מנחה twice; and if he thinks he can restrain himself בשעת ק״ש, he dons תפילין בין אהבה לק״ש

This siman teaches the case of one who cannot restrain himself from הפיח (passing gas) during the ק״ש and the תפלה: if he is certain (ברי לו), מוטב שיעבור הזמן — better to let the time pass — than to pray בלא גוף נקי (without a clean body); if he has let the time pass, he is אנוס and prays מנחה שתים; and if he thinks he can restrain himself during the ק״ש, he dons תפילין בין אהבה לק״ש. Hebrew text, fluent English translation and explanation of the סעיף אחד, with a section of practical cases.

The Choulhan Aroukh teaches (אורח חיים פ׳): מוטב שיעבור זמן קריאת שמע ותפלה ולא יתפלל ממה שיתפלל בלא גוף נקי — it is better that the time of the ק״ש and the תפלה pass and he does not pray, than to pray without a clean body. For one who prays stands before the King (עומד לפני המלך), and it would be a disgrace to pass gas before Him. We study here at the level of principle; for personal conduct, one refers to the custom and to the ruling of the Rav.

📑 Study outline

A. The סעיף אחד — מוטב שיעבור הזמן (the order of priority), אנוס ומתפלל מנחה שתים (the תשלומין), תפילין בין אהבה לק״ש (הגה: ומברך עליהם)
1. Practical case — he knows he will not be able to restrain himself: let the זמן pass rather than pray בלא גוף נקי
2. Practical case — the זמן of the תפלה has passed: אנוס, מתפלל מנחה שתים (תשלומין)
3. Practical case — he thinks he can restrain himself during the ק״ש: תפילין בין אהבה לק״ש

A. One who cannot restrain himself — the סעיף אחד

מִי שֶׁאֵינוֹ יָכוֹל לְהִשָּׁמֵר מֵהָפִיחַ — one who cannot guard himself from passing gas — the תפלה (Amida) requires a גוף נקי (a clean body), for one who prays « stands before the King » (עומד לפני המלך). One who is certain (ברי לו) that he cannot restrain himself should prefer to let the זמן pass rather than pray בלא גוף נקי. Hence the law of one who has let the time pass (אנוס, תשלומין), and the question of תפילין during the ק״ש.

Point 1 — מוטב שיעבור הזמן: better to let the time pass

One who is certain (מי שברי לו) that he cannot restrain himself from passing gas until he completes the קריאת שמע and the תפלה — it is better that he let the time of the קריאת שמע and the תפלה pass and not pray (מוטב שיעבור הזמן), than to pray without a clean body (בלא גוף נקי).
The תפלה requires a גוף נקי. One who is certain (ברי לו) that he cannot master himself to the end should not pray in that state: מוטב שיעבור הזמן — better to lose the זמן than to « stand before the King » בלא גוף נקי. It is an order of priority: the dignity of the תפלה precedes fulfilling it in its time.

Point 2 — אנוס ומתפלל מנחה שתים: the anous and tashlumin

ואם עבר זמן תפלה, אנוס הוא ומתפלל מנחה שתים.
And if the time of the תפלה has passed, he is under duress (אנוס) and prays מנחה twice (ומתפלל מנחה שתים).
Since he let the זמן pass under duress — he could not pray בלא גוף נקי — he has the status of אנוס. Now the תפלה has תשלומין (a make-up): one who missed שחרית under duress prays מנחה twice — once for מנחה, once as a make-up for the missed שחרית.

Point 3 — תפילין בין אהבה לק״ש: tefillin during the ק״ש

ואם יראה לו שיכול לעמוד עצמו בשעת קריאת שמע, יניח תפילין בין אהבה לקריאת שמע. הגה: ומברך עליהם [טור].
And if it seems to him that he can master himself at the time of the קריאת שמע, he dons תפילין between אהבה (רבה) and the קריאת שמע. Note (הגה): and he blesses over them (ומברך עליהם) [טור].
The תפילין too require a גוף נקי. Throughout the תפלה he cannot master himself; but if it seems he can hold for the time of the ק״ש alone, he dons תפילין בין אהבה לק״ש — just before the ק״ש — so as to read the ק״ש with תפילין. The רמ״א adds that he blesses over them (per the טור).
The siman in one sentence: one who is certain he cannot restrain himself from הפיח to the end — מוטב שיעבור הזמן rather than pray בלא גוף נקי; if he let the זמן pass he is אנוס and prays מנחה twice (תשלומין); and if he thinks he can master himself during the ק״ש, he dons תפילין בין אהבה לק״ש (הגה: ומברך עליהם).

Practical cases

Case 1 — He knows he will not be able to restrain himself

Situation: he knows with certainty that he will not be able to restrain himself from passing gas until the end of the תפלה. Should he nonetheless pray in its time?
Conduct: no — the תפלה requires a גוף נקי, and מוטב שיעבור הזמן: better to let the זמן pass than to pray בלא גוף נקי. He should not « stand before the King » in that state. For the practical application (how real the doubt is), one follows one's Rav.

Case 2 — The זמן of the תפלה has passed

Situation: because of this difficulty, he let the time of שחרית pass without praying. Has he lost the תפלה?
Conduct: he is אנוס (under duress), and the תפלה has תשלומין. He prays מנחה twice: the first for מנחה, the second as a make-up (תשלומין) for the missed שחרית. For the exact order of the two Amidot, one follows one's Rav.

Case 3 — He can restrain himself for the time of the ק״ש

Situation: he cannot master himself for the whole תפלה, but thinks he can hold for the time of the ק״ש. May he don תפילין?
Conduct: yes — he dons תפילין בין אהבה לק״ש, just before the ק״ש, to read it with תפילין (which also require a גוף נקי). According to the רמ״א, he blesses over them (טור). For the details (removing them immediately after), one follows one's Rav.

Comprehension questions

Check your understanding:
  1. Why מוטב שיעבור הזמן rather than pray בלא גוף נקי, and what does « standing before the King » mean?
  2. Who is ברי לו (certain he cannot restrain himself) — and does that change his conduct?
  3. One who let the זמן pass — why is he אנוס, and what are the תשלומין (Point 2)?
  4. How many Amidot does he pray at מנחה, and why מנחה שתים?
  5. When does he don תפילין בין אהבה לק״ש, and what does the רמ״א add (Point 3)?
