Daat HaRav — The Alter Rebbe's Shulchan Aruch on Siman

The shitah of the Alter Rebbe on the 18 seifim codifying the possible errors in the Shabbos tefilah (Amidah) — confusion between weekday/Shabbos, forgetting Vaykhulu, omitting the mention of Shabbos. Conceptual framework: repetition, return, addition after the Amidah.

Why a Level 4 dedicated to the Alter Rebbe? The Alter Rebbe's Shulchan Aruch is not a commentary on the Mechaber (מחבר) — it is an autonomous and complete Shulchan Aruch, written by the Alter Rebbe. Its singularity: it combines halachah (הלכה) + טעמי המצוות + inner dimension in one work, and rules with a unique talmudic rigor.

For Chabad, the Alter Rebbe is הפוסק האחרון. This page brings together, for siman רס״ח, the full text of the Rav, his originality, and the words of the Rebbe that illuminate the subject.

The law of one who errs in the tefillah of Shabbos — and it contains 18 seifim:

One must say the parashah of "Vayechulu" in the tefillah of Maariv. And whoever davens and says "Vayechulu" — Scripture credits him as though he had become a partner with the Holy One blessed be He in the work of creation. As it is said "Vayechulu" — do not read "Vayechulu" but rather "Vayechalu" ("and they completed"), as if to say: the Holy One blessed be He and he:

If one erred and began the weekday middle berachos: if he caught himself in the midst of a berachah — he must finish that entire berachah, and then begin the middle berachah of Shabbos. This holds both when he caught himself in the first of the weekday middle berachos, namely "Atah chonein", and when he caught himself in the other weekday middle berachos; and similarly on Yom Tov. The reason: by strict law it would have been fitting to institute on Shabbos and Yom Tov too all the middle berachos as on a weekday, mentioning the kedushah of the day within the berachah of the Avodah, as on Rosh Chodesh and Chol HaMoed. But in honor of Shabbos and Yom Tov, the Sages did not impose this burden and instituted a single middle berachah for the kedushas hayom. Therefore one who began the weekday middle berachos should finish the berachah he began, since it would have been fitting to say it now by strict law:

In what case is this stated? In the tefillah of Maariv, Shacharis, or Mincha; but in Mussaf, if one began the weekday middle berachos he must stop in the middle of the berachah he caught himself in, and begin the middle berachah of Mussaf. For at Mussaf it was by strict law not fitting at all to daven all the weekday middle berachos but only the single Mussaf berachah. Indeed, even on Rosh Chodesh and Chol HaMoed, where they imposed davening the 18 (י״ח) at Maariv, Shacharis, and Mincha — nevertheless at Mussaf one davens only 7 berachos. So the reason is not because of the burden, but because no more is needed. And some dispute this. And in safek berachos one is lenient:

Even if one only began with a single word of the weekday middle berachos in which he caught himself — he must finish the whole berachah. In what case is this stated? In all the other middle berachos, except for the berachah "Atah chonein": if he said only the word "Atah" alone — even though he intended to say "Atah chonein" because he thought it was a weekday, and he caught himself before saying "chonein" — he does not finish that berachah. Rather, he says immediately "Kidashta es yom hashevii…" if he is at Maariv; and likewise if he is at Mincha — he says immediately "Echad u'shmecha echad…", because he has not yet begun the weekday tefillah with his mouth: the word "Atah" is found in the Shabbos tefillah as well. And although his thought was on the weekday tefillah — that does not matter, for a berachah is not invalidated on account of another intention, as explained in siman 209.

But if he is in the tefillah of Shacharis, where the word "Atah" does not appear in that tefillah, then he who said "Atah" thinking it was a weekday — has indeed begun the weekday tefillah, and he must finish that berachah and afterwards begin "Yismach Moshe".

But if he knew it was Shabbos but stumbled on his tongue out of weekday habit and said the word "Atah", and caught himself before saying "chonein" — he does not finish that berachah, but returns to the Shabbos tefillah. For this is like one who merely substituted one Shabbos tefillah for another, since he knows it is Shabbos, and he only said the word "Atah", which appears in the Shabbos tefillos too — e.g., "Atah kidashta" or "Atah echad". Had he wanted, he could have said "kidashta" or "echad" after the word "Atah" he uttered. He has therefore not yet begun the weekday [tefillah]. Nevertheless, he need not say "kidashta" or "echad", but says immediately "Yismach Moshe"; and the meaning of his words will be: "Atah" — Holy One blessed be He, "Yismach Moshe bematnas chelko":

One who erred and began a weekday tefillah on Shabbos — it is a bad sign for him: let him examine his deeds and reflect on teshuvah:

Some have the custom — for the reason known to them — to say at Maariv "veyanuchu vah" (feminine), at Shacharis and Mussaf "veyanuchu vo" (masculine), and at Mincha "Shabbesos kodshecha veyanuchu vam" (plural):

One who erred and prayed the whole weekday tefillah on Shabbos without mentioning the kedushah of Shabbos in his tefillah at all — has not fulfilled his obligation, and must repeat and daven the Shabbos tefillah. But if he mentioned Shabbos within the 18 (י״ח), even without setting a separate berachah for Shabbos — he has fulfilled his obligation. And at Mussaf, if he prayed the 18 and only said "vena'aseh lefanecha es chovoseinu betemidei yom uvekorban Mussaf" in one of the berachos — he has fulfilled:

If he has not yet taken three steps back, even though he has finished his tefillah but has not yet said the supplications customarily recited after his tefillah, such as "Elokai netzor" — he returns only to the beginning of the Shabbos berachah, and then completes the three final berachos. But if he has already finished the supplications — he must return to the beginning, even though he has not yet taken three steps back:

And if he is in doubt whether he mentioned Shabbos in the 18-berachos tefillah he prayed — he must repeat and daven; for by default we assume he did not mention it, since it is not a person's habit [in that place].

But if he is in doubt whether he prayed the weekday 18 or the seven berachos of Shabbos — there is room for doubt as to whether he must repeat and daven:

One who errs in the middle berachah of the Shabbos tefillos and substitutes that of this tefillah with that of another Shabbos tefillah: if he caught himself before he finished that berachah of the other tefillah — he must stop and return to the head of this berachah from the current tefillah. If he has finished that berachah — he does not return. For the essence of the middle berachah is "Retzeh na bimnuchaseinu", which is the same in all the tefillos:

סעיף יא בַּמֶה דְּבָרִים אֲמוּרִים? בִּתְפִלַּת עַרְבִית שַׁחֲרִית וּמִנְחָה, אֲבָל בִּתְפִלַּת מוּסָף, אִם…

Likewise, if he prayed Mussaf at Maariv, Shacharis, or Mincha — he has not fulfilled, since he mentioned the korban Mussaf within his tefillah and uttered a falsehood before the Omnipresent:

After the silent tefillah at Maariv, the custom is to repeat and say "Vayechulu", because of a Yom Tov that falls on Shabbos — when it is not said within the tefillah, and it must then be said after the tefillah. And so as not to make a distinction between one Shabbos and another, they took the custom to say it on every Shabbos, and also to fulfill it for one who does not know how to say it.

The custom is to say it all together, aloud and standing, because by this we bear witness to the Holy One blessed be He concerning the work of creation, and witnesses must testify standing.

And if one forgot to say it in shul — it is good to say it at Kiddush, standing:

וְאַף הַמִּתְפַּלֵּל בְּיָחִיד שֶׁרוֹצֶה לוֹמַר כֵּן — הָרְשׁוּת בְּיָדוֹ:

The Sages instituted that after the silent tefillah the shaliach tzibbur say one berachah "me'ein sheva" (summarizing the seven). Why did they institute this on Friday night more than the other nights, when they did not institute the chazaras hashatz after the tefillah of Maariv (as the reason was explained in siman 237)? Because the synagogues of their time were in the fields, where demons were prevalent; on all the other nights they were busy with their work, and upon finishing their work they would daven Maariv at home and not come to shul at night. But on Friday night they would come to shul. They were concerned that some would not hurry to come and would tarry after the tefillah of the tzibbur, and remain alone in shul and be endangered. They therefore lengthened the tefillah of the tzibbur so that there would be time for the individual to finish his tefillah while the shaliach tzibbur recited this berachah.

Therefore they instituted it only upon the shaliach tzibbur alone. And if the tzibbur wishes to say it with the shaliach tzibbur — they must say it without the opening "baruch atah" and without the conclusion (חתימה), in order not to recite a berachah in vain. And such is the custom in these lands: to say with the shaliach tzibbur "magein avos" until "zecher lema'aseh vereishis".

And even one who davens alone (be-yachid) who wishes to say it thus — the option is in his hand:

סעיף יד יוֹם טוֹב שֶׁחָל לִהְיוֹת בְּשַׁבָּת — אֵינוֹ מַזְכִּיר יוֹם טוֹב בִּבְרָכָה מֵעֵין שֶׁבַע, לְפִי…

When Yom Tov falls on Shabbos — one does not mention Yom Tov in the berachah "me'ein sheva"; for had it not been for Shabbos there would be no berachah "me'ein sheva" on Yom Tov, since this berachah was not instituted on Shabbos because of the chiyuv hayom but because of the demons (and on the night of Yom Tov as well they did not come to shul, because they were busy with the work of preparing food — melechet ochel nefesh).

And this is not similar to Ne'ilah of Yom Kippur that falls on Shabbos, where one must mention Shabbos also at Ne'ilah even though there is no Ne'ilah on Shabbos — for in any case, on that day one is obligated in four tefillos, namely Shacharis, Mussaf, Mincha, Ne'ilah, and one must mention the matter of the day, which is Shabbos, in each of them. But here the berachah was not instituted for the chiyuv hayom, but on account of the danger of the demons:

One does not say the berachah "me'ein sheva" except in a permanent shul (beis haknesses kavua), that is, in every place where they daven with a minyan on a regular basis. But a place where they daven with a minyan only occasionally — such as those who from time to time make a minyan in their home, and likewise in the homes of chasanim and aveilim where they make a minyan at home — one does not say the berachah "me'ein sheva" there. For since there is no permanent minyan there, the reason of "so that latecomers may finish their tefillah" does not apply.

And although nowadays our synagogues are in inhabited places and this reason no longer applies at all, an enactment of the Sages does not lapse even when its underlying reason lapses. Nevertheless, in any place where there is no permanent minyan — the Sages never instituted [this berachah] there to begin with.

And if one fixes a place to daven there with a minyan for some period of time — as at fairs (yeridim) where it is customary to fix a place for several weeks — there is one who ruled that it be said there, since latecomers exist there as well.

And in a place where the custom is to say it even in an occasional minyan — one should not protest (since this matter is not mentioned in the Gemara nor in the words of the Geonim):

סעיף טז אַף בְּשַׁבָּת שֶׁאַחַר יוֹם טוֹב אוֹמְרִים בְּרָכָה מֵעֵין ז', אַף עַל פִּי שֶׁאָז אֵינוֹ מָצוּי כָּל כָּךְ…

Even on the Shabbos following Yom Tov, one says the berachah "me'ein sheva", although then latecomers are not as commonly found as on other Friday eves — which are weekdays, when people are occupied with melachah until evening:

An incident with a certain chassid who saw in his dream another chassid whose face was greenish. He said to him: "Why is your face greenish?" He answered: "Because I was talking while the tzibbur was saying 'Vayechulu' and I did not say it together with them; and also because I was talking while the shaliach tzibbur was saying the berachah 'me'ein sheva' and while he was saying 'yisgadal' (Kaddish) until 'amen yehei shmei rabba', and I did not incline my ear to listen to him with kavanah." Therefore one must be careful:

If one erred and prayed the weekday tefillah on Friday night, or even if he did not daven at all: if he heard the berachah "me'ein sheva" from the shaliach tzibbur from beginning to end — he has fulfilled his obligation. And although in other tefillos the shaliach tzibbur fulfills only one who is not learned (eino baki) but not the learned (baki) — nevertheless, in the tefillah of Maariv, which is reshus (optional), they were lenient, and therefore one fulfills also with "me'ein sheva" in place of the seven. And it is good to say it with the shaliach tzibbur when one is fulfilling thereby.

But if the shaliach tzibbur has already said it — it is forbidden for an individual to say it in order to fulfill his obligation, since it was instituted only in the tzibbur. Nevertheless, if he transgressed and said it as an individual — he has fulfilled his obligation, since the tefillah of Maariv is reshus:

"All together…" — According to what the Taz wrote, the individual (yachid) need not stand, since he has no intention of bearing witness. But that is not the opinion of the Mateh Moshe or the Magen Avraham here, nor of the Shulchan Aruch siman 271, who required him to stand. And so it appears in the Beis Yosef there in the name of the Orchos Chaim that "they were not so particular, etc." — implying that it would have been fitting to be particular about standing specifically, even when there is no complete assembly (eidah sheleimah). And such is the prevailing practice:

Chidush א — Vayechulu as testimony (268:1, 268:12; Kuntres Acharon ב)

Vayechulu, testimony to the work of Creation

What the Rav writes: in seif 1, one must say the passage of Vayechulu in the Maariv tefillah, and whoever says it is regarded as a partner of the Holy One, blessed be He, in the work of Creation. In seif 12, the custom is to repeat it after the tefillah all together, aloud and standing, for by this "אָנוּ מְעִידִים לְהַקָּדוֹשׁ בָּרוּךְ הוּא בְּמַעֲשֵׂה בְרֵאשִׁית וְהָעֵדִים צְרִיכִים לְהָעִיד מְעֻמָּד". In the Kuntres Acharon (ב) he sets against the Taz, for whom an individual need not stand, the view of the Mateh Moshe, the Magen Avraham and the Shulchan Aruch (siman 271), who require him to stand; and he infers from the Beis Yosef that one should take care to stand even without a full congregation, "והכי נהוג עלמא". The Mishnah Berurah (268 s.k. 19) writes that it is good to say it together with the congregation, and at least with two ("ועכ״פ יהיה בשנים"); for one who forgot it in shul, it too cites the Mateh Moshe: say it at Kiddush, standing.

Practical consequence: if one forgot to say it in shul, it is good to say it at Kiddush, standing (268:12).

Chabad conduct in practice

Points of halachic conduct that flow directly from the Alter Rebbe's Shulchan Aruch siman רס״ח, in the Chabad sensibility.

For the Chabad Chassid (חסיד) — Siman רס״ח

  • ① Vayechulu: it is said in the Maariv tefillah; after the tefillah, the custom is to repeat it all together, aloud and standing; if one forgot it in shul, it is good to say it at Kiddush, standing. See section 2. Reference: Alter Rebbe's Shulchan Aruch רס״ח:1, 12.
  • ② A weekday berachah begun by mistake in the Shabbos Amidah: at Maariv, Shacharis and Mincha, one finishes the berachah one began, and then begins the middle berachah of Shabbos (268:2). At Musaf, one stops in the middle of the berachah and begins that of Musaf; the Rav notes a dissenting view and concludes "וּסְפֵק בְּרָכוֹת לְהָקֵל" (268:3). The case where one said only the word "אַתָּה" has its own distinctions (268:4). If one prayed the whole weekday tefillah without any mention of Shabbos, one has not fulfilled the obligation (268:7): as long as one has neither moved one's feet nor finished the supplications after the tefillah, such as "אֱלֹהַי נְצוֹר", one goes back to the beginning of the Shabbos berachah and finishes the last three; otherwise, one starts again from the beginning (268:8). Reference: Alter Rebbe's Shulchan Aruch רס״ח:2-4, 7-8.
  • ③ One Shabbos tefillah exchanged for another Shabbos tefillah: if one notices before finishing the middle berachah, one stops and goes back to the beginning of the berachah of the current tefillah; if one has finished it, one does not go back. At Musaf, the exchange, either way, does not fulfil the obligation. Reference: Alter Rebbe's Shulchan Aruch רס״ח:10-11.
  • ④ The me'ein sheva berachah at Friday-night Maariv: it was instituted for the shliach tzibbur alone; a congregation that wishes to say it with him says it without opening or closing blessing, and the custom in these lands is to say with him from "מָגֵן אָבוֹת" to "זֵכֶר לְמַעֲשֵׂה בְרֵאשִׁית" (268:13). It is said only where one prays with ten on a fixed basis (268:15). One must take care not to talk while the congregation says Vayechulu, while the shliach tzibbur says me'ein sheva, and during Kaddish until "אָמֵן יְהֵא שְׁמֵהּ רַבָּא" (268:17). Reference: Alter Rebbe's Shulchan Aruch רס״ח:13, 15, 17.
