1. The Central Axiom
Siman שמ"ב in one sentence.
During bein hashemashos (the twilight, that safek moment between day and night), Chazal did not extend their rabbinic decrees (שבות) — on condition that there is a tzorech mitzvah or a pressing need (דְּחָק). One may then climb a tree or swim to retrieve a lulav or shofar, fetch a forgotten eiruv, or tell a nochri to light a Shabbos lamp.

2. Key concepts condensed
| Concept | Definition | Application |
|---|---|---|
| בֵּין הַשְּׁמָשׁוֹת | Twilight — safek day/night | From shkiyah to tzeis hakochavim |
| שְׁבוּת | Rabbinic issur of Shabbos | Only this level is concerned by the heter |
| דְּבַר מִצְוָה | Need for a mitzvah | Lulav, shofar, eiruv |
| דּוֹחַק | Pressing need, a "harried" person | Permits the shevus even without a mitzvah |
| מְלָאכָה דְּאוֹרַיְתָא | Melachah forbidden by the Torah | Never permitted — outside the scope of the siman |
3. The rule in one image
Why is bein hashemashos lenient?
↓
Bein hashemashos is a safek: day or night? If it is still day, there is no issur at all.
↓
A rabbinic decree on a moment of safek would be a "decree upon a decree". Chazal refrained from it.
↓
But they did not lift it entirely: there must be a need (mitzvah or dochak). Without a need, the shevus stands even at bein hashemashos.
4. Decision tree
Q1: Is the act a melachah deOraisa?
↓ NO (otherwise: forbidden)
Q2: Are we at bein hashemashos of the entry of Shabbos?
↓ YES (motzaei Shabbos: one is machmir)
Q3: Is there a tzorech mitzvah or a dochak?
↓ YES (otherwise: the shevus stands)
Q4: Is this shevus "remote" from a melachah (not an act close to a Torah issur)?
↓ YES
→ Permitted during twilight.
5. The four cumulative conditions
| # | Condition | If it is lacking |
|---|---|---|
| 1 | Purely rabbinic issur (shevus) | Melachah deOraisa → always forbidden |
| 2 | Time: twilight of entry of Shabbos | Motzaei Shabbos → one is machmir |
| 3 | Need: mitzvah or dochak | Mere comfort → the shevus stands |
| 4 | Shevus remote from a melachah | Shevus close to a Torah issur → not permitted |
6. Mnemonic רֶמֶז
ר — רק שבות: only rabbinic issurim, and only those remote from a melachah. Never a Torah melachah.
מ — מצוה או דוחק: there must be a tzorech mitzvah (lulav, shofar, eiruv) or a pressing need. Not mere comfort.
ז — זמן הכניסה: only the twilight of the entry of Shabbos; at the twilight of the exit, one is machmir.
7. Pitfalls to avoid
Pitfall 1: Believing that everything is permitted at twilight. A melachah deOraisa remains totally forbidden — the heter only touches shevus.
Pitfall 2: Applying this heter out of comfort. Without a mitzvah or a real dochak, the rabbinic decree stands even at bein hashemashos.
Pitfall 3: Confusing the two twilights. The siman speaks of the entry of Shabbos; at the exit, one preserves the stringency of the kedusha that has already settled in.
Pitfall 4: Making this heter a habit. Lechatchila, one hurries to do what is needed before shkiyah and does not rely on this device.
8. Practical cases
| Situation | Analysis | Conduct |
|---|---|---|
| Lulav/shofar forgotten out of reach | Tzorech mitzvah; climbing the tree / swimming = shevus | Permitted at twilight of entry |
| Eiruv left on a tree or in a karmelis | Tzorech mitzvah (validity of the techum) | Permitted to bring it down / out |
| Shabbos lamp not lit | Real dochak; amira le-akum = "remote" shevus | Permitted to ask him at twilight |
| Lighting a light oneself at twilight | Melachah deOraisa | Forbidden |
| Shevus of mere comfort, without a mitzvah | Condition 3 absent | Forbidden |
9. Final synthesis table
| Element | Detail |
|---|---|
| Subject of the siman | Shevus permitted during bein hashemashos for a mitzvah or dochak |
| Number of seifim | 1 |
| Mishnah Berurah | 7 entries |
| Talmudic source | שבת ל"ד ע"א — baraita; Mishnah Shabbos 2:7; Eruvin 32b |
| Internal cross-references | סי' רס"א (zone of twilight) · end of סי' ש"ז (amira le-akum) |
| Practical decision | Permitted under the 4 conditions; lechatchila hurry before shkiyah |
10. Practical commandments of Siman שמ"ב
For daily conduct
- Hurry to do whatever is needed before shkiyah — do not count in advance on the heter of twilight.
- Verify the 4 conditions (רֶמֶז): rabbinic issur, twilight of entry, mitzvah/dochak, shevus remote from a melachah.
- Never do a melachah deOraisa at twilight, even for a mitzvah.
- Lulav, shofar, forgotten eiruv — one may recover them at twilight of entry; lamp not lit — one may ask a nochri.
- In case of safek or borderline case — ask your Rav.
