Daat HaRav — The Shulchan Aruch HaRav on Siman שמ"ב

The Shitah of the Alter Rebbe on the single se'if that codifies: during twilight (the onset and conclusion of Shabbos) one may perform rabbinic acts for a mitzvah need. A period of halachic uncertainty harnessed for necessities.

Why a Level 4 dedicated to the Alter Rebbe? The Shulchan Aruch HaRav is not a commentary on the Mechaber (מחבר) — it is an autonomous and complete Shulchan Aruch, authored by the Alter Rebbe. Its distinctiveness: it combines halachah (הלכה) + reasons for the mitzvos (טעמי המצוות) + the inner dimension in a single work, and it rules with a unique Talmudic rigor.

וְיֵשׁ מִי שֶׁהָיָה מִסְתַּפֵּק אִם הִתִּירוּ כָּל זֶה גַּם בְּמוֹצָאֵי שַׁבָּת בֵּין הַשְּׁמָשׁוֹת, כִּי שֶׁמָּא מִסָּפֵק לֹא פָקְעָה קְדֻשַּׁת עֶצֶם הַיּוֹם.

וְיֵשׁ לְהָקֵל (עַיֵּן מָגֵן אַבְרָהָם סוֹף סִמָּן תר[כ]"ג וְסִמָּן תקפ"ח):

Bein hashemashos — it is permitted to do things which Chazal forbade as a decree — and it contains one seif:

All things which are forbidden by the words of the Sofrim (the Sages) — they decreed about them only in the body of the day itself, but during bein hashemashos they are permitted. And this is provided there is a matter of mitzvah involved — such as climbing a tree or floating on the surface of the water to bring a lulav or a shofar; or one is pressed and rushed and needs this thing, even if it is a need of the order of reshus (mundane), as long as it is a great need or a great loss (hefsed meruba); or it is a clear need for Shabbos even though it is not a great need — for example, to make an eruv chatzeiros in order to be able to carry from house to courtyard — as all this was explained in siman 261.

And there is one who was in doubt whether they permitted all this also at the bein hashemashos of motzaei Shabbos, since perhaps, by the doubt, the sanctity of the body of the day itself has not yet passed.
