1. Central axiom
Siman שנ"ט in one sentence.
A partition alone does not suffice to make a large space a reshus hayachid for carrying: it must have been erected for the sake of dwelling (הֻקַּף לְדִירָה). A rechava behind houses, larger than beis sa'asayim and enclosed without that intent, becomes a karpef where one may carry only within 4 amos.
2. Key concepts
| Concept | Definition | Application |
|---|---|---|
| רְחָבָה | Open space behind the houses | The place addressed by the siman |
| בֵּית סָאתַיִם | Area of the Mishkan courtyard: 50 × 100 = 5000 amos² | Threshold: above, karpef status possible |
| הֻקַּף לְדִירָה | Enclosed for dwelling | Makes the space reshus hayachid regardless of size |
| קַרְפֵּף | Large enclosure not meant for dwelling | Carrying limited to 4 amos |
| פֶּתַח קֹדֶם לְהֶקֵּף | Doorway opened from the house before the fence | Proof of dwelling intent |
3. Hierarchy of cases
Case 1: Rechava ≤ beis sa'asayim — not a karpef: free carrying, including to the house.
↓
Case 2: Rechava > beis sa'asayim, but doorway opened from the house before enclosing — mukefes le-dira: free carrying throughout.
↓
Case 3: Same case with a threshing floor between the house and rechava — still permitted: we don't say the doorway serves the threshing floor.
↓
Case 4: Rechava > beis sa'asayim, not enclosed for dwelling — karpef: 4 amos only, forbidden to the house.
4. Decision tree
Q1: Does the rechava exceed beis sa'asayim (5000 amos²)?
↓ NO → no karpef status: free carrying, even to the house.
Q2: Was a doorway opened from the house before enclosing?
↓ YES → mukefes le-dira: free carrying. NO → karpef status: carrying limited to 4 amos. (But per the Rema, our era's courtyards are presumed mukefes le-dira.)
5. The role of the Rema's gloss
| Aspect | The Mechaber | The Rema's gloss |
|---|---|---|
| Purpose | States the theoretical case: rechava not mukefes le-dira = karpef | Explains the real practice of his time |
| Teaching | Distinguishes large/small rechava and the prior doorway | Today the courtyards behind houses are סְתָמָן enclosed for dwelling |
| Reference | — | Relies on what was said in siman 358 (karpef) |
| Chabad | Follow the Shulchan Aruch HaRav, siman 359 — see Level 4 Daat HaRav | |
6. Mnemonic
R — Rechava: the large space behind the house.
S — Sa'asayim: the 5000-amos² threshold.
D — Dira: one must enclose "for dwelling" to permit the large space.
P — Pesach first: doorway from the house then enclose = mukaf le-dira.
7. Pitfalls
Pitfall 1: Thinking any partition turns land into a reshus hayachid. Beyond beis sa'asayim, the partition does not suffice without the dwelling intent.
Pitfall 2: Ignoring the order of operations. "Doorway then fence" makes the space mukaf le-dira; enclosing first and then opening a doorway is not enough.
Pitfall 3: Thinking that an intervening threshing floor nullifies the doorway. The siman explicitly rules: the doorway remains attached to the rechava.
Pitfall 4: Confusing the courtyard in front of the house (chatzer, always mukefes le-dira) with the rechava behind the house (the subject of this siman).
8. Modern practical cases
| Situation | Reference | Conduct |
|---|---|---|
| Small fenced garden (≤ beis sa'asayim) behind the house | Seif א | Free carrying, including to the house |
| Large fenced lot for storage, no doorway to the house | Seif א | Karpef: 4 amos only |
| Large lot: doorway opened first, then enclosed | Seif א | Mukaf le-dira: free carrying |
| Ordinary courtyard behind a currently inhabited house | Rema's gloss | Presumed mukefes le-dira; consult re eruv for co-op |
9. Final synthesis table
| Item | Detail |
|---|---|
| Topic | Large space (rechava) behind houses |
| Number of seifim | 1 (Mechaber + Rema) |
| Mishnah Berurah | 5 entries |
| Key threshold | Beis sa'asayim = 5000 amos² |
| Central rule | Beyond threshold: karpef, unless הֻקַּף לְדִירָה |
| Heter criterion | Doorway from the house opened before enclosing |
| Practical decision | Rema's gloss: today's courtyards presumed mukefes le-dira — follow your minhag and your Rav |
10. Practical commandments of Siman שנ"ט
For daily conduct
- Measure the adjacent land area: below beis sa'asayim, no karpef issue.
- Check the order of operations: the doorway from the house must precede the fence to make the space mukaf le-dira.
- Don't rely on the fence alone for a large non-dwelling lot: it remains karpef.
- For an ordinary modern courtyard: rely on the Rema (presumed mukefes le-dira); verify the eruv for co-ops.
- In doubt or borderline cases — consult your Rav.
- Deep pilpul — Level 2; Shitah of the Alter Rebbe (Chabad) — Level 4.
