1. The central axiom
Siman שנ"ח in one sentence.
A space enclosed by partitions is, min haTorah, a perfect reshus hayachid — but Chazal forbade carrying within it beyond 4 amos when it is large (more than beis sa'asayim) and not enclosed for dwelling. The entire siman answers a single question: was this enclosure designed for human dwelling? — and if not, how to "repair" it or what may still "nullify" its dwelling status.
2. Key concepts condensed
| Concept | Definition | Application |
|---|---|---|
| מֻקָּף לְדִירָה | Enclosed for dwelling | Free carrying regardless of area |
| קַרְפֵּף | Enclosed without intent to dwell | > beis sa'asayim → carrying limited to 4 amos |
| בֵּית סָאתַיִם | Threshold area (≈ 70 amos + 4 tef. per side) | Derived from the Mishkan courtyard |
| מִעוּט | "Reducing" the area (pillar, plaster, roof) | To return below the threshold |
| בִּטּוּל הַדִּירָה | Nullifying dwelling status | Seedings, non-potable water (≠ trees, drinking water) |
3. Hierarchy of statuses
Status 1 — enclosed for dwelling: carrying free throughout, even several milin.
↓
Status 2 — uninhabited, ≤ beis sa'asayim: carrying free within (but not into the house).
↓
Status 3 — uninhabited, > beis sa'asayim: carrying limited to 4 amos.
↓
Status 4 — inhabited but mostly sown: seedings nullify dwelling → back to restricted regime.
4. Decision tree
Q1: Does the enclosure have a doorway/house preceding the fence (or fence made for dwelling)?
↓ YES → enclosed for dwelling, free carrying; NO ↓
Q2: Does the area exceed beis sa'asayim?
↓ NO → free carrying within; YES ↓
Q3: Has the enclosure been "repaired" (breach > 10 amos then re-enclose, area reduction)?
↓ YES → carrying permitted; NO → limited to 4 amos
→ Any doubt → consult your Rav.
5. Reducing the area / nullifying dwelling
| Element | Effect |
|---|---|
| Pillar at least 3 tefachim wide | Reduces area (valid mi'ut) |
| Thick clay plaster (stands alone) | Reduces area |
| Roof covering part of the enclosure | Reduces open area, even slanted |
| Planted trees / dug well | Do not reduce (their place is customary in an enclosure) |
| Seedings over the majority | Nullify dwelling status |
| Drinking water | Does not nullify ("no finer dwelling") |
| Non-potable water 10 tefachim deep | Nullifies like seedings |
6. Mnemonic דִּירָה
ד — דֶּלֶת קוֹדֶמֶת: the doorway (or house) must precede the fence for the enclosure to be "enclosed for dwelling."
י — יוֹתֵר מִסָּאתַיִם: only an uninhabited enclosure exceeding beis sa'asayim is hit with the 4-amos restriction.
ר — רֵפּוּי וּמִעוּט: a large enclosure is "repaired" by re-enclosing for dwelling or by reducing its area.
ה — הֲרֵס הַדִּירָה: seedings and non-potable water "nullify" dwelling; trees and potable water do not.
7. Pitfalls to avoid
Pitfall 1: Believing that any 10-tefachim-fenced area permits carrying. Min haTorah, yes — but Chazal restricted it if vast and uninhabited.
Pitfall 2: Ignoring construction order. Fencing then opening a doorway is insufficient: the doorway (or house) must precede the fence.
Pitfall 3: Thinking trees "reduce" an oversized karpef. They do not — only a pillar, thick plaster, or roof do.
Pitfall 4: Forgetting that even an inhabited enclosure can "lose" its status: a vegetable garden over the courtyard's majority nullifies dwelling.
8. Practical cases
| Situation | Analysis | Conduct |
|---|---|---|
| Small fenced garden adjoining the house | Enclosed for dwelling, ≤ beis sa'asayim | Free carrying |
| Large uninhabited fenced lot | Karpef > beis sa'asayim | Carrying limited to 4 amos |
| Courtyard with large vegetable plot | Per portion sown | See seif י |
| Pool in the enclosure | Potable / non-potable 10 tef. deep | See seif יא |
9. Final synthesis table
| Item | Detail |
|---|---|
| Topic of the siman | Which enclosed places are "enclosed for dwelling" (mukafin le-dira) |
| Number of seifim | 14 |
| Mishnah Berurah | 101 entries |
| Talmudic source | עירובין, פרק עושין פסין (כג–כד) |
| Key threshold | Beis sa'asayim — the dimension of the Mishkan courtyard |
| Golden rule | Dwelling (doorway/house) must precede the fence; otherwise "repair" the enclosure |
10. Practical commandments of Siman שנ"ח
For daily conduct
- Enclosure enclosed for dwelling (doorway/house before fence): free carrying, no area limit.
- Uninhabited enclosure ≤ beis sa'asayim: free carrying within.
- Uninhabited enclosure > beis sa'asayim: carrying restricted to 4 amos — unless "repaired."
- Beware of seedings: a majority vegetable plot nullifies dwelling status.
- In doubt — consult your Rav.
- Deep pilpul — Level 2; Shitah of the Alter Rebbe (Chabad) — Level 4.
