1. The Central Axiom
Siman שס"א in one sentence.
A reshus is not defined only by its metzius (10 tefachim of height, mechitzos): it is preserved or degraded also by shimush and by the form of its pirtzos. A roof that is reshus hayachid mide'oraisa, but used by the rabbim, is treated as reshus harabbim — until a sulam kavua demonstrates that the baal habayis has "removed" it from public use.

2. Key concepts condensed
| Concept | Definition | Application |
|---|---|---|
| גַּג הַסָּמוּךְ לְרה"ר | Gag adjacent to reshus harabbim | Low on street side, high on chatzer side |
| כְּעֵין רה"ר | "Like" reshus harabbim — not actually | Status of gag used by the rabbim |
| סֻלָּם קָבוּעַ | Sulam kavua = giluy daas | Removes gag from public use |
| צִדֵּי רה"ר | The "sides" of the street = karmelis | Place of breached mechitzah |
| קֶרֶן זָוִית | A corner | Aggravated pirtzah — not a "pesach" |
| פִּי תִקְרָה יוֹרֵד וְסוֹתֵם | The edge of the tikrah descends and seals | Virtual mechitzah outside a corner |
3. The three statuses of a gag by height
High by 10 tefachim also on the street side → full reshus hayachid → no sulam necessary, the rabbim has no access.
↓
Low (less than 10) on street side, high (10+) on chatzer side → reshus hayachid mide'oraisa, but treated "like" reshus harabbim because the rabbim places kelim on it → assur to use from the chatzer, except with a sulam kavua.
↓
Low (less than 10) on all sides → karmelis → the sulam is useless: the gag was never reshus hayachid.
4. Decision tree
Q1: Is the gag higher than 10 tefachim on the street side?
↓ YES → reshus hayachid, use it; NO ↓
Q2: Is it higher than 10 tefachim on the chatzer side?
↓ NO → karmelis, the sulam is useless; YES ↓
Q3: Has a kavua sulam been installed (be'kvius, for chol and for Shabbos)?
↓ YES → the rabbim is "removed," one may use the gag; NO → assur
→ At the slightest doubt → consult your Rav.
5. The chatzer breached toward the street
| Situation | Verdict |
|---|---|
| Pirtzah less than 10 amos, not in full width | Treated "like a pesach" — the chatzer remains mutar |
| Pirtzah in full width, or more than 10 amos, toward the street | The place of the mechitzah and the chatzer become karmelis |
| Pirtzah in a corner (קֶרֶן זָוִית) | Assur even at less than 10 amos |
| Pirtzah not in a corner, pi tikrah not slanted | פִּי תִקְרָה יוֹרֵד וְסוֹתֵם — the pi tikrah "closes" |
6. Mnemonic סֻלָּם
ס — סָמוּךְ וְנָמוּךְ: a roof adjacent to the street and low on that side — the rabbim uses it, it is treated as reshus harabbim.
ל — לְמַעְלָה מֵעֲשָׂרָה לֶחָצֵר: high by 10 tefachim on the chatzer side, it is reshus hayachid mide'oraisa — otherwise it is only karmelis.
ם — מַעֲשֵׂה קֶבַע: a sulam kavua, placed be'kvius for chol and Shabbos, removes the rabbim and permits use.
7. Pitfalls to avoid
Pitfall 1: Thinking that a gag treated "like" reshus harabbim actually is one. It is only a derabbanan degradation due to shimush — precisely why a sulam can repair it.
Pitfall 2: Placing a sulam on a gag too low. If the gag does not reach 10 tefachim on the chatzer side, it is karmelis and the sulam changes nothing.
Pitfall 3: Settling for a sulam placed only for Shabbos. A "kavua" sulam must be so for chol as for Shabbos — otherwise it remains arai.
Pitfall 4: Applying פִּי תִקְרָה יוֹרֵד וְסוֹתֵם to a pirtzah in a corner, or under a slanted ceiling. In a corner, there is no "pesach"; under a slanted roof, the tikrah has no "edge" that can be extended.
8. Practical cases
| Situation | Analysis | Conduct |
|---|---|---|
| Low gag on street side where passersby place objects | "Like" reshus harabbim | Sulam kavua to use from the chatzer |
| Gag high by 10 tefachim on both sides | Full reshus hayachid | Use mutar without any installation |
| Gag too low on all sides | Karmelis | The sulam has no effect |
| Chatzer breached for more than 10 amos toward the street | Karmelis | Carrying limited to 4 amos |
9. Final synthesis table
| Element | Detail |
|---|---|
| Topic of the siman | The status of a gag adjacent to reshus harabbim |
| Number of seifim (Mechaber) | 2 (the Shulchan Aruch HaRav counts 6) |
| Mishnah Berurah | 18 entries |
| Talmudic sources | עירובין פד-פה ; עירובין צד-צה |
| Golden rule | Shimush and pirtzah affect the status of a reshus — giluy daas restores it |
| Practical decision | Measure height on both sides; verify pirtzah and corner; consult your Rav |
10. Practical mitzvos of Siman שס"א
For daily conduct
- Gag adjacent to the street, low on that side, high on chatzer side: treated as reshus harabbim — assur to use from the chatzer.
- The sulam kavua demonstrates that the baal habayis "removes" the gag from public use: it permits use.
- "Kavua" means placed be'kvius — for chol as for Shabbos; a one-time sulam does not suffice.
- Chatzer breached in its full width or for more than 10 amos toward the street: becomes karmelis; pirtzah in a corner — assur even below 10.
- In case of doubt — consult your Rav.
- Deep pilpul — Level 2; Shitah of the Alter Rebbe — Level 4.
