1. שורש הסימן — three registers for one and the same scene

Siman 124 measured contact: the non-Jew’s hand, or the object he holds. Siman 125 measures what is no contact at all — the wine moved because he moved. Three registers then compete over one and the same scene, and almost every difficulty in the siman is born of confusing them.

The anchor: a rabbinic prohibition, and one that does not extend equally on both sides of the vessel In a single line the Gemara fixes the status of the whole siman — and with it its geography: what came out is caught, what stayed is not. « כח דגוי מדרבנן הוא דאסיר, ההוא דנפק לבראי — גזרו ביה רבנן, ההוא דלגואי — לא גזרו ביה רבנן » (עבודה זרה ע״ב ע״ב) Two things are settled here: koaḥ is rabbinic, and the rabbinic decree has a bounded reach — it did not follow the wine everywhere. From that boundary the whole question of nitzok in seif 1 will grow.
The mother-formula of koaḥ Rav Papa, in perek Rabbi Yishmael, states the paradigm case of which seif 1 and seif 8 are but two cuts: « גוי אדנא וישראל אכובא — חמרא אסיר, מאי טעמא? כי קאתי — מכח גוי קאתי » (עבודה זרה ס׳ ע״א) Nothing was touched. The non-Jew holds the jar, the Jew holds the tub, and the wine is nevertheless forbidden — כי קאתי מכח גוי קאתי. The reason is not the hand; it is the provenance.

Every major dispute in the siman is a consequence of this one question: the need to lift the vessel (seif 1), the decay into כח כחו (seif 2), mixed koaḥ (seif 3), assistance without substance (seif 4), throwing (seif 5), down to the drop that was already falling by itself (seif 11).

2. כחו — why drinking only, and not benefit

The Mechaber writes נאסר בשתייה — two words that decide a machloket of Rishonim which the Tur lays out openly. And the choice of those two words already contains a thesis about what koaḥ is.

The Tur sets the two shitot face to face « וכתב הרשב״א שאסור אפילו בהנאה וא״א הרא״ש ז״ל אינו אוסרו אלא בשתייה » (טור יו״ד קכ״ה) The Rashba forbids even benefit; the Rosh, the author’s father, forbids only drinking. The Mechaber copies the Rosh.
The Mechaber’s language « נאסר בשתייה שהרי היין בא מכחו » (שו״ע יו״ד קכ״ה:א) The reason is given in the very sentence: the wine came from his force. This is not a libation; it is a provenance.
The Rambam, for his part, writes נֶאֱסַר without qualification « נָטַל כְּלִי שֶׁל יַיִן וְהִגְבִּיהוֹ וְיָצַק הַיַּיִן אַף עַל פִּי שֶׁלֹּא שִׁכְשֵׁךְ נֶאֱסַר שֶׁהֲרֵי בָּא הַיַּיִן מִכֹּחוֹ. הִגְבִּיהַּ וְלֹא שִׁכְשֵׁךְ וְלֹא נָגַע מֻתָּר » רמב״ם הלכות מאכלות אסורות פרק י״ב הלכה ב The Beit Yosef reads that silence as a stringency — and will draw from it, further on, a consequence for what remains in the vessel.
Why drinking only? Two roots (a) Koaḥ is a diminished libation: an imperfect act of nisukh, deserving therefore only part of the sanction. On this reading the Rashba is right to press toward a benefit prohibition, and the measure of the prohibition follows the measure of the act. (b) Koaḥ is no libation at all: it is a distancing, a rabbinic fence. On this reading there is no reason to reach benefit — and the measure of the prohibition follows the measure of the risk.
The Taz plainly chooses the second branch In the middle of his long ס״ק א he lays down as obvious that the prohibition of koaḥ is not a nisukh prohibition but a fence: « ובאמת בכחו לא בעינן אפילו הגבהה דאיסור כחו הוא מחמת לך לך אמרי׳ נזירא » (ט״ז יו״ד קכ״ה ס״ק א) This is the key to his whole ס״ק א — and, as we shall see, to his demolition of the Rama’s gloss.
Nafka mina A batch of wine has passed through a non-Jew’s force. According to the Rosh and the Mechaber it may not be drunk but may be sold, and the money is permitted. According to the Rashba it may not be sold either. And the Shach adds that in our time the question no longer stands in the same terms, since he refers the whole siman back to the leniency of siman 124: « אבל לדידן שרי כאן אפי׳ שלא במקום הפסד מרובה » (ש״ך יו״ד קכ״ה ס״ק ב)

3. נצוק לכחו — does the stream follow the force?

The Mechaber does not stop at the wine that came out: he forbids what remains in the vessel as well, on account of nitzok — the continuous stream joining the two. The Rama immediately sets a יש אומרים against him, and the Shach finds here two contradictions he cannot resolve.

The Mechaber’s language « ומה שנשאר בכלי אסור גם כן משום נצוק » (שו״ע יו״ד קכ״ה:א)
The source of nitzok Nitzok comes from another sugya, in perek HaSokher et haPo’el: « המערה מכלי לכלי, את שמערה ממנו — מותר, הא דביני ביני — אסור. שמע מינה: נצוק חיבור » (עבודה זרה ע״ב ע״ב) And the Rambam gives its physical reason, in the very chapter of our halakhot:
The Rambam on nitzok « שֶׁהֲרֵי הָעַמּוּד הַנִּצֹּק מְחַבֵּר בֵּין הַיַּיִן שֶׁבַּכְּלִי הָעֶלְיוֹן וּבֵין הַיַּיִן שֶׁבַּכְּלִי הַתַּחְתּוֹן » רמב״ם הלכות מאכלות אסורות פרק י״ב הלכה י״ב
Does nitzok apply to a non-Jew’s koaḥ? Tosafot, the Rosh, the Mordechai and the Ran in Rashi’s name say no; the Rif, the Rambam, the Raavad and the Rashba say yes. « ומיהו כחו של עובד כוכבים הוא ובמאי דלבראי גזור והנשאר בכלי מותר » (תוספות עבודה זרה ס׳ ע״א ד״ה עובד כוכבים אדנא וישראל אכובא)
The Tur says why « ומה שנשאר ממנו בכלי מותר אפי׳ בשתייה ואינו אסור משום נצוק שלא החמירו בכח הנכרי לאסור המחובר לו ע״י נצוק » (טור יו״ד קכ״ה) The argument is very fine: nitzok is a stringency, and koaḥ is already a stringency; one does not stack one rabbinic stringency upon another.
How the Beit Yosef reads the Rambam’s silence « ומדלא כתב שהיין שנשאר מותר משמע שהוא סובר לאוסרו » (בית יוסף יו״ד קכ״ה) and for the halakha he concludes:
The Beit Yosef’s conclusion « ולענין הלכה כיון שרבו האוסרין והרי״ף והרמב״ם מכללם אע״ג דמידי דרבנן הוא אין להקל » (בית יוסף יו״ד קכ״ה) This is exactly the reverse of his conclusion on the previous question, where he had written:
and on the level of the prohibition « ולענין הלכה כיון דמידי דרבנן הוא יש לסמוך על דברי המתירים » (בית יוסף יו״ד קכ״ה) The very same “since it is rabbinic” thus serves once to be lenient and once not to be — because in the second case those who forbid are more numerous and weightier.
The Shach’s two contradictions First: in siman 124 seif 14 the Mechaber himself wrote that what remains inside is permitted, precisely because nitzok was not extended to koaḥ. « קשה דלעיל סי׳ קכ״ד סי״ד פסק דמה שנשאר בפנים מותר והיינו משום דלא החמירו כחו בניצוק » (ש״ך יו״ד קכ״ה ס״ק א) Second, sharper still: nitzok operates, per siman 126, only on wine forbidden in benefit; yet here the wine that came out is forbidden only for drinking.
and his conclusion « והכא כיון דהיוצא לא נאסר אלא בשתייה אמאי מה שנשאר בכלי אסור משום ניצוק וכן קשה על הרב וצ״ע » (ש״ך יו״ד קכ״ה ס״ק א)
The Taz adds a remark on the Rama’s wording The Rama had tempered his יש אומרים with ומכל מקום יש להחמיר אם לא בהפסד מרובה. The Taz judges the formula badly calibrated: « זה לשון אינו מדוקדק דבהפסד מרובה אפי׳ בניצוק גמור דהיינו ליין הנאסר במגע עובד כוכבים אנו מקילין » (ט״ז יו״ד קכ״ה ס״ק ד) In other words: if we are lenient in a great loss even with a full nitzok, what is gained by saying it here, where nitzok itself is doubtful? The Rama’s gloss would add nothing.
Nafka mina A non-Jew lifted a cask and let wine run from it into a second vessel. The wine that came out is at issue — that is settled. There remains the whole cask. According to Tosafot, the Rosh and the Rama — permitted. According to the Rif, the Rambam and the Rashba — caught. According to the Shach the matter stands as צריך עיון, and in our time all is permitted where there is loss.

4. ההגבהה — does the prohibition attach to the act or to its result?

At the end of seif 1 the Rama grafts five words in parentheses: או שלא הגביה הכלי. If he did not lift the vessel, all is permitted. This gloss, borrowed from the Beit Yosef, is the most attacked position in the siman: the Taz devotes to it the longest ס״ק in the whole chapter, and the Shach opens on it with צריך עיון. Here the underlying chakira surfaces bare.

The disputed gloss « ואם הוא שלא בכוונה שלא ידע שהוא יין (או שלא הגביה הכלי) (בית יוסף סימן קכ״ד) הכל מותר אפי׳ בשתייה » (שו״ע יו״ד קכ״ה:א)
The chakira, put plainly (a) The act. What is forbidden is a gesture shaped like a libation: one takes, lifts, pours. Without lifting the gesture lacks the required shape — אין דרך ניסוך בכך — and there is no koaḥ to forbid. (b) The result. What is forbidden is that the wine moved because of him. The shape of the gesture is irrelevant: lifting, tilting, opening a tap — all one. The Beit Yosef and the Rama hold the first branch; the Taz and the Shach, the second.
What set the Beit Yosef on this path The Rambam describes the case writing expressly והגביהו. From this the Beit Yosef infers that lifting is constitutive: « נָטַל כְּלִי שֶׁל יַיִן וְהִגְבִּיהוֹ וְיָצַק הַיַּיִן אַף עַל פִּי שֶׁלֹּא שִׁכְשֵׁךְ נֶאֱסַר שֶׁהֲרֵי בָּא הַיַּיִן מִכֹּחוֹ. הִגְבִּיהַּ וְלֹא שִׁכְשֵׁךְ וְלֹא נָגַע מֻתָּר » רמב״ם הלכות מאכלות אסורות פרק י״ב הלכה ב
The Taz’s answer: the Rambam refutes this himself one halakha earlier For the Rambam has already written, in the preceding halakha, that shaking suffices without lifting: « וְכֵן אִם אָחַז כְּלִי פָּתוּחַ שֶׁל יַיִן וְשִׁכְשְׁכוֹ אַף עַל פִּי שֶׁלֹּא הִגְבִּיהַּ הַכְּלִי וְלֹא נָגַע בַּיַּיִן נֶאֱסַר הַיַּיִן » רמב״ם הלכות מאכלות אסורות פרק י״ב הלכה א The Taz then explains why the Rambam mentioned lifting at all: for the end of his sentence — הִגְבִּיהַּ וְלֹא שִׁכְשֵׁךְ וְלֹא נָגַע מֻתָּר — and not for its beginning.
The Taz’s four proofs (a) In siman 123 a non-Jew who treads renders the wine forbidden without lifting anything, and that is an explicit Gemara. (b) In siman 124 seif 14 the wine that comes out when the non-Jew removes the plug is forbidden — with no lifting. (c) Tosafot in our daf warn against a non-Jew tilting the tub, which is not lifting. (d) In seif 4 here the Rama forbids where the non-Jew jogs the Jew’s hand — and there nothing is lifted at all.
The Darkhei Moshe’s answer, and its refutation The Darkhei Moshe answered that the plug case is different, because that is the usual way of drawing wine from a cask. The Shach finds this strained: « וגם זה דחוק דג״כ דרך הוא בכך להריק בלא הגבהה ועוד דמה בכך ס״ס הכא והכא כחו הוא » (ש״ך יו״ד קכ״ה ס״ק ג) And the Taz lands the decisive blow: if the only forbidding gesture is lifting, what does it matter whether drawing from the tap is customary — in both cases אין דרך ניסוך בכך.
The Shach on the gloss « צ״ע בדין זה דמה שהוציא הב״י בסימן קכ״ד מהרמב״ם והרא״ש (גבי מוריק אוריקו) והר״ן ואחריו נמשך הרב לא משמע מידי מדבריהם » (ש״ך יו״ד קכ״ה ס״ק ג)
The Taz’s way out — a reading of genre Rather than contradict the Beit Yosef, he proposes not to read those lines as a ruling at all: « ע״כ נראה דהב״י לא כתב דברים אלו אלא דרך משא ומתן של פלפול ולא לקבוע כן הלכה » (ט״ז יו״ד קכ״ה ס״ק א) and from this he draws the simplest and strongest argument: the Beit Yosef did not write it in his Shulchan Arukh either. It is the Rama alone who turned a discussion into a rule.
The verdict on the Rama « ורמ״א שהגיה כאן בסוף הסעיף או שלא הגביה הכלי לא טרח לעיין כל הצורך אלא סמך על מה שכתב הב״י » (ט״ז יו״ד קכ״ה ס״ק א) A remarkably frank formulation — and, in itself, a lesson in method: a gloss of the Rama copied from a discussion in the Beit Yosef does not necessarily carry the authority of a ruling of the Rama.
The Taz’s practical conclusion « ואין להקל כלל כאן בכח עובד כוכבים אפי׳ בלא הגבהה דמ״מ כח עובד כוכבים יש כאן » (ט״ז יו״ד קכ״ה ס״ק א) The result branch therefore prevails with both nosei kelim. What forbids is not the shape of the gesture but the provenance of the motion.
The gloss’s other limb: שלא ידע שהוא יין The Mechaber permits where the non-Jew did not know it was wine. The Taz recalls that the Gemara measures this ignorance very concretely: « בגמרא איתא דאפילו בריחא תליא מלתא דהיינו אם הוא יין ישן ודאי ידע שהוא יין ע״י הריח » (ט״ז יו״ד קכ״ה ס״ק ה) Smell alone constitutes knowledge: with old wine the excuse falls of itself.
Nafka mina A non-Jew opens the tap of a wine vat, or tilts a cask standing on the ground to run off the rest. By the letter of the Rama’s gloss nothing is caught: he lifted nothing. According to the Taz and the Shach the wine that came out is genuine כחו, and the gloss must not be used to be lenient. The gloss is therefore to be treated as an additional ground of leniency, good where there is already loss, and not as an independent one.

5. כח כחו — does force wear away by degrees?

Seif 2 sets up a ladder: כח כחו counts as כחו, while כח כח כחו is permitted after the fact. A ladder presupposes that force decays by degrees. Yet Tosafot object, in a single line, that no one ever fixed a degree — and the whole sugya turns on that.

The sugya The question arises from a screw press, where the non-Jew touches neither grapes nor wine: « מעצרא זיירא — רב פפי שרי, רב אשי, ואיתימא רב שימי בר אשי, אסר » (עבודה זרה ס׳ ע״א) The Gemara then specifies where the disagreement lies — and immediately reverses it:
The two leshonot, and the deed done « בכחו, כולי עלמא לא פליגי דאסיר. כי פליגי — בכח כחו. איכא דאמרי: בכח כחו, כולי עלמא לא פליגי דשרי. כי פליגי — בכחו. הוה עובדא בכח כחו, ואסר רב יעקב מנהר פקוד » (עבודה זרה ס׳ ע״א) Rabbeinu Chananel rules like Rav Yaakov of Nehar Pekod, דמעשה רב: a deed actually done outweighs a version of the discussion.
Rashi counted the forces of the press of his day « ורש״י היה מסתפק בגת שלנו שיש בו שלשה כחות כמו הדפין והקורה והגלגל אם חשיבי ככחו » (טור יו״ד קכ״ה)
How many forces does it take to leave the prohibition? Three positions, and they differ not by a degree but in principle. « והרשב״א כתב אפי׳ עשר כחות דיינינן להו ככחו לאוסרו בהנאה » (טור יו״ד קכ״ה)
The Rosh’s responsum — the leniency, and what it rests on « ראיתי רבותי מתירין לפי שיש כמה כחות וכן אני מתירו אפי׳ בשתיה » (טור יו״ד קכ״ה) The Beit Yosef is puzzled: the Rosh ruled that כח כחו is forbidden, and Rashi himself was unsure about the number. Whence, then, the leniency? He offers two answers.
The Beit Yosef’s first answer — lechatchila and bedi’avad « נהי דמשום דרב יעקב עבד עובדא ומעשה רב פסקינן לאסור היינו לכתחלה אבל בדיעבד סמכינן אלישנא בתרא דשרי » (בית יוסף יו״ד קכ״ה) Second answer: perhaps Rav Yaakov forbade only with two forces, not with three or four. Seif 2 of the Mechaber is therefore, quite literally, a bedi’avad compromise between two versions of the Gemara.
Tosafot’s objection, which destroys the very idea of a ladder After reporting the Rashbam’s leniency in a case of great loss: « אמנם רשב״ם פי׳ שאם גלגל העובד כוכבים לבדו ויש כאן הפסד מרובה יש לסמוך על איכא דאמרי שמתיר בכח כחו » (תוספות עבודה זרה ס׳ ע״א ד״ה הוה עובדא בכח כחו) they add the decisive sentence:
The sentence « ומיהו למאן דאסר לא מצינו חילוק בין ג׳ כחות לב׳ » (תוספות עבודה זרה ס׳ ע״א ד״ה הוה עובדא בכח כחו) In other words: for the one who forbids כח כחו, the prohibition does not decay with distance. A fourth link no more removes it than a third.
The chakira: quantity or category? (a) Quantity. Koaḥ is a magnitude that attenuates as it is transmitted: at each link it weakens, and finally falls below the threshold. The question of number then makes sense, and the Mechaber rightly fixes a threshold at the third force. (b) Category. Koaḥ is a relation of attribution: the wine moved because of him, or it did not. The number of intermediaries changes nothing. The Rashba plainly holds this branch — אפי׳ עשר כחות — and Tosafot show that the one who forbids must hold it too. The Mechaber’s ladder is therefore not a measurement of force but a compromise between two versions of the sugya.
The Rashba’s remark that dissolves the question of time It deserves a slow reading, for it holds for the entire siman: « אע״ג דבההיא שעתא דקא עצר אכתי ענבים נינהו ולא יין ובשעה שהיין זב לא כחו איכא ולא כח כחו אפ״ה אסרוהו כיון דמכח כחו נמשך » (בית יוסף יו״ד קכ״ה) At the moment of the act there is not yet wine; at the moment the wine flows there is no longer force. Koaḥ is therefore never simultaneous with its object. It cannot then be a transmitted physical magnitude — which confirms the second branch of the chakira.
The Shach shuts the door on lechatchila « אבל לכתחלה אסור אפילו בעשרה כחות ויותר כן משמע בטור ופוסקים » (ש״ך יו״ד קכ״ה ס״ק ד)
Nafka mina A mechanical chain: a non-Jew works a lever, which drives a wheel, which lowers a beam, which presses the boards onto the grapes. The Mechaber permits after the fact, since there are three forces here. The Rashba would forbid. And all agree on lechatchila: it is not allowed, even at ten forces.

If the Jew pours along with him, is the act still his? Seif 3 answers yes after the fact — and adds an exception that looks like a contradiction: a child’s help does not suffice. To understand that exception is to understand what the word koaḥ measures.

The lechatchila comes from the Gemara itself « אמר להו רבא להנהו שפוכאי: כי שפכיתו חמרא — לא ליקרב גוי לסייע בהדייכו, דלמא משתליתו ושדיתו ליה עליה, וקאתי מכחו ואסיר » (עבודה זרה ע״ב ע״ב) Rava does not forbid the help as such: he fears that in the end everything will be left to the non-Jew. It is a prohibition of caution, not of definition — hence the permission after the fact.
Tosafot draw the rule from it « דכל היכא דכח עובד כוכבים אסור אם כח אחר מעורב בו מותר ומיהו לכתחלה אסור » (תוספות עבודה זרה ס׳ ע״א ד״ה עובד כוכבים אדנא וישראל אכובא)

The Rashba’s answer, as the Tur reports it « ויראה לי שמותר שאף נכרי מסייע לישראל ולמה נעשה הנכרי עיקר וישראל מסייע דכל שבדבריהם הולכין להקל » (טור יו״ד קכ״ה) An argument from symmetry: if one may say the Jew is merely an assistant, one may equally say the non-Jew is. Nothing forces us to make one primary and the other secondary — and in a rabbinic doubt we go toward leniency.
The Ran turns the case into a proof He reads Rav Papa’s very statement as teaching this point, and concludes: « ולמדתי ממנה שני דברים חדא דאפילו זה יכול וזה אינו יכול גבי י״נ שרי ועוד דכל דאיכא כח נכרי וכח ישראל אע״פ שאין כחותיהן מעורבים שרי » (בית יוסף יו״ד קכ״ה) Two gains at once: even “this one can and that one cannot” is permitted, and it is not even necessary that the two forces be mingled — it suffices that both are at work.
The Shach confirms, and recalls the lechatchila « ואפי׳ הישראל לבדו אינו יכול מותר בדיעבד כן הוא ברשב״א בתה״א » (ש״ך יו״ד קכ״ה ס״ק ו)
Then why does the child not suffice? The Mechaber nonetheless rules like the Rashba, and yet forbids with a minor: « ואפילו אם היה העובד כוכבים יכול לבדו לערות בלא סיוע ישראל והוא שיהא הישראל המסייע גדול אבל אם היה נער קטן אסור משום דהוי מסייע שאין בו ממש » (שו״ע יו״ד קכ״ה:ג) If one may say of the adult Jew that he is not a mere assistant, why not say it of the child?
The Darkhei Moshe’s answer, cited by the Shach « ול״ד לקטן דמאחר שניכר שהעובד כוכבים הוא עיקר אסור » (ש״ך יו״ד קכ״ה ס״ק ו) The criterion is therefore not physical strength but the legibility of the act: as soon as it appears that the non-Jew is the principal, attribution closes back on him. With an adult the act stays ambiguous; with a child it no longer does.
The Taz’s sevara — why ambiguity suffices « אף שלעובד כוכבים יש כח יותר מ״מ עכשיו שגם הישראל נושא בכחו מי יאמר לנו שבאותו כח הצריך למשא זו יש בה חלק העובד כוכבים יותר מן הישראל » (ט״ז יו״ד קכ״ה ס״ק ו) A remarkable argument: he does not say the Jew’s force equals the non-Jew’s; he says that no one can establish which of the two supplied the necessary part. The leniency does not rest on a measurement but on the impossibility of measuring.
The yesod Koaḥ is not a quantity but an imputation. It applies as long as one can say “he did it”; it lapses once that can no longer be said without arbitrariness. That is why mixed force is permitted — not because the non-Jew’s force falls short, but because the act has ceased to be identifiable as his. And that is why a minor saves nothing: there the act remains perfectly identifiable.
Nafka mina Two men lift a cask together to pour it: a non-Jewish worker and a Jewish one. The Jewish worker is strong — permitted after the fact, even though the non-Jew could have managed alone. The same work with a twelve-year-old apprentice: forbidden, since it is plain that the load rests on the non-Jew. And in neither case is this done deliberately.

The case, as Tosafot saw it with their own eyes People used to let the non-Jew lift by himself the wagon on which the cask stood, while the wine ran into the tub, so that it should run better. R. The Rama’s gloss, and its source The Rama then draws the exact consequence of the criterion: if the wine was not flowing without him, everything changes. « אבל אם לא היה מקלח בלא הגבהת עובד כוכבים אסור » (שו״ע יו״ד קכ״ה:ד) And he extends it to the case of R. Peretz reported by the Mordechai: a non-Jew who jogs the hand of the Jew who is pouring. There too everything turns on the single question: was it already flowing?
The seif’s second limb — the workman busy at his task « שרי דהוי שלא בכוונה דבמלאכתו הוא עוסק » (שו״ע יו״ד קכ״ה:ד) The unloader did not intend to pour: he intended to unload. This is the Gemara’s כחו שלא בכוונה applied to hired work — and it is already, in seed, seif 11.

Seif 5 permits throwing and forbids rolling. The difference looks slight; it is in fact conceptual, and the Gemara grounds it on an unexpected analogy: that of the zav.

Rav Ashi’s rule « אמר רב אשי: כל שבזב טמא בגוי עושה יין נסך, כל שבזב טהור בגוי אינו עושה יין נסך » (עבודה זרה ס׳ ע״ב) The measure of koaḥ is thus borrowed from the laws of impurity: what in a zav transmits impurity by movement (heset) makes yayin nesekh; what does not, does not. And throwing is not heset — the object has left his hand.
The mishna, and the word that limits it « נטל את החבית וזרקה בחמתו לבור, זה היה מעשה והכשירו » (עבודה זרה ס׳ ע״ב) Rav Huna immediately turns the word בחמתו against Rav Ashi:
The objection « בחמתו — אין, שלא בחמתו — לא » (עבודה זרה ס׳ ע״ב) If the mishna had to specify “in his anger,” then outside of anger it is forbidden — so throwing as such does not suffice to permit. The Gemara answers that the mishna’s case is one where the object goes from him and stays from him (דקאזיל מיניה ומיניה), that is, a pushed roll and not a throw.

The Taz’s decision — and the inversion it works Ordinarily a narrower first reason is the more lenient. The last three seifim no longer speak of koaḥ but of its limit. The wine sloshes, it comes out, it runs — and nothing is caught. For Rav Ashi introduced a criterion that is neither contact nor force: the form of the act. Tosafot made of it a formidable instrument, and the Rashba, in the siman’s last line, brings everything back to the counterfactual test of seif 4.

The sugya, and Rav Ashi’s disagreement with Rav Papa « האי גוי דדרי זיקא וקאזיל ישראל אחוריה, מליא — שרי, דלא מקרקש. חסירא — אסיר, דלמא מקרקש. כובא: מליא — אסיר, דלמא נגע. חסירא — שרי, דלא נגע » (עבודה זרה ס׳ ע״א) Rav Papa thus distinguished, for the skin, between full and partly empty. Rav Ashi sweeps the distinction away:
Rav Ashi’s criterion « זיקא, בין מליא ובין חסירא — שרי, מאי טעמא? אין דרך ניסוך בכך » (עבודה זרה ס׳ ע״א) It is not that the wine did not move — it moved, and by him. It is that this way of moving it has nothing to do with a libation. The criterion is morphological, not causal.
The Rambam states it as a general rule « כְּלִי סָתוּם מֻתָּר לְטַלְטְלוֹ הָעַכּוּ״ם מִמָּקוֹם לְמָקוֹם וְאַף עַל פִּי שֶׁהַיַּיִן מִתְנַדְנֵד שֶׁאֵין זֶה דֶּרֶךְ הַנִּסּוּךְ » רמב״ם הלכות מאכלות אסורות פרק י״ב הלכה ד and the Mechaber copies it in seif 9:
The Mechaber’s language « ואע״פ שהיין מתנדנד שאין דרך ניסוך בכך » (שו״ע יו״ד קכ״ה:ט)
The use Tosafot make of this criterion They first derive from it the limit of seif 10: « ודוקא כשנושאה על ראשו או על כתיפו דאיכא למיחש דלמא נגע אבל במוט או לישא הדלי דרך טבעתו מותר » (תוספות עבודה זרה ס׳ ע״א ד״ה זיקא בין מליא בין חסירא שרי) Then Rabbeinu Tam uses it to permit a whole series of cases of his day — a loose tap a non-Jew tightens, a slack stopper he presses in, a soft leather skin he squeezes until its walls meet. In all of these the wine moves by his force; in none is there any form of libation.
The Shach, on why a wide vessel is treated leniently « דכיון שהוא רחב לא ניחא ליה בשכשוך דלמא תשתפך והלכך אפי׳ הגביה שרי כאן » (ש״ך יו״ד קכ״ה ס״ק י״ט) A psychological rather than legal argument: he does not want to shake it, lest it spill on him. The Shach adds, in parentheses, that the source-citation printed in the Shulchan Arukh at this point is a mistake.
Seif 10 and its gloss « ואם היה נושא הכלי במוט בשנים אפילו מלא והישראל הולך אחריו מותר » (שו״ע יו״ד קכ״ה:י) The Rama attaches a condition, taken from the Mordechai in the name of the Raavyah:
The gloss « ובלבד שהישראל סייעו כשהכניס המוט בטבעת הכלי » (שו״ע יו״ד קכ״ה:י) Which is logical: the permission of the carrying-pole rests on the hand being far away; one must still know that the hand did not come near at the moment of inserting it.
The Taz, why the skin-carrier does not fall under the Rambam « ונראה דכיון דנושא דרך הילוכו לא מקרי דרך ניסוך בכך » (ט״ז יו״ד קכ״ה ס״ק י״ג) The mere fact of carrying while walking suffices to exit the form of libation, even for those who forbid shaking an open vessel.
Seif 11 and its source « מותר בשתייה אפילו מה שיצא לחוץ דכחו שלא בכוונה לא גזרו » (שו״ע יו״ד קכ״ה:י״א) The formula comes as it stands from the Gemara:
The Gemara « לא צריכא, דקא מוריק אורוקי, והוה ליה כחו שלא בכוונה, וכל כחו שלא בכוונה לא גזרו ביה רבנן » (עבודה זרה נ״ח ע״ב) and the Rambam turns it into a halakha:
The Rambam « בָּא הַיַּיִן מִכֹּחוֹ שֶׁל עַכּוּ״ם בְּלֹא כַּוָּנָה הוֹאִיל וְלֹא נָגַע בַּיַּיִן הֲרֵי זֶה מֻתָּר בִּשְׁתִיָּה » רמב״ם הלכות מאכלות אסורות פרק י״ב הלכה ו Note the gap, often overlooked: an unintentional contact leaves the wine permitted for benefit only; an unintentional force leaves it permitted even for drinking. This is the best proof that koaḥ and negia are not two degrees of one and the same thing.
The siman’s last line — and the yesod that holds it all The Shach closes the chapter with a responsum of the Rashba, reported by the Tur, on a cask that was already dripping: « שאין היין נשפך מכחו של עובדי כוכבים ולא מרבה בשפיכה בנדנודו שאפי׳ היתה מונחת ע״ג קרקע היתה מטפטפת ומוציאה » (ש״ך יו״ד קכ״ה ס״ק כ״ב) This is not merely a leniency: it is the counterfactual test of seif 4, applied one last time and pressed to its conclusion. What would have happened anyway is not his force — ואין כאן כחו של עובד כוכבים כל עיקר. And the Shach concludes: ולדידן פשוט דשרי. The siman opens with force without contact and closes with motion without force: between the two, it has taught how to tell what comes from a man from what merely happens in his presence.
