Siman 125 measured a man’s force; siman 126 measures no man at all. Two bodies of wine, one of them forbidden, are for a moment joined by a thread of liquid falling from one into the other. Does that thread — the נצוק — make the two a single body? Everything follows from the answer: the threshold of loss that lets one set it aside, a chain of two streams, wine poured into mud, nullification in sixty, the winepress. One question, seven seifim.
The Mehaber gives two reasons in one sentence — and they do not say the same thing The first half of seif 1 is the Rambam word for word: the stream joins.
« המערה יין לתוך כלי שיש בו יין עובד כוכבים האסור בהנאה נאסר כל היין שבכלי העליון שהרי העמוד הנצוק מחבר בין היין שבכלי העליון ובין היין שבכלי התחתון » (שו״ע יו״ד קכ״ו:א)
That is the language of חיבור. The Mehaber then adds a second formula, absent from the Rambam:
« ורואים כאילו יין של האיסור מעורב בשל היתר » (שו״ע יו״ד קכ״ו:א)
That is the language of תערובת. The whole siman lives in the gap between the two halves of the sentence.
The source of the first clause The Rambam writes the physical reason, and nothing more:
« הַמְעָרֶה יַיִן לְתוֹךְ כְּלִי שֶׁיֵּשׁ בּוֹ יֵין עַכּוּ״ם נֶאֱסַר כָּל הַיַּיִן שֶׁבַּכְּלִי הָעֶלְיוֹן. שֶׁהֲרֵי הָעַמּוּד הַנִּצֹּק מְחַבֵּר בֵּין הַיַּיִן שֶׁבַּכְּלִי הָעֶלְיוֹן וּבֵין הַיַּיִן שֶׁבַּכְּלִי הַתַּחְתּוֹן » רמב״ם הלכות מאכלות אסורות פרק י״ב הלכה י״ב
Not a word about mixture: the column of wine joins, full stop. The Shach already notes, in his very first ס״ק, the Mehaber’s other insertion into the Rambam’s words — the three words האסור בהנאה:
« אלא שהכניס המחבר בדבריו האסור בהנאה ובא להוציא יין שאינו אסור אלא בשתייה דלא שייך ביה ניצוק » (ש״ך יו״ד קכ״ו ס״ק א)
Three words, and an entire rule: nitzok operates only on wine forbidden in benefit. We return to this at seif 5 — it is the key to everything.
The chakira that governs all seven seifim(א) חיבור. The stream makes the two wines one body. Then the lower wine’s stringency settles on the upper as such: there is nothing to nullify, and the prohibition reaches as far as it reaches below — as far as benefit. (ב) תערובת. The stream effects nothing; it merely opens a legal fiction, רואין כאילו מעורב. Then the entire law of mixtures applies — sixty, מין במינו, יוליך הנאה לים המלח — and the prohibition can never exceed what a real mixture would have produced. Seifim 5, 6 and 7 are three nafka minot of this single chakira.
The Taz names both branches, and takes a side In his long ס״ק ו he ascribes the first to the יש אומרים cited by the Tur:
« דהא ס״ל דהחומרא שיש בתחתון היא גופה חלה עלה עליון ולא חשבינן להו כמעורבים ולבטל בס׳ » (ט״ז יו״ד קכ״ו ס״ק ו)
and then states the second as the common view:
« ומ״מ לכ״ע הנצוק אינו כמגע עובד כוכבים אלא כתערובות יין » (ט״ז יו״ד קכ״ו ס״ק ו)
Nitzok is not contact — it is a mixture. Held firmly, that one sentence resolves all four of the Beit Yosef’s difficulties against the Tur.

2. סוגיית רב הונא — a derivation that collapses, and a retraction
The entire prohibition of nitzok rests on a single Amoraic statement. Whether that statement survived is another matter. The sugya in perek HaSokher states it, demolishes it, and spends the rest of the daf trying to rebuild it — never once successfully.
The mishnah of Makhshirin, as the Gemara cites it
« הַנִּצּוֹק, וְהַקָּטַפְרֵס, וּמַשְׁקֶה טוֹפֵחַ — אֵינוֹ חִיבּוּר, לֹא לְטוּמְאָה וְלֹא לְטׇהֳרָה. הָאַשְׁבּוֹרֶן — חִיבּוּר לְטוּמְאָה וּלְטׇהֳרָה » (עבודה זרה ע״ב ע״א)
Nitzok is not a connection for tumah. Rav Huna infers, a contrario, that it is one for yayin nesekh:
« אָמַר רַב הוּנָא: נִצּוֹק וְקָטַפְרֵס וּמַשְׁקֶה טוֹפֵחַ חִיבּוּר לְעִנְיַן יֵין נֶסֶךְ » (עבודה זרה ע״ב ע״א)
Rav Nachman overturns the inference by its own symmetry If the first half of the mishnah is read by inverse inference, so must the second be — and the result is precisely the opposite.
« לְטוּמְאָה וּלְטׇהֳרָה הוּא דְּלָא הָוֵי חִיבּוּר, הָא לְעִנְיַן יֵין נֶסֶךְ הָוֵי חִיבּוּר » (עבודה זרה ע״ב ע״א)
then the אימא סיפא: the end of the mishnah would yield that the אשבורן is not a connection for yayin nesekh. The Gemara concludes that the mishnah proves nothing at all.
Four attempts to rebuild it, and what became of them(א) The funnel and the עכבת יין:
« אִם יֵשׁ בּוֹ עַכֶּבֶת יַיִן — אָסוּר. הָא עַכֶּבֶת יַיִן בְּמַאי קָא מִתַּסְרָא? לָאו בְּנִצּוֹק? שְׁמַע מִינַּהּ: נִצּוֹק חִיבּוּר » (עבודה זרה ע״ב ע״ב)

« תָּא שְׁמַע: הַמְעָרֶה מִכְּלִי לִכְלִי, אֶת שֶׁמְּעָרֶה מִמֶּנּוּ — מוּתָּר, הָא דְּבֵינֵי בֵּינֵי — אָסוּר. שְׁמַע מִינַּהּ: נִצּוֹק חִיבּוּר » (עבודה זרה ע״ב ע״ב)

(ג) The barrel emptied into the pit — Rav Sheshet refers it to koach, not to nitzok:
« כֹּחַ דְּגוֹי מִדְּרַבָּנַן הוּא דַּאֲסִיר, הַהוּא דִּנְפַק לְבָרַאי — גְּזַרוּ בֵּיהּ רַבָּנַן, הַהוּא דִּלְגַוַּאי — לָא גְּזַרוּ בֵּיהּ רַבָּנַן » (עבודה זרה ע״ב ע״ב)

« שָׁמְעַתְּ מִינַּהּ נִצּוֹק חִיבּוּר? שָׁאנֵי הָתָם, דְּכוּלֵּי חַמְרָא אַגִּישְׁתָּא וּבַת גִּישְׁתָּא גְּרִיר » (עבודה זרה ע״ב ע״ב)
The Rosh’s chakira: did Rav Huna retract?(א) His statement is a thesis, supported by a proof; the proof falls, the thesis stands. (ב) His statement is the proof — he said nothing beyond a דיוק; the דיוק falls, and nothing remains. The Rosh holds the second branch, and says so plainly.
The Rosh
« כי רב הונא לא אמר מסברא ומגמרא דנצוק הוי חבור. אלא דרך משא ומתן רצה להוכיח מן המשנה מדקתני לטומאה ולטהרה. והוכיח לו רב נחמן דהא דיוקא ליתא וחזר בו רב הונא » (רא״ש על עבודה זרה, פרק השוכר את הפועל, סימן כ״ו)
and he adds an internal proof: elsewhere in the tractate the Gemara still asks whether nitzok is a connection — which it would not do had Rav Huna settled the matter.
« ומאי בעי הא ודאי רב הונא אית ליה הכי. אלא ש״מ דקים ליה לתלמודא דרב הונא חזר בו » (רא״ש על עבודה זרה, פרק השוכר את הפועל, סימן כ״ו)
Nafka mina If Rav Huna retracted, then nowhere in the Talmud does a single Amora state that nitzok is a connection. The prohibition becomes a reception from the Geonim — and that is exactly how the Beit Yosef will ground it. It also explains why a substantial loss will suffice, at seif 2, to lift it: a demonstrated rule is not so easily set aside; a received one is.
3. ההכרעה — Rashi, the Geonim, the Rif and the Rambam against Rabbeinu Tam
The sugya leans toward leniency; the halakha rules stringently. That gap, rare and openly acknowledged, is the most instructive fact in the siman — and the Rosh states it with a candour one does not often meet.
The two camps The Tur sets them face to face in two lines.
« הניצוק פסק רש״י דהוי חיבור וכן דעת רב אלפס » (טור יו״ד קכ״ו)
« ור״ת פסק דניצוק לא הוה חיבור ומסקנת א״א הרא״ש ז״ל כרש״י » (טור יו״ד קכ״ו)
The Rif, in his own text, rules without debate:
« אמר רב הונא נצוק לטומאה ולטהרה לא הוי חבור לענין יי״נ הוי חבור » (רי״ף על עבודה זרה, פרק השוכר את הפועל)
and the Rambam codifies it without even noting that there had been a dispute — it is the text of seif 1.
What Rabbeinu Tam holds, and on what grounds Tosafot first report the position:
« ופסק רש״י כרב הונא דאמר נצוק חיבור מדסבר רב חסדא הכא כוותיה ומעשה רב אבל ר״ת פסק דנצוק אינו חיבור » (תוספות עבודה זרה ע״ב ע״ב ד״ה אמר להו רב חסדא)
then the strongest argument, one of method rather than of text:
« ועוד מביא ר״ת ראיה דנצוק אינו חיבור מדפריך תלמודא בכל דוכתין ש״מ נצוק חיבור משמע דקשה לתלמודא לאסור בנצוק » (תוספות עבודה זרה ע״ב ע״ב ד״ה אמר להו רב חסדא)
Every time the Gemara concludes ש״מ נצוק חיבור, it does so as an objection. A conclusion the sugya always receives as a difficulty is not a conclusion it holds.
The Rosh concedes the sugya and rules against it This is the most remarkable sentence in the siman:
« וראיות אילו נכוחות וברורות אלא שהגאונים ורש״י פסקו דנצוק חבור. וכן דעת רב אלפס » (רא״ש על עבודה זרה, פרק השוכר את הפועל, סימן כ״ו)
He does not refute Rabbeinu Tam: he agrees with him, and follows the other road all the same. The halakha here is not the conclusion of the argument; it is the reception of a tradition.
The Beit Yosef names the principle He cites the Rosh, then the Rashba:
« והרא״ש כתב על דברי ר״ת ראיות אלו נכוחות וברורות אלא שהגאונים ורש״י פסקו דניצוק חיבור וכן דעת רי״ף וכ״פ הרשב״א בת״ה » (בית יוסף יו״ד קכ״ו)
« וכתבה שאין לזוז מקבלתן של גאונים ז״ל שקבלתן תורה שלימה » (בית יוסף יו״ד קכ״ו)
“One must not budge from the reception of the Geonim, for their reception is an entire Torah.” And he rules:
« ולענין הלכה כיון דהרי״ף והרמב״ם וכל הני רבוותא מסכימים לאסור ניצוק הכי נקטינן וכן פשט המנהג » (בית יוסף יו״ד קכ״ו)
A slip of the Ran, caught by the Beit Yosef The Ran wrote that Rabbeinu Tam too holds the halakha follows Rav Huna. The Beit Yosef is astonished — and the two closest witnesses are with him:
« וכתב שר״ת סובר כן דהלכה כרב הונא וזה תימה בעיני שהתוספות והרא״ש כתבו שר״ת הוא פוסק דאין הלכה כרב הונא » (בית יוסף יו״ד קכ״ו)
A lesson in method: when one Rishon reports another’s view, one goes and checks that other’s own words.
Nafka mina A received prohibition behaves differently from a demonstrated one. Three immediate consequences, all in this siman: it is lifted in case of substantial loss (seif 2); it is not extended to a stream of a stream (seif 3); it is not applied to wine forbidden only for drinking (seif 5). Three refusals to extend, for one and the same reason.
4. קנישקנין — the question that measures the reach of nitzok
If nitzok joins, why does the Gemara permit drinking from a two-spouted vessel together with a non-Jew? The Raavad’s answer, reported by the Ran, does not merely save that case: it gives nitzok its geometry, and through it both the kittuf of seif 1 and the nitzok bar nitzok of seif 3 become intelligible.
The difficulty
« אָמַר מָר זוּטְרָא בְּרֵיהּ דְּרַב נַחְמָן: קְנִישְׁקְנִין שְׁרֵי, וְהָנֵי מִילֵּי דִּקְדֵים פְּסַק יִשְׂרָאֵל, אֲבָל קְדֵם פְּסַק גּוֹי — לָא » (עבודה זרה ע״ב ע״ב)
and the Beit Yosef states the objection at full strength:
« דודאי חיבורו של כלי לא גרע מחיבורו של ניצוק » (בית יוסף יו״ד קכ״ו)
A vessel’s connection is surely no weaker than a stream’s: if a falling stream joins, wine in a single cup is joined all the more.
The Raavad’s answer, reported by the Ran
« דכי אמרינן ניצוק חיבור ה״מ מאי דאתי בההוא פתחא או בההוא ברזא. אבל בהאי קנישקנין מאי דאתי בברזא דישראל לא אתי בברזא דנכרי ומש״ה לא הוי חיבור » (בית יוסף יו״ד קכ״ו)
Nitzok joins only what comes through the same opening, through the same tap. In the kanishkanin, what the Jew draws does not come through the non-Jew’s spout: two paths, no connection.
The yesod: nitzok is a path, not a volume It is not the wine’s proximity that joins, nor its being in one container: it is the continuity of a single flow. Three consequences follow, and they cover half the siman. (א) Cutting the stream dissolves the bond — עירה וקיטף, seif 1. (ב) A second stream opens a second path, and the first does not reach the third vessel — seif 3. (ג) Where the Gemara did forbid all the wine, it was careful to say this was not on account of nitzok but because כולי חמרא אגישתא ובת גישתא גריר.
5. עירה וקיטף — how a stream is broken, and at what moment
Seif 1 ends with a practical manoeuvre. It looks like a detail of the trade; in fact it is the crucial experiment for the chakira, because it asks at what moment the bond is formed.
The Mehaber’s language
« ואם עירה וקיטף שקודם שנגע בשל האיסור הפסיק קלוח היורד מהיין של היתר מותר » (שו״ע יו״ד קכ״ו:א)
The source The Gemara already uses it as an answer:
« אִי נִצּוֹק חִיבּוּר, אֲפִילּוּ דְּגַוֵּיהּ דְּמָנָא נָמֵי לִיתְּסַר! הָא לָא קַשְׁיָא, דְּקָא מְקַטֵּיף קַטּוֹפֵי » (עבודה זרה ע״ב ע״ב)
and Rav Chisda makes it an instruction to the wine merchants:
« אֲמַר לְהוּ רַב חִסְדָּא לְהָנְהוּ סָבֹיָתָא: כִּי כָיְילִיתוּ חַמְרָא לְגוֹיִם — (קָטְפִי) [קַטִּיפוּ] קַטּוֹפֵי, אִי נָמֵי (נָפְצִי) [נַפִּיצוּ] נַפּוֹצֵי » (עבודה זרה ע״ב ע״ב)
The Rambam turns it into a rule of practice
« לְפִיכָךְ הַמּוֹדֵד לְעַכּוּ״ם לְתוֹךְ כְּלִי שֶׁבְּיָדוֹ יְנַפֵּץ נְפִיצָה אוֹ יִזְרֹק זְרִיקָה כְּדֵי שֶׁלֹּא יִהְיֶה נִצֹּק חִבּוּר וְיֶאֱסֹר עָלָיו מַה שֶּׁיִּשָּׁאֵר בַּכְּלִי הָעֶלְיוֹן » רמב״ם הלכות מאכלות אסורות פרק י״ב הלכה י״ב
Two techniques, not one: shaking, or throwing. One breaks the stream’s continuity, the other prevents it from forming.
The chakira Does קיטוףprevent the bond from forming, or undo it once formed? An immediate nafka mina: wine that has already reached the bottom before the top is cut. Rashi, as Tosafot report him, decides — and his answer is final.
Rashi, as reported by Tosafot One must cut above before the head of the stream reaches below:
« שיפסוק ראש העליון של נצוק מכליו של ישראל קודם שיגיע ראש התחתון לכליו של עובד כוכבים » (תוספות עבודה זרה ע״ב ע״ב ד״ה אמר להו רב חסדא)
and if he did not act first:
« תו לא מהני קיטוף דנצוק חיבור » (תוספות עבודה זרה ע״ב ע״ב ד״ה אמר להו רב חסדא)
Kittuf undoes nothing; it merely prevents. Once the connection has formed there is no remedy: it has taken hold, and it is irreversible.
Nafka mina A Jew measures wine into a non-Jew’s vessel. If he cuts off the flow at the moment the stream is already touching the bottom, the kittuf avails him nothing and the remainder of his cask is implicated. Hence the Rambam’s preference for zerika: one who throws never formed a column at all.

Seif 2 does what few seifim dare: with a single word it withdraws the general force of the seif before it. Nitzok holds only where the loss is slight. What counts as a slight loss remains to be settled — and here the Terumat HaDeshen, the Rama, the Shach, the Taz and the Levush do not agree.
The Mehaber’s language
« הא דנצוק חבור ה״מ בהפסד מועט אבל בהפסד מרובה כגון שהוציא מהחבית לכלי שיש בו יין נסך מותר » (שו״ע יו״ד קכ״ו:ב)
Where the clause comes from It is old: the Maharam of Rothenburg practised it, following the great men of France.
« ור״מ היה נוהג ע״פ גדולי צרפת דבהפסד מרובה היה מתיר נצוק כגון אם משך מן החבית לכלי שיש בו יין נסך אבל לא בהפסד מועט » (רא״ש על עבודה זרה, פרק השוכר את הפועל, סימן כ״ו)
Tosafot state the same thing:
« והשתא במקום שיש הפסד גדול יש לסמוך על דברי ר״ת להתיר מגע עובד כוכבים ע״י נצוק אבל בהפסד מועט יכול להחמיר כדברי רש״י » (תוספות עבודה זרה ע״ב ע״ב ד״ה אמר להו רב חסדא)
The chakira: is loss measured by volume, or by money not recovered?(א) An absolute measure: a cask is a cask and a cup is a cup; quantity decides. (ב) A net measure: what counts is what cannot be recouped; if the wine can be sold, even a large cask, the loss is slight. The Terumat HaDeshen states both in turn — and they contradict each other in the commonest case, a large cask saleable at a discount.
The Terumat HaDeshen’s two criteria, as the Beit Yosef reports them
« דכל מה שהוא בחבית הן גדולה הן קטנה חשיב הפסד מרובה לאפוקי מה שהוא בכד או בקנקן » (בית יוסף יו״ד קכ״ו)
and immediately after, the opposite criterion:
« מיהו כתב דהיכא דאיפשר למכור לנכרי אפילו חבית גדולה חשיב הפסד מועט הואיל ואיפשר לימכר ואע״פ שצריך לזלזל קצת במכירה » (בית יוסף יו״ד קכ״ו)
and finally his own retreat, which is a third position:
« אמנם איפשר דבי״נ דאקילו ביה רבוותא בזמן הזה בכמה דוכתי לא דייקינא כולי האי להחמיר » (בית יוסף יו״ד קכ״ו)
summary: in yayin nesekh, where the great authorities have already been lenient in many places, one does not press the analysis so far toward stringency. The Beit Yosef cites Terumat HaDeshen siman רל״ד; the Rama’s gloss and the Taz write ת״ה סימן ר״ד.
The Rama decides: the container is the measure
« ואין חילוק בין אם היה הרבה יין בחבית או לא ואפי׳ יכול למכרו לעובד כוכבים וכל מה שהוא בקנקן או בכוס מקרי הפסד מועט » (רמ״א יו״ד קכ״ו:ב)
Three rulings in one line. The quantity of wine in the cask is irrelevant; the possibility of resale is irrelevant; what decides is the vessel — a cask, or else a jug and a cup. He then restricts all of it to yayin nesekh alone:
« ודוקא ביין נסך אבל בשאר איסורים אם יכול למכרו לעובד כוכבים ואין בו הפסד מרובה לא מיקרי הפסד מרובה » (רמ״א יו״ד קכ״ו:ב)
The Shach follows step by step On the leniency:
« אבל בהפסד מרובה כו׳. סמכי׳ אהפוסקים המתירים » (ש״ך יו״ד קכ״ו ס״ק ב)
On selling at a discount:
« ואפילו יכול למכרו לעובד כוכבים. אלא שצריך לזלזל קצת במכירה לעובד כוכבים » (ש״ך יו״ד קכ״ו ס״ק ג)
And he gives the Terumat HaDeshen’s twofold reason for confining this to yayin nesekh:
« דאקילו ביה רבוותא בזמן הזה בכמה דוכתי ותו דלא שייך כ״כ למיחשבי׳ הפסד מועט משום דאפשר למכור לעובד כוכבים » (ש״ך יו״ד קכ״ו ס״ק ד)
« ומש״ה נחמיר לשויה יי״נ חומרא דאתי לידי קולא הוא דכמה רבוותא אסרו למכור יין הנאסר במגע עובד כוכבים לעובד כוכבים » (ש״ך יו״ד קכ״ו ס״ק ד)
The Taz sorts the two reasons — one still holds, the other does not The Terumat HaDeshen’s second reason assumed it is forbidden to sell a non-Jew wine he has touched. The Taz observes that we no longer hold so:
« וטעמא בתרא אינו שייך לדידן » (ט״ז יו״ד קכ״ו ס״ק א)
since
« דסתם יינם מותר בהנאה בזמן הזה » (ט״ז יו״ד קכ״ו ס״ק א)
But the first reason stands perfectly:
« מ״מ טעמא קמא דת״ה הוא מתיר לנו דמקולי יין בזמן הזה שנו כאן וחשבינן זה להפסד מרובה מה שצריך למכור בזול לעובדי כוכבים » (ט״ז יו״ד קכ״ו ס״ק א)
summary: the leniencies proper to wine in our time apply here, and having to sell at a low price counts as a substantial loss.
Taz against the Levush: what is to be done with the wine where the loss is slight? The Levush would have him pour it out rather than sell it to a non-Jew — since it was precisely the doubt over that sale which served to be lenient elsewhere. The Taz finds the reasoning unsound and turns it around:

and draws the consequence in a biting phrase: on the Levush’s view a rabbinic rule would become

Nafka mina A cup of wine has been touched, through a stream, by forbidden wine. A cup’s worth is a slight loss, so the stringency of seif 1 applies. But what is to be done with the cup? On the Levush’s view, pour it out. On the Taz’s, it may plainly be sold — and even the strictest authorities would concede as much here, since the prohibition itself is only probable.
Five words for a whole seif, and one of the most useful rules in the chapter. It is also the best test of the yesod of seif 4: were nitzok a bond of substance, a chain would be a chain. It is not, because nitzok is a bond of path.
The source: Rashbam and Rivan in Rashi’s name, from the strainer sugya The Beit Yosef reports the proof — the holes of the גרגותני are narrow and set in the side, so that there is one stream from the press to the strainer and a second from the strainer to the pit:
« והכא הוי ניצוק בר ניצוק כי נקבי הגרגותני דקין ועומדין מן הצד » (בית יוסף יו״ד קכ״ו)
Rivam rejects the proof, but the Rosh and Tosafot do not follow him:

and the Beit Yosef concludes:

Three pens, one case: the jug is caught by the stream descending into the non-Jew’s flask; the vessel that filled the jug is not.
The chakira Why does the second stream not extend the first? (א) Because the bond weakens with distance — but then it would have to be graded, and no one grades it. (ב) Because the גזירה has a bounded reach, and was only ever pronounced upon a direct flow. The halakha takes the second branch — and it is the very logic of לא גזרו ביה רבנן in seif 4: what is within was never reached by the decree.
Nafka mina A chain of three vessels. The second is caught, the first is not — and is permitted even for drinking, as the Beit Yosef specifies in the Rashba’s name. An immediate practical consequence: one never traces a chain of pourings back beyond a single link.

8. הנצוק ההולך לאיבוד — the mud, and what it annuls
Seif 4 steps for a moment out of the register of connection and into that of the form of the act. A non-Jew pours wine into mud: nothing is caught, neither what goes out nor what stays. Then the seif reverses: if someone else was pouring and the non-Jew touches the stream, all is forbidden. Two reasons compete over that reversal, and they do not yield the same nafka minot.
The Mehaber’s language
« אם העובד כוכבים מערה יין מכלי לטיט או לאשפה או למקום לכלוך אין דרך נסוך בכך והכל מותר בין מה שיצא לחוץ בין מה שבפנים » (שו״ע יו״ד קכ״ו:ד)
and the reversal:

The chakira: what does the mud annul?(א) The form of the act. One does not libate onto something repellent; the gesture has no shape of nissukh and does not count — a case of אין דרך ניסוך בכך. (ב) The status of the wine. In pouring it to waste he himself demoted it: he made it water. It is not the form that is lacking, but the object that has ceased to be wine.
The first reason — the Rashba, as the Beit Yosef reports him
« שאין דרכן של מנסכים לנסך על גבי דבר המאוס » (בית יוסף יו״ד קכ״ו)
The second reason — the Raavad and his tradition The Taz quotes his words:
« מסורת בידי מרבותי ומאבינו שבשמים שלא התירו אלא כח שפיכתו בזמן שהוא שופך אותו לאיבוד דנעשה בשפיכתו כזורק מים לטיט » (ט״ז יו״ד קכ״ו ס״ק ה)
and the Beit Yosef gives the reason in five words:
« דהא נעשה בשפיכתו כזורק מים לטיט דהא בטליה מחשיבותיה » (בית יוסף יו״ד קכ״ו)
The two reasons part company in two cases(א) The non-Jew pours into the mud himself and touches the stream. The Shach rules leniently, and this is the second reason:
« דאפילו נגע העובד כוכבים זה שמערהו לטיט הכל מותר שכיון שהוא בעצמו שופכו לאיבוד הרי בטלי׳ מחשבתיה ושויה כמים בעלמא ואין כאן מחשבת ניסוך כלל » (ש״ך יו״ד קכ״ו ס״ק ז)
(ב) Another pours, and a second non-Jew touches. The Taz cites the Raavad:
« ומכלל זה שכל שהעובד כוכבים נוגע בו בענין אחר אע״פ שהולך מעצמו לאיבוד בין ע״י ישראל או ע״י עובד כוכבים אחר ובא עובד כוכבים ונגע בקלוחו אסור דהא עובד כוכבים בתרא לא בטליה » (ט״ז יו״ד קכ״ו ס״ק ה)
The last one annulled nothing at all — and so he libates.
Mud and bare ground Pouring onto bare earth is not pouring into filth: on the contrary, that is just what idolaters do before their idols. The Shach:
« אבל ע״ג קרקע לא שאף הם מזלפין ע״ג קרקע לפני עבודת כוכבים שלהן » (ש״ך יו״ד קכ״ו ס״ק ו)
and the Taz says the same:
« אבל שלא במקום לכלוך הוי דרך ניסוך שאף הם מזלפים על הקרקע לפני עבודת כוכבים שלהם » (ט״ז יו״ד קכ״ו ס״ק ד)
The Shach, correcting the Levush, states the principle of the siman The Ateret Zahav had written that the stream poured onto the ground is forbidden by contact, and what remains inside by nitzok. The Shach accepts the outcome but rejects the explanation, and his argument is the heart of the chapter: what went out is forbidden only by koach, hence only for drinking; and
« דניצוק אינו אוסר אלא ביין האסור בהנאה » (ש״ך יו״ד קכ״ו ס״ק ו)
Wine forbidden for drinking alone can transmit nothing by nitzok. This is why the Mehaber added the three words האסור בהנאה in seif 1; and why the Shach, in siman 125, left the gloss extending nitzok to koach standing under a צריך עיון.
The Raavad against the Mordechai The Raavad’s whole construction assumes that wine going to waste of itself remains forbidden so long as no one has demoted it. The Beit Yosef notes that the Mordechai holds the opposite:
« ומיהו מדברי המרדכי בפסק רבי ישמעאל גבי חבית דפקעה לארכה נראה דניצוק ההולך לאיבוד מאליו מותר ושלא כדברי הראב״ד » (בית יוסף יו״ד קכ״ו)
The Rosh, for his part, had already refused to extend nitzok to koach, and it is the same restraint:
« ומשום נצוק לא מיתסרא דלא החמירו כולי האי בכח עובד כוכבים לאסור המחובר לו על ידי נצוק » (רא״ש על עבודה זרה, פרק השוכר את הפועל, סימן כ״ה)

9. שלוש שיטות — the central machloket of the siman, and the Taz’s reconstruction
Seif 5 is the decisive one. It appears to treat a marginal case — wine poured into a non-Jew’s unrinsed vessel — and in fact it settles the chakira of the siman. Three positions collide, the Beit Yosef presses four difficulties on the Tur, and the Taz resolves them all at a stroke in the longest ס״ק of the chapter.
The Mehaber’s language
« המערה יין לתוך כלי של עובד כוכבים שלא הודח ואין בו משקה טופח את שעירה בו אסור בשתייה ואת שעירה ממנו מותר אפי׳ בשתייה » (שו״ע יו״ד קכ״ו:ה)
Position א׳ — the יש אומרים: maximal stringency The Tur reports them:
« ויש אומרים דניצוק אפילו לסתם יין אוסר הכל בהנאה » (טור יו״ד קכ״ו)
The Taz explains their sevara, and it is the chibur branch in its pure form:
« דהא ס״ל דהחומרא שיש בתחתון היא גופה חלה עלה עליון ולא חשבינן להו כמעורבים ולבטל בס׳ » (ט״ז יו״ד קכ״ו ס״ק ו)
This is no mixture: the lower wine’s stringency settles on the upper as such, as though it had itself become stam yeinam.
Position ב׳ — the Rashba: maximal leniency The Tur abridges him:
« והרשב״א כתב בשם הגאונים דניצוק לא חשוב חיבור אלא במערה לתוך יין נסך גמור אבל המערה לתוך כלי של נכרי שלא הודח הנשאר בו מותר אפי׳ בשתייה » (טור יו״ד קכ״ו)
The Beit Yosef gives his own, clearer words:
« איסור ניצוק אינו אלא מדין חיבור ולפיכך אם נעשה ניצוק לסתם יינם הכל מותר בהנאה אבל אם נעשה הניצוק לודאי יינם אסור בהנאה כאילו נתערבו זה בזה » (בית יוסף יו״ד קכ״ו)
then the criterion:

The Beit Yosef’s difficulties against the Tur First: the Tur opens with certain wine and ends with the unrinsed vessel, skipping the middle case.

Second, and weightier: what use is יוליך הנאה, when nothing is actually mixed?
« שתיקונים אלו לא שייכי אלא ביין המעורב ממש עם סתם יינם שא״א להבדילם זה מזה » (בית יוסף יו״ד קכ״ו)
The Taz’s answer, and it is masterly He begins by turning the difficulty back on its author: the Beit Yosef should have raised it against himself first, since in seifim 6 and 7 he codifies nullification in sixty against a stream that is no more mixed than this one.
« ולמה לא הקשה ב״י היאך שייך בגת ביטול בששים נגד הקילוח והא הקילוח אינו מעורב שם » (ט״ז יו״ד קכ״ו ס״ק ו)
Then he supplies the key, by an analogy that decides everything:
« דבר ברור הוא דחכמים עשו חיבור הניצוק ביין נסך כהיתר הבלוע איסור על ידי שהוא רותח דקי״ל אף שהאיסור הוא בשלימותו בעינן ששים נגד כולו כן ממש עשו חכמים חומרא בזה וצריכים ס׳ לבטל הקילוח כאילו הוא ממש שם » (ט״ז יו״ד קכ״ו ס״ק ו)
summary: nitzok is like a prohibition absorbed by heat. The prohibited substance remains whole and is mixed with nothing — and yet sixty is required against all of it. Nitzok is exactly of that kind: a fiction of mixture, carrying a mixture’s measures.
And the second half of the answer If the fiction serves for nullification, it serves equally where nullification fails:
« וכן לענין אם אין שם ס׳ אנו רואין כאלו חלק מן ההיתר שלמעלה נעשה איסור ממש » (ט״ז יו״ד קכ״ו ס״ק ו)
This is why the Tur’s יוליך הנאה makes sense: a portion of the upper wine is deemed to have become forbidden, and it is that portion one carries to the sea. The Taz concludes:
« על כן יפה פסק רמ״א כאן ואם הוא סתם יינם בטל בס׳ » (ט״ז יו״ד קכ״ו ס״ק ו)
He finally clarifies the Rashba’s position on the unrinsed vessel:
« אבל במערה לתוך כלי שלא הודח שאין שם יין גמור אלא בליעה לחוד מיקל הרשב״א שכאן אין חיבור לגמרי והעליון מותר אפילו בשתייה » (ט״ז יו״ד קכ״ו ס״ק ו)
The Shach, on the criterion of the lower wine He states the Rashba’s rule:
« שלא אמרו נצוק חבור אלא המערה לתוך יי״נ האסור בהנאה » (ש״ך יו״ד קכ״ו ס״ק ט)
and then a very fine point. Nowadays all stam yeinam is permitted in benefit; nitzok should therefore have nothing to act upon. The Shach answers:

summary: what decides is not the actual status of the lower wine but its status in law. A chakira in itself — and the Shach treats it as obvious.
Nafka mina A Jew measures wine into a non-Jew’s unrinsed vessel. On the יש אומרים view all is forbidden in benefit; on the Tur’s, what remains in the upper vessel is forbidden for drinking; on the Rashba’s, followed by the Mehaber, it is permitted even for drinking. The Mehaber rules with the Rashba, and the Taz explains why: where there is no wine in substance but only absorption, there is no nitzok at all.
10. משקה טופח — the Rama’s gloss against the Beit Yosef’s own leaning
The Mehaber set his case in a vessel without moisture. The Rama completes it: and if there is some? The answer requires a threshold — and here the gloss parts from what the Beit Yosef, in his commentary, had written for himself.
The gloss
« ואם יש בו כדי להטפיח אסור בנצוק » (רמ״א יו״ד קכ״ו:ה)
and its second half, which is by itself a ruling on the chakira:
« מיהו אינו אוסר יותר מאילו היה מעורב בו ואם הוא סתם יינם בטל בס׳ כמו שיתבאר בסימן קל״ד » (רמ״א יו״ד קכ״ו:ה)
“It forbids no more than had it been mixed in” — that is: the fiction never exceeds its model. The ta’arovet branch, unambiguously.
The threshold: משקה טופח or טופח על מנת להטפיח? The Beit Yosef, reasoning from Rav Huna’s own statement, leans to the lower threshold:
« משמע לי דאפילו בשיש בו משקה טופח אוסר משום ניצוק ואע״פ שאין בו כדי להטפיח » (בית יוסף יו״ד קכ״ו)
but he at once reports the contrary requirement:
« אבל רבינו ירוחם הצריך טופח ע״מ להטפיח לאסור משום ניצוק » (בית יוסף יו״ד קכ״ו)
The Rama codified Rabbeinu Yeruḥam — the higher threshold — against the leaning the Beit Yosef expressed in his own commentary. The gloss even lists its authorities, and they are many: Rabbeinu Yeruḥam, the Semag, Tosafot, the Rosh.
And this closes the circle of the sugya in §2 The argument of Tosafot and the Rosh against Rav Huna lay exactly here: the דיוק drawn from his mishnah cannot hold for משקה טופח, since in practice the halakha plainly requires טופח על מנת להטפיח. A דיוק that fails for one clause fails for the other. In requiring כדי להטפיח, then, the Rama applies to the letter the reasoning of those who rejected nitzok — while keeping nitzok.
The Shach adds an exception
« ואם הוא כלי שמכניסו לקיום אפילו בטופח לחוד הוי חבור » (ש״ך יו״ד קכ״ו ס״ק י)
In a vessel used for storing wine, mere moisture suffices. The reason is plain: there the walls’ absorption is real and lasting, and one is no longer in nitzok but very near to beli’ah.

11. ששים או ששה — a machloket over the printed text of the Shulchan Arukh
Seif 6 applies the ta’arovet branch to a concrete case, and gives a number. That number the Shach cannot reconcile with what the same author writes elsewhere — and in the end he suspects the printer.
The Mehaber’s language
« קנקן יין שיש בו קיתון של מים ועירה ממנו לתוך צלוחית שיש בו יין של עובד כוכבים אם יש במים של קנקן לבטל היין שבצלוחית מותר » (שו״ע יו״ד קכ״ו:ו)

Why water, and not wine? The Taz answers, and his answer is a dating:
« דהיין אינו מבטל היין האסור דמין במינו הוא ולא בטיל גבי יין אבל לדידן דקי״ל » (ט״ז יו״ד קכ״ו ס״ק ז)
« דבטיל לא צריך כאן מים » (ט״ז יו״ד קכ״ו ס״ק ז)
summary: wine cannot nullify wine, being מין במינו; hence the need for water. But for us, who hold that stam yeinam is nullified, the water is no longer required. The seif describes a state of the law the Taz already regards as past.
The Shach suspects a misprint — and he is not alone Some editions carry here a note referring to siman 134, where the threshold is not sixty but six parts. The Shach lays out the difficulty and its history:
« והפסקים סותרים זא״ז וכן הקשה הב״ח בקונטרס אחרון ופסק דסגי בששה חלקים והיה נראה להגיה כאן ששה וכן הוא בש״ע דפוס הענאוי אך בעט״ז כתוב בפירוש ששים תרי זימני וצ״ע » (ש״ך יו״ד קכ״ו ס״ק י״א)
summary: the Bach, in his Kuntres Acharon, raised the same contradiction and ruled that six parts suffice; one would be inclined to emend “six” here, and the Henau printing indeed reads so; but the Ateret Zahav writes “sixty” twice over — צריך עיון.
Nafka mina A tenfold difference in the threshold of nullification, and it issues from a printing variant. Substantively the question is this: does nitzok fall under the general law of mixtures (sixty) or under the leniency proper to stam yeinam in our time (six parts)? The Shach leaves it open; the Bach rules for six; the received text of the Shulchan Arukh reads sixty.

12. סלק את מינו — the press, and the tzarikh iyun that closes the siman
The last seif is the most technical and the most revealing. A non-Jew touches the stream descending from the press into the pit. The stream is nullified against the stalks, pips and grapes — not against the wine, which is of its own kind. The Shach finds here a contradiction the Rama could not have missed, and ends the siman with a צריך עיון addressed to the Rashba himself.

The Shach’s תימה against the Rama The device of סלק את מינו makes sense only for one who holds, like the Tur, that stam yeinam mixed with its own kind is forbidden in the smallest quantity. But the Rama himself holds it is nullified in sixty.

If everything is nullified in sixty, the wine of the press counts too — and there is no need to “remove the kind” at all.
Two resolutions, and the Shach gives both(א) The seif states the law of the Talmud, not that of our time; the Rama’s gloss in siman 134 expressly addresses our era. (ב) A view reported by the Hagahot Maimoniyot distinguishes within stam yeinam itself:
« משמע להדיא דאפילו למ״ד סתם יינם אינו בטל בס׳ היינו דוקא יין שנגע בו עובד כוכבים שנתערב אבל נצוק בטל בס׳ לכ״ע » (ש״ך יו״ד קכ״ו ס״ק י״ג)
That is: what the non-Jew touched is not nullified; what is forbidden only by nitzok is nullified in sixty according to all. This is, in another idiom, the Taz’s thesis in ס״ק ו: nitzok is not contact but mixture.
The closing צריך עיון, and it is aimed at the Rashba The Shach ends the siman with an objection of Tosafot that neither the Rashba nor the Tur nor the Mehaber adopted:
« ומ״מ הא דס״ל להרשב״א דאם נגע בקילוח מבטלין בס׳ ונמשכו לדעתו הט״ו צ״ע לדינא » (ש״ך יו״ד קכ״ו ס״ק י״ג)
Tosafot had drawn a distinction the halakha of our seif does not know:

and they confine the forbidding nitzok to the case of direct contact alone:

The final chakira: two nitzoks, or one?(א) One. The stream joins, and what happened upon it is immaterial: the fiction of mixture always works the same way, and nullification in sixty applies throughout. That is the Rashba, and that is seif 7. (ב) Two. There is the nitzok that carries a mixture — nullified as a mixture — and the nitzok the non-Jew has touched: there his hand reached the stream, and through it the whole cask, as though he had touched the cask. That is Tosafot, and the Shach left it standing against the received halakha.
The Rashba’s responsum on the lees, and the reach of the principle The Beit Yosef reports the question — are the lees settled at the bottom of the cask a different kind? — and the answer:
« מסתברא שהשמרים כל שלא נתמדו ולא עברו עליהם יב״ח דין יין יש להם ושמרי יין מיקרי וכאילו לא נשתנה שמם » (בית יוסף יו״ד קכ״ו)
then the general principle:
« שכל שנאסר מחמת האיסור מבטל את האיסור ומצטרף לבטל את האיסור » (בית יוסף יו״ד קכ״ו)
and the Shach extends the press ruling to a cask:
« וה״ה חבי׳ כדמוכח מתשובת הרשב״א שהביא הב״י ס״ס זה ופשוט הוא » (ש״ך יו״ד קכ״ו ס״ק י״ב)
The Beit Yosef’s last line — and the yesod of the siman In the Bedek HaBayit, on that same responsum, he notes in passing a consequence that amounts to a summary of the whole chapter:
« ולפי מה שנתבאר בסימן זה דכל גדול כמו חבית אין בו משום ניצוק חיבור לא נפקא לן בהך תשובה מידי » (בית יוסף יו״ד קכ״ו)
summary: since it has been established in this siman that nothing as large as a cask is subject to nitzok, the responsum teaches us nothing further. The sentence is extraordinary: it registers what seif 2 did to seif 1. A prohibition received rather than demonstrated, bounded to the path of a single stream, withdrawn wherever there is loss, refused to wine forbidden only for drinking, and nullified in sixty by whatever is not of its kind — that is all that remains, at the siman’s end, of the statement Rav Nachman had already dismantled in its first line.
