1. The axiom: one man's word costing another man a barrel

The starting point:

Simanim 123 to 126 asked what makes wine forbidden — contact, force, mixture, the connecting stream. Siman 127 shifts the register: it no longer asks what happened, but who is entitled to say that it happened. A man comes and announces to his fellow that his wine has become forbidden. He is one. Nobody saw him see. And his sentence, once received, costs a barrel to somebody who is not him.

So the Mehaber opens with the very question of the heading — אם נאמן האדם לאסור יינו של חבירו — and settles it in two seifim; then, in seifim 3 and 4, he leaves wine behind and lays down the general rule of the single witness, which governs all of Yoreh De'ah.

💡 The marker: two regimes never to be blurred. Ordinary testimony requires two mouths and cannot stand contradicted; here the matter is an issur, where one mouth suffices — but on measured conditions. Wherever the siman looks strict, one of those conditions is met; wherever it looks lenient, one is missing.

⚖ The two engines of credibility in seif 1

  1. בידו — the wine is in his hands. The ש״ך fixes what that means and rules out the misreading: summary : the wording of the טור is that it was handed to him for safekeeping, not that it lies in his power to make it forbidden (ש״ך יו״ד קכ״ז ס״ק א). Yet he also brings the opposite reading, that of רש״י, רבנו תם and הרשב״א, on which the credibility flows precisely from his having been able to forbid it himself — that is, from a מיגו.
  2. The first meeting — if the wine is no longer his to hold, he must have spoken the moment he saw the owner again. Whatever he says later cannot stand against a denial. And the ש״ך makes this branch a narrow one: summary : it holds for a man who once had the wine in hand; a stranger who never had it is believed, even at the first meeting, only where the owner keeps silent (ש״ך יו״ד קכ״ז ס״ק ה).
Keep the נפקא מינה that closes his first ס״ק: one who says of cooked wine that it was made forbidden before the cooking is not believed even while the wine is in his hands — for cooked wine he can no longer forbid, and the מיגו is gone.

2. The 3 reflex questions

■ 1. WHO IS SPEAKING, AND IS THE WINE STILL IN HIS HANDS? If he is its keeper and still holds it, he is believed with no further condition. If he gave it back, he needs the second condition. If he never held it, nothing is left to him but the owner's silence.

On the third question the Mehaber states the condition in so many words: « והוא שיאמר לו נתנסך יינך בפניך או שאמר ליה ידעת דרגלים לדבר » (שו״ע יו״ד קכ״ז:א).

And the ש״ך warns that this silence is no admission in the strict sense: « לאו כהודאה ממש … אלא כיון ששותק נראה שיודע רגלים לדבר וסומך על העד » (ש״ך יו״ד קכ״ז ס״ק י).

💡 Why the first meeting weighs so much: a man who knows a wine has become forbidden, meets its owner and says nothing, behaves like somebody who does not believe it himself. That is רבא's reasoning in the gemara, and it is why an אמתלא — an avowable reason for having kept quiet — repairs the breach: it gives the silence a meaning other than disbelief.

⚠ The fine line in silence: silence forbids only where it is an informed silence. If the speaker did not say “in your presence” nor “you know there is ground for it”, the owner may perfectly well have kept quiet because he knows nothing — and such a silence proves nothing. That is exactly what the ש״ך says: silence works only because one infers that the owner himself knows of רגלים לדבר.

5. The Rama's device: « איני מאמינך »

To seif 1 the Rama adds a practice that spread widely, and a limit that is regularly forgotten.

« ומלמדי׳ אותו לכתחלה שיאמר איני מאמינך ואז לכ״ע שרי דבעלים נאמנים על שלהם » (רמ״א יו״ד קכ״ז:א).

And he adds that the inner conviction does not undo the spoken answer: « ואם הבעלים אומרים איני מאמינך אע״ג דבלבו מאמין לו כבי תרי אין להחמיר » (רמ״א יו״ד קכ״ז:א).

⚖ What the ש״ך forbids teaching

The device is not a lie, and the ש״ך insists on it: summary : one instructs him in advance, so that he answers תוך כדי דיבור when the witness comes — and one does not teach him to deny, « דהיאך ילמדוהו לשקר » (ש״ך יו״ד קכ״ז ס״ק י״א).

The difference is total: “I do not believe you” is a refusal to receive one man's word, which the law allows; “it never happened” would be an assertion about the facts, and that is taught to nobody.

Then comes the limit, the most quoted sentence in the siman and the most often quoted out of place: « ודוקא ביין נסך שאין לדקדק בו כל כך אבל בשאר איסורים לא מהני אם אמר איני מאמינך אם מאמין בלבו » (רמ״א יו״ד קכ״ז:א).

The ט״ז supplies the ground for that restriction: « כי יש חולקין וס״ל דכל שהוא מאמין בלבו שאומר אמת אין מועיל מה שמכחישו ועל זה נאמר ויראת מאלהיך » (ט״ז יו״ד קכ״ז ס״ק א).

💡 In one line: the device belongs to stam yeinam, a rabbinic prohibition where one need not press the enquiry; it does not belong to an ordinary issur, where a man who believes in his heart stays bound.

6. When one contradicts one

The Rama goes on with three neighbouring cases that must not be melted into one.

The gemara had put the question in four words, and the whole discussion starts there: « עד אחד בהכחשה מי מהימן » (קידושין ס״ה ע״ב).

⚠ Do not confuse “not believed” with “permitted”: מיגו במקום עדים cancels the speaker's credibility towards the world — the wine stays permitted to all. But he said what he said: he made the wine a חתיכה דאיסורא for himself, and it is forbidden to him alone. One and the same wine can thus be permitted to its owner and forbidden to the man who denounced it.

7. The worker who forfeits his wage (seif 2)

Seif 2 revisits the whole of seif 1 with a במה דברים אמורים : the conditions of the first meeting and of the wine still held apply in one case only — where speaking costs the speaker nothing.

« במה דברים אמורים כשעושה עמו בחנם או אפי׳ בשכר והוא בענין שלא יפסיד שכירותו » (שו״ע יו״ד קכ״ז:ב).

« אבל אם שכרו הרבה והוא בענין שמפסיד כל שכרו כגון שאומר שנתנסך בפשיעתו נאמן אפילו אינו עתה בידו » (שו״ע יו״ד קכ״ז:ב).

■ HE LOSES NOTHING BY SPEAKING — he works for free, or his wage is safe: because he ascribes the mishap to an אונס, or because he was hired for very little. → All the conditions of seif 1 apply.

The principle comes from the scribe who reports having written a sefer Torah improperly: « מתוך שאתה נאמן להפסיד שכרך אתה נאמן להפסיד ספר תורה » (גיטין נ״ד ע״ב).

Just before, the gemara had brought the opposite position, that of רבי אמי: « נאמן אתה להפסיד שכרך ואי אתה נאמן להפסיד ספר תורה » (גיטין נ״ד ע״ב).

⚖ The two conditions that narrow seif 2

  1. The loss must be plain. « ודוקא שאומר שנאסר היין בדרך שהוא גלוי וידוע לכל שמפסיד שכרו » (רמ״א יו״ד קכ״ז:ב). If the worker framed it so that one may hold him mistaken and think his wage safe, he is not believed — « אע״פ שמפסידו על פי הדין אינו נאמן » (רמ״א יו״ד קכ״ז:ב).
  2. The loss need not be total. The ט״ז corrects the narrow reading: summary : even a mistake bearing on part of the wage, and on a slight sum, falls under the same rule (ט״ז יו״ד קכ״ז ס״ק ד).
And the ש״ך declines to stretch the seif to a case where the owner denies: summary : the proof from the sefer Torah assumes nobody contradicts him, whereas here the owners are believed about their own (ש״ך יו״ד קכ״ז ס״ק כ״א).

8. The general rule of seif 3 — and its four breaches

In seifim 3 and 4 the siman stops being a siman about wine. In six words it states one of the most heavily used rules in all of Yoreh De'ah.

« עד אחד נאמן באיסורים להתיר אבל לא להחמיר » (שו״ע יו״ד קכ״ז:ג).

The ש״ך explains why the second half is not a stringency but an observation: « כלומר תמצא דעד א׳ נאמן באיסורים להתיר אפי׳ בלא שתיקת הבע״ד דתהוי כהודאה אבל להחמיר לא תמצא דהעד נאמן בלא שתיקת הבע״ד » (ש״ך יו״ד קכ״ז ס״ק כ״ג).

In other words: where nothing is established, the object is already doubtful without the witness; where the permitted status is established, one witness alone does not overturn it. The Rama then opens four breaches in that rule, and it is the breaches that are remembered.

💡 The thread running through the four breaches: not one of them contradicts the rule; each marks its edge. A witness never overturns a חזקה; he speaks where none exists (breach 2), where one can go and look (breach 1), where it lies in his power to put things right (breach 3), or where the object is his own (breach 4). Keep the ש״ך's ground for the fourth: there too it is בידו לתקנו that does the work (ש״ך יו״ד קכ״ז ס״ק כ״ח).

The Rama closes his gloss with three cross-references that should not be dropped: to Siman 119 for a man suspect on the very matter he comes to attest, to Siman 185 for one who invokes a sage who denies it, and to Even HaEzer 152 for הפה שאסר הוא הפה שהתיר.

9. Who may testify: pesulei edut, a woman, a minor

« וכל הפסולי עדות כשרים לענין איסורים אם לא שחשוד לאותם דברים » (רמ״א יו״ד קכ״ז:א).

Those the law bars from a court remain admissible in matters of issur — unless they are suspect on the very matter at hand. The ש״ך notes, however, that the הר״ן, cited as the source, writes the opposite elsewhere, and offers a distinction: to permit, a disqualified man is certainly believed (ש״ך יו״ד קכ״ז ס״ק כ). And two witnesses are not always two: « ב׳ אחים אינם אלא כעד אחד לענין איסורים » (רמ״א יו״ד קכ״ז:א).

A woman

« ואשה נאמנת בדבר איסור לומר תקנתיו » (רמ״א יו״ד קכ״ז:ג).

She is believed where the prohibition is certain and the task is a defined one — the נִיקּוּר of meat. She is not believed in a doubt, nor where the matter admits of grounds for leniency: « אין אשה נאמנת דאשה דעתה קלה להקל » (רמ״א יו״ד קכ״ז:ג). The ש״ך adds two decisive qualifications: summary : she is believed even on a Torah prohibition, but only where putting it right lies in her power or the object is hers (ש״ך יו״ד קכ״ז ס״ק כ״ט); and he excludes whatever calls for prolonged toil — « וכן דבר שיש בו טרחא אין הנשים נאמנות דנשים עצלניות הן » (ש״ך יו״ד קכ״ז ס״ק ל).

A minor — and seif 4

« קטן אין לו דין עד להיות נאמן באיסורין » (רמ״א יו״ד קכ״ז:ג).

The Rama lays down the rule, then qualifies it three times. First towards stringency: « מ״מ בקטן חריף ובקי בדבר ואיכא רגלים לדבריו יש להחמיר אם מעיד על דבר איסור » (רמ״א יו״ד קכ״ז:ג). Then towards leniency, and only in the rabbinic sphere: « ואם מעיד על איסור דרבנן להקל ולא אתחזק איסורא … כגון בדיקת חמץ נאמן דהמנוהו רבנן בדרבנן » (רמ״א יו״ד קכ״ז:ג). Finally the closing bar: « אבל אם אתחזק איסורא אינו נאמן כלל » (רמ״א יו״ד קכ״ז:ג).

⚖ Seif 4: the minor as a keeper, not as a witness

« דברים שאין בהם חזקת איסו׳ אלא חששא שמא יחליפנו עובד כוכבים או יגע בו יש מי שאומר שסומכין על הקטן מכיון שבא לכלל דעת שמירה » (שו״ע יו״ד קכ״ז:ד).

The shift is sharp, and it is what closes the siman on its opening subject. The minor is not asked to testify that nothing happened: he is asked to have guarded. Where there is no חזקת איסור at all and only the fear that a non-Jew swapped the thing or touched it, a child who has come to דעת שמירה is enough to lay that fear to rest. The Mehaber gives it as יש מי שאומר: a reported opinion, not a settled matter.

10. The 6 golden rules

  1. One mouth is enough — to permit. That is the forgotten half: the rule of seif 3 is first of all a rule of leniency (שו״ע יו״ד קכ״ז:ג).
  2. To forbid, he needs a support. The wine in his hands, the word at the first meeting, the owner's silence, or his own forfeited wage — beyond these his word does not hold (שו״ע יו״ד קכ״ז:א ; שו״ע יו״ד קכ״ז:ב).
  3. An owner is believed about his own. This is the pivot of the whole siman, and the ground of the Rama's device (רמ״א יו״ד קכ״ז:א ; רמ״א יו״ד קכ״ז:ג).
  4. Silence is an admission only when informed. Without בפניך and without ידעת דרגלים לדבר it proves nothing (שו״ע יו״ד קכ״ז:א).
  5. An אמתלא reopens what silence had closed — on both sides: the owner who kept quiet, and the speaker who delayed (שו״ע יו״ד קכ״ז:א ; רמ״א יו״ד קכ״ז:א).
  6. A witness never overturns a חזקה. He speaks where none exists, or where he can put things right (רמ״א יו״ד קכ״ז:ג).

❌ Pitfall 1 — Taking the siman to be about wine only: it starts with wine and leaves it at seif 3. Seifim 3 and 4 are the general source of עד אחד נאמן באיסורים for the whole of kashrut — meat, טבל, בדיקת חמץ, fish — and it is on that account that they are quoted everywhere else. Reducing the siman to yayin nesekh loses its most used half.
❌ Pitfall 2 — Treating « שתיקה כהודאה דמיא » as a universal rule: the Mehaber attaches a condition to it at once — the speaker must have said בפניך or ידעת דרגלים לדבר — and the ש״ך makes clear that this is no admission in the strict sense, but a sign that the owner himself knows of רגלים לדבר (ש״ך יו״ד קכ״ז ס״ק י). Drop the condition and the silence proves nothing at all.
❌ Pitfall 3 — Confusing “he is not believed” with “the wine is permitted”: when the מיגו falls before witnesses, the wine stays permitted to its owner and to everybody — yet it remains forbidden to the man who declared it, דשוייה אנפשיה חתיכה דאיסורא. The same wine is then permitted to one and forbidden to the other, with no contradiction.
❌ Pitfall 4 — Exporting « איני מאמינך » beyond yayin nesekh: the Rama himself draws the line, and the ט״ז gives the ground. In other prohibitions, a man who believes in his heart what the witness tells him is not released by declaring otherwise with his mouth. The device is a convenience of stam yeinam, not a general technique.
❌ Pitfall 5 — Thinking a forfeited wage opens every door: seif 2 is fenced in twice. The Rama requires the loss to be plain to everybody, failing which the worker is not believed even though he does forfeit as a matter of law; the ט״ז recalls that the loss need not be total; and the ש״ך declines to stretch the seif to a case where the owner denies (ש״ך יו״ד קכ״ז ס״ק כ״א). Add that the ט״ז, on the טבח who retracts, writes that one should not rule as the Rama does (ט״ז יו״ד קכ״ז ס״ק ג): several pieces of this siman are contested.

2The worker who forfeits his wageAll of that holds where he works for him for free, or even for a wage where he loses nothing by speaking — say he ascribes the mishap to an אונס, or he was hired for very little. But if he was hired dearly and forfeits his whole wage — because he says the wine was spoilt through his own negligence — he is believed even though the wine is no longer in his hands and even though he said nothing at the first meeting. Rama: provided the forfeiture is plain and known to all; if one may hold that the worker is mistaken and thinks his wage safe, he is not believed — even though he does forfeit as a matter of law.
3The general rule of the single witnessOne witness is believed in matters of issur to permit, but not to be stringent. Rama: yet in a matter that can be checked — “come and I will show you a non-Jew making your wine nesekh” — his words must be reckoned with. Where nothing is established, neither permitted nor forbidden, he is believed even to forbid. Where the prohibition is established — טבל, meat not cleaned — he is not believed to permit, unless it lies in his power to put it right; but between two pieces, one forbidden and one permitted, he is believed to say which is which. Everyone is believed about his own, even against a חזקת איסור. A woman is believed to say “I have put it right” where the prohibition is certain, not in a doubt nor where there are grounds for leniency. A minor has no standing as a witness; but if he is sharp, expert and his words have support, one is stringent, and he is believed to be lenient in a rabbinic prohibition — such as בדיקת חמץ — so long as nothing forbidden is established.
4The minor as a keeperIn matters with no חזקת איסור at all, but only the fear that a non-Jew swapped the thing or touched it, there is an opinion that one relies on the minor, once he has reached the age of knowing how to guard — דעת שמירה.
