Is the wine forbidden merely because a non-Jew was left alone with it?
Yes, and that is the opening line of the siman: « עובד כוכבים שנתייחד עם היין אפילו ברשותנו אפילו שעה מועטת אסור בהנאה » (שו״ע יו״ד קכ״ח:א). No contact has to be established and nobody has to testify: the situation is enough, and two concessions make it as wide as possible — even in our own domain, and even for a single moment. The Mehaber at once opens an exception, resting on knowledge and not on a guess: « אבל מי שנודע לנו שאינו עובד עבודת כוכבים מותר לייחד יין אצלו ברשותנו לזמן מועט » (שו״ע יו״ד קכ״ח:א). What is the difference between leaving alone (יחוד) and depositing (הפקדה)?
They are two distinct regimes, and seif 1 permits the first to the very man to whom it forbids the second: « אבל אין מפקידין אצלו יין בביתו ואפילו בבתינו אסור אם הוא לזמן מרובה » (שו״ע יו״ד קכ״ח:א). The ט״ז explains the boundary and adopts Rashi's sense for the word yiḥud: « דיחוד היינו שמייחדו עם העובד כוכבים ברשות ישראל ולא שם את העובד כוכבים שומר עליו כלל » (ט״ז יו״ד קכ״ח ס״ק א). And the ש״ך shows that the fear is not the same in both: « דטעמא דהפקיד אצלו אסור משום שאנו חוששין שמא החליפו בשלו ושלו ודאי אסור » (ש״ך יו״ד קכ״ח ס״ק ג). For halacha le-ma'aseh, ask your Rav.
Does a non-Jew found standing against the barrel forbid the wine?
No — and the Mehaber takes pains to say so in the strongest terms: « ואפילו היה עומד בצד היין סמוך לו ממש בכדי פישוט ידים » (שו״ע יו״ד קכ״ח:ב). What guards the wine is not distance but what the non-Jew stands to lose: « מפני שמאחר שהוא יודע שיפסיד ישראל יינו הוא ירא ליגע » (שו״ע יו״ד קכ״ח:ב). The reckoning reverses as soon as he holds a loan secured on that very wine, and then a seal no longer suffices: « אסור ואפילו היה היין חתום בחותם אחד » (שו״ע יו״ד קכ״ח:ב). What does נתפס כגנב mean, and why does it permit the wine?
It is the test of seifim 4 and 5: « ואם הוא נתפס כגנב על הכניסה מותר בשתייה » (שו״ע יו״ד קכ״ח:ד). The ש״ך notes that it denotes no sentence but a liability: « בכ״מ שהוזכר נתפס כגנב פירושו שאם ימצאוהו יהא נתפס כגנב » (ש״ך יו״ד קכ״ח ס״ק י״ב). The ט״ז adds two conditions that are easily forgotten: « פי׳ שאם ימצאהו ישראל יהיה נתפס כדין גנב ע״פ המושל והוא אינו אלם » (ט״ז יו״ד קכ״ח ס״ק ח). In the marketplace the same idea takes the form of dread of the city judges (שו״ע יו״ד קכ״ח:ה). For halacha le-ma'aseh, ask your Rav.
How far does the prohibition reach — drinking, or benefit as well?
The siman has three outcomes rather than two. Yiḥud with an idolater forbids benefit as well (שו״ע יו״ד קכ״ח:א), and so do the barrels that could not be seen: « ואם לאו את שיכול לראות דרך שם מותר והשאר אסור בהנאה » (שו״ע יו״ד קכ״ח:ג). A deposit made in transgression forbids drinking only, and the ש״ך infers that benefit stays permitted — the ב״ח disputes it (ש״ך יו״ד קכ״ח ס״ק ג). And the Rama opens a broad leniency for our own time in seif 4, fencing it twice: « וי״א דבזמן הזה שאין העובדי כוכבים מנסכין אפילו אינו נתפס כגנב שרי » (רמ״א יו״ד קכ״ח:ד).
