1. שורש הסימן — מה בולע הכלי ? — the siman does not speak of taste but of moisture

Before any grid of materials, a foundational question: what remains in the wall? The sixteen seifim hold together only if it is answered, and the gemara answers it in five words.

The gemara sets down the difference, and it is a difference of temperature Why are glazed vessels permitted for wine and forbidden for chametz? Not because one is biblical and the other rabbinic — that answer is rejected — but:
« זֶה תַּשְׁמִישׁוֹ בְּחַמִּין, וְזֶה תַּשְׁמִישׁוֹ בְּצוֹנֵן. » (עבודה זרה ל״ד ע״א)
All the leniency of siman 135 rests on this, and the Rama will turn it round in seif 6: once the use was hot, the leniency falls.
The Rambam has already gathered the four remedies In a single halakhah: time, fire, heat, water — and he gives them as four equivalent paths.

Four heterogeneous remedies producing the same effect: this makes sense only if what must be removed is one and the same thing, and a thing that water, fire and time can each carry away.
Chakirah: בלוע or לחלוחית? (א) What is in the wall is an absorbed taste, as in ordinary prohibitions: it comes out only by heat, כבולעו כך פולטו, and cold water can do nothing. (ב) What is in the wall is only a retained moisture: it dissolves in water, evaporates with time, and burns in fire. The siman decides for (ב), and that is why its central remedy is cold water left standing. The Shach says so explicitly in the name of the Levush: the water weakens the taste of the wine.
The Shach names the mechanism And he does so precisely where the objection is strongest: for earthenware, of which we otherwise know that it never leaves its absorption.
« שאני הכא גבי הכשירו מיין נסך שתשמישו על ידי צונן עירוי המים מקלישין טעם היין עד כאן לשון עט״ז » (ש״ך יו״ד קל״ה ס״ק י״ב)
Note the structure of the argument: the general rule (“earthenware never leaves its wall”) is not contested; it is the case that is requalified — here it is not a cooked taste but a cold one.
An immediate nafka mina — and it is decisive today
« והא דכלי חרס מהני ליה עירוי היינו בדלא נשתמשו בו יין נסך רק בצונן אבל אם השתמשו בו בחמין כלי חרס אין לו תקנה ובשאר כלים צריכים הגעלה כמו בשאר איסורים » (רמ״א יו״ד קל״ה:ו)
On (ב), cold is a condition of the entire siman; the Rama writes it. Any industrial process in which the wine was heated — pasteurisation, hot filling, steam cleaning — leaves the regime of the sixteen seifim and falls back on the general law of prohibitions.
יסוד : כל הכשרי הסימן — שכשוך, עירוי, קליפה, כבשן, הגעלה ויישון — אינם אלא שש דרכים להוציא לחלוחית אחת, ומשום כך הם מתחלפים זה בזה ; ומשעה שהתשמיש בחמין, שוב אין הם מתחלפים.

2. גדר המזופף — does pitch forbid by what it holds, or by what it hides?

Seif 1 treats the pitched vessel more severely than the bare one. It remains to know why — and two reasons are possible, which do not yield the same consequences.

Chakirah (א) The pitch is forbidden because wine was poured into it at the time of pitching: the prohibition is in the substance of the coating itself. (ב) The pitch is not forbidden in itself; it drives into the wall the wine that will later be put in, and it prevents one from seeing that it was put in.
The Taz decides for (ב), and dismisses (א) in passing
« שהזפת מבליע היין לא שהאיסור משום היין שהם נותנים בשעת הזפיתה שאותו היין הוה כמשליך לאיבוד אלא שאח״כ נותנים בהם יין ואינו ניכר » (ט״ז יו״ד קל״ה ס״ק ב)
The word that decides it all: the wine poured at the moment of pitching is as though thrown away — it therefore left nothing that forbids. What forbids is what comes after, and cannot be seen.
The next two seifim are the nafka mina of this chakirah A hole stopped with pitch, a vessel smeared with wax:
« כלי שניקב וסתמו בזפת אינו נידון ככלי מזופף ולפי זה משפך שהוא מזופף מעט סביב הברזל אין לו דין כלי מזופף: » (שו״ע יו״ד קל״ה:ב)
« אין דינו כמזופף דשעוה לא בלעה: » (שו״ע יו״ד קל״ה:ג)
On (א), both would be forbidden — there is pitch here, and wax spread the same way there. On (ב), both are permitted, and for two distinct reasons: the plug is too small to drive anything into the body of the vessel, and wax does not absorb at all. The Mehaber gives exactly these two reasons.
Kushya If everything depends on absorption, why does the Rama permit, after the fact, a mere rinsing for a pitched vessel of wood, stone or metal? The coating did drive the wine in.
Teruts — the Shach measures the softness of the material

Pitch drives in only what the wall consents to receive. On wood, stone or metal the penetration stays superficial; on leather, which is soft, it is real — and by all opinions emptying is required. The Beer Hetev repeats the distinction as it stands.

3. שיעור השביעה — the one vessel in the siman that has a history

Seif 4 introduces a variable the siman did not have: the past of the vessel. But it seems to contradict itself within its own line, and two Acharonim differ over what the Mehaber meant.

The source: the cups of the gemara, and the Tur who draws the rule from them

The gemara spoke of cups a non-Jew had drunk from; the Tur makes of it a general rule for earthenware, and the Mehaber copies it.
Kushya of the Shach The seif first says the vessel is sated from the second time. Then it reports, in the name of “some say”, that two waterings do not suffice and emptying is required. How do the two clauses stand together?
Teruts — two liquids, two thresholds
« ונ״ל דסבירא ליה דגם הטור מודה דבמים לא שבעו מב׳ פעמים דדוקא ביין שבעו מב״פ ולא במים » (ש״ך יו״ד קל״ה ס״ק י״ד)
The Shach thereby avoids setting the Tur against the Sefer haTerumot and the Hagahot Maimoniyot: they are not speaking of the same liquid. The Darkhei Moshe had read the Beit Yosef as though this were a substantive disagreement; the Shach writes that there may be no disagreement at all.
Machloket — the Bach against the Shach on the already-sated vessel An earthen jar was long used by a Jew, so it is sated; a non-Jew then uses it for wine. Is emptying required?
« אבל הב״ח כ׳ דבכלי חרס אפילו במכניסו לקיום היכא דכבר שבע לבלוע ביד ישראל א״צ עירוי כשנשתמש בו עובד כוכבים אח״כ אלא סגי ליה בשכשוך וכל זמן שאינו שבע לבלוע ביד ישראל אפילו לא נשתמש בו העובד כוכבים אלא לפי שעה נמי צריך עירוי: » (באר היטב יו״ד קל״ה ס״ק ט)

The Bach is lenient: once sated, the jar drinks no more, and a rinsing suffices even for a storage vessel. The Shach concludes the opposite for the vessel that is not sated — even a passing use requires emptying — and he leans on the Rashba as the Tur reports him.
The Taz against the Maharshal on the reach of “we do not follow this” The Tur writes that our pitched earthen vessels should be likened to leather, “and we do not follow this”. What does that phrase govern?
« ע״כ נראה עיקר כפי׳ ב״י דאדיעבד קאמר דוקא דאין נוהגין לאוסרו: » (ט״ז יו״ד קל״ה ס״ק ז)

The Maharshal reads it as a permission at the outset where the vessel is already sated; the Beit Yosef and the Taz confine it to the after-the-fact case. The Taz proves it from the context: the Tur’s phrase governs the case he had just forbidden — the vessel that is not sated — so it cannot be aimed at the sated one.
Nafka mina — and the boundary that cancels the whole debate
« דוקא בשלא היה בו יי״נ מע״ל אבל היה בו מע״ל אין חילוק בין שבעו ללא שבעו אלא לעולם צריך מילוי ועירוי » (ש״ך יו״ד קל״ה ס״ק י״ג)
All this casuistry assumes a brief contact. Once the wine has stayed twenty-four hours in the vessel, saturation plays no part at all: emptying is always required. In practice, then, the first question is not “is this vessel sated?” but “how long did the wine stay in it?”

4. היקף המכניסו לקיום — the Ramban, the Rashba and the Rosh — three nested circles

Seif 8 lists three opinions without naming them, and rules like the third. The Beit Yosef gives the names, and the stake is enormous in practice: whether metal and stone do or do not fall under the stringency of the storage vessel.

The Mehaber follows the Rosh and writes it in three words — וכן ראוי לנהוג — yet he keeps the exception of glass, which the Rosh himself seemed to concede.
Why glass escapes: the reason is not juridical
« דשועים וקשים הם ובליעתם מועטת מכל הכלים. ר״ן: » (ש״ך יו״ד קל״ה ס״ק כ״ג)
« לפי שהוא חלק מאד ולא בלע כלל: » (ט״ז יו״ד קל״ה ס״ק י״א)
Two formulations of one thing. Glass does not drink — so there is nothing to extract, however long the stay. It is the only material in the siman for which the variable of “use” changes nothing.
A difficulty of the Taz on seif 8, and the answer of the Torat haBayit If earthenware already requires emptying even without storage (seif 4), why mention it as the proper case of storage?
« א״ל הא בכלי חרס אפי׳ אין מכניסו לקיום אסור כמ״ש בסעיף ד׳ תירץ בתה״א דקא משמע לן דאפילו בחרס דאיכא תרתי לריעותא מועיל עירוי » (ט״ז יו״ד קל״ה ס״ק י)
The answer turns the objection round: earthenware is mentioned not to make things stricter but lighter. Even where two grounds of stringency combine — a porous material and storage — emptying still suffices.
Nafka mina — the modern tank On the Ramban, a stainless steel tank that held forbidden wine for months would need only a rinsing; on the Rosh, and hence according to the Mehaber, it requires a three-day emptying. The siman decides, and that is the practical line.

5. גדר הקיום עצמו — purpose or actual use?

Seif 8 said which materials fall under storage. Seif 9 asks what “storage” means — and the answer determines, in practice, the classification of nearly all equipment.

The Tur rejects an opinion, and the reason he gives is decisive
« ונודות י״א שחשובין מכניסן לקיום וצריכין עירוי אפילו אינן זפותים ונראה שאין דרך להכניס בהן יין לקיום כיון שאינן זפותים » (טור יו״ד קל״ה)
Some held the wineskin to be a storage vessel. The Tur objects: one does not keep wine standing in an unpitched skin. The criterion is therefore not what happens, but what the object is made for.
The Taz formulates the rule: the original purpose, not the accident
« וס״ל דלא הוי מכניסו לקיום אלא במידי דעשוי לכך מתחלה משא״כ במידי דאינו עשוי לכך רק שדרך מקרה מכניסין בו לקיום לא גזרו בו לפי שעה אם משתמש בו העובד כוכבים ביין » (ט״ז יו״ד קל״ה ס״ק י״ב)
And he gives the strongest proof: every day a non-Jew drinks wine in a Jew’s house from an earthen cup, and it is merely rinsed. If occasional use sufficed to make a storage vessel, that daily practice would be forbidden.
The Rama’s number, and what the Taz does with it
« פי׳ שמתחלה ייחדו לכך כדפרישית בסמוך לפני זה אבל לא דרך מקרה שהיה שם יין ג׳ ימים » (ט״ז יו״ד קל״ה ס״ק י״ג)
« כלי שמכניסין בו יין לעמוד בו שלשה ימים מקרי מכניסו לקיום ולכן העירוי גם כן הוא שלשה ימים » (רמ״א יו״ד קל״ה:ט)
The Rama gives three days; the Taz at once specifies that those three days denote a purpose — a vessel designated for it — and not a stay that happened by chance. The two glosses are read together.
Machloket — and if we know the wine stood there three days?
« כלומר כל שדרך להכניס בו אבל אם ידוע שעמד בהן יין ג׳ ימים לא מהני ליה עירוי דה״ל כבוש כמבושל » (ש״ך יו״ד קל״ה ס״ק כ״ד)
« פי׳ שמתחלה ייחדו לכך אבל לא דרך מקרה שהיה בו יין ג׳ ימים. ט״ז. והש״ך כ׳ באם ידוע שעמד בהן יין ג׳ ימים לא מהני ליה עירוי דה״ל כבוש כמבושל ובלבוש משמע דאפילו ידוע שעמד בו יין ג״י זה אחר זה סגי בעירוי: » (באר היטב יו״ד קל״ה ס״ק ט״ז)
The Shach: emptying no longer suffices, for there was pickling, and pickling counts as cooking. The Levush, reported by the Beer Hetev, is more lenient and is still satisfied with an emptying. The disagreement concerns the border between this siman and the general law of prohibitions.
Nafka mina A transfer hose in which wine remained over a weekend. On the Taz it is not a storage vessel — it was never made for that. On the Shach, if the wine stayed in it, the question is no longer storage but pickling, and the regime is heavier.

6. נגיעה או תשמיש — the sharpest dispute of the siman, and the most practical

Seif 7 says the storage vessel is affected once the non-Jew has used it, even briefly. But if he merely touched it while the wall was still moist? The Mehaber’s word is ונשתמש, and everything turns on it.

כלים שמכניסים בהם יין לקיום צריכי׳ עירוי בין שלקחם ישנים מהעובד כוכבים בין שהם שלנו ונשתמש בהם העובד כוכבים אפילו לפי שעה ומיהו בעירוי סגי להו אפילו הם זפותים:

The Shach reports the Perishah, and gives it as a reading of the word
« דוקא בנשתמש בהן אבל אם נגע בהם בשעת טפיחה לא נאסר דגזרו משום שמא ישתמש בהם העובד כוכבים ויכניס בהן לקיום » (ש״ך יו״ד קל״ה ס״ק כ״ב)
The Perishah’s logic: the stringency of the storage vessel is a decree, prompted by the fear that he will end up keeping wine in it. A decree is not extended beyond its motive — and a mere touch is not a use.
The Taz refuses, and he refuses with three arguments
« ודבריו תמוהים מכל צידי צדדים חדא דמנין לנו לחלק בזה הא אין לנו רמז בתלמוד מזה » (ט״ז יו״ד קל״ה ס״ק ט)
« ואין לנו לבדות חילוקים ודינים מלבנו בפרט להקל כנלע״ד והרב בעל הפרישה לא דק כאן כל הצורך גם מו״ח ז״ל חולק עליו בזה: » (ט״ז יו״ד קל״ה ס״ק ט)
His three arguments: the Talmud knows no such distinction; the Shulchan Aruch itself, in siman 138, expressly forbids by contact alone; and the Torat haBayit learns the case of the winepress from the case of the storage vessel — which presupposes that contact forbids there too.
And he draws from it a ruling he himself gave
« ועל פי זה אסרתי במי שמכר יינו ונשאר החבית ריקם רק שמרים נשארו בו ומוכרם לעובד כוכבים שלא יקח העובד כוכבים השמרים משם כיון שהחבית יש בו טופח על מנת להטפיח וגם בין השמרים עצמם נשאר קצת יין צלול נמצא שאוסר העובד כוכבים את החבית דהא מכניסין בו יין לקיום ויצטרך החבית להגעלה או עירוי על כן צריך שיוציא ישראל את השמרים ועובד כוכבים לא יגע בו » (ט״ז יו״ד קל״ה ס״ק ט)
Note how the case is built: the barrel is empty of wine, but the wall is still moist and some clear wine remains among the lees. Two facts, and the second alone would suffice; it is the first — the moisture of the wall — that the Taz brings forward, because it holds even where there are no lees at all.
The Shach, in his נקודות הכסף, sides with the Perishah The Beer Hetev reports the disagreement as it stands, and reports it last:
« ובנה״כ מסכים לדעת הפרישה בכאן מטעם כיון דאינו מזופף לא גזרו בנגיעה כולי האי להחמיר להצריכו עירוי » (באר היטב יו״ד קל״ה ס״ק י״ג)
His reason is measured: the vessel is not pitched, and they did not decree upon mere contact to the extent of requiring an emptying. In other words, the Shach does not deny the Taz’s argument — he confines its reach to vessels where absorption is genuinely to be feared.
Nafka mina A non-Jewish employee moves an empty but still-moist tank without pouring anything in. On the Taz the tank requires an emptying; on the נקודות הכסף it requires no more than before, at least where it is not pitched. Both views are reported side by side by the Beer Hetev, undecided — this is the point of the siman where one must ask.

7. סדר העירוי ופיזורו — the Rashba against the Rosh: may hours be added together?

Seif 12 gives the protocol and lays down three rules of reckoning. The third — water poured off too early does not count — is the site of a dispute of Rishonim that the Taz refuses to accept, and to which the Shach replies in his נקודות הכסף.

The source, and its formulation by the Tur
« כָּךְ הוֹרָה רַבִּי אַמֵּי הֲלָכָה לְמַעֲשֶׂה — מְמַלְּאָן מַיִם שְׁלֹשָׁה יָמִים וּמְעָרָן. וְאָמַר רָבָא: צָרִיךְ לְעָרָן מֵעֵת לְעֵת. » (עבודה זרה ל״ג ע״א)

Only two data in the gemara: three days, and a renewal each time. All the rest of the seif is the work of the Rishonim on those two words.
First point established: the days may be spread apart
« ואפילו לכתחלה יכול לעשות ג׳ ימים מפוזרים. טור ורשב״א: » (ש״ך יו״ד קל״ה ס״ק ל)
And even at the outset. This already presupposes that each twenty-four-hour period is a complete unit in itself, not a third of a continuous process.
Machloket — the Rashba against the Rosh and the Tur If the water was poured off after six hours, are those six hours lost, or may they be completed the next day? The Rashba adds them up; the Rosh and the Tur cancel them. The Beit Yosef tried to reconcile, the Bach decided:
« ואם לא יוכל לצמצם ברגע א׳ לא ניתנה התורה למלאכי השרת אבל אם מיהר לערות בא׳ מג׳ ימים בב׳ שעות אותו היום לא עלה לו כלל » (ש״ך יו״ד קל״ה ס״ק כ״ח)
« וכתב עוד הב״ח והכי נקטינן לחומרא וכן משמע בש״ע שחזר בו עד כאן ודלא כהעט״ז שכ׳ כהרשב״א: » (ש״ך יו״ד קל״ה ס״ק ל״א)
The Shach agrees with the Bach and notes that the Shulchan Aruch, by omitting the Rashba’s view, retracted what he had written in the Beit Yosef.
The Taz does not understand the stringency
« ונראה לע״ד דבדיעבד אם עשה ההכשר כהרשב״א ונשתמש בו אחר כך בהיתר לא אסרינן ליה » (ט״ז יו״ד קל״ה ס״ק ט״ו)
His reasoning is tight: if we grant that the three days may be spread apart, then an interruption does not send back into the wall what has already come out of it. Why, then, should an interruption in the middle of the first day be an exception? He suggests that the Tur’s stringency rests only on מראית עין.
Teruts — the Shach’s answer, reported by the Beer Hetev
« ומטעם זה לא בעינן ג׳ מעל״ע רצופים אלא ג׳ פליטות זה אחר זה מיהו בלא״ה מותר בדיעבד ולאו דוקא הכא אלא בכל כלי היין שנשתמשו בהן בדיעבד בלי הכשר כלל משום דמסתמא איכא ס׳ נגד הקליפה ושרי לדידן כדלקמן סי׳ קל״ז עכ״ל): » (באר היטב יו״ד קל״ה ס״ק כ״א)
The answer is exact and closes the dispute: emptying does not work as a prolonged rinsing but as a pickling, and a pickling does not add up in fragments — a full twenty-four hours is needed. What need not be continuous is the three picklings among themselves.
Nafka mina A tank emptied by mistake after twenty hours. On the Rashba one completes four hours the next day; on the Rosh and the Bach the day is lost and three fresh periods are needed. The Taz permits reliance on the Rashba after the fact, where the vessel has already been used.

8. מי העירוי — מותרים או אסורים — has what came out of the vessel become forbidden?

The Mehaber permits the water poured off; the Rama reports that it is forbidden. Behind this detail lies a question of principle: if the water really extracts something, how could it remain permitted?

The two positions in the text itself
« ולסוף כ״ד שעות ישפכם והמים מותרים (ויש אוסרים המים » (שו״ע יו״ד קל״ה:י״ב)
The Mehaber holds the permission from the braita itself, where a Jew puts water into the non-Jew’s jars; the Rama reports the Raavyah through the Mordechai and the Agudah.
The Shach narrows the prohibition to three conditions
« נראה דוקא מים הואיל ואינן מאכל אלא מים גרידא מחמירין לכתחלה וכמ״ש בסי׳ צ״ד » (ש״ך יו״ד קל״ה ס״ק כ״ט)
Three restrictions: it holds only for water (beer and honey remain permitted); only where it was put in to make the vessel fit; and not at all where it happened to be there by chance. The motive is therefore not that the water became forbidden in itself, but that one may not annul a prohibition deliberately.
Nafka mina — and the consistency with siman 137 The Shach himself raises the objection: in siman 137 the Rama permits putting water and other liquids into them. His distinction resolves it — there the purpose is not to make the vessel fit. This is a fine example of the Shach’s method: he does not choose between two texts of the Rama, he shows that they are not speaking of the same act.

9. מי המלח — ט״ס בהגהה — when a commentator corrects not the reasoning but the printed text

The Rama’s gloss on seif 12 gives the siman’s only acceleration: strong brine does in one day what water does in three. But the proportion it states is exactly the reverse of the gemara’s.

What the printed gloss says
« מי מלח חזקים שיש בהן שליש מלח וב׳ שלישים מים מועילים במעת לעת (טור בשם הרמ״ה) כמו עירוי ג׳ ימים) (טור בשם הרא״ש): » (רמ״א יו״ד קל״ה:י״ב)
One third salt, two thirds water.
What the gemara says
« מַאי מֵי מֶלַח עַזִּין? רַבָּה וְרַב יוֹסֵף בַּר אַבָּא דְאָמְרִי תַּרְוַויְיהוּ: כֹּל שֶׁהַבֵּיצָה צָפָה בָּהֶן. וְכַמָּה? אָמַר אַבָּיֵי: תְּרֵי תִּילְתֵי מִילְחָא וְתִילְתָּא מַיָּא. » (שבת ק״ח ע״ב)
Two thirds salt, one third water — and the definition just before confirms it: brine in which an egg floats.
The Shach concludes that it is a printing error
« והש״ך כ׳ בנה״כ שט״ס הוא וצ״ל ב׳ שלישים מלח ושליש מים וכן איתא בש״ס שבת דף ק״ח ע״ב וכ״כ המחבר בא״ח סי׳ שכ״א ס״ב » (באר היטב יו״ד קל״ה ס״ק כ״ב)
Three converging proofs: the gemara, the body of the poskim, and the Mehaber himself in Orach Chaim. Note the methodological point: the Shach does not say the Rama is mistaken, he says the printed text does not render what the Rama wrote. This is a judgment about transmission, not about halakhah.
And why fish-brine disappeared from the Shulchan Aruch The Beit Yosef gives the source, an explicit braita:
« וכתב הטור ורשב״א דשאר כל המשקין אינם מועילין להכשיר במע״ל חוץ מציר ומורייס והמחבר והרב השמיטו הכשר ציר ומורייס משום דלא שכיח בינינו: » (ש״ך יו״ד קל״ה ס״ק ל״ב)
« כל דבר שצריך עירוי אם הכניס בו ציר או מורייס מותר ליתן בו יין אח״כ וכו׳. ברייתא בפרק אין מעמידין (שם) קנקנים של נכרים חדשים מותרים ישנים ומזופפים אסורים נכרי נותן לתוכן יין ישראל נותן לתוכן ציר ומורייס ואינו חושש ופירש״י נכרי נותן לתוכן יין ישראל נותן לתוכן ציר ומורייס מיד אע״פ שלא מילאהו מים לפי שהציר והמורייס שורפין את היין הנבלע ומכלין אותו. וכתב הרשב״א שנראין דברי רש״י מדאמרינן בגמרא ציר שורף אור לא כל שכן וכן פסקו הפוסקים ז״ל: » (בית יוסף יו״ד קל״ה)
The Shach explains the omission: the Mehaber and the Rama dropped this remedy because it was no longer in use. A useful reminder — the Shulchan Aruch sometimes omits not because it rejects, but because the case no longer arises.

10. כדי קליפה ומעת לעת — the Shach leaves the question open, the Noda biYehudah closes it

Seif 13 lays down that absorption does not go beyond the thickness of a peel. The Shach attaches to it a considerable reservation, which he ends by leaving in צריך עיון — and the Pitchei Teshuvah reports the one who decides it.

Two peelings, two objects: peeling the wall removes what was absorbed; peeling the pitch removes only the vehicle, and the vehicle has already done its work.
The Shach: this rule is only a presumption
« נראה דהיינו מסתמא אמרינן הכי משום שאינו ידוע שנכבש היין בתוכו יום שלם אבל אם היה ידוע שהיה יי״נ בתוכו יום שלם ה״ל כבוש וכבישה אוסר כל הכלי » (ש״ך יו״ד קל״ה ס״ק ל״ג)
He draws a heavy consequence from it: if we know the wine stayed there a full day, there was pickling, and pickling counts as cooking. A full hag‘ala would then be needed — and for earthenware nothing at all would suffice.
Teruts — and the Shach offers it to himself He then proposes the reverse: since the prohibition entered only when cold, one may say of it כבולעו כך פולטו and the emptying suffices even after a full day; the Sages knew that water weakens a taste absorbed cold. Then he concludes: צריך עיון. It is one of the rare places where the Shach writes both branches in succession without choosing.
The Pitchei Teshuvah reports the one who decides
« שכתב דדברי הש״ך בס״ק י״ג (הובא בבה״ט סק״ז) הם עיקר לדינא דאפילו אם עמד מעל״ע מהני עירוי » (פתחי תשובה יו״ד קל״ה ס״ק ב)
The Noda biYehudah decides for the lenient branch: even if the wine stayed twenty-four hours, the emptying suffices. Note the reference: the Pitchei Teshuvah points to the Shach’s s.k. 13 — the one that requires emptying in every case — and not to s.k. 33 where the question is raised.
Nafka mina A barrel in which the wine stayed a week. On the Shach’s first branch no hag‘ala would suffice if it is earthenware; on the Noda biYehudah the ordinary protocol of seif 12 applies. That is the difference between a vessel to be discarded and a vessel to be treated.

11. הגעלה ועירוי — ר״ת ור״י — can pouring count as a keli rishon?

Seif 15 opens a second route, a thermal one. The Mehaber requires a keli rishon; the Rama reports a lighter route and describes the practice. The whole question is how far one may descend without leaving the keli rishon.

The source: the mishnah of the winepress implements
« רַבִּי יוֹסֵי אוֹמֵר: הָרוֹצֶה לְטַהֲרָן מִיָּד, מַגְעִילָן בְּרוֹתְחִין, אוֹ חוֹלְטָן בְּמֵי זֵיתִים. » (עבודה זרה ע״ה ע״א)
The mishnah’s word is מגעילן ברותחין, with no further detail — and from this the question of the vessel’s level is born.
The Shach explains why we are lenient here
« ואפילו למ״ד עירוי אינו ככלי ראשון שרי הכא כיון דתשמישו בצונן תוס׳ ופוסקים ומה״ט הקילו נמי הפוסקים הכא בהכשר שכתב הרב: » (ש״ך יו״ד קל״ה ס״ק ל״ד)
The argument is the same as in the first chapter of this level: the absorption took place cold, so the expulsion does not need the full force of a keli rishon. All the leniency of the siman flows from a single premise.
Machloket on the reach of Rabbenu Tam’s permission
« ויש מתירין אפילו ע״י עירוי שמערה בהן רותחין ולגלגלן » (רמ״א יו״ד קל״ה:ט״ו)
« נראה דוקא מכלי ראשון דכל מה שאפשר לקרב לנו לעיקר הדין כן עבדינן לכתחלה » (ט״ז יו״ד קל״ה ס״ק י״ט)
The Rama writes שמערה בהן רותחין without saying from where. The Taz, against a broad reading, proves from the Rosh’s responsum that even Rabbenu Tam required the water to come from a keli rishon: it is the rolling that is eased, not the source of the heat.
The Beer Hetev turns it into a short rule
« כ׳ הט״ז נראה דוקא מכלי ראשון ובמזופף לא מהני שום דבר רק קליפת הזפת ולהכשירו אחר כך אם א״א שיכניסנו לכלי ראשון ואי לא עביד הכי אפילו דיעבד אסור ע״ש: » (באר היטב יו״ד קל״ה ס״ק כ״ה)
And he adds the consequence the Taz draws for the pitched vessel: there, only peeling the pitch opens the way, and the thermal treatment comes after. A hag‘ala on a still-pitched vessel redeems nothing.
Nafka mina A wooden cask that cannot be immersed. The Rama’s solution — white-hot stones inside the cask, boiling water poured over them, and then rolling it — is exactly the procedure still in use. But it holds, according to the Taz, only if the water itself comes from a keli rishon.

12. יסוד הסימן — לחלוחית ולא חומר — why the last seif justifies all the others

The siman ends with a remedy that requires no act at all. The Beit Yosef sees a difficulty in it; the Taz shows that there is none, and his answer states what the prohibition has been about since the first word.

Two formulations in the gemara, and the difficulty
« וְהִלְכְתָא קַנְקַנִּים שֶׁל גּוֹיִם לְאַחַר שְׁנֵים עָשָׂר חֹדֶשׁ מוּתָּרִין. » (עבודה זרה ל״ד ע״א)
« הָנֵי גּוּלְפֵי, בָּתַר תְּרֵיסַר יַרְחֵי שַׁתָּא שָׁרֵי. » (עבודה זרה ל״ד ע״א)
The Tosafot write that there is no vessel not made fit by an emptying. The Beit Yosef objects: the gemara says of the גולפי that they are permitted after twelve months — a sign that an emptying did not suffice for them.
The Taz turns the objection round
« אלא ברור הוא דלא בעי שם בגמרא למעט גולפי מתקנת עירוי אלא בא לומר אם לא עשה עירוי ושהה י״ב חודש שרי גם כן » (ט״ז יו״ד קל״ה ס״ק י״ט)
His reading is the right one: the gemara does not exclude the גולפי from emptying, it adds a second route for one who did not perform an emptying. And he brings the Rambam as proof: where he treats the jars he gives both. Twelve months do not replace the emptying — they are added to it.
How many days make twelve months?
« דהנך חדשים הם חדשי לבנה כל חודש כ״ט יום ע״ש: » (פתחי תשובה יו״ד קל״ה ס״ק ג)
The Pitchei Teshuvah reports the Brit Avraham, who establishes it from Tosafot on Niddah 65b: these are lunar months. The reckoning matters: three hundred and forty-eight days, not three hundred and sixty-five.
The Shach’s last two remarks, and what they confirm
« וא״צ להתיר הקשרים הרשב״א ופוסקים וכ״פ ב״י » (ש״ך יו״ד קל״ה ס״ק ל״ה)
« ואפי׳ יין כן הוא בתשו׳ הרא״ש ומביאו ב״י וע״ל סי׳ קל״ז ס״ק י״ח: » (ש״ך יו״ד קל״ה ס״ק ל״ו)
For aging, one need not untie the knots of a wineskin — water indeed enters everywhere, but time acts without anything being opened. And water put into the vessel during the year does not restart the count; even wine, writes the Shach in the name of the Rosh, would not restart it.
