A single seif. Vessels set aside for wine are shipped by the hand of a non-Jew; they are empty, and yet they must be sealed — because the danger is not that the wine be touched, but that the cask be used. The whole siman measures one thing: the gain of whoever would use it

1. The axiom: the seal closes nothing, it signs

The starting point:

Simanim 128 to 131 protected wine. Siman 136 protects an empty container. Nothing can be touched, nothing can be poured: casks are being shipped. What is at stake is therefore no longer contact but use — that the carrier fill the cask with his own wine, empty it before delivery, and that the wood keep the taste.

Hence the axiom: the seal is not a lock, it is a signature. It does not make opening impossible, it makes it ascertainable. The text says so itself in four words: כדי שיהא ניכר.

The source is a practice of Rava, not a debate: « רָבָא כִּי הֲוָה מְשַׁדַּר גּוּלְפֵי לְהַרְפַּנְיָא, סָחֵיף לְהוּ אַפּוּמַּיְיהוּ וְחָתֵים לְהוּ אַבִּירְצַיְיהוּ. קָסָבַר: כׇּל דָּבָר שֶׁמַּכְנִיסוֹ לְקִיּוּם, אֲפִילּוּ לְפִי שָׁעָה — גְּזַרוּ בֵּיהּ רַבָּנַן. » (עבודה זרה ע״ד ע״ב)

The Tur fixes its measure, and this is what the Mechaber takes up: « השולח כלי ביד נכרי צריך להחתים שכל כלי ששהה ביד נכרי אפילו שעה אחת צריך הכשר כפי ההכשר שצריך אילו היה ישן בבית הנכרי ובא לקנותו ממנו » (טור יו״ד קל״ו)

💡 The landmark: whenever the siman seems stringent, ask what would be gained by whoever used the vessel; whenever it seems lenient, ask whether such use is even plausible. There is no other variable in the whole siman.

2. The 3 reflex questions

1. Is the vessel set aside for wine? כלים המיוחדים ליין — if not, the siman does not apply.
2. Was it sealed? One seal according to the Mechaber; two according to the second view; one suffices after the fact (Bach, ש״ך ס״ק א).
3. If not: is it plausible that it was used? Yes for an ordinary cask, even for one hour; no for a very large cask at the craftsman’s. In the first case: kashering according to siman 135.

4. One seal or two: the ma’hloket and its spring

It is born not of a halakhic divergence but of a reading. The Tur reports both: « ורש״י כתב שצריך חותם בתוך חותם והריב״ם כתב שדי בחותם אחד » (טור יו״ד קל״ו)

Rashi reads two closures one over the other: « כך מבואר מדבריו שפי׳ סחיף להו אפומייהו כופה אותן שוליהן למעלה ופיהן למטה משום חב״ח » (בית יוסף יו״ד קל״ו)

The others read a single closure, but applied to each of the two openings: « אבל אחרים פירשו סחיף להו אפומייהו דמהדק דיקולא אפומייהו והיינו חותם אחד וחתים לה אבירצייהו דהיינו באותו נקב קטן שמשם מוציאים היין וכל זה אינו אלא חותם אחד » (בית יוסף יו״ד קל״ו)

⚖ The spring, in one sentence of the Ran (via the Shach)

Where the forger would gain only a slight difference in quality, one seal deters; here he would gain the entire use of the cask: « דהתם אין העובד כוכבים יכול להחליפו אלא ביין מבושל או בחומץ שהוא גרוע ממנו מעט שאם היה שבחו של זה מרובה ממנו היה חלופו ניכר ומיתפס עליו כגנב ומשום שבחא פורתא לא טרח ומזייף אבל כאן משום תשמיש מרובה טרח ומזייף. הר״ן » (ש״ך יו״ד קל״ו ס״ק ב)

After the fact, one seal suffices. « כתב הב״ח ובדיעבד כדאי הם המתירין בחותם א׳ לסמוך עליהם וע״ל סימן ק״ל ס״ב » (ש״ך יו״ד קל״ו ס״ק א) and the Ba’er Hetev repeats it: « הטעם דמשום תשמיש מרובה טרח ומזייף וכתב הב״ח דבדיעבד כדאי הם המתירים בחותם א׳ לסמוך עליהם וע״ל סימן ק״ל ס״ב » (באר היטב יו״ד קל״ו ס״ק א)

5. “Even for a short while”: the time threshold

The Shach rules out any minimum threshold: « ושהה אפילו שעה אחת ביד העובד כוכבים צריך הכשר כפי ענין כו׳ טור » (ש״ך יו״ד קל״ו ס״ק ג)

He adds Rabbenu Yeruḥam: « וכ״כ ר׳ ירוחם דצריך הכשר אפי׳ לא שהה בידו אלא לפי שעה » (ש״ך יו״ד קל״ו ס״ק ג)

⚠ The trap of delay. One might think it enough to wait twenty-four hours for the taste to become spoiling. The Shach expressly refuses this, and it is a rule of matter, not of procedure: « דדוקא בקדרות וקערות שעמדו בבית העובד כוכבים קאמר הרא״ה דמשהה אותם מעל״ע אבל בכלי היין לא שייך נ״ט לפגם אפילו ישהנו כמה ימים וכדלקמן סימן קל״ז » (ש״ך יו״ד קל״ו ס״ק ג)

6. Without a seal: kashering, and which one

The Shach refers in a word to the siman that treats the question: « ועל הדרך שנתבאר סי׳ קל״ה: » (ש״ך יו״ד קל״ו ס״ק ד)

The Taz delimits the Rama’s reference, and excludes earthenware: « פי׳ אם היה של עובד כוכבים מתחילה וקנאו ישראל ממנו ואין בכלל זה כלי חרס דאם תחילת תשמישו ביד עובד כוכבים צריך עירוי אע״פ שאין מכניסו לקיום ואילו בזה שהיה תחלה של ישראל א״צ אלא כמבואר סימן קל״ה סעיף ד׳ » (ט״ז יו״ד קל״ו ס״ק א)

7. Already used: Rama against Taz

Rama — what has already been done is not condemned. Taz — on the contrary: « לעיל סי׳ קכ״ב סעיף ט׳ הארכנו דלא קי״ל כן אלא אף בדיעבד אסור » (ט״ז יו״ד קל״ו ס״ק ב)

The Ba’er Hetev records it and extends it to all vessels: « גם פסק דאפילו בדיעבד יש לאסור בכל הכלים דלא כרמ״א וע״ל סי׳ קכ״ב ס״ט » (באר היטב יו״ד קל״ו ס״ק ב)

⚖ What justifies the Rama’s position

The Shach separates the decree from its object: the decree bears on the vessel, not on the contents. « דכיון דלא היה ביד עובד כוכבים אלא לפי שעה א״כ ודאי לא נבלע איסור בכלי וגם לא נשתמש בו בודאי ודי שגזרו שהכלי צריך הכשר דלפי שעה חשיב כמכניסו לקיום אבל ודאי בדיעבד המאכל מותר » (ש״ך יו״ד קל״ו ס״ק ג)

8. Large casks: the exception and its limit

The source, in the Tur in the name of the Sefer haTerumah: « ובספר התרומה התיר לשלוח חביות של עץ גדולים לבית נכרי אומן יום או יומים לתקנם דבכלי גדול כזה אין רגילין להשתמש בו לפי שעה » (טור יו״ד קל״ו)

The Beit Yosef adds two qualifications — a preference for stringency, and a debate over duration: « ומיהו כתבו דמ״מ טוב להחמיר ונראה מדבריהם דלא שרי להשהות אלא יום או יומים אבל בא״ח כתב בשם ר״י דאפי׳ זמן מרובה שרי להשהות בבית האומן » (בית יוסף יו״ד קל״ו)

The Shach does not debate the duration: he recalls the caution. « מיהו כתבו יש פוסקים דלכתחלה יש ליזהר בכל מאי דאפשר וכ״כ האחרונים » (ש״ך יו״ד קל״ו ס״ק ה) And the Ba’er Hetev places it to the account of the Acharonim: « מיהו כתבו יש פוסקים דלכתחלה יש ליזהר בכל מאי דאפשר וכן כתבו האחרונים » (באר היטב יו״ד קל״ו ס״ק ג)

9. The 5 golden rules

  1. The seal signs, it does not close. Its force comes from making the opening ascertainable.
  2. The number of seals is measured by the gain, not by the gravity of the prohibition — which is why siman 136 is more demanding than simanim 118 and 130.
  3. One hour suffices. A wine vessel is מכניסו לקיום, and the decree holds אפילו לפי שעה.
  4. Time does not erase. נותן טעם לפגם does not apply to a wine cask.
  5. The decree bears on the vessel, not on its contents: that is what makes the Rama’s gloss coherent in both halves.

10. Mnemonic — the memory aid “חותם”

ח חָבִית — which vessel is it? Set aside for wine, or not.
ו וַדַּאי — the decree turns doubt into certainty, but on the vessel alone.
ת תַּשְׁמִישׁ — what is feared is use, not contact; and the gain of that use measures the number of seals.
ם מִדָּה — the measure: one hour is enough to create the obligation, the size of the cask may undo it.

11. The 4 classic pitfalls

  1. Thinking “empty” means “nothing at stake”. The reverse is true: the siman arises precisely because the vessel is empty and therefore available.
  2. Waiting twenty-four hours. That reasoning holds for pots, not for a wine cask (ש״ך ס״ק ג).
  3. Conflating the two storeys of the Rama’s gloss. Kashering the vessel is not in dispute; the fate of what was poured into it is.
  4. Extending the permission for large casks. It rests on a factual implausibility; a small cask, a drum or a skin does not benefit from it.
