1. שורש הסימן — the nature of what the vessel gives back

The siman opens on a strange combination: the wine is forbidden to drink but permitted for benefit. Yet what made it so — a non-Jew’s wine — was itself forbidden for benefit. How does a graver prohibition beget a lighter one?

The Mishnah, and the ma’hloket the halakha decides « נוֹדוֹת הַגּוֹיִם וְקַנְקַנֵּיהֶן, וְיַיִן שֶׁל יִשְׂרָאֵל כָּנוּס בָּהֶן — אֲסוּרִין, וְאִיסּוּרָן אִיסּוּר הֲנָאָה » (עבודה זרה כ״ט ע״ב) Rabbi Meir holds it a prohibition of benefit; the Sages do not. And the Beit Yosef, at the opening of the siman, says which of the two governs: « בפרק אין מעמידין (עבודה זרה כט:) תנן נודות הנכרי וקנקניהם ויין של ישראל כנוס בהם אסורים ואיסורם איסור הנאה דר״מ וחכמים אומרים אין איסורם איסור הנאה וידוע דהלכה כחכמים » (בית יוסף יו״ד קל״ז)
The ḥakira: what mixed into the kosher wine? (א) A non-Jew’s wine, merely diluted — in which case it should be treated as such, that is, as a prohibition of benefit that forbids in the least quantity. (ב) What the vessel gave back — a taste, not a substance; and a taste released by a wall never takes on the status of the food it came from. The Shach chooses a path that takes from both branches, and it is the key to the whole siman.
The Shach: the origin decides the quantity, the mode of mixture decides the status « שאני הכא דקודם שנבלע בכלי היה אסור בהנאה נמצא כשמתערב ביין שבקנקנים איסור הנאה מתערב אלא שלפי שלא נתערב בעין רק מפליטת הכלי אינו אוסר רק בשתייה » (ש״ך יו״ד קל״ז ס״ק ג) Two propositions in one sentence. Because what was absorbed had been forbidden for benefit, it forbids במשהו — in the least quantity. Because it did not mix in substance but through the wall, it forbids only for drinking. Gravity and quantity are therefore not measured by the same criterion.
Immediate nafka mina The residue of an unkashered vat across a whole vintage. On (א), nothing saves it. On (ב), sixty suffices. On the Shach’s position, the answer depends on what is being measured: sixty against the wine already forbidden, but nothing dispenses against the פליטה itself according to the Mechaber.

Two positions on the same absorption

The Ra’ah, in the Bedek HaBayit, reasons by symmetry: since absorbed wine forbids only for drinking, it should be nullified in sixty like any drinking prohibition. The Mechaber holds the contrary.

« אכן מדברי הרא״ה בב״ה דף קכ״ו ע״ב משמע להדיא דיין שנבלע בכלים אינו אוסר רק בס׳ כיון שאינו אוסר רק בשתייה » (ש״ך יו״ד קל״ז ס״ק ג)
Kushya How do we know which of the two positions the Mechaber holds, since he does not say so in seif 1?
Terutz — the Shach deduces it from the following seifim, and it is a fine internal proof. In seif 2 the Mechaber forbids the wine drawn through the hole without mentioning sixty: he therefore holds that the פליטה forbids במשהו. In seif 3 he requires sixty in the second wine against the first — and not against the peels alone: the same conclusion. The Shach writes it expressly, and the Ba’er Hetev condenses it: « כ׳ בת״ה סי׳ ר״א דאין חילוק בין כלי עובד כוכבים ובין כלי ישראל שבלע יין נסך » (באר היטב יו״ד קל״ז ס״ק א)
What the ma’hloket really decides. It bears not on severity but on characterisation: does absorbed wine keep the memory of what it was? The Mechaber says yes for quantity and no for status; the Ra’ah says no for both. The whole casuistry of seifim 2 and 3 is the application of that difference.

3. שיעור הבליעה — a peel, or the whole vessel?

Seif 1 permits when there are six volumes of water כנגד קליפת הקנקן. But one must know what that “peel” covers — and it is here that the order of magnitude of the calculation is settled.

The Rashba, via the Beit Yosef: a peel, and no more « שאין היין נבלע אלא כדי קליפה שמקלפים העץ ברהיטני (כדלעיל סי׳ קל״ה סי״ג) רשב״א ומביאו ב״י וריב״ש סי׳ קל״ג » (ש״ך יו״ד קל״ז ס״ק ט) « וכ״כ בתשובה דאין צריך לשער בכל הכלי שאין היין נבלע אלא כדי קליפה שמקלפים העץ ברהיטני ואם יש בכל היין ששה חלקים כנגד הקליפה ההוא מותר » (בית יוסף יו״ד קל״ז)

The Bach, in the name of Rabbenu Tam and the Rosh

In a storage vessel the absorption exceeds the peel — and sixty is then required against the whole vessel, which in practice is almost never attainable.

Kushya How can these be reconciled? The Rashba is plainly right about ordinary physics — cold wine does not penetrate wood beyond a film. But Rabbenu Tam is plainly right about a jar in which wine stood for a long time.
Terutz — the Shach distinguishes by כבוש, and it is decisive in practice « אבל בידוע שעמד בו מעל״ע הרי נעשה כבוש וכבר נתבאר בסימן ס״ט ס״ק ס׳ ובסימן צ״ח ס״ק י״ג דכבישה אוסר כל הכלי » (ש״ך יו״ד קל״ז ס״ק ט) Where one knows that the wine remained twenty-four hours, the vessel has been pickled, and כבוש הרי הוא כמבושל: the absorption is no longer superficial. Where one does not know, we remain in the regime of the peel — and that is what the Rama meant in writing בטל בס׳. The Ba’er Hetev repeats the distinction word for word: « ולפ״ז בכלי שידוע שעמד בו יין נסך מעל״ע ונתנו בו אח״כ יין כשר היכא דאין בו מים אסור דהא צריך לשער בס׳ נגד כל הכלי ואין במה שבכלי ס׳ נגד הכלי כדלעיל סי׳ צ״ג והרב דכ׳ דבטל בס׳ היינו בסתמא שאין ידוע שעמד בו מעל״ע דאז אפילו כלי שמכניסו לקיום סגי בקליפה ויש במה שבכלי ס׳ נגד הקליפה » (באר היטב יו״ד קל״ז ס״ק ד)
Nafka mina A vat known to have held stam yeinam for more than a day, into which kosher wine is poured without water: according to the Shach it is forbidden, since sixty would be needed against the whole vessel. The same vat, with nothing known about it: the peel suffices, and sixty against it is reached without difficulty.
And a counterweight, in the Pitchei Teshuva. He reports the Chacham Tzvi, who refuses any extension beyond the peel: « ועי׳ בתשובת ח״צ סימן ע״ה שמתיר בכל ענין דאין אוסר יותר מכדי קליפה » (פתחי תשובה יו״ד קל״ז ס״ק א) The debate is therefore not closed by the Shach: it continues among the Acharonim, and that is why level 4 draws no mechanical rule from it.

4. שלושת שיעורי הזמן — and the vessel that was not rinsed

The two extremes, each in one line of the Taz « דגזרו עליו אפילו לפי שעה » (ט״ז יו״ד קל״ז ס״ק ב) « דצונן לא מפליט בפחות מזה » (ט״ז יו״ד קל״ז ס״ק ג) The first holds for the storage vessel; the second for the one that is not. And the Rosh’s reason, reported by the Shach, says why it is a full day: « משום דצונן בצונן פולט ובולע במעת לעת. הרא״ש » (ש״ך יו״ד קל״ז ס״ק ה)
Ḥakira: where does the twenty-four-hour threshold come from? (א) It is a measure of fact — the time cold needs to give out and absorb. (ב) It is a norm — the Sages fixed a period, as they did elsewhere. The Rosh rules for (א), and that is why the threshold disappears entirely in a storage vessel, where the decree operates without delay.

The borderline case: a vessel that rinsing would have sufficed to clear, and which was not rinsed

This case is not in the text of the seif; it is in what the seif presupposes. Two readings clash over it, and their practical consequences are opposite.

The Shach: forbidden to drink from twenty-four hours « משמע דה״ה כלים שאין מכניסין לקיום שנכשרים בהדחה כדלעיל סי׳ קל״ה אם לא הדיחן ונתן בהם יין אסור בשתייה כל ששהה בהן מעל״ע » (ש״ך יו״ד קל״ז ס״ק א) But he at once reports the opposite view of Rabbenu Yeruḥam « אבל רבינו ירוחם כ׳ דאם נתייבש ואח״כ נשתמש בו ישראל בלא הדחה מותר אלא שלכתחלה צריך הדחה » (ש״ך יו״ד קל״ז ס״ק א)
The Taz rules for leniency, and does so by a close reading of the Rosh « ע״כ נ״ל דאין דברי הרא״ש הללו אמורין אלא בצריך עירוי ג׳ ימים שכתב לעיל ריש סימן קל״ה באין מכניסו לקיום אבל במידי דא״צ רק הדחה אין שם איסור כלל אפילו נשתהה מעל״ע » (ט״ז יו״ד קל״ז ס״ק א) « אבל נראה לע״ד דהסומך על דברי המקילין במידי דרבנן כי הכא לא הפסיד » (ט״ז יו״ד קל״ז ס״ק א) The Rosh’s words, he says, referred only to what requires a three-day עירוי; where a mere rinsing suffices, there is no prohibition at all, even after a full day. And he concludes that one who relies on the lenient opinions in a rabbinic matter loses nothing.

Seif 2 permits treading in an unkashered press and forbids drawing the wine out through the hole. But why forbid, if everything ends up nullified?

The Tur states the rule and its reason « ויראה לי שאפי׳ כן אסור להוציא היין דרך נקבי הברזא שהנקב אסור והיין יוצא משם צלול מבלי תערובת החרצנים » (טור יו״ד קל״ז)

The real question: is this a case of מבטל איסור לכתחלה?

The Beit Yosef thinks so, at least as a possibility; the Bach denies it; the Shach follows the Bach; the Taz returns to the Beit Yosef. It is one of the few ma’hlokot in the block where the Shach and the Taz clash head-on over a course of action.

The Beit Yosef « ומ״מ איפשר דלכתחלה אסור להוציא דרך נקב הברזא משום דהוי כמבטל לכתחלה » (בית יוסף יו״ד קל״ז) The Bach, reported and followed by the Shach « וכתב הרשב״א בתשוב׳ דאף ביוצא דרך הברזא שבחבית מותר דפליטת הברזא הוא מתבטל במים דכל יין שיוצא יוצאים עמו המים » (ש״ך יו״ד קל״ז ס״ק ז) « והב״ח השיג עליו שאין זה מבטל איסור לכתחלה כיון שאין כוונתו אלא להוציא יין ולא כדי לבטל האיסור שבנקב » (ש״ך יו״ד קל״ז ס״ק ז)
The Taz’s kushya on the Bach The Bach’s reasoning — “his intention is not to nullify but to draw off” — is borrowed from siman 84, where one is permitted to filter honey full of ants. But does the analogy hold?
Terutz — the Taz: the argument of siman 84 presupposes that there is no other way « בב״י כתוב דזה דוקא אם ההיתר בא מחמת החרצנים והזגים לפיכך נאסר היין דרך הנקב וצריך שיעשה נקב חדש או יוציא היין מלמעלה » (ט״ז יו״ד קל״ז ס״ק ד) « ולי נראה דדברי ב״י נכונים דאע״ג דמצינו סברא זו דאין הכוונה לבטל האיסור בסי׳ פ״ד סעיף י״ג גבי נמלים שבדבש שמותר לסננו וכן בתולעים שבחטים ולא הוי מבטל לכתחלה שאני התם דא״א בענין אחר משא״כ כאן דאפשר לעשות נקב חדש או להוציא דרך פיו למעלה כל שמוציאו בדרך שיש בו חשש איסור מקרי לכתחלה ואסור לעשות כן » (ט״ז יו״ד קל״ז ס״ק ד) There, the honey cannot be recovered otherwise; here, one can make a new hole or draw off from above. As soon as another way exists, choosing the one that passes through the prohibition is nullifying it a priori.
Nafka mina A draw-off valve on an unkashered vat. According to the Shach and the Bach, one may use it. According to the Taz and the Beit Yosef, one may not — so long as another draw-off point exists. The Ba’er Hetev records both positions: « והט״ז חולק על הב״ח דל״ד לסי׳ פ״ד דשאני התם דא״א בענין אחר משא״כ כאן דאפשר לעשות נקב חדש או להוציא דרך פיו וכו׳ » (באר היטב יו״ד קל״ז ס״ק ג) And for the accomplished fact, the Rama and the Shach agree: all the wine remains permitted — « אלא הטעם הוא דהקליפה של הנקב בטל בס׳ דמה שיוצא דרך הנקב יש לעולם ס׳ נגד הקליפה דהא הרשב״א והטור גופיה לא אסרי אלא משום שהיין יוצא שם צלול ונאסר בכל שהוא אבל אם היה יוצא שם עם החרצנים וזגים היו מתירי׳ משום שיש ס׳ נגד קליפת הנקב וא״כ לדידן דקי״ל דסתם יינם בטל בס׳ אם כן בכל ענין שרי וזה ברור » (ש״ך יו״ד קל״ז ס״ק י״א)

6. חשבון היין השני — the Taz against the Nekudot HaKesef

The source of the seif: a responsum of the Rivash, reported by the Beit Yosef « אלא שכיון שהיין הראשון לא נאסר כי אם בשתייה אינו אוסר במשהו אלא בנ״ט וא״כ אם יש ביין השני ס׳ ביין הראשון הכל מותר אפי׳ בשתייה » (בית יוסף יו״ד קל״ז) And the Shach gives the logic in one line: « דכיון שהיין הראשון לא נאסר אלא בשתייה אינו אוסר בכל שהוא ריב״ש שם » (ש״ך יו״ד קל״ז ס״ק י״ב)

The Taz: the seif’s rule has become unnecessary

The Rivash wrote for those who hold that stam yeinam forbids in the least quantity. Since we hold that it is nullified in sixty (siman 134), the Taz proposes a simpler — and more lenient — calculation.

« אבל לפי מה דקי״ל שם דבטל בס׳ אין אנו צריכין להוראה זאת אלא אם יש בין הכל דהיינו יין הראשון והשני ששים נגד קליפת הכלי האסור מותר הכל » (ט״ז יו״ד קל״ז ס״ק ו) In other words: the first wine need not be counted as a full prohibition; it is enough that the whole — first and second wine together — make sixty against the vessel’s peel.
The Nekudot HaKesef’s kushya If the first wine did not have sixty against the peel, it has itself become forbidden — חתיכה נעשית נבילה — and sixty is then required in the second against all of the first. The Taz’s shortcut erases that step.
The Taz’s answer is already in the Shach, at ס״ק י״ג « ולא אמרינן חתיכה נעשית נבילה כדלעיל סי׳ קל״ד ס״ק ט״ז » (ש״ך יו״ד קל״ז ס״ק י״ג) The Shach writes expressly that here we do not say חתיכה נעשית נבילה, and refers to siman 134. The ma’hloket therefore reduces to whether that rule of siman 134 holds for a liquid in a liquid — a question the Nekudot HaKesef decides otherwise, as the Ba’er Hetev reports: « ובנה״כ השיג עליו וכי דודאי צריך ביין הא׳ לחודיה ס׳ דאל״כ היין הא׳ נ״נ וצריך אחר כך ביין הב׳ ס׳ נגד כל היין הא׳ דע״כ לא ס״ל גבי יין ביין דלא נ״נ אלא מטעם דכיון דנאסר במשהו משא״כ היכא דנאסר מחמת שלא היה בו ס׳ והכי קי״ל לעיל סימן צ״ב ס״ד דאף לח בלח נ״נ אם לא במקום הפסד גדול עכ״ל » (באר היטב יו״ד קל״ז ס״ק ו)
Nafka mina A batch put into an unkashered vat, then poured into a kosher vat ten times its volume. On the Taz, the whole suffices if it makes sixty against the peel. On the Nekudot HaKesef, sixty is first required in the first batch itself, failing which it becomes forbidden in its entirety. And the Shach (ס״ק י״ד) adds a consequence that is often forgotten: « ואם אין לבטל גם הכלים אסורים כאילו נתן יין של איסור בכלים כשרים » (ש״ך יו״ד קל״ז ס״ק י״ד)

7. שאר משקים ומליחה — אקראי or קבע

The sugya: the question is settled by a deed, not by an argument « אִיבַּעְיָא לְהוּ: מַהוּ לִיתֵּן לְתוֹכוֹ שֵׁכָר? רַב נַחְמָן וְרַב יְהוּדָה אָסְרִי, וְרָבָא שָׁרֵי. רָבִינָא שְׁרָא לֵיהּ לְרַב חִיָּיא בְּרֵיהּ דְּרַב יִצְחָק לְמִירְמָא בֵּיהּ שִׁכְרָא, אֲזַל רְמָא בֵּיהּ חַמְרָא, וַאֲפִילּוּ הָכִי לָא חַשׁ לַהּ לְמִילְּתָא, אֲמַר: אַקְרַאי בְּעָלְמָא הוּא » (עבודה זרה ל״ג ע״ב) The decisive word is the last: אקראי בעלמא הוא.
The Shach draws from it a limit the Mechaber does not write « ולא גזרי׳ משקין אטו יין משום דאקראי בעלמא הוא ש״ס ולפ״ז אסור ליתן בהם משקין דרך קבע » (ש״ך יו״ד קל״ז ס״ק ט״ז) If the permission rests on the occasional character of the act, it does not cover regular use. And the Shach refers to siman 122 seif 4, where the Rama laid down the same distinction for other prohibitions.

And if the liquid remains a full day?

The Taz answers that it makes no difference, and his reason matters: what permits here is not brevity but the nature of the absorption.

« נ״ל פשוט אפילו אם המשקין נשתהים שם מעל״ע מותר דהא הטור כתב הטעם כיון שהיין פוגם אותם ואע״ג דבשאר דוכתי קיימא לן נותן טעם לפגם אסור לכתחלה שאני הכא דנבלע בצונן » (ט״ז יו״ד קל״ז ס״ק ז) The absorption took place cold; the taste that comes out of it spoils, and a spoiling taste does not become forbidden by remaining longer.
Kushya on salting The Bach objects: in siman 105 it is forbidden a priori to salt in a forbidden utensil. Why should it be permitted here?

The question is a real one, and the Shach raises it: if the first wine nullified the vessel’s פליטה, why not do it again? « וכב״י ואע״פ שהרא״ש בתשו׳ התיר לפי שמתחלה נפלט בליעת הקנקן ביין ונתבטל היינו לדברי המתירין סתם יינם בס׳ וכבר כתבתי בסימן קל״ד דלא קי״ל אלא כדברי האומרים דאוסר במשהו ע״כ » (ש״ך יו״ד קל״ז ס״ק י״ח)
Kushya The Rosh, in a responsum, did permit. And we hold, against the Beit Yosef, that stam yeinam is nullified in sixty. Should the Rosh’s conclusion not prevail?
Terutz — the Shach distinguishes nullification undergone from nullification willed. What is nullified in sixty is nullified after the fact, and because there was no other way; here, one would choose to pour wine into it. 9. מסיח לפי תומו — why the general rule does not apply

Kushya The Gemara in Bava Kamma allows that a non-Jew speaking innocently is believed for a rabbinic prohibition, and stam yeinam is one. Why does seif 6 set that aside?
Terutz — the Shach, in the name of the Rivash: the difference lies in the חזקה « י״ל דהתם מיירי בדבר דלא אתחזק איסורא משא״כ הכא דודאי נשתמש בכלים אלו יין של איסור » (ש״ך יו״ד קל״ז ס״ק י״ט) Where nothing is established, a statement suffices to remove a doubt; here, the forbidden use of the vessel is an established fact, and a statement does not overturn an established fact.
The Beit Yosef had already refused to rule otherwise, and his formulation deserves reading « ולענין הלכה אע״פ שנראין דברי הר״ן מי יקל ראשו כנגד הנך רבוותא דאוסרים וכ״ש במקום שהר״ן לא רצה לסמוך על עצמו לעשות מעשה » (בית יוסף יו״ד קל״ז) He reports that the Ran inclined to leniency but would not act on it — and he draws the practical conduct from that: one does not set oneself against the masters who forbid.
Nafka mina A kashering attestation resting solely on the statement of a non-Jewish employee, even one made without knowing that a question depended on it. Seif 6 judges it insufficient, and refers to siman 122 for the practical conduct.

מה שהכלי פולט אינו יין בעין אלא פליטת הכלי ; ולפיכך אינו אוסר רק בשתייה, ואף על פי כן, לפי שקודם לכן היה אסור בהנאה, הוא אוסר במשהו. וכל הסימן אינו אלא מדידה : כמה נבלע — כדי קליפה ; כמה זמן — מעת לעת בכלי שאין מכניסו לקיום, מיד במכניסו לקיום, וי״ב חדש לגבול העליון ; וכנגד מה — ששה במים, ס׳ ביין. ובמקום שאין מודדים — עד שיכשירנו.
Three lines to take away. (1) Quantity is measured by the origin of the prohibition; status, by the mode of mixture — that is the Shach’s sentence at ס״ק ג. (2) The time thresholds are not conventions but physical facts, which is why they fall away when the physics changes (storage vessel, residual moisture). (3) What is permitted for water and beer is permitted because wine spoils them — and it is the only place in the siman where נותן טעם לפגם works in favour of leniency.
